स्य.का.नि. 265. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और सफदरजंग अस्पताल (तृतीय श्रेणी पद ) भर्ती नियमावली , 1973 को , जहां तक उसका संबंध परिवार समाज कार्यकर्ता के पद से है , उन बातों के सिवाय अधिक्रान्त करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , सफदरजंग अस्पातल , नई दिल्ली में परिवार कल्याण कार्यकर्त्ता ' के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम सफदरजंग अस्पताल , नई दिल्ली ( परिवार कल्याण कार्यकर्त्ता ) समूह ' ग ' पद भर्ती नियम, 2007 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनम्मामः- उक्त पद की संख्या, उसका वर्गीकरण और उसका बेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदिः उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हताः-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदीं में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । के

5. शिथिल करने की शक्तिः- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग वा प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

बनका केन्द्रीय और अन्य 6. व्यावृत्तिः- इन नियमों की कोई बात , ऐसे आरक्षण , आयु -सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जामियों, अति जति भूतपूर्व से विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1:-अनुभव संबंधी अर्हता ( अर्हताएं ) सक्षम प्राधिकारी के विवेका-

नुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी.. की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

टिप्पण 2: - राजभाषा अधिनियम , 1963 के अधीन विरचित राजभाषा नियम , 1976 के नियम 10 के अनुसार , अभ्यर्थी ( अभ्यर्थियों ) को हिंदी का कार्यसाधक ज्ञान होना चाहिए । यदि उसे हिंदी का ज्ञान नहीं है तो उसे परिवीक्षा अवधि के दौरान अवश्य प्राप्त करना होगा ।

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नत्ति द्वारा या प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

G.S.R. 265. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession ofthe Safdarjung Hospital (Class III posts) Recruitment Rules , 1973 , insofar as it relates to the post of Family Welfare Worker , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Family Welfare Worker in the Safdarjung Hospital , NewDelhi , namely:-

1. Short title and commencement.-( 1 ) These Rules may be called the Safdarjung Hospital , New Delhi (Family Welfare Worker) Group ' C ' Post, Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay.----The number of the said post, its classification and the scale of pay attached thereto shalt be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of Recruitment, age limit, other qualificaitons etc. The Method of recruitment age limit, qualifica- tions and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification.- No person,-

(a) who , has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post.

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class orcategory of persons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for persons belonging to the Scheduled Casts , the Scheduled Tribes , Ex-servicerment and other special categories of persons , in accordance with the orders , issued by the Central Government from time to time in this regard.

2. प्रौढ़ शिक्षा निदेशालय ( संयुक्त निदेशक , उप निदेशक और सहायक निदेशक ) भर्ती नियम , 2005 में जिसे इसमें इसके पश्चात् उक्तनियम विनिर्दिष्ट किया गया है ) , " प्रारंभिक शिक्षा और साक्षरताः विभाग " शब्दों के स्थान पर , जहां- जहां वे आते हैं, " स्कूल शिक्षा और साक्षरता विभाग ' शब्द रखे जाएंगे ।

3. उक्त नियमों की अनुसूची में,-

(i ) क्रम सं. 2 पर आने वाले उप निदेशक के पद के सामने स्तंभ 11 की प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्

" (क) 50 प्रतिशत प्रोन्नति , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , जिसके अंतर्गत अल्पकालिक संविदा भी है;

(ख) 50 प्रतिशत प्रतिनियुक्ति द्वारा जिसके अंतर्गत अल्पकालिक संविदा भी है । "

G.S.R. 266. In exercise of the powers conferred by proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Directorate of Adult Education, (Joint Director, Deputy Director and Assistant Director) Recruitment Rules , 2005 namely :-

: 1. (1) These Rules may be called the Directorate of Adult Education , (Joint Director, Deputy Director and Assistant Director) Recruitment (Amendment ) Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Directorate of Adult Education , (Joint Director , Deputy Director and Assistant Director ) Recuitment Rules, 2005 (hereinafter referred to as the said rules) , for the words " Department ofElementary Education and Literacy " wherever they occur, the words " Department of School Education arid Literacy " shall be substitutd.

3. In the said rules , in the Schedule ,-

(i) against the post of Deputy Director appearing at serial number 2, in column 11 , for the entry, the following entry shall be substituted, namely:-

"(a) fifty per cent . by promotion failing which by deputation including short term contract;

सा.का.नि. 267. आंवला श्रेणीकरण और चिन्हांकन नियम, 2007 का निम्मलिखित प्रारूप जिसे केन्द्रीय सरकार, कृषि उपज (श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए , जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम उस तारीख से , जिसको भारत के राजपत्र की, जिसमें यह अधिसूचना अंतर्विष्ट हो, प्रतियां जनता को उपलब्ध करा दी जाती हैं , पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;

ऐसा कोई व्यक्ति, जो उक्त प्रारूप नियमों के संबंध में ऊपर विनिर्दिष्ट अवधि के भीतर कोई सुझाव या आक्षेप करना चाहता है , उन्हें केन्द्रीय सरकार के विचार के लिए, भारत सरकार के कृषि विपणन सलाहकार , विपणन और निरीक्षण निदेशालय , प्रधान कार्यालय सी.जी.ओ. काम्पलेक्स एनएच- IV , फरीदाबाद-121001 को भेज सकेगा ।

प्रारूप नियम

1. संक्षिप्त नाम , लागू होना और प्रारंभ:-( 1 ) इन नियमों का संक्षिप्त नाम आंवला श्रेणीकरण और चिन्हांकन नियम, 2007 है । (2) ये सूखा आंवला और आंवला चूर्ण सूफोरबी आसीए परिवार के एमबलिका आफिसीनलिस अभिप्राप्त चूर्ण को लागू होंगे ;

( 3 ) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:-इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

( i ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है ;

(ii ) " प्राधिकृत पैकर " से ऐसा कोई व्यक्ति या व्यक्ति- निकाय अभिप्रेत है , जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया के अनुसार आंवला चूर्ण के श्रेणीकरण और चिन्हांकन के लिए प्राधिकार प्रमाणपत्र अनुदत किया जाए ;

( iii ) " प्राधिकार प्रमाणपत्र " से साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 को उपबंधों के अधीन जारी प्रमाणपत्र अभिप्रेत है, जो किसी व्यक्ति या व्यक्ति निकाय को श्रेणी अभिधान और चिन्ह से सूखा आंवला और आंपला चूर्ण के श्रेणीकरण और चिन्हांकन करने का प्राधिकार देता है ;

(iv) " साधारण श्रेणीकरण और चिन्हांकन नियम " से कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 अभिप्रेत है ;

(v ) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

श्रेणी अभिधान: - श्रेणी अभिधान सूखा आंवला और आंवला चूर्ण की क्वालिटी वही होगा जो अनुसूची 2 और 3 के स्तंभ 2और 7 में है ।

3. श्रेणी अभिधान चिन्ह -श्रेणी अभिधान चिन्ह में प्राधिकार प्रमाणपत्र संख्यांक, " एगमार्क " शब्द, वस्तु का नाम और अनुसूची 1 में यथा उपवर्णित के सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक " होगा । 1278

4. श्रेणी अभिधान- शुष्क आंवला और आंवला चूर्ण की गुणवत्ता उपदर्शित करने वाला श्रेणी अभिधान अनुसूची 2 और अनुसूची 3 के स्तंभ । में वर्णित किए गए के अनुसार होगा ।

5. गुणवत्ता- सूखा आंवला और आंवला चूर्ण की गुणवत्ता वह होगी जो अनुसूची 2 के संतीम 1 में प्रत्येक श्रेणी अभिधान के सामने और अनुसूची 3 में उपवर्णित होगी ।

6. पैकिंग की पद्धति ( 1 ) शुष्क आंवला और आंवला चूर्ण को जूट या कपड़े के बने खाद्य श्रेणी सामग्री के उपयुक्त अंतर वाले ठोस, स्वच्छ एवं शुष्क आधानों में , गत्ते के कार्टनों में , कपड़े के थैलों, लैमिनेटिड पॉलीथिलिन या पॉलीप्रोपिलान या उच्च सघनता वाले पॉलीथिलीन के थैलों, पाउचों या ऐसे किसी अन्यपैकेजिंग सामग्री में ही पैक किया जाएगा जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा सम्यक रूप से अनुमोदित हो ;

( 2) आधान किसी कीट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीव या असहनीय गंध से भी मुक्त होगा ;

(3 ) शुष्क आंवला और इसके चूर्ण को ऐसी रीति में पैक किया जाएगा ताकि उत्पादं की उचित रूप से संरक्षा हो सके । आधान को कृषिविपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में सुरक्षित रूप से बंद और सीलबंद किया जाएगा ;

(4) पैकेज के अंदर प्रयुक्त सामग्री , स्वच्छ और ऐसी गुणवत्ता की होनी चाहिए जिससे कि उत्पाद को कोई किसी बाहरी या आंतरिक क्षति होने से बचाया जा सके ;

( 3 ) सामग्री विशिष्ट रूप से कागज की या व्यापार विनिर्देशों वाली स्टेम्पों का उपयोग अनुज्ञात, किया जाता है बशर्ते कि मुद्रण और लेबल लगाने का कार्य अविषैली स्थाही या गोंद से किया गया हो ;

( 6) प्रत्येक पैकेज में केवल एक ही श्रेणी अभिधान की शुष्का आंवला या चूर्ण होगा । उसी लाट/बैच की श्रेणीकृत सामग्री और श्रेणी अभिधान वाले शुष्क आंवला या चूर्ण की उपर्युक्त संख्या या छोटे पैकेटों को जूट की थैलियों, लकड़ी के बक्सों, गत्तों के कार्टनों आदि जैसे मास्टर आधानों में मान्य आधारों पर ब्यौरे के साथ पैक किए जा सकेंगे ;

( 7 ) शुष्क आंवला और चूर्ण को, समय- समय पर जारी कृषि विपणन सलाहकार अनुदेशों के अनुसार पैकेटों के आकारों में पैक किया जाएगा ।

7. चिन्हांकनकी पद्धति और लेबल लगाना

( 1 ) श्रेणी अभिधान चिन्ह प्रत्येक आधान में सुरक्षित रूप से लगाया जाएगा या स्पष्ट और सुपाठ्य रूप में मुद्रित होगा । ( 2 ) प्रत्येक पैकेज पर श्रेणी अभिधान चिन्ह के अतिरिक्त, निम्नलिखित विशिष्टियां स्पष्ट और सुपाठ्य रूप में चिन्हांकित होंगी , अर्थात्:-

(क) वस्तु का नाम

(ख) किस्म;

(ग) श्रेणी अभिधान ;

(घ) लाट/बैच संख्यांक ;

(ङ) पैकर का नाम और पता ;

( च) शुद्ध भार/ यूनिट की संख्या ;

(छ) भंडारण स्थिति, यदि कोई हो ;

(ज) उद्गम का देश ;

(झ ) पैकिंग की तारीख ; *

(ञ) के पूर्व उपभोग सर्वोत्तम ( जहां भी लागू हो ) ;

(ट ) आकार कोड ( यदि विहित हो ) ;

(ठ) अधिकतम खुदरा कीमत (सभी करों सहित ) और ;

(ड) कोई अन्य विशिष्टियां जो कृषि विपणन सलाहकार द्वारा विनिर्दिष्ट की जाएं ।

(3 ) पैकेजों पर चिन्हांकन के लिए प्रयुक्त स्याही ऐसी गुणवत्ता वाली होगी जो उत्पाद को संदूषित न करे ।

( 4 ) प्राधिकृत पैकर, कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात् श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिन्ह या व्यापार ब्रांड का उपयोग कर सकेगा परंतु वह इन नियमों के अनुसार आधान पर लगाए गए श्रेणी अभियान चिन्ह द्वारा उपसित क्वालिटी से भिन्न गुणवत्ता उपदर्शित न करता हो । 8. शुष्क आंवला और शुष्क चूर्ण को निर्यात के लिए क्रेता की अपेक्षाओं के अनुसार श्रेणीकृत और चिन्हांकित किया जा सकेगा परंतु वह सुसंगत अनुसूची में विनिर्दिष्ट न्यूनतम अपेक्षाओं को पूरा करता हो ।

9. प्राधिकार प्रमाणपत्र के अनुदान के लिए विशेष शर्ते :-

( 1 ) प्रत्येक प्राधिकृत पैकेटर साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के नियम 3 के उपनियम ( 8 ) में विनिर्दिष्ट शतों के अतिरिक्त समय - समय पर किसी विपणन सलाहकार द्वारा विहित सभी अनुदेशों का अनुपालन करेगा ।

(2) प्राधिकृत पैकर शुष्क आंवला और चूर्ण की गुणवत्ता का परीक्षण करने के लिए साधारण श्रेणीकरण और चिन्हांकन नियम 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या उस प्रयोजन के लिए अनुमोदित राज्य श्रेणीकरण प्रयोगशाला या निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा ;

(3) प्रसंस्करण , श्रेणीकरण और पैकिंग के लिए परिसरों को स्वास्थ्यप्रद और स्वच्छता की दशाओं में रखा जाएगा । इन संक्रियाओं मेंलगे हुए कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संचारी , संसर्गी या संक्रामक रोग से मुक्त होंगे ;

(4) परिसरों में पक्के फर्श, प्रकाश और वायु के लिए बेहतर संवातन वाली पर्याप्त भंडारण सुविधाएं होगी तथा वह कृन्तकं और कीटों के आकीर्णन से वे मुक्त होंगे ;

1. शुष्क आंवला को यूफोरविआसीए परिवार के एमबलिका से अभिप्राप्त किया जाएगा ।

2. न्यूनतम अपेक्षाएं: -

(i) शुष्क आंवला वस्तुके रंग और विशेषताओं वाला होगा

(ii) यह

(क) अविकल और ठोस होगा ;

(ख) किसी दृश्यं बाह्य पदार्थ से मुक्त होगा ;

(ग ) कीट संदूषण, जीवित कीटाणु , मृत कीटाणुओं, कीट गंध, फफूंदी/दमड़ी, लाखा से मुक्त होगा ;

(घ) खमीर किण्वन विकृतगंधी स्वाद और पुरानी महक से मुक्त होगा ;

(ङ) बाह्य पदार्थ और मिलाए गए रंजक पदार्थ और अन्य हानिकारक पदार्थों आदि से मुक्त होगा ;

( च ) फफूंदी और बैक्टीरिया ( माइक्रोबाइल संदूषण ) से मुक्त होंगी ;

(iii ) शुष्क आंवला का स्वाद और गंध उत्पाद से संयुक्त होगा ।

(iv ) यूरिक अम्ल और अफ्लाटॉक्सिन क्रमशः 100 मिलीग्राम और 30 माइक्रोग्राम/ कि.ग्रा. से अधिक नहीं होगा । (v ) यह विषाषत धातु ( नियम-57 ) , फसल संदूषकों ( नियम 57- क) प्राकृतिक रूप से पैदा होने वाले विषैले पदार्थों , कीट नाशियों और नाशियों और नाशकजीवमारों और घरेलू व्यापार के लिए समय- समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन यथाविहित अन्य खाद्य सुरक्षा मापदंडों का अनुपालन करेगी ।

1. आंवला चूर्ण यूफेबीआसीए परिवार का एमबीलिका आफिसिनलिस की किस्मों की स्वच्छ अच्छी तरह पके हुए फलों को पीसकर अभिप्राप्त किया जाएगा ।

2. न्यूनतम अपेक्षाएं:-

( i ) आंवला चूर्ण

(क ) किसी दृश्य बाहय पदार्थ से मुक्त होगा;

( ख ) कीट संदूषक, जीवित कीटाणु , मृत कीटाणुओं, कीट गंध, फफूंदी , दमड़ी, लारवा , कृतंक रोम मलमूत्र से मुक्त होगा ;

(ग) खमीर और पुरानी महक से मुक्त होगा ;

( घ) धूल, बाह्य पदार्थ और ऐसे ही मिलाए गए रंजक पदार्थ और अन्य प्रकार के अपद्रव्यों से मुक्त होगा ;

G.S.R. 267. The following draft of the Amla Grading and Marking Rules, 2007 which the Central Government proposes to make in exercise ofthe powers conferred by Section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), are hereby published as required by the said Section, for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry ofa period of forty- five days from the date on which copies of the Gazette of India containing this notification are made available to the public ;

Any person desirous to make any suggestion or objection in respect of the said draft rules may forward the same for consideration of the Central Government within the period specified above to the Agricutural Marketing Adviser to theGovernment of India, Directorate of Marketing and Inspection, Head Office , N.H. IV, Faridabad- 121001 .

DRAFT RULES

1. Short title, application and commencement:-

(1) These rules may be called the Amla Grading and Marking Rules , 2007.

(2) They shall apply to Amla dried and Amla powder obtained from Emblica officinalis of the family Euphorbiaceae ;

(3) They shall come into force on the date of their final publication in the Official Gazette .

2. Definition :-In these rules , unless the context other wise requires ;-

(1) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India ;

(ii) "Authorized packer" means a person or body of persons who has been granted the certificate of autho- rization to grade and mark Amla dried and Amla powder in accordance with the grade standards and procedure prescribed under these rules;

( iii) "Certificate of Authorization" means a certificate issued under the provisions of General Grading and Marking Rules , 1988 authorizing a person or a body of persons to grade and mark Amla dried and Amla powder with the grade designation mark ;

(iv) " General Grading and Marking Rules" means the General Grading and Marking Rules , 1988 made under Section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 ( 1 of 1937) ;

(v) " Schedule" means a Schedule appended to these rules .

3. Grade designation mark :--The grade designation mark consist of " AGMARK INSIGNIA " consisting ofa design incorporating the certificate of authorization number, the word "AGMARK" , name of commodity and grade designation resembling the one as set out in Schedule I.

4. Grade designation-The grade designation to indicate the quality of Amla dried and Amla powder shall be as set out in Column No. 1 of Schedule II & III .

5. Quality-The quality of Amla dried and Amla powder shall be as set out against each grade designation in Column 2 to 7of Schedule II and III .

6. Method of packing.-

(1 ) Amla dried and its powder shall be packed only in sound , clean and dry containers made ofjute or cloth with suitable inner lining of food grade material , laminated polyethylene or poly propylene or high density polyethylene bags, pouches or any other packaging material duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf;

(2) The container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell;

(3) Amla dried or powder shall be packed in such a way as to protect the produce properly. The container shall be securely closed and sealed in a manner approved by the Agricultural Marketing Adviser onan officer authorized by him in this behalf.

(4) The materials used inside the package must be new, clean and of such a quality as to avoid causing any external or internal damage to the produce.

(5) The use of materials particularly of paper or stamps bearing trade specification is permitted provided the printing or labeling has been done with non toxic ink or glue .

(6) Each package shall contain Amla dried or powder of one grade designation only. Suitable number or small packets- ofAmla dried or powder containing graded material of the same lot/ batch and grade designation may be packed in a master container such as jute bags , wooden cases , cardboard cartons etc. , with details on master containers;

(7) Amla dried or powder shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time to time .

7. Method of Marking and Labeling-

( 1 ) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each container ;

(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked on each package, namely :-

(a) Name of the commodity ;

(b) Variety;

(d) Lot/Batch Number ;

(e) Name and adress of the packer ;

(f) Net Weight/No . of units ;

(g) Storage condition , ifany ;

(h) Country of origin ;

(i) Date of packing ; *

(j ) Best before date ( wherever applicable) ;

(k) Size code ( if prescribed) ;

(1 ) Maximum retail price ( inclusive of all taxes) ; and

(m) Any other particulars as may be specified by the Agricultural Marketing Adviser .

(3) The ink used for marking on packages shall be of such quality which may not contaminate the product.

(4) The authorized packer , may, after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same do not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules .

8. Amla dried and powder may be graded and marked as per buyer's requirements for export provided minimum require- ments specified in the relevant schedule are met .

9. Special conditions for grant of certificate of authorization :-

(1) In addition to the conditions specified in sub -rule (8 ) of rule 3 ofthe General Grading and Marking Rules , 1988 . every authorized packer shall follow all instructions prescribed by Agricultural Marketing Adviser from timeto time.

(2) The authorized packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorized by him in this befalf in accordance with Rule 9 of the General Grading and Marking Rules , 1988 for testing the quality of Amla dried and its powder or has access to the State Grading Laboratory or Private Commercial Laboratory approved for the purpose ;

(3) The premises for processing , grading and packing shall be maintanined in prefect hygienic and sanitary conditions . The personnel engaged in these opearations shall be in sound health and free from any infectious , contagious or communicable diseases .

(4) The premises shall have adequate storage facilities with pucca floor and ventilation for light and air and free from rodent and insect infestation .

* The date ofpacking shall be the date of completion of the analysis of the sample.

Gradedesignation and quality of Amla dried

1. Amla dried shall be obtained from Emblica officinalis of family Euphorbiaceae .

2. MINIMUM REQUIREMENTS :

(1) Amla dried shall have the colour and characteristics of the commodity.

(ii) It shall be,

(a) Sound and clean ;

(b) free from any visible foreign matter ;

excreta;

(d) free from fermentation , rancid taste and musty odours ;

(e) free from extraneous matter , added colouring matter and other farmful matters ;

(f) free from any fungal or bacterial (microbial ) contamination ;

iii) The taste and smell of Amla dried shall be associated with the procduce .

( (iv) Amla dried shall not contain uric acid and aflatoxin more than 100 milligrams and 30 micrograms/kilograms respectively.

(v) It shall comply with restrictions in regard to Poisonous metals (Rule- 57), Crop contaminants (Rule 57-A), Naturally occuring toxic substances (Rule 57 -B ), Insecticide and Pesticides (Rule 65) and other food safely parameters and other provisions prescribed under the Prevention of Food Adulteration Rules , 1955 as amended from time to time for domestic trade .

(vi) Amla dried shall comply with residue levels of Heavy metal , insecticide/pesticide residue and other food safety parameters as laid down by the Codex Alimentarius Commission for exports .

Grade designation and quality of Amla Powder

1. Amla Powder shall be obtained by grinding clean , mature and dried fruit of Emblica officinalis offamily Eupherbiaceae.

2. MINIMUM REQUIREMENTS :-

(1) Amla Powder shall be .--

(a) free of any visible foreign matter ,

(b) free from insect infestations , live insect , dead insects , insect fragments , mould, mites , larvae , rodent hair and excreta,

(d) free from dirt , extraneous matter like added colouring matter and other type of adulterants ;

(e) free from any fungal or bacterial contamination.

(ii) The taste and smell of Amla powder shall be associated with the produce.

(iii) Uric acid and Aflatoxin shall not exceed 100 milligrams and 30 micrograms /kilograms respectively.

(iv) It shall comply with restrictions in regard to Poisonous metals (Rule - 57) , crop contaminants (Rule 57A) naturally occurring toxic substances (Rule 57- B) , insecticide and Pesticides ( Rule 65) and other food safety parameters and other provisions prescribed under the Prevention of Food Adulteration Rules , 1955 as amended from time to time for domestic trade .

(v) It shall also comply with residue levels of Heavy Metals , insecticides residue and other food safety parameters as laid down by the Codex Alimentarius Commission for export .

सा.का.नि. 268.-इमली ( बीज वाली ) श्रेणीकरण और चिन्हांकन नियम, 2007 का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और शुष्कित इमली श्रेणीकरण और चिन्हांकन नियम, 1983 को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया था या करने का लोप किया गया था , बनाने का प्रस्ताव करती है, उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम पर , उस तारीख से, जिसको भारत के राजपत्र की प्रतियां, जिसमें यह अधिसूचना अंतर्विष्ट हो, जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;

उक्त प्रारूप नियमों के संबंध में कोई सुझाव या आक्षेप करने का इच्छुक कोई व्यक्ति , ऊपर विनिर्दिष्ट अवधि के भीतर उन्हें केन्द्रीय सरकार के विचार के लिए , कृषि विपणन सलाहकार, भारत सरकार , विपणन और निरीक्षण निदेशालय , प्रधान कार्यालय , एनएच- IV, फरीदाबाद-121001 को भेज सकेगा ।

प्रारूप नियम

1. संक्षिप्त नाम, लागू होना और प्रारंभ:-

( 1) इन नियमों का संक्षिप्त नाम इमली ( बीज वाली ) , श्रेणीकरण और चिन्हांकन नियम , 2007 है;

(2 ) ये फलीदार सी, सेजैलपिनिया सी प्रजाति की टैमरींडस इंडिका एल , इमली ( बीज वाली ) को लागू होंगे;

(3 ) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(i) " कृषि विपणन सलाहकार" से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है ;

( ii ) " प्राधिकृत पैकर " से ऐसा कोई व्यक्ति या व्यक्ति- निकाय अभिप्रेत है , जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया के अनुसार इमली ( बीज वाली ) का श्रेणीकरण और चिन्हांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया गया है ;

( iii) " प्राधिकरण प्रमाणपत्र" से साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के उपबंधों के अधीन जारी प्रमाणपत्र अभिप्रेत है , जो किसी व्यक्ति या व्यक्ति- निकाय को श्रेणी अभिधान चिन्ह से इमली ( बीज वाली ) का श्रेणीकरण और चिन्हांकन करने का प्राधिकार देता है ;

(v) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

3. श्रेणी अभिधान चिन्ह श्रेणी अभिधान चिन्ह में प्राधिकार प्रमाणपत्र संख्यांक, " एगमार्क " शब्द, वस्तु का नाम और अनुसूची-1 में यथा उपवर्णित के सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक " होगा । 4. श्रेणी अभिधान: इमली ( बीज वाली ) की गुणवत्ता उपदर्शित करने वाला श्रेणी अभिधान अनुसूची 2 के स्तंभ सं. 1 में वर्णित किए गए के अनुसार होगा ।

5. गुणवत्ता: इमली ( बीज वाली ) की गुणवत्ता वह होगी जो अनुसूची 2 के स्तंभ 2 से 9 में प्रत्येक श्रेणी अभिधान के सामने उपवर्णित है ।

6. पैकिंग की पद्धति :-

( i ) इमली ( बीज वाली ) को जूट या कपड़े के बने खाद्य श्रेणी सामग्री के उपयुक्त अंतर अस्तर वाले ठोस, स्वच्छ और शुष्क आधानों, लैमिनेटिड पॉलीथिलिन या पॉलीप्रोपिलीन या उच्च सघनता वाले पॉलीथिलीन के थैलों, पाउचों या ऐसे किसी पैकेजिंग सामग्री में ही पैक किया जाएगा जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा सम्यक् रूप से अनुमोदित हो;

( ii ) आधान किसी कीट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीय या असहनीय गंध से भी मुक्त होगा;

(iii ) इमली ( बीज वाली ) को ऐसी रीति में पैक किया जाएगा ताकि उत्पाद की उचित रूप से संरक्षा हो सके । आधान को कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में सुरक्षित रूप से बंद और सीलबंद किया जाएगा;

(iv ) पैकेज के अंदर प्रयुक्त सामग्रियां , स्वच्छ और ऐसी गुणवत्ता की होनी चाहिए जिससे कि उत्पाद को किसी बाहरी या आंतरिक नुकसान होने से बचाया जा सके;

(v) सामग्रियों में विशिष्ट रूप से कागज की या व्यापार विनिर्देशों वाली स्टेम्पों का उपयोग अनुज्ञात किया जाता है बशर्ते कि मुद्रण और लेबल लगाने का कार्य अविषैली स्याही या ग्लू से किया गया हो;

( vi ) प्रत्येक पैकेज में केवल एक ही श्रेणी अभिधान की इमली ( बीज वाली ) होगी । उसी लाट/बैच की श्रेणीकृत सामग्री और श्रेणी अभिधान वाले इमली ( बीज वाली ) की उपयुक्त संख्या या छोटे पैकेटों को जूट की थैलियों, लकड़ी के बक्सों, गत्तों के कार्टनों आदि जैसे मास्टर आधानों में, मास्टर आधानों पर ब्यौरों के साथ पैक किया जा सकेगा ।

( vii ) इमली ( बोज वाली ) को , समय- समय पर जारी कृषि विपणन सलाहकार अनुदेशों के अनुसार पैकेटों के आकारों में पैक किया जाएगा ।

7. चिह्नांकन की पद्धति और लेबल लगानाः-( i ) श्रेणी अभिधान चिह्न प्रत्येक आधान में सुरक्षित रूप से लगाया जाएगा या स्पष्ट और सुपाठ्य रूप में मुद्रित होगा;

( ii ) प्रत्येक पैकेज पर श्रेणी अभिधान चिह्न के अतिरिक्त , निम्नलिखित विशिष्टियां स्पष्ट और सुपाठ्य रूप में चिह्नांकित होंगी , अर्थात्:-

(क) वस्तुका नाम;

(ख) श्रेणी अभिधान;

(ग) पैकर का नाम और पता

(घ ) शुद्ध भार/ यूनिट की संख्या;

(ङ) भंडारण स्थिति , यदि कोई हो;

( च) उद्गम का देश;

(छ ) पैकिंग की तारीख; *

( ज)

के पूर्व उपभोग सर्वोत्तम ( जहां भी लागू हो ) ;

(झ ) लाट/बैच संख्यांक;

(ञ) अधिकतम खुदरा कीमत;

(ट) टार्टरिक अम्ल अंतर्वस्तु;

(ठ) कोई अन्य विशिष्टियां जो कृषि विपणन सलाहकार द्वारा विनिर्दिष्ट की जाएं ।

( ii ) पैकेजों पर चिह्नांकन के लिए प्रयुक्त स्याही ऐसी गुणवत्ता वाली होगी जो उत्पाद को संदूषित न करे ।

( iv ) प्राधिकृत पैकर , भारत सरकार के कृषि विपणन, सलाहकार या उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात् श्रेणीकृत पैकेजों पर अपने निजी व्यापार चिह्न या व्यापार ब्रांड का उपयोग कर सकेगा परंतु वह इन नियमों के अनुसार आधान पर लगाए गए श्रेणी अभिधान चिह्न द्वारा उपदर्शित गुणवत्ता से भिन्न गुणवत्ता उपदर्शित न करता ही ।

*पैकिंग की तारीख , नमूने का विश्लेषण पूरा होने की तारीख होगी ।

8. इमली ( बीज वाली ) को निर्यात के लिए क्रेता की अपेक्षाओं के अनुसार श्रेणीकृत और चिन्हांकित किया जा सकेगा परंतु वह सुसंर्गत अनुसूची में विनिर्दिष्ट न्यूनतंम अपेक्षाओं को पूरा करता हो ।

9. प्राधिकार प्रमाणपत्र के अनुदान के लिए विशेष शर्तें : -

(i ) प्रत्येक प्राधिकृत पैकर , साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के नियम के उपनियम ( 8 ) में विनिर्दिष्ट शर्तों के अतिरिक्त, कृषि विपणन सलाहकार द्वारा समय - समय पर विहित किए गए सभी अनुदेशों का पालन करेगा ।।

(ii ) प्राधिकृत पैकर इमली ( बीज वाली ) की गुणवत्ता का परीक्षण करने के लिए साधारण श्रेणीकरण और चिह्नांकन नियम 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या उस प्रयोजन के लिए अनुमोदित राज्य श्रेणीकरण प्रयोगशाला या निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा;

(iii ) प्रसंस्करण , श्रेणीकरण और पैकिंग के लिए परिसरों को पूर्णतः स्वास्थ और स्वच्छ स्थितियों में रखा जाएगा । इन क्रियाओं में लगे हुए कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संचारी , संसर्गी या संक्रामक रोग से मुक्त होंगे ; !

(iv ) परिसरों में पक्के फर्श , प्रकाश और वायु के लिए बेहतर संवातम वाली पर्याप्त भंडारण सुविधाएं होगी और वह कृन्तक और कीटों के आकीर्णन से मुक्त होंगे ।

( इमली ( बीज वाली ) का श्रेणी अभिधान और गुणवत्ता

1. इमली ( बीज वाली ) को फलीदार सी इंडिका एल से पूर्णरूप से तैयार और पके हुए फलों से बाहरी छिलके को हटाने के पश्चात् प्राप्त किया जाएगा ।

2. न्यूनतम अपेक्षाएं:-

( i ) इमली ( बीज वाली ) वस्तु के रंग और विशेषताओं वाली होगी ।

( ii ) इमली ( बीज वाली ),-

(क) पूर्ण रूप से विकसित और पकी हुई होगी;

(ख) स्वच्छ होगी;

(ग ) हानिकारक पदार्थों से मुक्त होगी;

(घ) घृणजन्य गंध से मुक्त होगी;

(ङ) किसी बाहरी नमी से मुक्त होगी;

( च ) किसी अकार्बनिक बाध्य पदार्थों से मुक्त होगी ।

(iii ) इमली ( बीज वाली ) खमीर स्वाद और फफूंदी गंध नहीं देती ।

( iv ) इमली ( बीज वाली ) कीट संदूषण , जीवित या मृत कीटाणुओं, फफूंददार कृतंक रेशों और उत्सर्ग , मिश्रित रंजक पदार्थ , धूल या जन्तुओं के कारण किसी अन्य अंशुद्धता से मुक्त होगी ।

( v ) इमली ( बीज वाली ) भारों धातुओं , नाशकजीवमारों के अवशिष्ट स्तरों और निर्यात के लिए कोडेक्स एलिमेन्टेरियस आयोग द्वारा अधिकथित अन्य खाद्य सुरक्षा के मापदंडों का अनुपालन करेगी ।

( vi ) इमली ( बीज वाली ) भारों धातुओं , कीटनाशियों और नाशकजीवमारों, फसल संदूषकों, प्राकृतिक रूप से पैदा होने वाले विषैले पदार्थों के अवशिष्ट स्तरों और व्यापार के लिए समय - समय पर यथा संशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन यथाविहित अन्य खाद्य सुरक्षा मापदंडों का अनुपालन करेगी ।

( vii ) इमली ( बीज वाली ) में क्रमशः 100 मिलीग्राम और 30 माइक्रोग्राम प्रति किलोग्राम से अधिक यूरिक अम्ल और एफ्लाटाक्सिन नहीं होगा ।

इमली ( बीज वाली ) का विकास और दशा ऐसी होगी जिससे कि वह निम्नलिखित के लिए समर्थ हो सके:-

-परिवहन और हथालन को सहन करने के लिए और

-गंतव्य स्थान पर समाधानप्रद दशा में पहुंचने के लिए ।

टार्टरिक अम्ल अंतर्वस्तुओं को पैकेजों पर उल्लिखित किया जाएगा ।

स्पष्टीकरण:

(1 ) कार्बनिक बाह्य पदार्थ के अंतर्गत इमली की फलियों और उसके बीजों से भिन्न पौधों के वनस्पति पदार्थ हैं ।

( i ) अकार्बनिक बाहय पदार्थ के अंतर्गत रेत , कंकड़ , रोड़े , मिट्टी के ढेले , चिकनी मिट्टी , कीचड़ , आदि हैं ।।

( ii ) क्षतिग्रस्त फलियों से कीट द्वारा क्षतिग्रस्त और ऐसी फलियां अभिप्रेत हैं जो गूदा रहित हैं ।

G.S.R. 268. The following draft of the Tamarind ( with seed) Grading and Marking Rules, 2007 which the CentralGovernment proposes to make in exercise ofthe powers conferred by section 3 ofthe Agricultural Produce(Grading andMarking) Act, 1937 ( 1 of 1937) and in supersession of Dried Tamarind Grading and Marking Rules , 1983 except as respect of things done or omitted to be done before such supersession are hereby published as required by the said section, for information of all persons' likely to be affected thereby and netice is hereby given that the said draft rules shall betaken into consideration after the expiry of a period of forty five days from the date on which copies of the Gazette of India containing this notification are made available to the public;

Any person desirous to make any suggestion or objection in respect of the said draft rules may forward the same for consideration of the Central Government within the period specified above , to the Agricultural Marketing Adviser to the Govt. ofIndia,Directorate of Marketing and Inspection , Head Office , N.H. IV, Faridabad- 121: 001 .

DRAFT RULES

1 Short title, application and commencement :-( 1 ) These rules may be called the Tamarind (with seed) Grading and Marking Rules , 2007.

(2) They shall apply to Tamarind (with seed) obtained from Tamarindus indica L. of family Legumino sae, Caesalpiniaceae.

(3) They shall come into force on the date of their final publication in the Official Gazette .

2 Definitions :-In these rules ; unless the context otherwise requires:

(1) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;

(i) "Authorized packer " means a person or body of persons who has been granted the certificate ofauthorization to grade and mark Tamarind (with seed) in accordance with the grade standards and procedure prescribed under these rules;

(iii) "Certificate of Authorization " means a certificate issued under the provisions of General Grading and Marking Rules , 1988 authorizing a person or a body of persons to grade and mark Tamarind ( with seed) with the grade designation mark;

(iv) "General Grading and Marking Rules " means the General Grading and Marking Rules , 1988 made under section 3 ofthe Agricultural Produce (Grading and Marking) Act, 1937 ( 1 of 1937 );

(v) " Schedule " means a Schedule appended to these rules .

3.Grade designation mark:--- The grade designation mark shall consist of "AGMARK INSIGNIA " consisting of a desigh incorporating the certificate of authorization number, the word " AGMARK" , name of commodity and grade designation resembling the one as set out in Schedule I.

4. Grade designation:--The grade designation to indicate the quality ofTamarind (with seed) shall be as set out in colunın No. I of Schedule II .

5. Quality : The quality of Tamarind ( with seed) shall be as set out in against each grade designation in columns 2 to 9 of Schedule II .

6. Method of packing:-

( 1) Tamarind (with seed) shall be packed only in sound, clean and dry containers made ofjute or cloth with suitable inner lining of food grade material , laminated polyethylene or poly propylene or high density. polyethylene bags , pouches or any other packaging material duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf;

(ii) The container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell;

(iii) Tamarind (with seed) shall be packed in such a way as to protect the produce properly . The container shall be securely closed and sealed in a manner approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf;

(iv) The materials used inside the package must be clean and of such a quality as to avoid causing any external or internal damage to the produce ;

(v) The use of materials particularly of paper or stamps bearing trade specifications is permitted provided the printing or labeling has been done with non toxic ink or glue;

(vi) Each package shall contain Tamarind (with seed) of one grade designation only. Suitable number or small packets ofTamarind ( with seed) containing graded material of the same lot/batch and grade designation may be packed in a master container such as jute bags , wooden cases , cardboard cartons etc. , with details on master containers ;

(vii) The Tamarind ( with seed) shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time to time .

7. Method ofMarking and Labeling : (i ) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each container;

( ii) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked on each package , namely :---

(a) Name ofthe commodity;

(b) Grade designation;

(d) Net Weight/No. of unit ;

(e) Storage condition, if any;

(f) Country of origin;

(g) Date ofpacking ; *

(h) Best before date (wherever applicable) ;

(i) Lot/Batch number;

(1) Maximum retail price;

(k) Tartaric Acid content;

(1) Any other particulars as may be specified by the Agricultural Marketing Adviser;

(iii ) The ink used for marking on packages shall be of such quality which may not contaminate the product;

The date of packing shall be the date of completion of the analysis of the sample .

(iv) The authorized packer may after obtaining prior approval of the Agricultural Marketing Adviser to the Government of India or an officer authorized by him in this behalf, use his privațe mark or trade brand on the graded packages provided that the same do not indicate quality other than indicated by the grade designation mark affixed on the container in accordance with these Rules .

8. Tamarind (with seed) may be graded and marked as per buyer's requirements for export provided minimum requirements and quality specified in the relevant schedule are met.

9. Special conditions for grant ofcertificate of authorization :-

In addition to the conditions specified in sub - rule (8) of rule 3 of the General Grading and Marking Rules, 1988 , every authorized packer shall follow all instructions prescribed by Agricultural Marketing Adviser from time to time .

(1) The authorized packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf in accordance with Rule 9 of the General Grading and Marking Rules , 1988 for testing the quality of Tamarind (with seed) or has access to the State Grading Laboratory or Private Commercial Laboratory approved for the purpose;

(ii) The premises for processing, grading and packing shall be maintained in perfect hygienic and sanitary conditions. The personnel engaged in these operations shall be in sound health and free from any infectious , contagious or communicable diseases .

(iv) The premises shall have adequate storage facilities with pucca floor, good ventilation for light and air and free from rodent and insect infestation.

(vii ) Tamarind (with seed) shall not contain uric acid and aflatoxin more than 100 milligrams and 30 micrograms perkilogram respectively.

सा.का.नि. 269.-संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय मृदा और भूमि उपयोग सर्वेक्षण ( एसएलयूएसआई ) ( सरकारी पक्ष ) ( वरिष्ठ आशुलिपिक ) भर्ती नियमावली , 1976 के अतिक्रमण में तथा भारतीय मृदा और भूमि उपयोग सर्वेक्षण (समूह ' ग ' गैर- लिपिक-वर्गीय पदों) भर्ती नियमावली , 1977 जहां तक वे वरिष्ठ आशुलिपिकों और आशुलिपिक ( ग्रेड- III ) के पदों से संबंधित है, इस प्रकार के अतिक्रमण से पूर्व की गई अथवा लोप किए जाने वाले कार्यों को कोड़कर, राष्ट्रपति एत‌द्वारा कृषि मंत्रालय (कृषि और सहकारिता विभाग ) के अधीन भारतीय मृदा और भूमि उपयोग सर्वेक्षण में आशुलिपिक ( ग्रेड-1 ) , आशुलिपिक ( ग्रेड- II ) और आशुलिपिक (ग्रेड- III ) के पद के लिए भर्ती की पद्धतियों को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( i ) इन नियमों को भारतीय मृदा एवं भूमि उपयोग सर्वेक्षण संगठन आशुलिपिक ( ग्रेड- I , II एवं III ) भर्ती नियम , 2007 कहा जाएगा ।

( ii ) ये राजपत्र में प्रकाशन की तारीख से प्रदत्त होंगे ।

2. पदों की संख्या , उसका वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और वेतनमान जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से (4 ) तक में विनिर्दिष्ट हैं, होंगे ।

3. भर्ती की पद्धति , आयु-सीमा और अन्यअर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य मामले जो उक्त अनुसूची के स्तम्भ ( 5 ) से ( 14 ) तक में विनिर्दिष्ट हैं होंगे ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , ग्रा

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पद पर नियुक्ति का पात्र नहीं होगा :

छूट दे सकेगी । बशर्ते कि केन्द्र सरकार , यदि इससे संतुष्ट हो जाए कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू वैयक्तिक विधि केअधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार मौजूद है , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से

5. शिथिल करने की शक्ति. - जिस मामले में केन्द्र सरकार की यह राय हो कि ऐसा करना आवश्यक वा संशोधन है वहां, वह, उसके लिए जो कारण है उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को , किसी वर्ग या प्रवर्ग के व्यक्तियों को बाबत आदेश द्वारा शिथिल कर सकेगी । जिस मामले में केन्द्र सरकार की यह राय हो कि ऐसा करना आवश्यक है, वह आदेश द्वारा , जिसके लिए लिखित में कारण दर्ज करते हुए तथा संघ लोक सेवा आयोग से परामर्श करके समूह ' ख ' पद के संबंध में , इन नियमों को किसी वर्ग अथवा श्रेणी के व्यक्तियों के संबंध में किन्हीं प्रावधानों की शिथिल कर सकती है ।

6. व्यावृत्ति. इन नियमों में ऐसा कोई प्रावधान नहीं होगा जो आरक्षणों , आयु सीमा की छूट और अन्य रियायतों जो अनुसूचित जातियों, जनजातिया , अन्य पिछड़ा वर्गों , भूतपूर्व सैनिकों अथवा अन्य विशेष श्रेणी के व्यक्तियों के लिए प्रदान किया जाना अपेक्षित हो इस संबंध में केन्द्र सरकार द्वारा समय - समय पर जारी आदेशों के अनुसार दुष्प्रभावित नहीं करेंगे ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Soil and Land Use Survey of India ( SLUSI ) ( Government Side) ( Senior Stenographer) Recruitment Rules, 1976, and the Soil and Land Use Survey of India (Group ' C' Non -ministerial posts ) Recruitment Rules , 1977 , in so far asthey relate to the posts of Senior Stenographer and Stenographer (Grade - III ) , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer (Grade I) , Stenographer (Grade II ) , and Stenographer (Grade III ) in the Soil and Land Use Survey of India, under the Ministry of Agriculture ( Department of Agriculture and Cooperation), namely ---

Short title and commencement .( 1 ) These rules may be called the Soil and Land Use Survey of India Stenographer (Grade I , II and III ) , Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.

4. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law aplicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule .

हुए और राष्ट्रीय बीज बीज विश्लेषक, बीज निजी सचिव से है , उन और सहकारिता विभाग के लिए निम्नलिखित सा.का.मि. 270. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते अनुसंधान और प्रशिक्षण केन्द्र ( समूह ' क ' और समूह ' ख ' पद ) भर्ती नियम 2004 को, जहां तक उनका संबंध मुख्य प्रौद्योगिकीविद, ज्येष्ठ बीज विश्लेषक और कनिष्ठ बीज विश्लेषक , बीज प्रसंस्करण इंजीनियर , प्रशासन/लेखा अधिकारी , बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया हो या करने का लोप किया गया है , कृषि के अधीन राष्ट्रीय बीज अनुसंधान तथा प्रशिक्षण केन्द्र में समूह ' क' और ' ख' पदों पर भर्ती की पद्धति का विनियमन करने नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय बीज अनुसंधान तथा प्रशिक्षण केन्द्र ( समूह ' क' और समूह ' ख' पद ) भर्ती नियम , 2007 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद-संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं । 4. निरहता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं , विवाह किया है, या

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह, समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत संघ लोक सेवा आयोग के परामर्श से आदेश द्वारा शिथिल कर सकेगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in superssion of the National Seed Research and Training Centre ( Group ' A' and Group ' B' posts) Recruitment Rules, 2004, in so far as they relate to the posts of Chief Seed Analyst , Seed Technologist, Senior Seed Analyst Junior Seed Analyst , Seed Processing Engineer , Administration/Accounts Officer and Private Secretary except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group A and Group B posts in the National Seed Reserch and Training Centre under the Department of Agriculture and Cooperation , namely:----

1. Short Title and commencement.( 1 ) These rules may be called the National Seed Research and Training Centre(Group A and Group B posts ) Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications , etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the aforesaid Schedule .

4. Disqualifications . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who , having a spouse living, has entered into or contracted a marriage with any person,.

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person fromthe operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category ofpersons .

6. Savings . 1. (1) These rules may be called the Central Water Commission (Assistant Research Officer ) Recruitment ( Amendment ) Rules; 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Scheduleto the Central Water Commission (Assistant Research Officer ) Recruitment Rules , 2006 , in column - 8 , for the existing entries , the following entries shall be substitutued, namely :--

(i) Master's Degree in Chemistry from a recognized University or equivalent ; and

(ii) two years research experience in Chemistry from Central/State Governments/Union Territories /Universities / recognized institutions .

सा .कानि. 272.-संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और प्रशिक्षण निदेशालय ( समूह ' क' और समूह ' ख' पद ) भर्ती नियम, 1971 को, जहां तक उसका संबंध प्रशासनिक अधिकारी के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है, श्रम और रोजगार जत्रालय के अधीन रोजगार और प्रशिक्षण महानिदेशालय के प्रशिक्षण निदेशालय ( महिला उपजीविका प्रशिक्षण के सिवाय) में प्रशासनिक अमल के पद पर भर्ती की पद्धत्ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम प्रशिक्षण निदेशालय ( महिला उपजीविका प्रशिक्षण के सिवाय ) , प्रशासनिक अधिकारी भर्ती नियम 2007 हैं ।

( ii ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. प्रद-संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण,और उसका वेतनमान वह होगा, जो इन नियमों उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं । से

अर्हताएं और उससें 3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा, संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5 ) से स्तंभ (14 ) में विनिर्दिष्ट हैं

4. निरर्हता. वह व्यक्ति

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी मत्त्री जीवितहै, विसात किया है यान

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति नि विवादमा है ।

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करता आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है

G.SR. 272. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Directorate of Training ( Group ' A' and ' B ' posts ) Recruitment Rules , 1971 , in so far as it relates to the post of Administrative Officer, except as respects things done or omitted to be done before such supersession, the President herebymakes the following rules regulating the method ofrecruitment to the post of Administrative Officer in the Directorate of Training (except Women occupational Training ), in the Directorate General of Employment and Training under the Ministry of Labour and Employment, namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Directorate ofTraining ( except Women Occupational Training ) , Administrative Officer Recruitment Rules, 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay , etc.-The number of the post , its classification and the scale ofpay attached thereto , shall be as specified in column, (2 ) to (4) of the Schedule annexed to these rules.

3.Method of recruitment , age limit and other qualifications etc. The method of recruitment, to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to (14 ) of the aforesaid Schedule .

4. Disqualification ,--No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post ::

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law aplicable to such person and the other party to the marriage and that there are other grounds for so doing, extrapt any person from the operation of these rules ..

5. Power to relax- Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving-Nothing in these rules shall affect reservations , relaxation ofage - limit and other concessions required to be provided for candidates belonging to the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note:Wherejuniors who have completed their qualifying/ eligibility. service are being considered for promotion , their seniors would also be considered provided they are not short ofthe requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service.

Deputation:

Officers under the Central or State Governments/Union Territories:

(a) (i) Holding analogous post on regular basis in the Parent Cadre/ Department; or

(ii) With five years' service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 6500-10500 or equivalent in the parent Cadre/Department or

(iii ) with eight years ' service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5500-9000 or equivalent in the parent Cadre/Department ; and

(b) possessing the educational qualifications and experience as under:

(i ) Degree of a recognised University or equivalent ;

(ii ) Five years experience of Administration , Accounts and Establishment matters .

Note 1 : Departmental Officers in the feeder category who are in the direct line ofpromotion will not be eligible for consideration for appointment on deputation .

Similarly deputationist shall not be eligible for consideration for

appointment by promotion .

Note 2 : Period of deputation including period of deputation in another Ex-cadre post held immediately preceding this appointment in the same or some other organization/Department of the Central Government shall ordinarily not exceed three years .

Note3: The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of applications.

If, a Departmental Promotion Committee exists what is its composition
