सा. का. नि. 209.- सूचना का अधिकार अधिनियम , 2005 ( 2005 का 22 ) के भाग 28 के खण्ड ( 1 ) और ( 2 ) ( i से iv ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रपति सचिवालय एतद्द्वारा नीचे लिखे नियम निर्मित करता है , जो इस प्रकार हैं:
( 1) लघुशीर्षक और प्रारम्भ ( 1 ) ये नियम राष्ट्रपति सचिवालय सूचना का अधिकार ( शुल्क और लागत विनियम ) नियम, 2007 कहलाएंगे ।
(2) ये , भारत के राजपत्र में प्रकाशन की तिथि से लागू होंगे ।
2. परिभाषाएं- इन नियमों में, बशर्ते कि संदर्भ अन्यथाअपेक्षित हो, -
(क) ' अधिनियम ' का अर्थ है सूचना का अधिकार अधिनियम, 2005;
(ख ) ' धारा' का अर्थ है अधिनियम की धारा;
( ग) इसमें प्रयोग में लाए जाने वाले अन्य सभी शब्द व वाक्यांश जो परिभाषित नहीं किए गए हैं और अधिनियम में परिभाषित है,. उनका अधिनियम में नियत अर्थ ही माना जाएगा ।
3. धारा 6 की उप- धारा ( i ) के तहत सूचना प्राप्त करने के अनुरोध के साथ , राष्ट्रपति सचिवालय के लेखा अधिकारी को देय , 10 रुपए मात्र के आवेदन शुल्क का उचित रसीद के बदले नकद भुगतान करके अथवा डिमाण्ड ड्राफ्ट अथवा बैंकर्स चैक अथवा भारतीय पोस्टल 4051 G1/07

4. धारा 7 की उप धारा ( i ) के तहत सूचना उपलब्ध करने के लिए शुल्क राष्ट्रपति सचिवालय के लेखा अधिकारी को देय उचित रसीद के बदले नकद भुगतान से अथवा डिमाण्ड ड्राफ्ट अथवा बैंकर्स चैक अथवा भारतीय पोस्टल ऑर्डर द्वारा नीचे लिखी दरों पर लिया जाएगा । (क) प्रत्येक तैयार किए गए पृष्ठ अथवा प्रतिलिपि ( ए-4 ए-5 आकार के कागज में ) के लिए 2 रुपए ;
(ख) बड़े आकार के कागज पर तैयार प्रतिलिपि का लागत मूल्य और वास्तविक मूल्य;
(ग ) नमूनों अथवा मॉडलों की लागत अथवा वास्तविक मूल्य और
(घ) अभिलेखों की जांच के लिए पहले घण्टे निःशुल्क , उसके बाद प्रत्येक घण्टे ( अथवा उसके अंश ) के लिए 5 रुपए शुल्क लिया जाएगा ।
5. धारा 7 की उप धारा 5 के तहत सूचना उपलब्ध करवाने के लिए शुल्क, राष्ट्रपति सचिवालय के लेखा अधिकारी को देय उचित रसीद के बदले नकद भुगतान से , अथवा डिमाण्ड ड्राफ्ट अथवा बैंकर्स चैक अथवा भारतीय पोस्टल ऑर्डर द्वारा नीचे लिखी दरों पर लिया जाएगा । (क) डिस्क अथवा फ्लॉपी में सूचना उपलब्ध करवाने हेतु प्रति डिस्क 50 रुपए और प्रति फ्लॉपी 20 रुपए देने होंगे; और (ख) मुद्रित रूप में सूचना उपलब्ध करवाने के लिए ऐसे दस्तावेजों के लिए नियत लागत अथवा प्रकाशन से ली गई सामग्री की फोटोकापी केलिए 2 रुपए प्रति पृष्ठ देने होंगे ।

G. $ .R. 209.-In exercise of the powers conferred by clauses ( 1 ) and (2) ( i to iv ) of Section 28 of the Right to Information Act, 2005 (22of2005 ) , the President's Secretariat hereby makes the following rules , namely:--
1. Short title and commencement .( 1 ) These rules may be called the President's Secretariat Right to Information (Regulation of Fee and Cost ) Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions-In the rules , unless the context otherwise requires,
(a) Act' means the Right to Information Act , 2005;
(b) ' Section' means Section of the Act;
(c) all other words and expression used herein but not defined and defined in the Act shall have the meanings assigned to them in the Act .
3. Arequest for obtaining information under sub - section ( 1 ) of Section 6 shall be accompanied by an application fee of rupees ten by way of cash against proper receipt or by demand draft or bankers cheque or Indian Postal Order payable to the Accounts Officer of the President's Secretariat.
4. For providing the information under sub- section (1 ) of Section 7 , the fee shall be charged by way of cash against proper receipt or by demand draft or bankers Cheque or Indian Postal Order payable to the Accounts Officer of the President's Secretariat at the following rates :-
(a) rupees two for each page ( in A- 4 or A-3 size paper ) created or copied;
(b) actual charge or cost price of a copy in larger size paper;
(c) actual cost or price for samples or models ; and
(d) for inspection of records , no fee for the first hour; and a fee of rupees five for each subsequent hour ( or fraction thereof) there after.
5. For providing the information under sub- section (5) of Section 7 , the fee shallbe charged by way of cash against proper receipt or by demand draft or bankers cheque or Indian Postal Order payable to the Accounts Officer of the President's Secretariat at the following rates :---
(a) for information provided in diskette or floppy rupees fifty per diskette or rupees twenty per floppy; and (b) for information provided in printed form at the price fixed for such publication or rupees two per page of photocopy for extracts from the publication.

सा. का. नि. 210.- राष्ट्रपति , संविधान के अनुच्छेद 3.09 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , स्वास्थ्य और सीमा शुल्क और केंद्रीय उत्पाद शुल्क समझौता आयोग में समूह ' ख ' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सीमां - शुल्क और केन्द्रीय उत्पाद शुल्क समझौता आयोग समूह ' ख' पद भर्ती नियम , 2007 है ।
(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना. -ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ । में विनिर्दिष्ट पदों पर लागू होंगे।
3. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति, आयु सीमा व अहंताएं आदि. संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे विनिर्दिष्ट हैं ।
5. निरर्हता. वह व्यक्ति-
(क) जिसने किसी ऐसे व्यक्तिसे जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
( ख) जिसने अपने पत्ति यां अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृति. - इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

संयुक्त पद्धति ( प्रतिनियुक्ति धन प्रोन्नति)
I. केन्द्रीय सरकार के ऐसे अधिकारी- (i ) जिन्होंने मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या
(ii ) जिन्होंने मूल काडर/ विभाग में 6500-10500/- रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् निजी सचिव श्रेणी में तीन वर्ष सेवा की हो या मूल काडर/विभाग में आशुलिपिक श्रेणी में 5500-9000/- रुपए य। 6500-10500/- रुपए या समतुल्य के वेतनमान में सात वर्ष की सम्मिलित सेवा की हो ।
II. ऐसे विभागीय निजी सचिवों पर जिन्होंने आयोग की संबद्ध पीठ में 6500-10500/- रुपए के वेतनमान में तीन वर्ष नियमित सेवा की है, भी विचार किया जाएगा और उसके चयन की दशा में , पद प्रोन्नति द्वारा भरा समझा जाएगा ।
प्रतिनियुक्तिकी अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अनय संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा । प्रोन्नति: ऐसे आशुलिपिक, श्रेणी-2 , जिन्होंने आयोग की संबद्ध पीठ में 5000-8000/- रुपए के वेतनमान में उस श्रेणी में छह वर्ष नियमित सेवा की है।
टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोम्मति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता, सेवा पहले ही पूरी कर ली है, अगली उच्बतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
प्रतिनियुक्ति:
केन्द्रीय सरकार के ऐसे अधिकारी-
(i ) जिन्होंने मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है ; या
(ii ) जिन्होंने मूल काडर/ विभाग में 5500-9000/ - रुपए या समतुल्य के बेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् आशुलिपिक श्रेणी में तीन वर्ष सेवा की हो; या मूल काडर/विभाग में आशुलिपिक श्रेणी 1 और श्रेणी 2 में 5500-9000/- रुपए या 5000-8000/- रुपए या समतुल्य के वेतनमान में छह वर्ष की सम्मिलित सेवा की हो ।
पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।
इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाध्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी. । 1046

G.S.R. 210. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to regulate the method of recruitment to Group ' B ' posts in the Customs and Central Excise Settlement Commission, namely :-
1.Short title and commencement.-( 1 ) These rules may be called the Customs and Central Excise Settlement Commission Group ' B ' Posts , Recruitment Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application . These rules shall apply to the posts specified in column 1 of the schedule annexed to these rules.
3. Number of posts , classification and scale of pay . The number of posts , their classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .
4. Method of recruitment, age limit , qualification etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .
5. Disqualification .-No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to any of the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do . itmay, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .
7. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex - Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard .

ड्रिलिंग साजसमान के प्रचालन तथा उसके रखरखाव में एक वर्ष का अनुभव । टिप्पण1. अर्हताएं , अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।
टिप्पण:- आयु-सीमा अवधारित करने के लिए निर्णायक तरीख भारंत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी। ( न कि वह अंतिम तारीख जो असम , मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर , नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों को लिए विहित की गई है । )
टिप्पण 2. अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदाय के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

टिप्पण 1 जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पान्त्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधि क से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसे अर्हक/पात्रता सेवा पहले ही पूरी की ली है अर्गली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । टिप्पण 2: - प्रोन्नति के लिए पात्रता सूची अधिकारियों द्वारा उनकी अपनी श्रेणी पद पर विहित अर्हक सेवा पूरी किए जाने की तारीख के प्रतिनिर्देश से तैयार की जाएगी ।
