का.नि.आ. 66.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सेना इंजीनियर सेवा (गैर औद्योगिक वर्ग 3 और 4 पद ) भर्ती नियम , 1971 को , जहां तक उनका संबंध एम.टी. ड्राइवर श्रेणी 2 और एम.टी. ड्राइवर श्रेणी 1 से है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , सेना इंजीनियर सेवा में सिविलियन मोटर ड्राइवर के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ (1 ) इस नियमों का संक्षिप्त नाम सेना इंजीनियर सेवा ( सिविलियन मोटर चालक) भर्ती नियम , 2008 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना.-ये नियम इन नियमों से उपाबद्ध अनूसूची में यथाविनिर्दिष्ट पदों को लागू होंगे ।
3. पद संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ 4 में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति, आयु-सीमा , अर्हताएं, आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
5. निरर्हता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगाः
[PART II -SEC. 4] परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 : आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम , मेघालय , अरुणाचल प्रदेश, मिजोरम , मणिपुर , नागालैण्ड, त्रिपुरा , सिक्किम, जम्मूकश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )
टिप्पण 2 : उन पदों के संबंध में जिन पर रोजगार कार्यालयों के माध्यम से नियुक्तिकी जानी है आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है । 257 [भाग II-खण्ड 4 ]

प्रोन्नति : ऐसा सिविलियन मोटर चालक ( सांधारण श्रेणी ) जिसने उस श्रेणी में न्यूनतम 9 वर्ष सेवा की हो और सिविलियन मोटर चालक श्रेणी-2 का व्यवसाय परीक्षण उत्तीर्ण किया हो ।
टिप्पण : जहांऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी की ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

S.R.O. 66.--In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Military Engineer Services (Non-Industrial , Class III and IV Posts) Recruitment Rules , 1971 , in so far as they relate to the post of MT Driver Grade II and MT Driver Grade I except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts ofCivilian Motor Driver in the Military Engineer Services , namely :-
1. Short title and commencement. ( 1 ) These rules may be called the Military Engineer Services (Civilian Motor Drivers) Recruitment Rules , 2008.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application . These rules shall be applicable to the post( s) as specified in the Schedule annexed to these rules .
3. Number of post, classification and scale of pay. The number of the said posts , their classification and the scales of pay attached thereto shall be as specified in Columns 2 to 4 of the Schedule annexed to these rules.
4.Method of recruitment, age- limit and other qualifications , etc. The method of recruitment , age - limit and other matters realțing to the said posts shall be as specified in Column 5 to 14 of the schedule aforesaid.
5. Disqualification.-No person,
(a) who has entered into or contracted a marriage with a person having a spouse living , or
(b) who, having a spouse living, has entered into or contracted a marriage with any person ,
shall be eligible for appointment to any of the said posts.

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules .
6. Power to relax.-Where the Central Government is of opinion that it is necessary or expedient to do so , it may by order, and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
7. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the other Backward Classes , Ex- servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard .

का.नि.आ. 68.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और तटरक्षक ( सहायक सिविलियन स्टाफ अधिकारी ) भर्ती नियम , 2000 को, जो भारत के राजपत्र के भाग II खण्ड 4 में सं. का.नि. आ. 282 तारीख 13 नवम्बर , 2000 द्वारा प्रकाशित किए गए थे , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , रक्षा मंत्रालय के अधीन तटरक्षक संगठन में अनुभाग अधिकारी ( सहायक सिविलियन स्टाफ अधिकारी का परिवर्तित नाम प्रणाली ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस नियमों का संक्षिप्त नाम तटरक्षक संगठन अनुभाग अधिकारी भर्ती नियम , 2008 है । (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं, आदि. उक्त पदों पर भर्ती की. पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति ,-
(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 266

[PART II-SEC. 4 ] 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
: 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिछड़ा वर्ग , भूतपूर्व सैनिकों और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति: केन्द्रीय सरकार के ऐसे अधिकारी :
(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या
(ii ) जिन्होनें मूल काडर या विभाग में 5500-9000 रु. के वेतनमान या समतुल्य में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् तीन वर्ष की सेवा की हो; और
(ख) जिनके पास प्रशासन , स्थापना और लेखा संबंधी विषयों में तीन वर्ष का
अनुभव है: -
पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्तिव्यक्त प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।
(प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि भी है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्तिद्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। )

In exercise of the powers conferred by the proviso to article 309 ofthe Constitution and in supersession ofthe Coast Guard Assistant Civilian Staff Officer Recruitment Rules, 2000 , published in the Gazette of India , Part II , Section 4 vide number S.R.O. 282, dated the 13th November, 2000 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Section Officer ( changed nomenclature of Assistant Civilian Staff Officer) , in Coast Guard Organisation under the Ministry of Defence, namely :---
1. Short title and commencement.-( 1 ) These rules may be called the Coast Guard Section Officer Recruitment Rules, 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2.Number ofposts , classification and scale of pay. The number ofthe said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3.Method of recruitment, age- limit, other qualifications , etc.-The method ofrecruitment, age- limit, qualifications and other matters realting to the said posts shall be as specified in column (5) to ( 14) of the said schedule.
4. Disqualification.-No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living , or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it mayby order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any ofthe provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall effect reservations , relaxation ofage - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the other Backward Classes, the Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

पुनर्नियोजन की दशा में - दो वर्ष (ii ) उसे भंडार गृह के कर्तव्यों को विशेष रूप से सुरक्षा और अग्नि पूर्वावधानियों का पैंकिंग सामग्रियों तथा बढ़ई के सामान्य उपयोग में आरी , हथौड़ा , जम्बर, छैनी , बाठ और माप जैसे बढ़ई के आवश्यक औजारों का ज्ञान होना चाहिए । उसे पैकेजों में भण्डार चिन्हों और चिन्हांकनों को पहचानने की योग्यता होना चाहिए या पैकर ( ए.एस.सी. ) और चैकर ( इंजी. ) के व्यवसाय के और सेना के समतुल्य व्यवसाय के तथा नौसेना के और वायुसेना के समतुल्य व्यवसाय के सेवारत भूतपूर्व सैनिकों के सामान को पहचानने की योग्यता होनी चाहिए ।

प्रतिनियुक्ति/पुनर्नियोजन सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा , जो एक वर्ष की अवधि के भीतर सेवानिवृत होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है ; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है।
यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

S.R.O. 69. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the National Cadet Corps Directorates Packers Recruitment Rules , 2003 , namely :-
1. ( 1 ) These rules may be called the National Cadet Corps , Directorates Packers Recruitment (Amendment) Rules, 2008 .

( ii) Must have knowledge of store house duties with particular reference to secruity and fire precautions , packing meterials and use of carpenter's essential tools such as saw , hammer , nail puller , chisel , weights and measures in common use . Be able to identify store signs and markings on packages , or serving/ex- service -men belonging to the trade of Packer(ASC) and Checker (Engrs) and equivalent of Army and those of equiv- alent trades in the Navy and Air Force .

Persons working in similar, equivalent or higher grades in other organi- sations of Ministry of Defence and possessing the qualifications as specified in column (8) .
ForEx - servicemen :
Deputation/re-employment : The Armed Forces personnel due to retire orwho are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered. Such persons will be given deputation terms up to the date onwhich they are due for release from the Armed Forces , thereafter they may be continued on re - employment.
