सा. का. नि. 64. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राजभाषा विभाग, केन्द्रीय हिन्दी प्रशिक्षण संस्थान/हिन्दी शिक्षण योजना ( दफ्तरी ) भर्ती नियम , 1995 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या किए जाने से लोप किया गया है , गृह मंत्रालय , राजभाषा विभाग के केन्द्रीय हिन्दी प्रशिक्षण संस्थान/हिन्दी शिक्षण योजना में दफतरी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संझिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय , राजभाषा विभाग , केन्द्रीय हिन्दी प्रशिक्षण संस्थान/ हिन्दी शिकण योजना ( दफ्तरी ) भर्ती नियम, 2008 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि: उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता : वह व्यक्ति-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि केअधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति : इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 64. In exercise ofthe powers conferredby the proviso to article 309 of the Constitution and in supersession of the Department of Official Language, Central Hindi Training Institute/Hindi Teaching Scheme (Daftry) Recruitment Rules. 1995 except as respect thing done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Daftry in the Central Hindi Training Institute/Hindi Teaching Scheme. Department of Official Language, Ministry of Home Affairs, namely:-

1. Short title and commencement- ( 1 ) These rules may be called the Ministry of Home Affairs , Department of Official Language . Central Hindi Training Institute/Hindi Teaching Scheme (Daftry ) Recruitment Rules, 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Method of recruitment , age limit , qualifications , etc.-The method of recruitment to the said posts, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule,

5. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do,it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category ofpersons.

6. Saving-Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes , the Ex- Servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

सा. का. नि. 67.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रद‌त्त शक्तियों का प्रयोग करते हुए और सड़क परिवहन एवं राजमार्ग मंत्रालय और पोत परिवहन मंत्रालय में अनुरक्षण और सभा अधिकारी ( समूह ' ख ' अराजपत्रित ) भर्ती नियम , 2001 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है, पोत परिवहन , सड़क परिवहन एवं राजमार्ग मंत्रालय में अनुरक्षण औरं सभा अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति : इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

Inexercise ofthe powers conferred by the proviso to Article 309 ofthe Constitution and in supersession of theMinistry ofRoad Transport and Highways and Ministry of Shipping, Maintenance and Meeting Officer (Group B, Non-Gazetted) Recruitment Rules , 2001 except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Maintenance and Meeting Officer in the Ministry of Shipping, Road Transport and Highways, namely

1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Shipping, Road Transport and Highways, Maintenance and Meeting Officer (Group B, Non-Gazetted ) Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the OfficialGazette.

2. Number of post, classification and scale of pay-The number of the said post. its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these niles.

3.Method of recruitment , age limit , qualifications, etc. The method of recruitment age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Scliedule,

4. Disqualification. No person-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person.

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal lau applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do . it may, by orders for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any ofthe provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा. का. नि. 68. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उद्योग मंत्रालय, लघु उद्योग विकास संगठन ( समूह " क " और समूह " ख " ) ( राजपत्रित ) पद भर्ती नियम, 1996 की, जहां तक उनका संबंध निर्देशक ( हौजरी ) उप निदेशक ( हौजरी ) और सहायक निदेशक ( श्रेणी 1 ) ( हौजरी ) के पदों से है , उन बातों के सिवाय आंशिक रूप से अधिक्रांत करते जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय , विकास आयुक्त ( सूक्ष्म, लघु और मध्यम उद्यम ) के कार्यालय में निदेशक ( हौजरी ) , उप निदेशक ( हौजरी ) और सहायक निदेशक ( श्रेणी 1 ) ( हौजरी ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम सूक्ष्म , लघु और मध्यम उद्यम मंत्रालय , विकास आयुक्त ( सूक्ष्म , लघु और मध्यम उद्यम ) का कार्यालय , समूह ' क ' पद ( हौजरी विद्या) भर्ती नियम, 2008 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागूहोना : ये नियम, इन नियमों से उपाबद्ध अनुसूची के सतंभ ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद- संख्या , वर्गीकरण और वेतनमान उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता; वह व्यक्ति-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जोषित है , विवाह किया है , या

( ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीच विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी।

6. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राम है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

जिन्होंने मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या

(क) (i )

जिन्होंने मूल काडर या विभाग में 10000-325-15200 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की है ; और (ii )

( ख) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों :-

आवश्यक :

(i ). किसी मान्याप्राप्त विश्वविद्यालय या संस्थान से वस्त्र या हाँजरी या बुनाई प्रौधोगिकी या समतुल्य में डिग्री या समतुल्य । (ii ) किसी तकनीकी संगठन या अनुसंधान संगठन या शैक्षिक संगठन में या हौजरी या बुने उत्पाद या बने - बनाएं वस्त्रों के विनिर्माण में लगे औधोगिक समुत्थान में दस वर्ष का अनुभव ।

वांछनीय : हौजरी या बुने उत्पाद या बने - बनाए वस्त्रों के विनिर्माण में आधुनिक मशीनों, उपस्कर और यंत्रों के उपयोग और उत्पादन की नींनतम तकनीकों की जानकारी ।

2. ऐसे विभागीय उप निदेशक ( हौजरी ) पर, जिन्होंने 10000-325-15200 रुपए के वेतनमान में पांच वर्ष नियमित सेवा की है , बाहर वालों के साथ विचार किया जाएगा और उसके पद पर नियुक्ति के लिए चयन किए जाने की दशा में वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा । टिप्पण : पोएक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

केंद्रीय सरकारे या राज्य सरकारों या संघ राज्य क्षेत्रों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधान संस्थानों या पब्लिक सेक्टर उपक्रमों या अर्द्धसरकारी या कानूनी या स्वशासी संगठनों के अधीन ऐसे अधिकारी-

(क) (i ) जिन्होंने मूल काहर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है ; या

(ii ) जिन्होंने मूल काडर या विभाग में 6500-10500 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की है; और

(ख) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों :-

आवश्यक:

( i) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से वस्त्र या हौजरी या बुनाई प्रौद्योगिकी या समतुल्य में डिग्री या समतुल्य । ( ii) किसी तकनीकी संगठन या शैक्षिक संगठन में या हौजरी या जुने उत्पाद या बने - बनाए वस्त्रों के विनिर्माण में लगे औद्योगिक समुत्थान में तीन वर्ष का अनुभव ।

वांछनीय : हौजरी या बुने उत्त्पाद या बने - बनाए वस्त्रों के विनिर्माण में आधुनिक मशीनों, उपस्कर और यंत्रों के उपयोग और उत्पादन की नवीनतम तकनीकों की जानकारी ।

टिप्पण: पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीभी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 68. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in the partial supersession of the Ministry of Industry, Small Industry Development Organisation Group A' and 'B ' (Gazetted) Posts Recruitment Rules, 1996, insofar as they relate to the posts of Director (Hosiery ) , Deputy Director ( Hosiery) and Assistant Director (Grade I) (Hosiery) in the then Ministry of Industry, Small Industry Development Organisation. except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules régulating the method of recruitment to the posts of Director (Hosiery), Deputy Director ( Hosiery) and Assistant Director (Grade I) ( Hosiery) of the Ministry of Micro, Small and Medium Enterprises , Office of the Development Commissioner (Micro , Small and Medium Enterprises ) , namely :-

1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Micro, Small and Medium Enterprises, Office of the Development Commissioner (Micro, Small and Medium Enterprises), Group A' Posts (Hosiery Discipline) Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

rules. 2. Application . These rules shall apply to posts specified in column ( 1 ) of the Schedule annexed to these 3. Number of posts , classification and scale of pay. The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4) of the said Schedule.

4. Method of recruitment , age limit and qualifications , etc. The method of recruitment to the said posts. the age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule,

5. Disqualification.-No person:

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax. Where the Central Government is ofthe opinion that it is necessary or expedient so todo, it may by order and, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category ofpersons ,

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा. का. नि. 69.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में कीट विज्ञानी ( कीटनाशक ) भर्ती नियम, 1974, ( उप- निदेशक, कीट विज्ञान ) भर्ती नियम, 1977 , संयुक्त निदेशक (व रो. षि ) और संयुक्त निदेशक (की.वि. ) भर्ती नियम, 1987 और संयुक्त निदेशक ( जैव निर्धारण ) एवं कनिष्ठ वैज्ञानिक अधिकारी (जैव- निर्धारण ) भर्ती नियम , 1991 को जहाँ तक उनका संबंध संयुक्त निदेशक ( फीट- विज्ञान ) के पद से है उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, कृषि मंत्रालय के अधीन वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में संयुक्त निदेशक ( कौट विज्ञान ) के पद पर भर्ती की पद्धति का विनिययन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पत्ति संरक्षण, संगरोध एवं संग्रह निदेशालय संयुक्त निदेशक ( कीट विज्ञान ) भर्ती नियम , 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदोंकी संख्या , वर्गीकरण और वेतनमान: उक्त पदों की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा, अन्य अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्थताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता : वह व्यक्ति

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्थीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संयं लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की यावत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृप्ति : इन नियमों की कोई आत , ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिक्खड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव है :

( 1 ) किसी मान्यताप्राप्त विश्वविद्यालय से कीट विज्ञान या कृमि विज्ञान एस.एस.सी. डिग्री या कीट विज्ञांन में विशेषज्ञता सहित कृषि में एम.एस.सी. डिग्री या कीट विज्ञान में विशेषज्ञता सहित प्राणि विज्ञान में एम.एस.सी. डिग्री या समतुल्य ।

( 2 ) वनस्पति संरक्षण से संबंधित कीट विज्ञान के क्षेत्र में प्रबंधक के रूप में दस वर्ष का व्यावहारिक अनुभव ।

( पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार जो अधिकारी प्रतिनियुक्ति पर है , प्रोन्मति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । )

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Plant Protection , Quarantine and Storage, Entomologist (Insecticides) Recruitment Rules, 1974(Deputy Director Entomology) Recruitment Rules 1977 , Joint Director (Plant Pathology) and Joint Director (Entomology) Recruitment Rules, 1987, and Joint Director (Bioassay ) and Junior Scientific Officer (Bioassay ) Recruitment. Rules 1991, in sofar as they relate to the post of Joint Director ( Entomology ) except as respects things done or omitted to: bedone before such supersession , the President hereby makes the following rules regulating the method of recruitmetu to the post of Joint Director (Entomology) in the Directorate of Plant Protection, Quarantine and Storage under the Ministry of Agriculture , namely :-

1. Short title and commencement-( i) These rules may be called Directorate of Plant Protection , Quarantine and Storage, Joint Director (Entomology) Recruitment Rules, 2008.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , Classification and Scale of Pay. The number of the said post, its classification and scale ofpay attached thereto shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules, 3. Method of recruitment, age limit, other qualifications , etc. The method of recruitment of the said post, uge mit, qualifications and other matter relating there shall be as specified in columns (5 ) to ( 14 ) of the said Schedule.

4. Disqualifications. No person

(i ) who has entered into or contracted a marriage with a person having a spouse living , or

( ii) who, having a spouse living. has entered into or contracted a marriage with any person.

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing. exempt any person from the operation of this rule.

Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order, for reasons to be recorded in writing . and in consultation with the Union Public Service Commission. relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes. सा. का. नि. 70. राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और बनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में उप- निदेशक ( जैव निर्धारण ) और कनिष्ठ वैज्ञानिक अधिकारी ( जैव निर्धारण ) भर्ती नियम, 1991 को, जहां तक उनका संबंध संयुक्त निदेशक ( जैव निर्धारण ) के पद से है उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, कृषि मंत्रालय के अधीन वनस्पति संरक्षण , संगरोध एवं संग्रह निदेशालय में संयुक्त निदेशक ( खरपतवार विज्ञान ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय संयुक्त निदेशक ( खरपतवार विज्ञान ) भर्ती नियम, 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त .होंगे ।

2. पदोंकी संख्या, वर्गीकरण और वेतनमान : उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अहंताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता: वह व्यक्ति-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधोग अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां यह उसके लिए जो कारण हैं उन्हें लेखनद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे वरिष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी आईक पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चवर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , कृषि मंत्रालय के अधीन वनस्पति संरक्षण , संगरोध एवं संग्रह निदेशालय में उप- निदेशक ( कीट विज्ञान ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय उप - निदेशक (कीट विज्ञान) भर्ती नियम, 2008 है।

(2).ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पदोंकी संख्या, घर्गीकरण और वेतनमान: उक्त पदों की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयुषु- सीमा , अन्यअहंताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अहंताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं । 4. निरहर्ता: वह व्यक्ति :-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, 'या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्यीय विधि केअधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो यह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके और इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों को बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्ध रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिक अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षिय है ।

टिप्पण 1 : - अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2: -अनुभव संबंधी अर्हता ( अहंताएं) संघ

लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन केकिसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

भर्ती की पद्धति: भर्ती सीधे या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा कथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोनति:

8000-13500 रु. के वेतनमान में ऐसा सहायक निदेशक ( क्रीट विज्ञान ) जिसने उस श्रेणी में पांच वर्ष नियमित सेवा की है ।

66.67% प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविंदा भी है ) द्वारा ।

33.33 प्रतिशत प्रतिनियुक्ति (जिसमें अल्प- कालिक संविधा भी शामिल है ) जिसके न हो सकने पर सीधी भर्ती द्वारा ।

टिप्पण:-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक या दो वर्ष से, इनमें से जो भी कम हो, कम ग.हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हकापात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चत्तर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

(2 ) मूल संवर्ग/ विभाग में जिन्होंने 8000-135000 रु. के या समतुल्य वेतनमान में उस पद पर नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में पांच वर्ष नियमित सेवा की है और

( ख) जिनके पास कालम 8 में सीधी भर्ती के लिए निर्धारित शैक्षिक अर्हताएं और अनुभव हैं; (पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। )

G.S.R. 71. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Directorate of Plant Protection, Quarantine and Storage, Group ' A' and ' B ' technical posts (Recruitment) Rules 1968, (Deputy Director Entomology) Recruitment Rules 1977 and Senior Scientific Officer (Bioassay) Recruitment Rules 1986 , insofar as they relate to the post of Deputy Director (Entomology ) , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Director (Entomology) in the Directorate of Plant Protection , Quarantine and Storage under the Ministry ofAgriculture , namely:-

1. Short title and commencement.- (1 ) These rales maybe called Directorate of Plant Protection, Quarantine and Storage, Deputy Director ( Entomology) Recruitment Rules, 2008,

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay. The number of the said posts, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Method of recruitment, age limit , other qualifications, etc. The method of recruitment to the said posts. the age limit, qualifications and other matters relating thereto shall be as specified in columns 3 to 14 of the said Schedule .

4.Disqualification . No person- (a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Providedthat the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so todo. it may, by order for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes . Ex-servicemen , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

सा. का. नि. 72.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वनस्पति संरक्षण ,, संगरोध एवं संग्रह निदेशालय में वनस्पति संरक्षण संगरोध निदेशालय , सस्य वैज्ञानिक ( शाकनाशी ) भर्ती नियम, 1979, उप- निदेशक ( खरपतवार विज्ञान ) भर्ती नियम, 1993 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अभिक्रमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्रालय के अधीन वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में उप- निदेशक ( खरपतवार विज्ञान ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ (खरपतवार विज्ञान ) भर्ती नियम , 2008 है । ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पति संरक्षण , संगरोध एवं संग्रह निदेशालय उप - निदेशक (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदोंकी संख्या , वर्गीकरण और वेतनमान -उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अन्य अहंताएं आदि, उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें ये होंगी जो उषत अनुसूची के स्तंभ (2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. निरहंता: वह व्यक्ति.-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

6. व्यावृत्ति, इन नियमों की कोई बात, ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्र सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्यं विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

टिप्पण 1-अर्हताएं, अन्यथा सुअहिंत अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2- अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तम शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

( 1 ) मान्यता प्राप्त विश्वविद्यालय से विशेषज्ञता के क्षेत्र में डॉक्टरेट डिग्री ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक पात्रता सेवा, अपेक्षित अर्हक/पात्रता 337 [ भाग II- खंड 3 (1) ]

(क) ( 1 ) जिन्होंने मूल संवर्ग/विभाग में नियमित आधार पर सदृश पदं धारण किए हुए हैं या

(2) मूल संवर्ग/ विभाग में जिन्होंने 8000-13500 रु. के या समतुल्य वेतनमान में उस पद पर नियुक्ति के पश्चात् नियमित आधार पर उस श्रेणी में पांच वर्ष नियमित सेवा की है;और

(ख) जिनके पास स्तम्भ (8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं ) :

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ) । प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) की अवधि जिसके अंतर्गत केन्द्र सरकार के उसी या किसी अन्य संगठन विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि है साधारणतया चार वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

1. Short title and commencement.- (1 ) These rules may be called Directorate of Plant Protection, Quarantine and Storage, Deputy Director (Weed Science ) Recruitment Rules, 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts , its classification and scale of pay attached thereto shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules,

3.Method of recruitment , age limit , other qualifications, etc.-The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns ( 5) to (14) of the said Schedule.

4. Disqualification. No person-

(i) who has entered into or contracted a marriage with a person having a spouse living, or

( ii ) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex-servicemen , Other Backward Classes and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता हैं कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दें सकेगी ।

5.शिथिल करने की शक्ति. जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन हैं , वहाँ वह उसके लिए ओ कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबद, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनंवा केन्द्र सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिक, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

following rules regulating the method of recruitment to the post of Assistant Director (Entomology) in the Directorate of Plant Protection . Quarantine and Storage under the Ministry ofAgriculture, namely:-

1. Short title and commencement.- ( 1 ) These rules may be called Directorate of Plant Protection , Quarantine and Storage , Assistant Director (Entomology ) Recruitment Rules , 2008.

(2) They shall conve into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay. The number of the said post, its classification and scale of pay attached thereto shall be as specified in columns (2 ) to ( 4) of the Schedule annexed to these rules.

3.Method of recruitment, age limit , other qualifications , etc.-The method of recruitment to the said post , the age limit , qualifications and other matters relating there shall be as specified in colunmuis (5 ) to ( 14) of the said Schedule.

4. Disqualifications-No person :

( a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

5. Power to relax. सा. का. नि. 74.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में संग्रह निदेशालय ( तकनीकी राजपत्रित पद) भर्ती नियम, 1972 , वनस्पति संरक्षण , संगरोध एवं संग्रहं निदेशालय सहायक निदेशक ( विस्तार) भर्ती नियम, 1989 वनस्पति संरक्षण , संगरोध एवं और कनिष्ठ वैज्ञानिक अधिकारी ( जैव निर्धारण ) भर्ती नियम, 1991 सहायक निदेशक ( खरपतवार विज्ञान ) भर्ती नियम , 1992 को, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अंधिक्रमण से पहले किया गया है या करने से लोप किया गया है , कृषि मंत्रालय के अधीन वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में सहायक निदेशक ( खरपतवार विज्ञान ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्;-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय सहायक निदेशक ( खरपतवार विज्ञान ) भर्ती नियम, 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को लागू होंगे ।

2. पदोंकी संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा , अन्य अर्हताएं आदि उक्त पदों की भर्ती की पद्धति, आयु सीमा, अर्हत्ताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।.

4. निरर्हता: वह व्यक्ति:-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

: परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्त्रीय विधि के अधीन अनुज्ञेय हैं और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके संघ लोक सेवा आयोग से परामर्श करके और इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की याबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायत्तों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों और अन्य विशेप प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

6500-10000 रु. के वेतनमान में वनस्पति संरक्षण अधिकारी ( खरपतवार विज्ञान ) जिसने उस श्रेणी में पांच वर्ष की नियमित सेवा की हो । टिप्पणी: जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक पात्रता सेवा के आधे से अधिक से यादो वर्ष से , इसमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनो परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Directorate of Plant Protection , Quarantine and Storage (Technical Gazetted posts ) Recruitment Rules. 1972. Assistant Director (Extension ) Recruitinent Rules, 1989, Junior Scientific Officer (Bioassay ) Rucruitment Rules. 1991 and Assistan Director (Weed Science) Recruitment Rules, 1992 insofar as they relate to the post of Assistant Director ( Weed Science ) . except as respects things done or omitted to be done before such supersession , the President hereby makes the following niles Tegulating the method of recruitment to the post of Assistant Director (Weed Science ) in the Directorate of Plant Protection Quarantine and Storage under the Ministry of Agriculture , namely:-

1. Short title and commencement.-( 1 ) These rules may be called the Directorate of Plaun Protection , Quarantine and Storage , Assistant Director (Weed Science ) Recruitment Rules , 2008 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules

3.Method of recruitment , age limit, other qualifications , etc. The method of recruitment of the said posts , the age limit , qualifications and other matters relating thereto shall be as specified in columns 5 10 14 of the said Schedule.

4. Disqualifications. No person

(i) who has entered into or contracted a marriage with a person having a spouse living. or

(ii) who, having a spouse living, has entered into or contracted a marriage with any person .

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marnage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relas any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall aflect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes . Ex- serviccmen . Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

सा. का. नि. 75.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वनस्पति संरक्षण , संगरोध एवं संग्रह निदेशालय में वनस्पति संरक्षण , संगरोध एवं संग्रहण निदेशालय ( फार्म अधीक्षक ) भर्वा नियमावली, 1985 , वरिष्ठ तकनीकी सहायेक (जैव- प्रभावोत्पादकवा ) भर्ती नियमावली , 1986 को उन चातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , कृषि मंत्रालय के अधीन बनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय में वनस्पत्ति संरक्षण अधिकारी ( खरपववार विज्ञान ) के पद पर भर्ती की. पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वनस्पति संरक्षण, संगरोध एवं संग्रह निदेशालय वनस्पति संरक्षण अधिकारी (खरपतवार विज्ञान ) भर्ती नियम , 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को लागू होंगे ।

2. पदोंकी संख्या , वगर्गीकरण और वेतनमान : उक्त पदों की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा, अन्य अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट है ।

4. निरहंता: यह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्यीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो यह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 354

सा. का. नि. 76.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कृषि मंत्रालय, पशुपालन, डेयरी और मत्स्यपालन विभाग , दिल्ली दुग्ध योजना ( कम्पाउंडर वर्ग ' ग ' ) के भर्ती नियम, 2006 के संशोधन के लिए निम्नलिखित नियम बनाती है , अर्थात्:

1. ( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय, पशुपालन , डेयरी और मत्स्यपालन विभाग, दिल्ली दुग्ध योजना ( कम्पाउंडर वर्ग' ग ' ) भर्ती ( संशोधन ) नियम, 2008 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को लागू होंगे ।

2. कृषि मंत्रालय, पशुपालन , डेयरी और मत्स्यपालन विभाग, दिल्ली दुग्ध योजना ( कम्पाउंडर वर्ग ' ग' ) के भर्ती नियम, 2006 की अनुसूची के स्तंभ 8 के अधीन खंड ( iii ) में विद्यमान प्रविष्टियों के स्थान पर और " वांछनीय " शीर्ष के अधीन निम्नलिखित रखा जाएगा, अर्थात्:

" ( iii ) राज्य भेषजा परिषद् से भेषजज्ञ के रूप में रजिस्ट्रीकृत होना चाहिए ।

घांछनीय: केन्द्रीय सरकार या राज्य सरकार या पब्लिक सेक्टर के उपक्रम के अधीन किसी अस्पताल या नर्सिंग होम या किसी औषधालय में कम्पाउंडर के रूप में 2 वर्ष का अनुभव" ।

G.S.R. 76. In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Agriculture , Department of Animal Husbandry, Dairying and Fisheries , Delhi Milk Scheme ( Compounder Group ' C ' ) , Recruitment Rules , 2006 namely:

1. ( 1 ) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries. Delhi Milk Scheme ( Compounder Group 'C' ) , Recruitment ( Amendment ) Rules , 2008.

(2 ) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries , Delhi Milk Scheme (Compounder Group ' C' ). Recruitment Rules , 2006, in the Schedule, under Col: 8, for the existing entries in clause ( iii ) and under heading " Desirable " the following shall be substituted, namely:

"( iii ) Should be registered as a Pharmacist with the State Pharmacy Council .

Desirable : Two years experience as Compounder in a Hospital of Nursing Home or any dispensary under Central or State Government or Public Sector Undertaking. "
