का.नि.आ. 32. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रधानाचार्य (समूह ' क' ) और अध्यापक ( राजपत्रित ) ( समूह ' ख ' ) सैनिक स्कूल भर्ती नियम , 1981 को, जहां तक उनका संबंध अध्यापक ( राजपत्रित ) के पद से है , उन बातों के सिवाए अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है , राष्ट्रीय मिलिट्री स्कूलों में अध्यापक ( राजपत्रित ) ( समूह ' ख ' ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए. निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम अध्यापक ( राजपत्रित ) ( समूह ' ख ' ) राष्ट्रीय मिलिट्री स्कूल भर्ती नियम, 2008 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद-संख्या , वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होगें जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं।

4. निरर्हताएं : वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

( ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

7. निरसन और व्यावृत्ति : इन नियमों का तत्स्थानी और इन नियमों के प्रारंभ से तत्काल पूर्व प्रवृत्त नियम निरसित किया जाता है : परंतु इस प्रकार निरसित किए गए नियमों के अधीन किया गया कोई आदेश या की गई कार्रवाई , इन नियमों के तत्स्थानी उपबंधों के अधीन किया गया आदेश ग्रा की गई कार्रवाई समझी जाएगी ।

सीधी भर्ती हुए व्यक्तियों केलिए दो वर्ष (i ) किसी मान्यताप्राप्त विश्वविद्यालय से स्नातकोत्तर उपाधि या समतुल्य। (संबंध विषय , प्रत्येक भर्ती के समय उपदर्शित किए जाएं )

किसी मान्यताप्राप्त विश्वविद्यालय से संबंध विषय में स्नातकोत्तर उपाधिहो।

आवश्यक:

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से कम्प्यूटर विज्ञान या कम्प्यूटर उपयोजन में स्नातकोत्तर उपाधि या समतुल्य ।

( ii ) सैकेंडरी या सीनियर सैकेंडरी स्कूलों में कम्प्यूटर विषय में तीन वर्ष का शिक्षण अनुभव।

वांछनीय:

साहसिक खेलों और एन.सी.सी./स्काऊट प्रशिक्षण के संचालन का अनुभव। टिप्पण 1 : अर्हताएं, अन्यथा सुआर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है । टिप्पण 2 : अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरेजाने वाली रिक्तियों की प्रतिशतता

60.00 प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्तिद्वारा ।

40.00 प्रतिशत सीधी भर्ती द्वारा ।

प्रोन्नति: राष्ट्रीय मिलिट्री स्कूल में ऐसा सहायक अध्यापक, जिसने 5500- 9000 रुपए के वेतनमान में उस श्रेणी में सात वर्ष की नियमित सेवा की है। टिप्पण 1 : राष्ट्रीय मिलिट्री स्कूल में अध्यापक ( राजपत्रित ) पद के नियमित पदधारी की उपयुक्तता , अध्यापक ( राजपत्रित ) के 7500-12000 रुपए के वेतनमान में उन्नत पद पर नियुक्ति के लिए , आरंभिक रूप से सक्षम प्राधिकारी द्वारा जांची जाएगी । यदि ' उपयुक्त' पाया जाता है तो वह प्रारंभिक गठन पर पद पर नियुक्त किया गया समझा जाएगा। यदि उन्नत वेतनमान पर नियुक्ति के लिए ' उपयुक्तनहीं' पाया जाता है तो वह 6500-10500 रुपए के पुनरीक्षित वेतनमान में बना रहेगा और उसके मामलों का प्रत्येक वर्ष पुनर्विलोकन किया जएगा। 122

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/ पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति: केद्रीय सरकार के ऐसे अधिकारी-

(क) ( i ) जिन्होंने मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या

(ii ) जिन्होंने मूल काडर/ विभाग में 6500-10500 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् तीन वर्ष सेवा की हो; और

(ख) जो स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित किए गए अनुभव और शैक्षिक अर्हताएं रखते हैं ।

टिप्पण 1 : प्रोन्नति विषय - वार होगी ।

टिप्पण 2 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

टिप्पण 3 : प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । यदिविभागीय प्रोन्नति समिति है तो उसकी संरचना

New Delhi , the 10th March, 2008

S.R.O. 32. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of the Principal (Group ' A ' ) and Master Gazetted (Group ' B ' ) Military Schools Recruitment rules 1981 in so far as they relate to the post of Master Gazetted , except as respects things done or omitted to be done before such supersession, the President hereby make the following rules regulating the method of recruitment to the post of Master Gazetted (Group ' B ' ) in Rashtriya Military Schools , namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Master Gazetted (Group ' B ' ) Rashtriya Military Schools Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay . The number of the said posts , and their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications etc. The method of recruitment, age limit , qualification and other matter relating to the said post shall be as specified in columns 5 to 14 of the Schedule aforesaid.

4. Disqualification .-No person,

(a) who has entered into or contracted a marriage with a person, having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any persan from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.-Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes/Scheduled Tribes and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

7. Repeal and Savings . Any rules corresponding to these rules and in force immediately before the commencement ofthese rules are hereby repealed.

Provided that any order made or action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules .

(i) Master's Degree from a recognised University or equivalent

Should possess Master's degree from a recognized University or equivalent in the concerned subject.

Note 1 : Relaxable for Government servant upto five years in accordance with the instructions or orders issued by the Central Government .

(The relevant subjects shall be indicated at the time of each recruitment)

(ii) Degree or Diploma in Education from a recognised University/ Institution or equivalent

(iii) Three years teaching experience in secondary or senior secondary schools . Desirable:

(i) Experience in conduct of Adventure Sports and NCC/ Scouts training.

(ii) Working knowledge of Computers.

Note 2. The crucial date for determining the age limit shall be the closing date for receipt ofapplications from candidates in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh , Mizoram , Manipur , Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir State, Lahaul and Spiti District and Pangi Sub - division ofChamba District ofHimachal Pradesh, Andaman and Nicobar Islands and Lakshadweep) .

ForMaster in Computer Science

Essential :

(i) Master'sDegree in Computer Science or Computer Application from a recognised University or equivalent

(ii) Three years teaching experience in computer subjects in secondary or senior secondary school

Desirable :

( i) Experience in conducting Adventure Sports and NCC/ Scouts training.

Note 1: Qualifications are relaxable at the discretion of the Union Public Service Commission in case ofcandidates otherwise well qualified.

Note 2 : The qualification (s) regarding experience is/ are relaxable at the discretion of the Union Public Service Commission in case of candidates belonging to Scheduled Castes or Scheduled Tribes , if at any stage of selection the Union Public Service Commission isof the opinion that sufficient number of candidates from these communities possess- ing the requisite experience are not likely to be available to fill up the posts reserved for them.

Assistant Master in Rashtriya Military School in the pay scale ofRs . 5500-9000 with seven years regular service in the grade.

Note 1 : The suitability of the regular holder of the post of

Master(Gazetted) in Rashtriya Military Schools will be initially assessed by the competent authority for appointment to the upgraded post of Master ( Gazetted) in the scale of pay of Rs. 7500-12000 . If assessed ' Suitable ' they shall be deemed to have been appointed to the post at the initial constitution. If assessed 'Not suitable ' for appointment to the upgraded scale ofpay, he/they shall continue to be in the revised pay scale of Rs. 6500-10500 and his/their case would be reviewed every year.

Note 2: Wherejuniors who have completed their qualifying or

eligibility service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service .

Deputation:

Officers ofthe Central Government :

(a) ( i) Holding analogous posts on regular basis in the parent cadre/department; or

( ii ) With three years service rendered after appointment thereto on regular basis in the pay scale of Rs . 6500-10500 or equivalent in the parent cadre/deptt.; and

(b) Possessing the educational qualifications and experience prescribed for direct recruits under Col. 8 .

Note 1 : The Promotion shall be subject-wise .

Note 2 : The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly , deputationists shall not be eligible for consideration for appointment by promotion .

Note 3 : Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation/department ofthe Central Government shall ordinarily not to exceed three years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of application.

क़ा.नि.आ. 33.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और रक्षा अनुसंधान और विकास संगठन तकनीकी काडर भर्ती नियम , 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम रक्षा अनुसंधान और विकास संगठन तकनीकी काडर भर्ती ( संशोधन ) नियम , 2007 है । (2 ) ये 1 सितंबर , 2006 से प्रवृत होंगे ।

2. रक्षा अनुसंधान और विकास संगठन तकनीकी काडर भर्ती नियम , 2000 में ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) , नियम 6 के उपनियम ( 1 ) में , " अगली उच्चतर श्रेणी में, " शब्दों के स्थान पर " अगली उच्चतर श्रेणी में, तकनीकी अधिकारी ' ग ' की दशा में, उस श्रेणी में छह वर्ष न्यूनतम नियमित सेवा , जो निर्धारण के उस वर्ष के 1 सितंबर को अगली उच्चतर श्रेणी में प्रोन्नति के लिए निर्धारण के लिए ओवश्यक होगी " शब्द रखे जाएंगे ।

3. उक्त नियमों की अनुसूची 1 में , प्रवर्ग ' ख ' में , क्रम सं. 6 के पश्चात्, निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-

सा.का.नि. 296 तारीख 5 दिसंबर , 2000 द्वारा अधिसूचित रक्षा अनुसंधान तकनीकी काडर नियम की अनुसूची 3 में उपबंधित प्रोन्नति की सीमित नमनीय अनुपूरक स्कीम और भारत सरकार के अनुमोदन के अधीन 15 व्यक्ति तकनीकी अधिकारी ' घ ' पद पर प्रोन्नत हुए और तकनीकी सहायक ' ख ' के पांच प्रतिशत अतिरिक्त, तकनीकी सहायक ' ग ' पर 1 सितंबर 2006 से प्रोन्नत हुए । इसलिए, संशोधन को भूतलक्षी प्रभाव देना अपेक्षित है । नियमों के उपबंधों को भूतलक्षी प्रभाव देने के कारण किसी भी व्यक्ति के हित पर प्रतिकूल प्रभाव नहीं पडेगा। पाद टिप्पण : - मूल भर्ती नियम , भारत के राजपत्र , भाग 2 , खंड 4 में का.नि.आ. 296 तारीख 5 दिसंबर , 2000 द्वारा प्रकाशित किए गए और का.नि.आ. 50 तारीख 12 फरवरी , तथा का.नि.आ. 147 तारीख 28 जून , 2002 द्वारा संशोधित किए गए।

S.R.O. 33. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Defence Research and Development Organization Technical Cadre Recruitment Rules , 2000 namely :-

1. (1 ) These rules may be called the Defence Research and Development Organization Technical Cadre Recruitment (Amendment) Rules , 2007.

(2) They shall come into force on the 1st day of September, 2006 .

2. In the Defence Research and Development Organization Technical Cadre Recruitment Rules , 2000 (hereinafter referred to as the said rules) , in rule 6, in sub -rule ( 1 ) , for the words " next higher grade " , the words " next higher grade , in case of Technical Officer ' C' a minimum of six years regular service in the grade as on 1 September of the year of assessment will be essential for assessment for promotion to the next higher grade " shall be substituted.

3. In Schedule 1 of the said rules, in Category ' B ' , after serial No. 5, the following shall be inserted namely :

Explanatory Memorandum :-

Under the Limited Flexible Complementing scheme ofpromotions provided in Schedule III of Defence Research Technical Cadre Rules notified vide number SRO 296 dated 5th December , 2000 and approval of Government of India, 15 persons were promoted to Technical Officer ' D ' and additional five percent of Technical Assistant ' B ' were promoted to Technical Assistant ' C ' with effect from 1st September , 2006. As such , the amendment is required to be given retrospective effect. By providing this retrospective effect to the provisions of the Rules , no one is being adversely affected .

का.नि.आ. 34.- केन्द्रीय सरकार , तटरक्षक अधिनियम 1978 की धारा 123 की उपधारा ( 2 ) के खंड ( ख ) तथा रक्षा मंत्रलय के पत्र सं. 11 ( 15 )/2001 /यू एस ( पर्स) /डी ( नौसेना -2 ) दिनांक 17 अगस्त 2001 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा ( i ) तटरक्षक नाविक (तकनीकी शाखा) , भर्ती नियम, 1982; ( ii ) तटरक्षक नाविक ( सामान्य डयूटी ) , भर्ती नियम , 1982 तथा ( iii ) तटरक्षक नाविक (घरेलूशाखा ) , भर्ती नियम, 1982 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है, एतद्वारा रक्षा मंत्रालय के अधीन तटरक्षक संगठन में प्रधान यांत्रिक, उत्तम यांत्रिक , यांत्रिक, प्रधान नाविक ( सामान्य डयूटी ) , उत्तम नाविक (सामान्य ड्यूटी ) , नाविक ( सामान्य डयूटी ) , प्रधान नाविक ( घरेलू शाखा ) , उत्तम नाविक ( घरेलू शाखा ) तथा माविक ( घरेलू शाखा ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक यांत्रिक, नाविक ( सामान्य डयूटी ) तथा नाविक (घरेलू शाखा) ( समूह ' ग/घ ' पद ) , भर्ती नियम 2008 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।

2. लागू होना : ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे ।

३. पदों की संख्या , वर्गीकरण तथा वेतनमान : उक्त पदों की संख्या , उनका वर्गीकरण और उनके घेतनमान वे होगें जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु- सीमा तथा अन्य अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं तथा उनसे सम्बन्धित बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं।

5. निरर्हताए : वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, अथवा

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी। 7. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों और भूतपूर्व सैनिकों, खिलाड़ियों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

नौसेना के सेवारत शिल्पी/मैकेनिशियन-3 और सेना और वायुसेना में समतुल्य पदों पर सेवारत अधिकारी या

In exercise of the powers conferred by the clause (b) of sub - section (2) of Section 123 of the Coast GuardAct 1978 and the Ministry of Defence letter No. 11 ( 15 )/2001 /US ( Pers )/D(Navy - II ) dated 17th August 2001 and in supersession of ( i ) the Coast Guard Naviks (Technical Branch) , Recruitment rules , 1982; ( ii ) the Coast Guard Naviks (General Duty), Recruitment rules , 1982 and (iii ) the Coast Guard Naviks (Domestic Branch ) , Recruitment rules, 1982 , except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Pradhan Yantrik, Uttam Yantrik, Yantrik, Pradhan Navik (General Duty) , Uttam Navik (General Duty ) , Navik ( General Duty) , Pradhan Navik (Domestic Branch) , Uttam Navik (Domestic Branch) and Navik ( Domestic Branch ) in the Coast Guard Organisation under the Ministry of Defence namely :-

1. Short title and commencement.--( 1 ) These rules may be called the Coast Guard Yantik, Navik (General Duty) and Navik (Domestic Branch ) (Group ' C/D ' Post ) Recruitment Rules, 2008 .

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. Application . These rules shall apply to the posts specified in the column ( 1 ) of the schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the said posts, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

4. Method of recruitment, age limit, other qualifications etc. The method ofrecruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the aforesaid Schedule .

5. Disqualification.-No person,-

(a) who has entered into or contracted a marriage with a person, having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class of category of persons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Caste, Ex - servicemen, Sportspersons and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in thisregard.

का.नि.आ. 35.- केन्द्रीय सरकार, तटरक्षक अधिनियम 1978 ( 1978 का 30 ) की धारा 123 की उपधारा ( 2 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा सहायक कमांडेंट सामान्य डयूटी शाखा ( पायलट नेवीगेटर ) भर्ती नियम , 1982 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने के लिए लोप किया गया है, तटरक्षक में सहायक कमांडेंट ( सामान्य डयूटी - पायलट शाखा ) के पद पर भर्ती पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम तथा प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम सहायक कमांडेंट सामान्य डयूटी- पायलट/ नेवीगेटर तथा सहायक कमांडेंट पायलट/ व्यावसायिक पायलट लाइसेंस अल्प सेवा भर्ती नियम, 2007 हैं ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण तथा वेतनमान : उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

३. भर्ती की पद्धति , आयु- सीमा तथा अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु-सीमा , अर्हताएं और उनसे सम्बन्धित अन्य विषय वे होंगे जो, पूर्वोक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. नियुक्तिकी अवधि: सहायक कमांडेंट सामान्य डयूटी शाखा ( पायलट व्यावसायिक पायलट लाइसेंस अल्प सेवा ) के रूप में चयनित उम्मीदवारों की नियुक्ति निम्नलिखित शर्तों के आधार पर होगी , अर्थात्:-

(क) अफसरों की नियुक्ति अवधि आठ वर्षों के लिए होगी , जोकि दस वर्ष तक बढ़ सकती है तथा सक्षम प्राधिकारी द्वारा उसे चौदह वर्ष तक आगे बढ़ाया जा सकता है ।

(ख) अफसरों को स्थायी भर्ती योजना में परिवर्तित होने का विकल्प नहीं होगा ।

(ग ) सक्षम प्राधिकारी के अनुमोदन उपरांत अपवादात्मक परिस्थितियों को छोड़कर अफसरों को आठ वर्षों की सेवा समाप्ति से पूर्व सेवा छोड़ने की इजाजत नहीं होगी ।

5. वैवाहिक स्थिति: नियुक्ति के लिए, विवाह निरर्हता नहीं होगी :

परंतु यह और भी कि प्रशिक्षण अवधि के दौरान ऐसा अफसर परिवार को साथ रखने का हकदार नहीं होगा :

परंतु इसके अतिरिक्त व्यक्ति जो कि अविवाहित है, को प्रशिक्षण समाप्ति, जो भी बाद में हो, होने तक विवाह करने अथवा उसका इकरार करने की अनुमति नहीं होगी :

परंतु साथ ही महिला अफसर के मामले में , नियुक्ति निम्नलिखित आधार पर आगे मर्यादित होगी , अर्थात्: -

( i) प्रशिक्षण समाप्ति की तारीख से तीन वर्षों के अंतर्गत गर्भावस्था मामले में उसकी नियुक्ति समाप्त हो जाएगी । (ii ) पूर्ण सेवाकाल के दौरान वह दो से अधिक गर्भधारण नहीं करेगी ।

6. निरर्हता : वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति , जिसका विवाहिती जीवित है , से विवाह किया है ; अथवा

(ख) जिसने , अपने विवाहिती के जीवित होते हुए , किसी व्यक्ति से विवाह अथवा विवाह का इकरार किया है , उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार को यह संतुष्टि हो जाती है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 7. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जी कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the clause (b ) of sub- section (2) of Section 123 of the Coast Guard Act 1978 (30 of 1978) and in supersession of the Assistant Commandant General Duty Branch (Pilot/Navigator) Recruitment Rules , 1982 , except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the mehod of recruitment to the post of Assistant Commandant (General Duty-Pilot Branch) in the Coast Guard , namely: ---

1. Short title and commencement. ( 1 ) These rules maybe called the Assistant Commandant General Duty-Pilot Navigator and Assistant Commandant Pilot/ Commericial Pilot Licence - Short Service Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay .-- The number of the said posts , their classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and qualifications etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14 ) of the aforesaid Schedule

4. Tenure of appointment . The appointment of seleced candidates as Assistant Commandant General Duty Branch (Pilot-Commercial Pilot Licence-Short Service) shall be subject to the following conditions , namely :-

(a) The tenure of appointment of Officers shall be eight years , which may be extended to ten years and may be further extended up to fourteen years by the competent authority.

(b) the officers shall not have the option for change over to Permanent Entry Scheme .

(c) the officers will not be permitted to resign before completion of eight years of service except in exceptional circumstances after approval of the competent authority.

5. Marital status. Marriage shall not be a disqualification for appointment :

Provided that no such officer shall during the period of training be entitled to stay with the family : Provided further that no person who is unmarried shall be permitted to enter into or contract a marriage till the completion of training or award of wings or completion of probation whichever is later :

namely: Provided also that in the case of lady officer , the appointment is subject to the following further restrictions , (1) Her appointment shall be terminated in case of pregnancy within three years from the date of completion of training. i

(ii) She shall not have more than two pregnancies during the entire term of appointment .

6. Disqualification .-No person,-

(a) who has entered into or contracted a marriage with a person , having a spouse living ; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

147 Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

7. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required. to be provided for the Scheduled Castes /Scheduled Tribes and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

का.नि.आ. 36 , - राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आयुध और आयुध उपस्कर फैक्टरी समूह ' ख', समूह ' ग ' और समूह ' घ ' अनौद्योगिक ( अर्द्धचिकित्सीय ) पद ( भर्ती और सेवा की शर्तें ) नियम, 2004 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम आयुध और आयुध उपस्कर फैक्टरी समूह ' ख' , समूह ' ग ' और समूह ' घ' अनौद्योगिक ( अर्द्धचिकित्सीय ) पद ( भर्ती और सेवा की शर्तें ) संशोधन नियम, 2008 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. आयुध और आयुध उपस्कर फैक्टरी समूह ' ख ', समूह ' ग ' और समूह ' घ ' अनौद्योगिक ( अर्द्धचिकित्सीय ) पद ( भर्ती और सेवा की शर्तें ) नियम , 2004 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है )

(क) संक्षिप्त नाम और प्रांरभ के नियम 1 के उप - नियम 1 में , अंक " 2004 " के स्थान पर " 2005 " अंक रखे जाएंगे । नियम 5 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्:-

" शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग ( केवल समूह ' ख ' पदों की दशा में ) से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । "

3. उक्त नियमों की अनुसूची में, -

(क) क्रम संख्यांक 1 से 13 और 17 , 18 के सामने , स्तंभ 2 में , विद्यमान अंक " 2004 " के स्थान पर " 2005 " अंक रखे जाएंगे ,

(ख) मेट्रान के पद से संबंधित क्रम संख्याक 1 के सामने स्तंभ 13 में विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखीं जाएंगी , अर्थात्:-

" समूह ' ख' विभागीय प्रोन्नति समिति ( प्रोन्नति के लिए ) की संरचना जिसमें निम्नलिखित होंगे । "

(क ) स्वास्थ्य सेवा निदेशक या अपर स्वास्थ्यसेवा निदेशक -अध्यक्ष

-सदस्य

(ख ) उप स्वास्थ्य सेवा निदेशक

-सदस्य

(ग ) उप सचिव या अवर सचिव

व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है ।

(i ) स्तंभ 5 में, विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित रखा जाएगा , अर्थात्:-

S.R.O. 36 .-- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ordnance and Ordnance Equipment Factories Group B , Group C andGroup DNon- industrial (Para -Medical posts (Recruitment and Conditions of Service ) Rules , 2004, namely:-

1. (1 ) These rules may be called the Ordnance and Ordnance Equipment Factories Group B ,Group C andGroup D Para-Medical (Non - industrial/Non-Gazetted ) posts (Recruitment and conditions of Service), Amendment Rules , 2008 . (2)They shall come into force on the date of their publication in Official Gazette .

2. In the Ordnance and Ordnance Equipment Factories Group B, Group C and Group D Non - industrial (Para- Medical ) posts (Recruitment and Conditions of Service ) Rules , 2004 (hereinafter referred to as the said rules ) (a) in rule 1 relating to ' Short title and commencement ' , in sub- rule ( 1 ) , for the figures , " 2004 " , the figures, " 2005 " shall be substituted.

(b) for rule 5, the following shall be substituted , namely,-

45. Power to relax- Where the Central Government is of the opinion that it is necessary or expedient so to do it may, by order and for reasons to be recorded in writing and in consultation with Union Public service Commission (only in case ofGroup B posts ) relax any of the provisions of these rules with respect to any class or category of persons ." 3. In the schedule to the said rules ,-

(a) against serial numbers 1 to 13 and 17, 18 , in column 2 , for the existing figure " 2004 " , the figure " 2005 " shall be substituted,
