सं. गैबैपवि. 197 /मुमप्र ( पीके ) -2007-- भारतीय रिज़र्व बैंक, इस बात से संतुष्ट होने पर कि जनता के हित में और वित्तीय प्रणाली को देश के हित में विनियमित करने हेतु बैंक को समर्थ बनाने के लिए गैर बैंकिंग वित्तीय कंपनियाँ सार्वजनिक जमा स्वीकरण ( रिज़र्व बैंक ) निदेश , 1998 को संशोधित करना आवश्यक है, भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 1934 का 2) की धारा 45 - ञ, 45 - अक, 45-८, 45- ठ एवं 45 ढग द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इस संबंध में उसे सक्षम बनाने वाली सभी शक्तियों का प्रयोग करते हुए निदेश देता है कि 31 जनवरी 1998 की अधिसूचना सं . डीएफसी . 118 / डीजी ( एसपीटी ) -98 में अंतर्विष्ट निदेश तत्काल प्रभाव से निम्नवत संशोधित होंगे अर्थात--
( i ) पैराग्राफ 3 का उप पैराग्राफ ( 1 ) हटा दिया जाएगा ।
( ii ) पैराग्राफ 3 का उप पैराग्राफ ( 2 ) निम्नलिखित से प्रतिस्थापित होगा :
" इन निदेशों में अंतर्विष्ट उपबंध म्युचुअल बेनीफिट फायनांसियल कंपनी एवं म्युचुअल बेनीफिट कंपनी पर लागू नहीं होंगे ; बशर्ते म्युचुअल बेनीफिट कंपनी का आवेदनपत्र भारत सरकार द्वारा कंपनी अधिनियम , 1956 ( 1956 का 1 ) के प्रावधानों के अंतर्गत निरस्त न कर दिया गया हो । "

भारतीय रिज़र्व बैंक, इस बात से संतुष्ट होने पर कि जनता के हित में और वित्तीय प्रणाली को देश के हित में विनियमित करने हेतु बैंक को समर्थ बनाने के लिए अवशिष्ट गैर बैंकिंग कंपनी ( रिज़र्व बैंक) निदेश, 1987 को संशोधित करना आवश्यक है , भारतीय रिज़र्व बैंक अधिनियम , 1934 ( 1934 का 2 ) की धारा 45-ञ, 45-ञक, 45- ट, 45 - ठ द्वारा प्रदत्त शक्तियों और इस संबंध में उसे सक्षम बनाने वाली सभी शक्तियों का प्रयोग करते हुए एतद्वारा निदेश देता है कि 15 मई 1987 की अधिसूचना सं . डीएफसी . 55/डीजी( ओ ) -87 में अंतर्विष्ट निदेश तत्काल प्रभाव से निम्नवत संशोधित होंगे :
पैराग्राफ 5A के बाद निम्नलिखित पैराग्राफ जोड़ा जाएगा अर्थात;
" जनता की जमाराशियों की विलंब से अदायगी करने पर ब्याज का भुगतान
5AA . जहाँ जमाकर्ता द्वारा दावा करने पर कोई अवशिष्ट गैर बैंकिंग कंपनी परिपक्वता पर देय ब्याज सहित जमाराशि की अदायगी में विफल होती है, वहाँ कंपनी निम्नवत ब्याज अदा करेगी ।
i . यदि कंपनी जमाराशि की परिपक्वता की तारीख से न्यूनतम 2 माह पूर्व परिपक्वता की सूचना जमाकर्ता को दे देती है और उसके पास इस बात के पर्याप्त सबूत हों जैसे जमाकर्ता से प्राप्त पावती हो किन्तु जमाकर्ता परिपक्वता पर दावा प्रस्तुत करने में विफल हो तो कंपनी दावे की तारीख से अदायगी की तारीख तक जमाराशि पर देय ब्याज दर से ब्याज सहित परिपक्वता की राशि अदा करेगी । ii . यदि कंपनी जमाराशि की परिपक्वता की तारीख से 2 माह पूर्व परिपक्वता की सूचना ( जमाकर्ता को) नहीं देती है तो जब जमाकर्ता दावा करेगा तब कंपनी परिपक्वता की तारीख से अदायगी की तारीख तक जमाराशि पर देय ब्याज दर से ब्याज सहित परिपक्वता की राशि अदा करेगी । "

सं. टीआरवाइ/आइएनवी/जेएससी/4354 दिनांकित 13/12/2007 बैंकिंग कंपनी उपक्रमों का अधिग्रहण और अंतरण) अधिनियम 1970 ( 1970 का 5) के अनुच्छेद के 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय रिज़र्व बैंक के परामर्श के बाद और केन्द्र सरकार की पूर्व मंजूरी के साथ बैंक ऑफ़ इंडिया का निदेशक बोर्ड, बैंक ऑफ़ इंडिया शेयर और बैठकें) विनियम 2003 में निम्नलिखित संशोधन प्रस्तावित करता है, अर्थात्:
1. संक्षिप्त शीर्षक और प्रारम्भ (1) इन विनियमों को बैंक ऑफ़ इंडिया शेयर और बैठकें) संशोधन विनियम, 2007 कहा जाएगा ।
(2) ये शासकीय-राजपत्र में उनके प्रकाशन की तारीख को प्रभावी होंगे ।
2. विनियम 2 और 4 का संशोधन बैंक ऑफ़ इंडिया (शेयर और बैठकें) विनियम , 2003 में
विनियम 2 , में खण्ड ( पी) के लिए निम्नलिखित खण्ड प्रतिस्थापित होगा - " (पी) इसमें प्रयुक्त कथन और अभिव्यक्ति तथा जो इन विनियमों में परिभाषित नहीं हैं , किन्तु अधिनियम या योजना , या भारतीय प्रतिभूति और विनिमय बोर्ड द्वारा जारी दिशानिर्देशों और अधिनियम के अनुच्छेद 3. के उप खण्ड ( 2बी) की धारा(सी) के उपबन्ध के अंतर्गत इस पर प्रदत्त शक्तियों के अनुसरण में भारतीय रिज़र्व बैंक द्वारा तैयार किए गये दिशानिर्देशों में परिभाषित हैं, का वही अर्थ है जो क्रमशः उन्हें अधिनियम या योजना या भारतीय प्रतिभूति और विनिमय बोर्ड या भारतीय रिज़र्व बैंक द्वारा जारी दिशानिर्देशों में निर्दिष्ट किया गया है, जैसा भी मामला हो"
(0) विनियम 4 के बाद निम्नलिखित विनियम सम्मिलित किया जाएगा , अर्थात- 4

"4क (1) सार्वजनिक निर्गम अथवा अधिमानी आबंटन अथवा प्राईवेट प्लेसमैंट के द्वारा बैंक इक्विटी या अधिमानी शेयर जारी कर बैंक पूँजी की उगाही कर सकता है ।
(2) इस प्रकार की पूँजी उगाही से संबंधित भारतीय प्रतिभूति और विनिमय बोर्ड के नियमों या अधिनियमों , दिशानिर्देशें के अनुरूप पूँजी उगाही के लिए बैंक एक प्रस्ताव का निरुपण करेगा ।
(3) सार्वजनिक निर्गम उथवा अधिमानी आबंटन या अधिमानी शेयरों का निजी स्थान नियोजन द्वारा पूँजी उगाही के लिए, उन अधिमानी शेयरों (चाहे बेमियादी या अप्रतिदेय अथवा प्रतिदेय) के प्रत्येक वर्ग तथा बैंक द्वारा जारी किए गए इस अधिमानी शेयरों के प्रत्येक वर्ग जो निबंधन और शर्तों के अध्यधीन शेयरों के प्रत्येक वर्ग जो निबंधन और शर्तों के अध्यधीन है उनका निर्धारण अधिनियम के भाग 3 के उप भाग (2ब) के खंड ( ग) के प्रावधान में सन्निहित प्रावधानों के अनुसारी में भारतीय रिज़र्व बैंक द्वारा ढाँचागत दिशानिर्देशों के अनुसार किया जाएगा ।
(4) बैंक अपना प्रस्ताव भारतीय रिज़र्व बैंक को प्रस्तुत करेगा तथा प्रस्ताव को अंतिम रूप देने से पहले भारतीय रिज़र्व बैंक के दृष्टिकोण को ध्यान में रखेगा ।
(5) इसके बाद अंतिम प्रस्ताव को स्वीकृति हेतु केन्द्र सरकार को प्रस्तुत किया जाएगा तथा ऐसे नियमों एवं शर्तों के अध्यधीन केन्द्र सरकार स्वीकृति देगी जैसा वह ठीक समझे ।
(6) केन्द्र सरकार की स्वीकृति के अनुरूप बैंक पूँजी उगाही, करेगा " .

परिषद अपने विशेषाधिकार के अन्तर्गत किसी भी परीक्षाकेन्द्र को किसी भी समय बिना कोई कारण दिये रद्द कर सकती है ।
सामान्य प्रवीणता परीक्षा की परीक्षा के लिये आवेदन पत्र, जो कि सूचना विवरणिका में संलग्न है 5 दिसम्बर 2007 से उपलब्ध होंगे , जो कि दि इन्सटीटयूट ऑफ चार्टर्ड एकाउन्टेन्टस ऑफ इण्डिया के संयुक्त सचिव (परीक्षा) के इन्द्रप्रस्थ मार्ग , आईसीएआई भवन , नई दिल्ली स्थित कार्यालय से 400 / - रूपये ( रू0 300/ - परीक्षा शुल्क व रू0 100/- आवेदन पत्र व सूचना विवरणिका हेतु) प्रति आवेदन पत्र भुगतान करने पर मिल सकता है । सूचना विवरणिका जिसमें सामान्य प्रवीणता परीक्षा ( सी.पी.टी. ) का आवेदन पत्र भी है में परीक्षा शुल्क भी सम्मिलित है, अतः आवेदन पत्र जमा करने के समय कोई अन्य शुल्क की आवश्यकता नहीं हैं । सूचना विवरणिका जिसमें आवेदन पत्र भी संलग्न है इंस्टीट्यूट के रीजनल और ब्रांचो के कार्यालयों में भी उपलब्ध हैं और नगद भुगतान करने पर 5 दिसम्बर, 2007 से प्राप्त किये जा सकते हैं । पूर्ण रूप से भरे हुये आवेदन पत्र 26 दिसम्बर 2007 तक स्वीकार किये जायेगें व 26 दिसम्बर 2007 के बाद आवेदन पत्र किसी भी स्थिति में स्वीकार नहीं किये जायेगें ।
सामान्य प्रवीणता परीक्षा का पूर्ण रूप से भरा हुआ आवेदन पत्र स्वयं आकर भी इन्स्टीट्यूट के नई दिल्ली कार्यालय व विकेन्द्रित कार्यालयों मुम्बई, कोलकाता, चैन्नई , कानपुर, अहमदाबाद , बंगलौर , हैदराबाद, जयपुर एवं पूना में 26 दिसम्बर 2007 तक जमा कराया जा सकता है । इन नगरों में रहने वाले परीक्षार्थियों को इस सुविधा का फायदा उठाने की सलाह दी जाती है ।
प्रश्नपत्र पत्रिका की भाषाः-
सामान्य प्रवीणता परीक्षा वस्तुनिष्ठ परीक्षा होगी । उम्मीदवारों को उत्तर हिन्दी माध्यम की प्रश्न पत्र पत्रिका द्वारा भी देने की सुविधा दी जाती है । विस्तृत जानकारी सूचना विवरणिका में उपलब्ध है ।
सामान्य प्रवीणता परीक्षा (सी० पी ०टी० ) केवल उन्ही परीक्षार्थियों के लिये जो पहले से इस परीक्षा के लिये दि इंस्टीट्यूट ऑफ चार्टर्ड एकाउन्टेन्टस ऑफ इण्डिया में 1 दिसम्बर , 2007 या इससे पहले रजिस्टर्ड हैं व योग्यता संबंधी आवश्यकतायें को पूर्ण करते हैं ।

The Reserve Bank of India , having satisfied that , in the public interest , and to enable the Bank to regulate the financial system of the country to its advantage , it is necessary to amend the Non- Banking Financial Companies Acceptance of Public Deposits ( Reserve Bank) Directions , 1998 , in exercise of the powers conferred by Sections 45J , 45JA, 45K, 45L and 45NC of the Reserve Bank of India Act , 1934 (2 of 1934) and of all the powers enabling it in this behalf, hereby directs that the said directions contained in Notification No.DFC . 118 /DG ( SPT)-98 dated January 31 , 1998 shall stand amended with immediate effect as follows , namely -
(i) Sub- paragraph ( 1 ) of paragraph 3 , shall be deleted.
( ii ) Sub -paragraph ( 2 ) of paragraph 3 , shall be substituted by the following paragraph:
"The provisions contained in these directions shall not apply to a Mutual Benefit Financial Company or a Mutual Benefit Company;
Provided that the application of Mutual Benefit Company is not rejected by Government of India under the provisions of the Companies Act , 1956 ( Act 1 of1956) . "

The Reserve Bank of India , having considered it necessary in the public interest and being satisfied that for the purpose of enabling the Bank to regulate the financial system of the country to its advantage it is necessary to amend the Residuary Non- Banking Companies ( Reserve Bank) Directions, 1987 , in exercise of the powers conferred by Sections 45J , 45JA, 45K and 45L of the Reserve Bank of India Act , 1934 ( 2 of 1934 ) and of all the powers enabling it in this behalf, hereby directs that the directions contained in Notification No.DFC.55/ DG ( O ) -87 dated May 15 , 1987 shall stand amended with immediate effect as follows:
After paragraph 5A, the following paragraph shall be inserted, namely;
"Payment of interest for delayed repayment of public deposits
5AA . Where an RNBC fails to repay the deposit along with interest on maturity on the claim made by the depositor, it shall be liable to pay interest in the following manner:
i . if the company has intimated about the maturity to the depositor at least two months before the date of maturity and has sufficient evidence for the same viz. acknowledgement from the depositor, but the depositor fails to submit his claim on maturity , then the company will be required to pay interest at the rate as applicable to the deposit from the date of claim till the date of repayment along with the amount due on maturity .
ii . if the company has not intimated about the maturity to the depositor two months before the date of maturity , then , as and when the depositor makes a claim, the company will be required to pay interest at the rate as applicable to the deposit from the date of maturity till the date of repayment along with the amount due on maturity. "

In exercise of powers conferred by section 19 of the Banking Companies (Acquisition And Transfer of Undertakings ) Act, 1970 ( 5 of 1970 ), the Board of Directors of Bank of India after consultation with the Reserve Bank of India and with the previous sanction of the Central Government propose to make the following amendments to the Bank of India ( Shares and Meetings ) Regulations , 2003 , namely: -
1. Short title and commencement- ( 1 ) These Regulations may be called the Bank of India ( Shares and Meetings ) Amendment Regulations , 2007 .
(2) They shall come into force on the date of their publication in the Official gazette.
2. Amendments of Regulations 2 and 4. In the Bank of India (Shares and Meetings ) Regulations , 2003.
(i ) in regulation 2, for clause ( p) , the following clause shall be substituted, namely -
" ( p) The words and expressions used herein and not defined in these Regulations but defined in the Act or Schemes , or guidelines issued by the Securities and Exchange Board of India , and the guidelines framed by the Reserve Bank in pursuant to the powers conferred on it under the proviso to clause ( c ) of sub- section (2B ) of section 3 of the Act shall have same meaning respectively assigned to them in the Act or the Scheme or the guidelines issued by the Securities and Exchange Board of India or framed by the Reserve Bank, as the case may be" ;
( ii ) after regulation 4, the following regulation shall be inserted , namely - 12

"4A ( 1 ) The Bank may raise capital by public issue or preferential allotment or private placement of Equity Shares or Preference Shares .
(2 ) The Bank shall formulate a proposal to raise capital in accordance with the guidelines , rules or regulations of the Securities and Exchange Board of India , relating to raising of such capital .
(3) For raising capital by public issue or preferential allotment or private placement of Preference Shares , the extent of issue of each class of such Preference Shares ( whether perpetual or irredeemable or redeemable ) and the terms and conditions subject to which each class of such Preference Shares that may be issued by the Bank shall be determined in accordance with the guidelines framed by the Reserve Bank in pursuant to the provisions contained in the proviso to clause ofsub - section ( 2B ) of section 3 of the Act .
(4) The Bank shall submit the proposal to the Reserve Bank and take into account the views of the Reserve Bank before finalizing the proposal .
(5) The final proposal shall thereafter be submitted to the Central Government for its sanction and the Central Government may grant sanction subject to such terms and conditions as it may deemfit.
(6) The Bank shall raise capital in accordance with the sanction of the Central Government . "

Applications for admission to Common Proficiency Test is required to be made on the relevant prescribed form as contained in the Information Brochure , which may be obtained from the Sr. Joint Secretary (Examinations) , The Institute of Chartered Accountants of India, ICAI Bhawan , Indraprastha Marg , New Delhi - 110 002 on payment of Rs . 400 /- ( Rs.300 / - towards examination fees and Rs . 100/- towards cost of application form and Information brochure) per application form . Since the cost of Information brochure containing Common Proficiency Test application form includes the examination fee no separate fee is required to be remitted at the time of submitting the filled in application form . The Information brochure containing Common Proficiency Test application form will also be available in the Regional and Branch Offices of the Institute and can be obtained therefrom on cash payment on or from 5th December , 2007 .
Common Proficiency Test application forms duly filled in may be sent so as to reach the Sr. Joint Secretary ( Examinations) at New Delhi not later than 26th December , 2007. Applications received after 26th December, 2007 shall not be entertained under any circumstances . Applications duly filled in will be received by hand delivery at the offices of Institute at New Delhi and at the Decentralised Offices of the Institute at Mumbai , Chennai , Kolkata , Kanpur, Ahmedabad , Bangalore , Hyderabad , Jaipur and Pune upto 26th December , 2007. Candidates residing in these cities are advised to take advantage of this facility . It maybe noted that there is no provision for acceptance of application forms after 26th December, 2007 with late fee.
QUESTION PAPER BOOKLET LANGUAGE :
Common Proficiency Test will be an objective type multiple choice based examination . Candidates will be allowed to opt for Hindi medium Question Paper Booklet for answering the questions. Detailed information will be found given in the Information brochure.
Common Proficiency Test (CPT) is open only to those students who are already registered with the Institute of Chartered Accountants of India for the said course on or before 1st December 2007 and fulfill the requisite eligibility conditions .
