सा.का.नि. 83. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त रामितंगों का प्रयोग करते हुए और कर्मचारी चयन आधीन अधीक्षक ( होलरीथ ) , सहायक अधीक्षक ( होलरीथ ) और लेखा अधिकारी भर्ती नियम, 1981 करें, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अभिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है , कर्मचारी चयन आयोग में लेखा अधिकारी के पद पर भर्ती की पद्धवि का विनियमन करने लिए निम्मलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम कर्मचारी चयन आयोग ( लेखा अधिकारी ) भर्ती नियम , 2008 है 1 (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्धा , वर्गीकरण और वेतनमान उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वाह होंगे जो इन नियमों से तपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा, अहंताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अहंताएं और उनसे संबंधित अन्य चायें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता वह व्यक्ति,-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

(ख ) जिसने अपने पत्ति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

[PART I-SEC.3(1) ] परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस निथुम के प्रवर्तन से छूट दे सकेंगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति : इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के अधीन ऐसे अधिकारी:-

क) ( i ) जिन्होंने मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण

किया हुआ है; या

(ii ) जिन्होंने मूल काडर/विभाग में 6500-10500 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में दो वर्ष सेवा की हो; या

(iii ) जिन्होंने मूल काडर या विभाग में 5500-9000 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में पाँच वर्ष सेवा की हो ;

(ख ) जो निम्नलिखित अर्हताएं एवं अनुभव रखते हों :-

( i ) केंद्रीय सरकार के लेखा विभाग द्वारा संचालित अधीनस्थ लेखा सेवा यासमतुल्य परीक्षा उत्तीर्ण;

(ii ) सचिवालय प्रशिक्षण और प्रबंध संस्थान से रोकड़ और लेख्खा कार्य या समतुल्य में प्रशिक्षण सफलतापूर्वक पूर्ण किया हो ;

और

( iii ) रोकड़ , लेखा और बजट कार्य में पांच वर्ष का अनुभव ।

( प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । )

प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अविम तारीख को 56 वर्ष से अधिक नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

G.S.R. 83. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession oftheStaffSelection Commission Superintendent (Hollerith), Assistant Superintendent (Hollerith) andAccountsOfficer Recruitment Rules, 1981, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts ofAccounts Officer in the Staff Selection Commission, namely:-

1. Short title and commencement . (1 ) These rules may be called the Staff Selection Commission (Accounts Officer), Recruitment Rules, 2008.

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. Number ofposts, classification and scale ofPay. The number of posts , their classification and scale ofpay attached thereto, shall be as specified in columns (2 ) to (4) of the Schedule amended to these rules .

3 Method ofrecruitment, age limit, qualifications, etc. The method ofrecruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to ( 14) of the said Schedule.

4Disqualification-No person,-

(a)who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person, 386

[PART II SEC. 3 (1) ] shall be eligible for appointment to the saidpost:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Goverment is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing relax any ofthe provisions of these rules with respect to any class or category ofpersons.

6. Saving. Nothing in these rules shall affect reservation , relaxation ofage limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 84.- केन्द्रीय सरकार , कंपनी अधिनियम, 1956 ( 1956 का 1) ( जिसे इसमें इसके पश्चात् अधिनियम कहा गया है ) की धारा 594 की उपधारा ( 1 ) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के तत्कालीन वित्त मंत्रालय (कंपनी विधि प्रशासन अनुभाग ) की अधिसूचना सं. का.नि.आ. 3216 तारीख 4 अक्तूबर, 1957 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहीं गया है ) का अशिक रूप से उपांतरण करते हुए, यह निर्देश करती है कि पैसर्स आगा खां फाउंडेशन, सरोजिनी हाऊस , दूसरा तल, 6 भगवान दास रोड, नई दिल्ली (जिसे इसमें इसके पश्चात् कंपनी कंपनी कहा गया है ) के मामले में, जो एक विदेशी कंपनी है , जिसे इस चार्टर में दिए गए अपने परोपकारी उद्देश्यों के क्रियान्वन के लिए भारत में अपना कार्यालय स्थापित करने के लिए पत्र सं. ई.सी.को. एफ.सी.एस. 4163/30 ( एक्टिविटी ) -78 खारीख 16 मई, 1978 द्वारा विदेशी मुद्रा विनियमन अधिनियम, 1973 की धारा 29 की उपधारा ( 1 ) के खंड ( क ) के अधीन भारतीय रिजर्व बैंक द्वारा अनुज्ञात किया गया है, उक्त अधिसूचना द्वारा किसी बिदेशी कंपनी को उनके आवेदनों में यथाउपांतरित उक्त धारा 594 की उपधारा ( 1 ) के खंद (क) के अपेक्षाएं निम्नलिखित और अपवादों और उपांतरणों के अधीन रहते हुए , लागू होंगी , अर्थात्

" इसे धारा 594 की उपधारा ( 1 ) के खंड ( क) के उपबंधों का पर्याप्त अनुपालन समझा जाएगा , यदि 1 जनवरी , 2006 से आरंभ होने वाले वित्तीय वर्षों के संबंध में वह कंपनी भारत में कंपनियों के समुचित रजिस्ट्रार को अपने भारतीय कारबार वार्षिक लेख्खा के संबंध में तीन प्रतियों में प्रस्तुत करती है । "

1. निम्नलिखित द्वारा प्रमाणित ऐसी कंपनी की भारतीय शाखाओं द्वारा की गई प्राप्तियों और संदायों का एक विवरण ,- (क) अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड ( घ ) के अधीन भारत में आदेशिका की तामील को स्वीकार करने के लिए, प्राधिकृत कोई व्यक्ति;

( ख ) यह प्रमाणित करते हुए कि उक्त विवरण में , 1 जनवरी , 2006 से प्रारंभ होने वाले वित्तीय वर्षों के लिए भारत में कंपनी की प्राप्तियों और संदायों में सही और उचित दृष्टिकोण है, भारत में व्यवसायरत कोई चार्टर्ड एकाउंटेंट;

3. यह प्रमाणित करते हुए कि कंपनी ने 1 जनवरी , 2006 को आरंभ होने वाली अवधि के दौरान भारत में कोई व्यापार या विनिर्माण, वाणिज्यिक या औद्योगिक क्रियाकलाप नहीं किया है । उक्त अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड (घ ) के अधीन भारत में आदेशिका की तामील स्वीकार करने के लिए प्राधिकृत किसी व्यक्ति द्वारा सम्यक् रूप से हस्ताक्षरित प्रमाणपत्र ।

G.S.R. 84. In exercise of the powers conferred by the proviso to sub-section ( 1 ) of Section 594 of the Compa- nies Act, 1956 ( 1 of 1956) (hereinafter referred to as the Act) and in partial modification of the notification of the Government ofIndia, erstwhile Ministry ofFinance (Department of Company Law Administration) numbers S.R. O.3216 dated the 4th October, 1957 ( hereinafter referred to as the said notification) , the Central Government hereby directs that in the case ofM/s . Aga Khan Foundation, Sarojini House , 2nd Floor, 6 Bhagawan Das Road, New Delhi (hereinafter referred toas the company) being a foreign company, having been permitted by the Reserve Bank of India under Clause (a) ofsub-section( 1) ofSection 29 ofthe Foreign Exchange Regulations Act, 1973 , vide letter No. EC Co. PCS . 4163/30 (Activity)-78 dated the 16th May, 1978 to establish its office in India, to carry out its philanthropic objects set out în its Charter , the requirements of clause (a) of sub -section (1 ) of the said Section 594 as modified in their application to a foreign company by the said notification shall apply subject to the following further exceptions and modifications, namely:--

" It shall be deemed to be sufficient compliance with the provisions of clause (a) of sub- section ( 1) of the Sectoin 594, if, in respect of the financial years commencing from the 1st day of January, 2006 the company in respect of its Indian Business Annual Accounts submits to the appropriate Registrar of Companies in India, in triplicate"

1. a statement of receipts and payments made by the Indian branches of such company certified by,- i

(a) a person authorized to accept service ofprocess in India under clause (d) of sub-section (1 ) of Section 592 oftheAct; and

(b) aChartered Accountant practicing in India, certifying that the said statement gives a true and fair view ofthe receipts and payments of the company in India for the financial years commencing from the 1st day of January,2006;

2. astatement of the company's assets and liabilities in India certified by-

(a) aperson authorized to accept service of process in India under clause ( d) of sub - section ( 1 ) of Section 592 ofthe Act; and

(b) a Chartered Accountant practicing in India, certifying that the said statement gives a true and fair view ofthe state of affairs of the company in India as at the end of the financial years commencing from the 1st day of January,2006;

3. a certificate duly signed by a person authorized to accept service of process in India under clause(d) ofsub- section( 1 ) ofSection 592 ofthe Act certifying that the company did not carry out any trading or manufacturing , commercial or industrial activity in India during the financial years commencing from the Ist day of January , 2006" .

सा.का. नि. 8.5, - राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और कृषि तकनीकी अधिकारी का वियाग ( वानिकी ) भर्ती निषम , 1979 को , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अभिक्रमण से पहले किया गया है या करने में लोप किया गया है , पर्यावरण एवं वन मंत्रालय में तकनीकी अधिकारी श्रेणी ( वानिकी ) , तकनीकी अधिकारी श्रेणी- II (वानिकी) और अनुसंधान अन्वेषक ( वानिकी ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्मलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम पर्यावरण एवं वन मंत्रालय, समूह ' ख' ( वानिकी ) अधिकारी भर्ती नियम, 2008 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या , वर्गीकरण और वेतनमान : उक्त पदों की संख्या, उनका वर्गीकरण और वेतनमान उपाबद्ध अनुसूची के कालम (2 ) से कालम (4 ) में विनिर्दिष्ट हैं ।

3. धर्ती की पद्धति , आयु सीमा, अहंताएं आदि पर्ती की पद्धति, आयु सीमा, अहंताएं और उनसे संबंधित अन्य बातें उक्त अनुसूची के कालम (5 ) से कालम ( 14 ) में विनिर्दिष्ट होगी । 4. निरर्हत्ता : यह व्यक्ति,-

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की नाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति : इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेंगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए जिनके लिए उपबंध करना अपेक्षित है ।

ऐसा तकनीकी अधिकारी (वानिको ) श्रेणी-2 , जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है ।

प्रोग्निति, जिसके न हो सकने पर प्रतिनियुक्ति द्वारा जिसके अन्तर्गत अल्पकालिक साँवदा भी है ।

टिप्पण: -

जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा है वहां उनसे वरिष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा कि गई ऐसी अर्हक पात्रता सेवा , अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) : केन्द्रीय सरकार/ राज्य सरकारों/ संघ राज्य क्षेत्रों/ क्षेत्रीय अनुसंधान संस्थाओं/विश्वविद्यालयों/ अर्ध- सरकारी कानूनी या स्वायत संगठनों के ऐसे अधिकारी:-

(क) (१ ) जो नियमित आधार पर सदृश पद धारण किए है ; या (ii ) जिन्होंने 6500-10500/-रुपए के वेतनमान वाले पदों पर तीन वर्ष नियमित सेवा की है; या

(iii ) जिन्होंने 5500-9000/-रुपए के वेतनमान वाले पदों पर सात वर्ष में नियमित सेवा की है;

और

(ख) ( i ) जिसके पास किसी मान्यता प्राप्त विश्वविद्यालय से सांख्यिकी या संक्रिया अनुसंधान या साख्यिकी सहित अर्थशास्त्र या सांख्यिकी सहित वाणिज्य सहित वाणिज्य या सांख्यिकी सहित गणित या सांख्यिकी सहित कृषि में मास्टर डिग्री या समतुल्य है ।

(ii ) जिन्हें कृषि या वानिकी में आंकड़ों के संग्रहण , संकलन और विश्लेषण का तीन वर्ष का अनुभव है ।

टिप्पण : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिएविचार किए जाने के पात्र नहीं होंगे ।

प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि भी है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । 391

1. (1) Short title and commencement. These rules may be called the Ministry of Environment and Forests, Group 'B' (Forestry) Officers Recruitment Rules , 2008.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2.Number of the posts, classification and scale of Pay.The number of the said posts, their classification and the scale ofpay attached thereto, shall be specified in columns (2) to (4) ofthe Schedule annexed thereto,

3 Method of recruitment, age limit, qualifications, etc. The method ofrecruitment, age limit, qualifications and other matters relating theseto shall be as specified in columns (5) to (14) ofthe said Schedule.

4Disqualification. No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointemnt to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any persons from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may,by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any ofthe provisions of these rules with respect to any class or category ofpersons.

6. Savings. Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes , ex-serviceman and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard. 143765108-4 3%

1. संक्षिप्त नाम और प्रारंभ -( 1 ) इन नियमों का संक्षिप्त नाम भारतीय मातिस्वकी सर्वेक्षण , ( सहायक, लेखा अधिकारी ) भर्ती नियम, 2008है ।

(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्म ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की घाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

5500-175-9000 रु. या समतुल्य के वेतनमान में ऐसे विभागीय ज्येष्ठ लेखाकार पर, जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की है, प्रतिनियुक्ति पर नियुक्ति के लिए आर्यदकों के साथ विचार किया जाएगा और उसके पद पर नियुक्ति के लिए चयन किए जाने की दशा में वह प्रोन्नति द्वारा भरा गया सम्झा जाएगा । ( प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले घारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी)

2008है । 1. संक्षिप्त नाम और प्रारंभ-( 1 ) इन नियमों का संक्षिप्त नाम एकीकृत मात्स्यिकी परियोजना प्रसंस्करण प्रोद्योगिकविद् मर्ती नियम, (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्म ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु - सीमा, अन्य अर्हताएं आदि-उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए ओ कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति, - इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायत्तों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबध में जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । 407

( ii ) जिन्होंने मूल काडर/विभाग में 5500-175-9000 रुपए के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष की सेवा की डो, :

( iii ) जिन्होंने मूल काडर/विभाग में उस श्रेणी में नियमित आधार पर नियुक्ति के पश्चात् 5000-150-8000 रुपए या समतुल्य वेतनमान में छः वर्ष की सेवा की हो, और

(ii ) मत्स्यप्रसंस्करण कारखानों में दो वर्षों का व्यावहारिक अनुभव या पत्त्य प्रसंस्करण क्षेत्र में दो वर्षों का अनुसंधान अनुभव ।

वांछनीय: विपणन या व्यापार प्रबंधन में डिप्लोमा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सौधी पंक्ति में है प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के लिये पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि , अल्पकालिक संविदा सम्मिलित है जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगटन/विभाग में इस नियुक्ति से ठीक पहले श्रारित किसी अन्य काडर वाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

G.S.R. 87. in exercise ofthe powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Integrated Fisheries Project (Processing Technologist) Recruitment Rules, 1992, in so far as they relate to the post ofProcessing Technologist, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Processing Technologst in the Integrated Fisheries Project Cochin under the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, namely:-

1.Short title and commencement. ( 1 ) These rules may be called the Integrated Fisheries Project, Processing Technologist, Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the OfficialGazette.

2. Number of post, its classification and the scale of pay. The number of the post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method ofrecruitment, age limit and other qualifications etc.-The method of recruitment, to the said post, age limit, qualification and other relating to the said post shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification. No person,

( 1) who has entered into or contracted a marriage with a person having a spouse living ; στ

(b) who having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal faw applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it maybyorder, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any ofthe provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तय सिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों से अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

In exercise ofthe powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Central Institute of Fisheries Nautical and Engineering Trainning (Group C andGroup D Posts) Recruitment Rules , 1977, in so far as they relate to the post of Physical Training Instructor-cum- Deputy Warden , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Physical Training Instructor- cum-Deputy Warden in the Central Institute of Fisheries, Nautical and Engineering Training , under the Ministry ofAgriculture, Department ofAnimal Husbandry , Dairying and Fisheries , namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Central Institute ofFisheries, Nautical and Engineering Training ( Physical Training Instructor-cum-Deputy Warden) Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number ofpost, classification and scale ofpay. The number ofthe said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualificationsetc. The method ofrecruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 14 ) of the said Schedule.

4. Disqualification .No person

(i) who has entered into or contracted a marriage with a person having a spouse living; or

(ii) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of these provisions of these rules with respect to any class or category of persons.

6. Saving . Nothing in these rules shall affect reservations, relaxation of age limit and other concessions requiredto beprovided for the Scheduled Castes, Scheduled Tribes , Ex -servicemen and other special categories ofpersons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 89. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कृषि और खाद्य मंत्रालय (डेयरी प्रभाग ) में तकनीकी वर्ग । और 2 पदों पर भर्ती नियम, 1958 , को अधिक्रांत करते हुए कृषि मंत्रालय, पशुपालन , डेयरी और पत्त्यपालन विभाग में तकनीकी अधिकारी ( डेयरी विकास ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् 1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम पशुपालन , डेयरी और मत्स्यपालन विभाग , तकनीकी अधिकारी (डेयरी विकास ) भर्ती नियम, 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान यह होगा , जो इन नियमों से उपाषद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्म ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु- सीमा तथा अन्य अर्हताएं- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट है ।

4. निरर्हता- वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेंगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हका पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा । परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्षों से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में ऐसे कनिष्ट व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है।

(a) (1) bolding analogous post on regular basis in the parent cadre orDepartment; or

(i) with three years' service in the grade rendered after appointment thereto on a regular basis in the scale of pay Rs.5500-9000 or equivalent in the parent cadre or Department, and

(b) possessing the following educational qualifications and experienceprescribed for direct recruits under column 8 .

The Departmental Officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment by deputation.
