सा. का. नि. 118. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कारपोरेट कार्य मंत्रालय , गंभीर कपट अन्वेषण कार्यालय में अभियोजक-2 के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम कारपोरेट कार्य मंत्रालय, गंभीर कपट अन्वेषण कार्यालय , समूह ' ख' पद राजपत्रित , अभियोजक-2 मर्ती नियम, 2008 है ।
(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्य , वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि उक्त पद पर भर्ती की पद्धति , आयु सीमा, अहंताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
4. निरर्हता : वह व्यक्ति-
(क) जिसने ऐसे व्यक्तिसे जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रर्वतन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेंगी ।
6. व्यावृत्ति : इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, मूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ख ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हैं:-
आवश्यक :
( i ) किसी मान्यताप्राप्त विश्वविद्यालय से विधि मेंस्नातक उपाधि या सम्तुल्य ; और
(ii ) पुकद्दमेबाजी और न्यायालय सम्बन्धी मामले संभालने में दो वर्ष का अनुभव ।
वांछनीय:
(i ) न्यायालयों में कारपोरेट दाडिक विधि में कम्पनियों से सम्बन्धित अभियोजन मामले सम्भालने में एक वर्ष का अनुभव होना चाहिए ।
( ii ) अभियोजन कार्यवाहियों में प्रयोग किए जाने वाले सर्वोत्तम साक्ष्यों के संग्रहण समाकलन और प्रस्तुतीकरण या कथन के अभिलेखन या साध्य संग्रहण की तकनीकों और साधनों में निपुण होना चाहिए।
(प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन विभाग में इस नियुक्दि से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि पी है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।
प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।)

G.S.R. 118.In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Prosecutor-II in the Serious Fraud InvestigationOffice, Ministry of Corporate Affairs , namely:-
1. Short title and commencement (1 ) These rukes may be called the Serious Fraud Investigation Office, Ministry ofCorporate Affairs Group 'B' Post Gazetted, Prosecutor- II Recruitment Rules,2008.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number ofPosts , Classification and Scale of Pay.-The number of the post , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to ( 4) ofthe Schedule annexed to these rules.
3. Method ofRecruitment, Age Limit, Educational Qualifications, etc. The method ofrecruitment, to the said posts, age limit, Educational qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.
4. Disqualification.No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, haying a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage, is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation ofthis rule.
5. Powerto relax. Where the Central Government is of the opinion that it is necessary or expedient soto do, it may,by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission relax any ofthe provisions of these rules with respect to any class or category ofpersons.

Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex- Servicemen and Other special categories ofpersons , in accordance with the orders issued by the Central Government from time to time in this regard.

(Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not exceed three years . प्रतिनियुक्ति:-केंद्रीय सरकार के अधीन ऐसे अधिकारी- (क) ( i ) जिन्होंने मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या
(ii ) जिन्होंने मूल काडर/विभाग में 6500-10500 रुपये या समतुल्य के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष सेवा की है ; या
( iii ) जिन्होंने मूल कार्डर विभाग में 5500-9000 रुपये या समतुल्य के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में सात वर्ष सेवा की हो ; और
(ख) ( i ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हीँ :-
(अ) ( i ) किसी मान्यताप्राप्त विश्वविद्यालय से कम्प्यूटर उपयोजन या कम्प्यूटर विज्ञान में स्नातकोत्तर उपाधि या प्रौद्योगिकी ( कम्प्यूटर उपयोजन में विशेषज्ञता सहित ) में स्नातकोत्तर या इंजीनियरी में स्नातक या कम्प्यूटर इंजीनियरी प्रौद्योगिकी या कम्प्यूटर विज्ञान या कम्प्यूटर प्रौद्योगिकी में स्नातक या समतुल्य और
( ii ) इलैक्ट्रानिक आंकड़ा प्रसंस्करण कार्य करने में चार वर्ष का अनुभव जिसके अंतर्गत वास्तविक क्रियाकलाप करने का अनुभव भी सम्मिलित है ।
या
(आ) किसी मान्यताप्रप्त विश्वविद्यालय से कम्प्यूटर उपयोजन या कम्प्यूटर विज्ञान में उपाधि या इलैक्ट्रानिक या इलैक्ट्रानिक और संचार इंजीनियरी में उपाधि या समतुल्य ; और
( ii ) इलैक्ट्रानिक आंकड़ा प्रसंस्करण कार्य करने में पांच वर्ष का अनुभव , जिसमें से वास्तविक क्रियाकलाप करने में कम से कम दो वर्ष का अनुभव होना चाहिए ।
( ई ) किसी मान्यताप्राप्त विश्वविद्यालय से रन्नातकोत्तर उपाधि या समतुल्य या किसी मान्यताप्राप्त विश्वविद्यालय से इंजीनियरी में उपाधि या समतुल्य; और

( ii ) इलैक्ट्रानिक आंकड़ा प्रसंस्करण कार्य करने में छह वर्ष का अनुभव, जिसमें से वास्तविक क्रियाकलाप करने में कम से कम दो वर्ष का अनुभव होना चाहिए ।
(इ ) इलैक्ट्रानिक विभाग के अधीन ' क' स्तर का डिप्लोमा और कंम्प्यूटर पाठ्यक्रम प्रोग्राम का प्रत्यायन या विश्वविद्यालय कार्यक्रम के अधीन प्रस्तुत कम्प्यूटर उपयोजन में स्नातकोत्तर डिप्लोमा या तकनीकी शिक्षा की राज्य परिषद् द्वारा प्रदत्त किया गया कम्प्यूटर उपयोजन में पश्च पोलोटेकनीक डिप्लोमा या समतुल्य ; और
(ii ) इलैक्ट्रानिक आंकड़ा प्रसंस्करण कार्य करने में छह वर्ष का अनुभव , जिसमें से वास्तविक क्रियाकलाप करने में कम से कम तीन वर्ष का अनुभव होना चाहिए ।

In exercise of the powers conferred by the proviso to Article 309 ofthe Constitution, the President herebymakes the following rules regulating the method of recruitment to the post of System Analyst in National Spatial DataInfrastructure (NSDI) Division, Ministry of Science and Technology, (Department of Science and Technology), namely:-
1. Short title and commencement. ( 1 ) These rules may be called the National Spatial Data Infrastructure (NSDI), Ministry of Science and Technology, (Department of Science and Technology) , System Analyst Recruitment Rules,2008
(2) They shall come into force on the date oftheir publication in the Official Gazette.
2. Number ofPosts, Classification and Scale of Pay. The number of the post, its classification and the scale ofpay attached thereto shallbe as specified in columns (2) to ( 4) ofthe Schedule annexed to these rules .
3. Method of Recruitment, Age Limit and other Qualifications, etc. The method ofrecruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.
4. Disqualification.--No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shallbe eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category ofpersons.
6. Saving. Nothing in these rules shall affect the reservations and other concessions required to be provided for theScheduled Castes, the Scheduled Tribes, Ex-Servicemen and Other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मत्स्यनौचालन एवं इंजीनियरी प्रशिक्षण संस्थान , कोच्ची, मेट ग्रेड- II समूह ' ख' भर्ती नियम , 2008 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान यह होगा, जो इन नियमों से उपाषद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट है ।
3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि उक्त पद पर भर्ती की पद्धति , आयु सीमा, अर्हत्ताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. मिरर्हता वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो यह किसी व्यक्ति को इस नियम के प्रर्वतन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति : इन नियमों की कोई बात , ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । [भाग खण्ड 3 (0) ]

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार का यह विचार है कि ऐसा करना आवश्यक अथवा समीचीन है , वह आदेश द्वारा , लिखित में तथा संघ लोक सेवा आयोग से विचार- विमर्श करने के पश्चात्, किसी श्रेणी अथवा व्यक्तियों के वर्ग के संबंध में उक्त नियमों के किसी भी प्रावधान में छूट दे सकती है ।
6. व्यावृत्ति: उक्त नियमों का कोई भी प्रावधान , अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों तथा अन्य विशेष वर्गो के व्यक्तियों को, इस संबंध में समय- समय पर केन्द्र सरकार द्वारा जारी आदेशों के अनुरूप प्रदान किए जाने वाले आरक्षणों , आयु सीमा की छूटों और अन्य रियायतों को प्रभावित नहीं करेगा ।

केन्द्रीय सरकार या राज्य सरकार या संघराज्य क्षेत्रों या विश्व- विद्यालयों या मान्यताप्राप्त अनुसंधान संस्थाओं या सार्वजनिक क्षेत्र के उद्यमों या अर्द्ध सरकारी या सांविधिक या स्वायत्तशासी संगठनों के अधीन कार्यरत वे अधिकारी :
(क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या
(ii ) जिन्होंने मूल काडर या विभाग में 6500-10,500/- रु. के वेतनमान के पदों या समतुल्य पदों में नियमित आधार पर उनकी नियुक्ति के पश्चात् इसी श्रेणी में पांच वर्षों की नियमित सेवा की हो; या
(iii ) जिन्होंने मूल काडर या विभाग में 5500-9000/- रु. के वेतनमान के पदों या समतुल्य पर्षों में नियमित आधार पर उनकी नियुक्ति के पश्चात् इसी श्रेणी में आठ वर्षों की नियमित सेवा की हो ; और
(ख) जिन्हें निम्नलिखित शैक्षिक अर्हताएं तथा अनुभव प्राप्त हों :
आवश्यक :
(क) (1 ) इतिहास या संस्कृत या पाली या प्राकृत या फारसी या अरबी या पुरातत्व या मानव-विज्ञान या ललित कला या कला इतिहास में किसी मान्यताप्राप्त विश्वविद्यालय से स्नातकोत्तर उपाधि या समतुल्य;
(ii ) किसी मान्यताप्राप्त विश्वविद्यालय से संग्रहालय- विज्ञान मेंडिप्लोमा या समतुल्य; और
(iii ) केन्द्र सरकार या राज्य सरकार या संघराज्य क्षेत्र के नियंत्रण के अधीन राष्ट्रीय या क्षेत्रीय महत्व के किसी संग्रहालय के सुसंगत क्षेत्र में तीन वर्ष का अनुभव:
(iv) मुद्रा विषयक एवं पुरालेख के क्षेत्र में एक वर्ष क़ा क्षेत्र अनुभव और व्यावहारिक प्रशिक्षण
या
(ख ) (३ ) किसी मान्यताप्रापा विश्वविद्यालय से स्नातक उपधि स्तर पर एक विषय के रूप इतिहास के साथ संग्रहालय विज्ञान में स्नातकोत्तर उपाधि या समतुल्यः
( ii ) केन्द्र सरकार या राज्य सरकार या संघराज्य क्षेत्र के नियंत्रण के अधीन राष्ट्रीय या क्षेत्रीय महत्व के किसी संग्रहालय के सुसंगत क्षेत्र में तीन वर्ष का अनुभव ;
(iii) मुद्राविषयक एवं पुरालेख के क्षेत्र में एक वार्ष का क्षेत्र अनुभव और व्यावहारिक प्रशिक्षण
वांछनीय :
किसी मान्यताप्राप्ता विश्वविद्यालय या समतुल्य से सुसंगत क्षेत्र में एम. फिल की उपाधि ।
टिप्पण 1 : फीडर श्रेणी के विभागीय अधिकारी , जो प्रोन्नति की तत्काल प्रतीक्षा में हैं, प्रतिनियुक्ति के आधार पर नियुक्ति हेतु पात्र नहीं माने जाएंगे ।
इसी प्रकार , प्रतिनियुक्ति के आधार पर नियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के पात्र नहीं होंगे ।

MINISTRY OF CULTURE New Delhi , the 11th June , 2008
G.S.R. 122. In exercise of the powers conferred by the proviso to Article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Curator (Numismatics and Epigraphy) in the Ministry ofCulture, National Museum , New Delhi , namely :-
1. Short title and commencement.( 1 ) These rules may be called the Ministry of Culture, National Museum, New Delhi , Deputy Curator (Numismatics and Epigraphy) , Group ' A' Post, Recruitment Rules , 2008.
(2) They shall come into force on the date oftheir publication in the Official Gazette.
2. Number of Posts , Classification and Scale of Pay. The number of the said post, its classification and scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .
3. Method ofRecruitment , Age Limit , Qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 ofthe Schedule .
4. Disqualification . No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex- Servicemen and Other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

(iii) with eight years' service in the grade rendered after appointment there to on a regular basis in post in the scale of pay ofRs . 5500-9000 or equivalent in the parent cadre or department ; and
(b) Possessing the following educational qualifications and experience: Essential :
(a)(i) Master's degree ofa recognized University or equivalent in History or Sanskrit or Pali or Prakrit or Persian or Arabic or Archaeology or Anthropology or Fine Arts or History ofArt.
(ii) Diploma in Museology from a recognized University or equivalent, and
(iii) Three years experience in the relevant field in a museum of national or regional importance under the control of Central Government or State Governments or Union territories.
(iv) One year's field experience and practical training in the field of Numismatics and Epigraphy.
OR
(b)(i) Master's degree from a recognized University or equivalent in Museology with History as a subject at Bachelor's degree level .

(ii) Three years ' experience in the relevant field in a museum ofnational or regional importance under the control of Central Government or State Governments or Union territories .
(iii) One year's field experience and practical training in the field of Numismatics and Epigraphy .
Desirable:
M. Phil degree in the relevant field from a recognized University or equivalent.
Note : 1. The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation .
Similarly, deputationists shall not be eligible for consideration for appointment by promotion.
Note 2.-Period ofdeputation ( including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three year) .
Note 3. The maximum age limit for appointment by deputation (including short term contract) shall be not exceeding 56 years as on the closing date of receipt of applications .
