सा.का.नि. 21.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और समंक विधायन प्रभाग और सर्वेक्षण अभिकल्प एवं अनुसंधान प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन ( लेखा एवं प्रशासनिक अधिकारी तथा कार्यालय अधीक्षक ) भर्ती नियमावली , 1994 को उन बातों के सिवाय अधिक्रमण करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्रालय में समंक विधायन प्रभाग और सर्वेक्षण अभिकल्प एवं अनुसंधान प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन में लेखा एवं प्रशासनिक अधिकारी तथा कार्यालय अधीक्षक के पदों पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का नाम समंक विधायन प्रभाग और सर्वेक्षण अभिकल्प एवं अनुसंधान प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन ( लेखा सह प्रशासनिक अधिकारी तथा कार्यालय अधीक्षक ) भर्ती नियम , 2008 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागूहोना--ये नियम इससे उपाबद्ध अनुसूची के कॉलम ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।
3. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

[PART II-SEC. 3 ( i) ] 14. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
5. निरर्हता. वह व्यक्ति, -
( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या विवाह का अनुबंध किया है;
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है , अथवा विवाह का अनुबंध किया है ।
उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार संतुष्ट हो जाती है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृत्ति: - इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।
इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्तिद्वारा।
प्रोन्नति: सहायक , जिसने 5000-8000 रुपये के वेतनमान में तीन वर्ष की नियमित सेवा की है , जिसके न हो सकने पर ऐसे सहायक, जिन्होंने सहायक और लेखाकार की श्रेणी में छह वर्ष की सम्मिलित सेवा की हो, जिसमें से सहायक की श्रेणी में कम से कम एक वर्ष की नियमित सेवा की हो ।
प्रतिनियुक्ति: केन्द्रीय सरकार के अधीन ऐसे अधिकारी-
(क) ( i ) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ है ; या
( ii ) जिन्होंने 5000-8000 रु. या समतुल्य के वेतनमान के पदों पर तीन वर्ष नियमित सेवा की हो; और

Administrative Officer and Office Superintendent in the Data Processing Division and Survey Design and Research Division, National Sample Survey Organisation, Ministry of Statistics and Programme Implementation, namely :-
1. Short title and commencement. ( 1 ) These rules may be called the Data Processing Division and Survey Design and Research Division , National Sample Survey Organisation , (Accounts- cum- Administrative Officer and Office Superintendent ) Recruitment Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application . These rules shall apply to posts specified in coloum ( 1 ) of the Schedule annexed to these rules .
3. Number of posts , classification and scale of pay. The number ofthe said posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .
4. Method of recruitment , age limit and other qualifications , etc. The method of recruitment, age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the afore said Schedule.
5. Disqualifications .---No person ,- (a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay , by order , for reasons to be recorded in writing , in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .
7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 22.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय सूचना सेवा ( समूह ' क' ) नियम 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय सूचना सेवा ( समूह ' क' ) ( संशोधन ) नियम , 2008 है ।
( 2 ) ये अनुसूची- III के नीचे टिप्पण -1 में उल्लिखित उपबंधों और उक्त अनुसूची के नीचे टिप्पण-2 में उल्लिखित उपबंधों को छोड़कर जो कमशः 12 अक्तूबर, 1991 और 25 मार्च , 1996 से प्रवृत्त होंगे , भारत के राजपत्र में उनके प्रकाशम की तारीख को प्रवृत्त होंगे । 2. भारतीय सूचना सेवा ( समूह ' क' ) नियम , 1987 में :--
(i ) नियम 7 में , उप - नियम 4 के स्थान पर निम्नलिखित उप- नियम रखा जाएगा , अर्थात्: -
" ( 4 ) प्रोन्नति के लिए अधिकारियों का चयन अनुसूची- IV के अनुसार गठित विभागीय प्रोम्नति समिति की सिफारिशों पर चयन द्वारा किया जाएगा , सिवाय कनिष्ठ प्रशासनिक ग्रेड ( एन एफ एस जी ) में पदों पर प्रोन्नति के लिए । " ( ii ) अनुसूची- I के स्थान पर निम्नलिखित अनुसूची रखी जाएगी , अर्थात्: -

संघ लोक सेवा आयोग द्वारा संचालित की जाने वाली प्रतियोगिता परीक्षा के परिणाम के आधार पर भारतीय सूचना सेवा समूह ' क' में सम्मिलित किए गए कनिष्ठ ग्रेड में समूह ' क ' पदों पर सीधी भर्ती के लिए न्यूनतम शैक्षिक अर्हताएं और आयु सीमा । किसी अभ्यर्थी के पास:-- ( i ) भारत में केन्द्रीय या राज्य विधान मंडल के किसी अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संसद् के किसी अधिनियम द्वारा स्थापित या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अधीन विश्वविद्यालय के रूप में समझे जाने के लिए घोषित अन्य शैक्षिक संस्थान या सरकार द्वारा समय - समय पर अनुमोदित किसी विदेशी विश्वविद्यालय की कोई डिग्री है या ऐसी शैक्षिक अर्हता रखता है जिसे सरकार द्वारा परीक्षा में प्रवेश के प्रयोजन के लिए मान्यता प्रदान की गई है ;
टिप्पण 1 : आपवादिक मामलों में , आयोग किसी ऐसे अभ्यर्थी को जिसके पास उपर्युक्त अर्हताओं में से कोई नहीं है , शैक्षिक रूप से अर्हित मान सके; परंतु यह तब जब कि आयोग का यह समाधान हो जाता है कि उसने अन्य संस्थाओं द्वारा संचालित ऐसी परीक्षा उत्तीर्ण कर ली है जिसका स्तर आयोग की राय में परीक्षा में उसके प्रवेश को न्यायोचित ठहराता है । 84

[PART II-SEC. 3 (i )] टिप्पण 2 : ऐसा अभ्यर्थी भी जिसके पास ऐसी वृत्तिक और तकनीकी अर्हताएं हैं जो सरकार द्वारा मृत्तिक और तकनीकी डिग्री के समतुल्य मान्यता प्राप्त हैं, परीक्षा में प्रवेश के लिए पात्र होगा । ( ii ) उस वर्ष में जिसमें परीक्षा ली जाती है , । अगस्त को 21 वर्ष की आयु पूरी कर ली है, किंतु 30 वर्ष की आयु पूरी नहीं कीहै ।"
( iv ) अनुसूची- III के स्थान पर निम्नलिखित अनुसूची रखी जाएगी , अर्थात्:--

चयन ग्रेड के अधिकारी जिनकी उस 'ग्रेड में दो वर्ष नियमित सेवा है । प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) जिसके अन्तर्गत केन्द्रीय सरकार संघ राज्य क्षेत्रों/स्वायत्त निकायों/पब्लिक सेक्टर उपक्रमों/कानूनी संगठनों/ अनुसंधान संस्थाओं/विश्वविद्यालयों/अर्द्ध सरकारी संगठनों के अधीन ऐसे अधिकारी :
(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या ( ii ) जिन्होंने 22,400-24,500 रु. के वेतनमान में या समतुल्य पद पर दो वर्ष नियमित सेवा की हो ।
ज्येष्ठ प्रशासनिक ग्रेड के ऐसे अधिकारी जिन्होंने उस ग्रेड में तीन वर्ष सेवा की है ।
कनिष्ठ प्रशासनिक ग्रेड के ऐसे अधिकारी जिन्होंने आठ वर्ष नियमित सेवा की है जिसके अंतर्गत अकृत्विक चयन ग्रेड में सेवा, यदि कोई हो, भीहै ।
ज्येष्ठ ग्रेड में ऐसे अधिकारी जिन्होंने उस ग्रेड में पांच वर्ष नियमित सेवा की है ।
कनिष्ठ ग्रेड में ऐसे अधिकारी जिन्होंने उस ग्रेड में चार वर्ष नियमित सेवाकी है ।
6,500-10,500 रु. के वेतनमान में भारतीय सूचना सेवा , समूह ' ख' कीज्येष्ठ ग्रेड में ऐसे अधिकारी जिन्होंने उस ग्रेड में पांच वर्ष नियमित सेवा की है ।
टिप्पण 1 : यदि सेवा में किसी पद पर नियुक्त किसी व्यक्ति के संबंध में किसी उच्चतर पद पर प्रोन्नति के प्रयोजन के लिए विचार किया जाता है तो उस ग्रेड में उससे ज्येष्ठ सभी व्यक्तियों के संबंध में भी इस बात के होते हुए भी विचार किया जाएगा कि उन्होंने अपेक्षित वर्षों की सेवा नहीं कीहै ।
टिप्पण 2 : 25 मार्च, 1996 से , जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नत के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक सेवा पहले ही पूरी कर ली है , अगली उच्चतर ग्रेड में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । 85 [ भाग II- खण्ड 3 ( i ) ]

स्पष्टीकारक ज्ञापन : भारतीय सूचना सेवा ( समूह ' क' ) नियम , 1987 भारतीय सूचना सेवा ( समूह ' क' ) संशोधन नियम , 1991 द्वारा संशोधित किए गए थे जो भारत के राजपत्र भाग -2 , खंड 3 , उपखंड ( i ) में तारीख 12-10-1991 को प्रकाशित किए गए थे । कार्मिक और प्रशिक्षण विभाग ने भर्ती नियमों के प्रारूपण के लिए यह विनिर्दिष्ट करते हुए दिशानिर्देश जारी किए थे कि इस प्रकार घटित हो सकता है कि प्रोन्नति के कुछ मामलों में जहां कनिष्ठ व्यक्ति प्रोन्नति के लिए विहित पात्रता शर्त पूरी कर लेते हैं , वहां ज्येष्ठ अधिकारी अपेक्षित सेवा पूरी नहीं करते हैं । ऐसे मामलों में उच्चतर पदों के लिए विचार करने से ज्येष्ठ व्यक्तियों को छोड़ दिया जाएगा । अतः ऐसी परिस्थिति से बचने के लिए भर्ती नियमों में एक टीम उचित टिप्प्ण अंतःस्थापित किया जा सकता है जिससे कि जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपेक्षित सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो , वहां ऐसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा जिन्होंने परिवीक्षा अवधि पूरी कर ली है । ऐसा एक टिप्पण भारतीय सूचना सेवा ( समूह ' क' ) नियम , 1987 की अनुसूची IV के नीचे टिप्पण III के रूप में अधिसूचित किया गया था । किंतु भारतीय सूचना सेवा ( समूह ' क' ) संशोधन नियम, 1991 की विरचना करते समय यह टिप्पण अनवधानता से विलोपित कर दिया गया था । पुनः कार्मिक और प्रशिक्षण विभाग ने अपने का.ज्ञा. एबी 14017/ 12/88 -स्था. ( आर आर ) तारीख 25 मार्च 1996 द्वारा भर्ती नियमों कीअनुसूची में सुसंगत सेवा नियमों/ स्तंभ के नीचे ऐसे टिप्पण के अंतःस्थापन के लिए उपरोक्त सलाह को दोहराया था । उक्त टिप्पण के विलोपन के परिणामस्वरूप ज्येष्ठ व्यक्तियों को उच्चतर पद के लिए विचार से छोड़ दिया गया था । उच्चतर ग्रेड में प्रोननति के लिए उनकी ज्येष्ठता और उपयुक्तता के प्रतिनिर्देश से सेवा में उन्हें उनके अधिकारपूर्ण स्थान पर प्रत्यावर्तित करने के लिए12 अक्टूबर , 1991 , उस तारीख से, जिसको भारतीय सूचना सेवा ( समूह ' क' ) संशोधन नियम , 1991 प्रवृत्त हुए थे , अनुसूची III के नीचे टिप्पण का पुनः पुरःस्थापित करने के लिए भूतलक्षी प्रभाव देना न्यायसंगत होगा । इसके अतिरिक्त पुनरीक्षित प्ररूप में उक्त उपबंधों को 25 मार्च , 1996 से, वह तारीख जिससे पुनरीक्षित उपबंधों को कार्मिक और प्रशिक्षण विभाग द्वारा उसी तारीख वाले उनके कार्यालय ज्ञापन द्वारा परिचालित किया गया था , पुनःस्थापित किया जाना था । यह प्रमाणित किया जाता है कि अनुसूची- III के नीचे टिप्पण को भूतलक्षी प्रभाव देने से सरकारी सेवकों के किसी वर्ग या प्रवर्ग पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

G.S.R. 22. In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules further to amend the Indian Information Service (Group ' A' ) Rules , 1987 , namely:-
1. ( 1 ) These Rules may be called the Indian Information Service (Group ' A' ) (Amendment) Rules, 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette, except the provisions mentioned below Schedule- III in note- 1 and the provisions mentioned below the said schedule in note -2 , which shall come into force w.e.f. 12th October , 1991 and 25th March, 1996 respectively.
2. In the Indian Information Service (Group ' A' ) Rules , 1987:
(1) in Rule 7 , for sub - rule 4, the following sub -rule shall be substituted , namely:
"(4) The selection of officers for promotion shall be made by . selection . on the recommendations of the Departmental Promotion. Committee-- constituted in accordance with Schedule IV, except for promotion to Junior Administrative Grade (NFSG) posts . " (ii) for Schedule I, the following Schedule shall be substituted, namely:

Minimum educational qualifications and age limit for direct recruitment to posts in Group ' A' in Junior Grade included in the Indian Information Service Group ' A ' on the results of the Competitive Examination to be conducted by the Union Public Service Commission . A candidate shall possess:
(i) A degree of any university incorporated by an Act of the Central or State Legislature in India or other educational institutes established by an Act of Parliament or declared to be deemed as University under Section 3 of the University Grants Commission Act , 1956 or a foreign University approved by Government from time to time or possess qualification which has been recognised by the Government for the purpose of admission to the examination ;
Note 1: In exceptional cases , the Commission may treat a candidate not possessing any of the above qualifications educationally qualified ; provided that the Commission is satisfied that he has passed examinations conducted by other institutions, the standard of which , in the opinion of the Commission , justified his admission to the examination .
Note 2: A candidate possessing professional and technical qualifications which are recognised by Government as equivalent in professional and technical degree would also be eligible for admission to the examination .

Explanatory Memorandum : The Indian Information Service ( Group ' A' ) Rules , 1987, were amended vide Indian Informa- tion Service (Group ' A' ) Amendment Rules, 1991 which were published in the Gazette of India Part II Section 3 Sub -section (i) on October 12, 1991. The guidelines for drafting recruitment rules issued by the Department of Personnel and Training, specify that it may so happen that in some cases of promotion, the senior officer would not have completed the required service whereas the junior would have completed the prescribed eligibility condition for promotion . In such cases , seniors will be left out from consideration for higher post . Therefore , to avoid such a situation a suitable note may be inserted in the Recruitment Rules so that the seniors , who have completed the probation period , are also considered for promotion where the juniors who have , completed the requisite service are being considered. Such a note was notified as Note III below Schedule IV to the Indian Information Service (Group ' A' ) Rules , 1987. But while framing the Indian Information Service (Group ' A' ) Amendment Rules , 1991 this Note had been omitted inadvertently . Again the Department of Personnel and Training vide their O.M. AB.14017/12 / 88 - Estt . (RR) dated 25th March 1996 reiterated the above advice for insertion of 202 G1/ 08-6 94

[PART II --SEC . 3 ( i ) ] such note below the relevant service rules /column in the schedule to the Recruitment Rules . As a consequence of omission of said note seniors were left out from consideration for higher post . In order to restore to them their rightful place in the service with reference to their seniority and suitability for promotion to higher grade it will be justified to give retrospective effect to reintroduction of the note below Schedule - III with effect from 12th October, 1991 , the date the Indian Information Service ( Group ' A ' ) Amendment Rules, 1991 had come into force . Further, the said provisions in the revised format was to be introduced from the 25th March , 1996, the date from which the revised provision was circulated by the Department of Personnel and Training vide their Office Memorandum bearing the same date . It is certified that the retrospective effect given to Notes below Schedule III will not affect any Section or Class of Government Servants adversely .

1. ( 1 ) इन नियमों का संक्षिप्त नाम श्रम ब्यूरो अन्वेषक श्रेणी -2 भर्ती ( संशोधन ) नियम, 2008 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

G.S.R. 23. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Labour Bureau Investigator Grade II Recruitment Rules, 2006 , namely:-
1. ( 1) These Rules may be called the Labour Bureau Investigator Grade - II , Recruitment (Amendment ) Rules, 2008.
(2) They shall come into force on the date oftheir Publication in the Official Gazette .
2. In the Labour Bureau Investigator Grade - II , Recruitment Rules , 2006, in the Schedule , under column 8, for the entries , the following entries shall be substituted , namely:-
"Essential:
(i ) Bachelor's Degree with Statistics or Mathematics or Economics or Commerce as one of the subjects from any recognized University or equivalent ;
(ii) Familiarity with computer and ability to operate various softwares for statistical analysis preferably with certificate of basic / fundamental course in computer applications from any recognized Institute /Organization.
Desirable:
(i) Master Degree in Statistics or Mathematics or Economics or Commerce;
(ii ) Two years experience in collection , compilation and analysis of data in any recognized organization."

सा. का. नि. 24. राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वर्ग जीप चालक ( क्षेत्रीय कार्यालय ) भर्ती नियम , 1981 , और मुख्य श्रम आयुक्त ( केन्द्रीय ) कार्यालय स्टाफ कार चालक भर्ती नियम , 1983 को अधिक्रान्त करते हुए, मुख्य श्रम आयुक्त के संगठन के क्षेत्रीय कार्यालयों में जीप चालकों तथा मुख्य श्रम आयुक्त ( केन्द्रीय ) , नई दिल्ली के कार्यालयों में स्टाफ कार चालक के पदों पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम मुख्य श्रम आयुक्त जीप चालक ( क्षेत्रीय कार्यालय ) और स्टाफ कार चालक ( मुख्यालय कार्यालय ) भर्ती नियम , 2008 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.- उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने, अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 96

[PART II-SEC. 3 (i) ] 6. व्यावृत्ति : -इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of Class - III Jeep Drivers (regional offices) , Recruitment Rules , 1981 , and the Chief Labour Commissioner's (Central ) Office Staff Car Driver Recruitment Rules , 1983 , the President hereby makes the following rules regulating the method of the recruitment to the posts of Jeep Drivers in the regional offices of the Chief Labour Commissioner's Organisation and Staff Car Driver in the Office of the Chief Labour Commissioner ( Central ) , New Delhi , namely:-
1. Short title and commencement . ( 1 ) These rules may be called the Chief Labour Commissioners ' Jeep Drivers (Regional Offices ) and Staff Car Driver (Headquarter Office ) Recruitment Rules , 2008.
(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay.-- The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .
3. Method of recruitment , age limit , and other qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the afore said Schedule.
4. Disqualification . No person, ---
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by orders , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .
7. Savings . Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , other backward classes , Ex serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
