सं. 26011/23/99- आई.पी.एस.- II-यतः, श्री वाई. पी . सिंह महाराष्ट्र संवर्ग के 1985 बैच के आई.पी.एस. अधिकारी हैं और उन्होंने दिनांक 23.12.1985 को सेवा में कार्यभार ग्रहण किया था;
2. और यतः , श्री वाई. पी . सिंह आई.पी.एस. ( महाराष्ट्र : 85 ) ने वर्ष 1993 से 1996 तक केन्द्रीय अन्वेषण ब्यूरो , मुम्बई में पुलिस अधीक्षक के पद पर रहते हुए कदाचार और कर्त्तव्य की अवहेलना के विभिन्न कृत्य किये थे जिस कारण उन पर लघु शास्ति लगाए जाने हेतु उनके विरुद्ध अखिल भारतीय सेवा ( डी एंड ए ) नियम के नियम 10 के तहत अनुशासनात्मक कार्यवाही शुरू की गई थी;
3. और यतः, जब शास्ति की प्रमात्रा के संबंध में सलाह लेने के लिए मामले को संघ लोक सेवा आयोग को भेजे जाने का प्रस्ताव इस मंत्रालय में विचाराधीन था, तभी महाराष्ट्र सरकार ने श्री वाई. पी. सिंह के स्वैच्छिक सेवानिवृत्ति के अनुरोध की प्रति अग्रेषित की और, तत्पश्चात् 9 मार्च, 2005 को राज्य सरकार ने यह सूचित किया कि श्री वाई. पी. सिंह को दिनांक 1 मार्च, 2005 से स्वैच्छिक सेवानिवृत्ति दे दी गई है तथा जिस पर यह मंत्रालय सहमत नहीं हुआ और चूँकि उनकी स्वैच्छिक सेवानिवृत्तिका आदेश अखिल भारतीय सेवा ( डी सी आर बी ) नियम, 1958 के नियम 16 ( 2 ) ( क) का उल्लंघन था , इसलिए महाराष्ट्र सरकार को श्री सिंह को वापस बुलाने की सलाह दी गई;

4. और यतः, तत्पश्चात् महाराष्ट्र सरकार ने दिनांक 23 नवम्बर, 2006 के अपने पत्र के द्वारा यह सूचित किया कि राज्य सरकार श्री वाई. पी. सिंह को भारतीय पुलिस सेवा से स्वैच्छिक सेवानिवृत्ति लेने की अनुमति देने के संबंध में कोई निर्णय नहीं लिया था और उनको फरवरी, 2005 में एक पत्र भेजा गया था जिसमें यह उल्लेख किया गया था कि उनकी स्वैच्छिक सेवानिवृत्ति राज्य सरकार द्वारा मंजूर कर ली गई है और उसे आवश्यक कार्रवाई हेतु केन्द्रीय सरकार को भेज दिया गया है और उन्होंने अपने दिनांक 9 मार्च, 2005 के पत्र पर खेद प्रकट किया और यह उल्लेख किया कि यह लिखना उचित नहीं था कि श्री वाई. पी. सिंह को दिनांक 1 मार्च , 2005 से स्वैच्छिक सेवानिवृत्ति दे दी गई है ;
5. और यतः , महाराष्ट्र सरकार ने अपने दिनांक 23 नवम्बर, 2006 के पत्र द्वार। यह भी सूचित किया है कि श्री वाई. पी . सिंह ने 20 अगस्त, 2003 से ही कार्यभार ग्रहण नहीं किया था , जब उन्हें कमान्डेंट, ग्रुप VIII, मुम्बई से एस. पी. रेलवे , नागपुर में स्थानान्तरित किया गया था और वह कोई पेंशन लाभ भी नहीं ले रहे थे । उनकी दिनांक 20 अगस्त, 2003 से 15 फरवरी , 2004 तक की छुट्टी डी.जी.पी. द्वारा अर्द्ध वेतन अवकाश के रूप में स्वीकृत की गई थी लेकिन 16 फरवरी , 2004 से उनकी छुट्टी के बारे में कोई निर्णय नहीं लिया गया था;
6. और यतः , महाराष्ट्र सरकार ने अपने दिनांक 19 मई, 2006, 6 मार्च, 2007 , 26 अप्रैल , 2007 तथा 19 जुलाई, 2007 के पत्रों के द्वारा श्री वाई. पी. सिंह से अनुरोध किया था कि वे कार्यभार ग्रहण कर लें और उसके बाद ही उनके स्वैच्छिक सेवानिवृत्ति के अनुरोध पर विचार किया जा सकता है;
657 कीतारीख से ही कार्यभार ग्रहण करने के पर्याप्त अवसर दिये गये लेकिन उक्त अधिकारी ने कार्यभार ग्रहण नहीं किया और इस प्रकार अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7 (2 ) ( क ) के अंतर्गत विचार किए जाने के लिए यह उचित मामला बनता है;
11. और अब, इसलिए, राष्ट्रपति अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7 ( 2 ) (क ) के उपबन्धों के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, श्री वाई. पी. सिंह, आई. पी. एस. ( महाराष्ट्र : 85 ) को दिनांक 16फरवरी , 2004 से भारतीय पुलिस सेवा से त्याग- पत्र दिया हुआ मानती हैं । वे उसी तारीख से भारतीय पुलिस सेवा से कार्यमुक्त भी होंगे तथा यह तद्नुसार अधिसूचति किया जाता है ।

09.06.2008 पू.नि.म.नि. 2. उक्त तदर्थ प्रोन्नति/नियुक्ति निम्नलिखित शर्तों के अध्यधीन होंगी :--
(i ) यह तदर्थ नियुक्ति, नियुक्त अधिकारियों को उसी ग्रेड में निरन्तर बने रहने अथवा नियमित नियुक्तिके लिए चयन सूची में शामिल किए जाने अथवा केन्द्रीय सचिवालय सेवा के अनुभाग अधिकारियों के ग्रेड में वरीयता संबंधी दावे का कोई अधिकार प्रदान नहीं करेगी ।
(ii ) तदर्थ नियुक्तियां , तब तक जारी रहेंगी जब तक अनुभाग अधिकारी ग्रेड में नियमित उम्मीदवार नहीं मिल जाते , चाहे वह वरीयता कोटा से हो अथवा सीमित विभागीय परीक्षा ( एल.डी.सी.ई. ) से । तदर्थ आधार पर नियुक्ति किए गए व्यक्तियों के इन दोनों में से किसी भी श्रेणी में नियमित नियुक्त के लिए अर्हक ( योग्य ) नहीं पाए जाने पर उन्हें इस प्रकार के नियमित अधिकारियों के उपलब्ध होने पर उसी तारीख से सहायक के ग्रेड में प्रत्यावर्तित कर दिया जाएगा जिस तारीख को इस विभाग द्वारा उन्हें आवंटित कैडर में कार्य ग्रहण कर लेंगे ।

2. तदर्थ प्रोन्नति निम्नलिखित शर्तों के अध्यधीन है:--

2. And whereas , disciplinary proceedings under Rule 10 of AIS (D &A) Rules for minor penalty were initiated against Shri Y. P. Singh , IPS ( MH : 85) for committing several acts of misconduct and dereliction of duty during his stint as SP CBI Mumbai from 1993-96;
3. And whereas , while the proposal to refer the case to UPSC for advice on the quantum of penalty to be imposed was under consideration in this Ministry, Government of Maharashtra forwarded a copy of the request for voluntary retirement from Shri Y. P. Singh and , thereafter on 9th March , 2005 the State Government intimated that Shri Y. P. Singh has been retired voluntarily w.e.f. 1st March , 2005 and which was not agreed to by this Ministry and the Government of Maharashtra was advised to recall Shri Singh since the order of his voluntary retirement was in violation of Rule 16 ( 2) (A) of All India Services ( DCRB ) Rules , 1958 .
4. And whereas , Government of Maharashtra thereafter in their letter dated 23rd November , 2006 intimated that the State Government did not take any decision to permit Shri Y. P. Singh to voluntarily retire from Indian Police Service and the communication was sent to him in February, 2005 stating that his voluntary retirement had been accepted by the State Government and forwarded to the Central Government for necessary action , and they regretted about their communication dated 9th March , 2005 stating that Shri Y. P. Singh has retired voluntarily w.e.f. 1st March , 2005 was not proper .
5. And whereas , Government of Maharashtra vide their letter , dated 23rd November , 2006 also informed that Shri Y.P. Singh had not joined the duties since 20th August , 2003, when he was transferred from Commandant, Group VIII , Mumbai to S.P. Railways , Nagpur and he was also not getting any pensionary benefits . His leave from 20th August, 2003 to 15th February, 2004 was sanctioned by D. G. P. as half pay leave but no decision had heen taken about his leave since 16th February , 2004 .
6. And whereas , Government of Maharashtra vide their letters , dated 19th May, 2006, 6th March , 2007 , 26th April , 2007 and 19th July, 2007 requested Shri Y. P. Singh to join duties and only thereafter his request for voluntary retirement could be considered;
[PART I-SEC . 2 9. And whereas , an Officer who intends to proceed on voluntary retirement or tenders his resignation from service cannot absent himself in anticipation of acceptance of his request . For all practical purposes Shri Singh's service will be counted upto 16.02.2004 only. Even if his past service in Indian Railways prior to his appointment in IPS is counted , he has completed only 19 years of service against the stipulation of 20 years of service for voluntary retirement .
10. And whereas , Shri Y. P. Singh has been on unauthorized absence since 16th February, 2004 and he has been granted ample opportunity to join service from the date of his unauthorized absence but the officer has failed to join the service and thereby making it a fit case to be considered under Rule 7 (2 ) ( a ) of the All India Services ( Leave ) Rules , 1955;
11. And now, therefore , the President , in exercise of the powers conferred by the provisions of rule 7 (2) ( a) of the All India Services ( Leave) Rules , 1955 , is pleased to treat Shri Y. P. Singh , IPS (MH: 85) as deemed to have resigned froin the Indian Police Service with effect from 16th February, 2004. He shall also stand relieved from the Indian Police Service from that date and it is notified accordingly.
