सा.का.नि. 173.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पुलिस अनुसंधान और विकास ब्यूरो ( वैज्ञानिक सहायक और प्रयोगशाला सहायक समूह ' ग ' पद ) भर्ती नियम , 1988 को, जहां तक उनका संबंध वैज्ञानिक सहायक और प्रयोगशाला सहायक के पदों से है , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लांप किया गया है, गृह मंत्रालय , न्यायालियक विज्ञान निदेशालय में वैज्ञानिक सहायक और प्रयोगशाला सहायक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्

1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इस नियमों का संक्षिप्त नाम न्यायालियक विज्ञान निदेशालय ( वैज्ञानिक सहायक और प्रयोगशाल सहायक समूह ' ग ' पद) भर्ती नियम, 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना, ये नियम , इन नियमों से उपाबद्ध अनुसूची में विनिर्दिष्ट नियमों पर लागू होंगे ।

3. पद-संख्या, वर्गीकरण और बेतनमाम उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि, उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता, वह व्यक्ति ,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(४) जिसने अभी पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जोकारण हैं उन्हें लेखबद्ध करकै, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावन, आदेश द्वारा शिथिल कर सकेंगी । 7. व्यावृत्ति नियमों को कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतां एर प्रभात नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग कं व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

दो वर्ष ( केवल सीधी भर्ती हुए व्यक्तियों के लिए ) किसी मान्यताप्राप्त विश्वविद्यालय से विज्ञान स्नातक स्टर पर एक विषय के रूप में रसायनशास्त्र या भौतिक शास्त्र के साथ , रसायनशास्त्र या जीव रसायन या औषधज्ञान या भेषजिकी या न्यायालियक विज्ञान में ( रसायनशास्त्र, विष- विज्ञान, स्वापक शास्त्र, विस्फोटक, जीव रसायन या औषधज्ञान जैसे किसी न्यायालियक रसायनशास्त्र संबद्ध विषयों में विशेषज्ञता सहित ) स्नातकोत्तर उपाधि या समतुल्य ।

प्रवर्ग 2 -शारीरिक विज्ञान :

किसी मान्यताप्राप्त विश्वविद्यालय से विज्ञान स्नातक स्तर पर एक विषय के रूप में भौतिक शास्त्र या गणित के साथ , भौतिक शास्त्र या गणित या जैव भौतिकी या धाद- शास्त्र या प्रयुक्त भौतिक शास्त्र या कम्प्यूटर विज्ञान या न्यायालियक विज्ञान में ( भौतिक शास्त्र या अस्त्र विज्ञान या वाद-शास्त्र में विशेषज्ञता सहित ) स्नातकोत्तर उपाधि या समतुल्य ।

प्रवर्ग ३ -शारीरिक विज्ञान :

किसी मान्यताप्राप्त विश्वविद्यालय से विज्ञान स्नातक स्तर पर एक विषय के रूप में वनस्पति विज्ञान या प्राणिविज्ञान के साथ आनुषांशिकी में या विज्ञान स्नातक, स्तर पर वनस्पति विज्ञान या प्राणिविज्ञान के साथ न्यायालियक विज्ञान ( डी.एन.ए. या जैव रसायन आदि में विशेषज्ञता सहित ) में, या विज्ञान स्नातक स्तर पर एक विषय के रूप में बनस्पति विज्ञान या प्राणिविज्ञान के साथ शारीरिक नृविज्ञान में या विज्ञान स्नातक स्तर पर एक विषय के रूप में वनस्पति विज्ञान या प्राणिविज्ञान के साथ जैव रसायन विज्ञान में या विज्ञान स्नातक स्तर पर एक विषय के रूप में वनस्पति विज्ञान या प्राणिविज्ञान के साथ बनस्पति विज्ञान या प्राणिविज्ञान या सूक्ष्मजीवी विज्ञान या जैव प्रौद्योगिकी में स्नातकोत्तर उपाधि या समतुल्य ।

प्रोन्नति : न्यायालियक विज्ञान निदेशालय के अधीन केंद्रीय न्यायालियक प्रयोगशालाओं में ऐसे प्रयोगशाला सहायक , जिन्होंने नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की है ।

( 1 ) 50 प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति, दोनों के न हो सकने पर सीधी भर्ती द्वारा; और

( ii ) 50 प्रतिशत सीधी भर्ती द्वारा 1

प्रतिनियुक्ति : केंद्रीय सरकार या राज्य सरकारों के अधीन ऐसे अधिकारी-

(क ) ( 1 ) जिन्होंने सदृश पद धारण किया हुआ; या

( ii ) जिन्होंने 4500-7000 रुपए या समतुल्य के वेतनमान के पद पर तीन वर्ष नियमित सेवा की है ; या

(iii ) जिन्होंने 4000-6000 रुपए या समतुल्य के वेतनमान के पद पर आठ वर्ष Klis

G.S.R. 173. -In exercise ofthe powers conferred by the proviso to article 309 of the Constitution and in superses- sion of the Bureau of Police Research and Development (Scientific Assistants and Laboratory Assistants--Group 'C' posts) Recruitment Rules , 1988 , in so far as they relate to the posts of Scientific Assistants and Laboratory Assistants except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Scientific Assistants and Laboratory Assistants in the Directorate of Forensic Science, Ministry of Home Affairs, namely : -

1. Short title and commencement .( 1 ) These rutes may be called the Directorate of Forensic Science ( Scientific Assistants and Laboratory Assistants Group ' C' posts ) Recruitment Rules , 2008 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application. These rules shall apply to the rules specified in the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4) of the said schedule.

4.Method of recruitment, age limit , qualifications , etc.-The method of recruitment , to the said posts , age limit , qualifications and other matters relating to the said post shall be as specified in columns ( 5 ) to ( 14 ) of the said Schedule.

5. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; o 819

(b) who, having a spouse living , has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of these provisions ofthese rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex-servicemen and other special categories of persons in accordancewith the orders issued by the Central Government from time to time in this regard.

सा.का. नि. 175.-- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, होम्योपैथिक भेषज संहिता प्रयोगशाला, गाजियाबाद में अनुसंधान अधिकारी ( प्रशिक्षण ) ( समूह - ख ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम आयुर्वेद, योग व प्राकृतिक चिकित्सा , यूनानी , सिद्ध एवं होम्योपैथो विभाग , होम्योपैथिक भेषजसहिता प्रयोगशाला , गाजियाबाद अनुसंधान अधिकारी ( प्रशिक्षण ) ( समूह- ख पद। भर्ती नियम , 2008 है । ( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसके वेतनमान वे होंगे , जो इस नियम की संलग्नक अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु सीमा , अन्य अहंताएं आदि उक्त पद पर भर्ती की पद्धति , आयु सीमा , अहंताएं और उक्त पद में संबंधित अन्य बातें वे होंगी ओ उक्त पूर्वोक्त अनुसू‌चो के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति.....

( क ) जिसने ऐसे व्यक्ति से , जिसका पति या जिसको पत्नी जीवित है , विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वोकायं विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों क बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की आई चात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका कंट्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े त्रर्गों भूनपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ख) स्तम्भ ४ के अधीन यथानिर्धारित शैक्षिक अर्हताएं रखते हों-

ऐसे विभागीय ज्येष्ठ वैज्ञानिक सहायक ( रसायनशास्त्र ) जिन्होंने 5500-9000 रुपये को उस श्रेणी में 3 वर्ष नियमित सेवा की है। जिसके अंतर्गत राष्ट्रीय स्तर कं प्रशिक्षण कार्यक्रम के आयोजन में एक वर्ष का अनुभव सम्मिलित है , का भी विचार किना जाएगा और यदि वह उस पद की नियुक्ति के लिए चयन होता है तो प्रोन्नति द्वारा भरा गया समझा जाएगा ।

फीडर श्रेणी में विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में हैं उन्हें प्रतिनियुक्ति संबंधी नियुक्ति हेतु विचार करने के लिए पात्र नहीं माना जाएगा । इसी प्रकार प्रतिनियुक्ति को भी प्रोन्नति द्वारा नियुक्ति के संबंध में विचार करने हेतु पात्र नहीं माना जाएगा ।

केंद्रीय सरकार के उसी अथवा किसी अन्य संगठन विभाग में इस नियुक्ति के तत्काल पूर्ववर्ती धारित अन्य बाह्य संवर्ग पद में प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति की अवधि सामान्य रूप से तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति हेतु अधिकतम आयु सीमा आवेदन की प्राप्ति की समाप्ति की तारीख से 56 वर्षों से अधिक नहीं होगी ।

3. Method of recruitment, age limits and other qualifications , etc. The method of recruitment, age limits, qualifications and other matters relating to the said post shall be as specified in Columns (5 ) to ( 14 ) of the said Schedule .

4. Disqualification . No person ,—

(a)who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation ofthis rule.

5. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.-Nothing in these rules shall affect reservations , relaxation or age limit and other required to be provided for the Scheduled Castes, Scheduled Tribes , Other Backward Classes, Ex- Servicemen and other special catego- ries ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.त्रि. 176. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय क्षयरोग संस्थान, बंगलौर मर्ती नियम, 1975 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने कालोप किया गया है , राष्ट्रीय क्षयरोग संस्थान , बंगलौर में ज्येष्ठ लोक स्वास्थ्य नर्स के समूह " ख " पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय क्षयरोग संस्थान, बंगलौर (ज्येष्ठ लोक स्वास्थ्य नर्स समूह 'ख' पद ) भर्ती नियम , 2008 है ।

( 2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनपान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरहंता, वह व्यक्ति ,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

[PART N-SEC.3 ( i) ] परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां कंन्द्रीय सरकार को यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस्ट संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनीअर्हक पात्रता सेवः पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अईक पात्रता सेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से . इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित 831 [ भाग II- खण्ड ( 1) ]

जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति : केन्द्रीय सरकार के अधीन ऐसे अधिकारी:

( क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या

( ii ) जिन्होंने मूल काडर या विभाग में 5500-9000 रु. या समतुल्य के वेतनमान में नियमित आधार पर उस पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष की सेवा की हो; और

(ख ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों:-

आवश्यक:

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से नर्सिंग में उपाधि या समतुल्यः

(ii ) भारत की नर्सिंग परिषद् के साथ रजिस्ट्रीकृत हो;

( iii ) लोक स्वास्थ्यनर्सिंग में प्रमाणपत्र हो;

( iv ) किसी सरकारी या प्राइवेट चिकित्सालय में स्टाफ नर्स या लोक स्वास्थ्यके

रूप में पांच वर्ष का अनुभव ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक महीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 176- In exercise ofthe powers conferred by the proviso to article 309 ofthe Constitution and in suprersession ofthe National Tuberculosis Institute , Bangalore Recruitment Rules , 1975, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the Group "B" post ofSenior Public Health Nurse in the National Tuberculosis Institute , Bangalore , namely:

1. Short title and commencement ( 1 ) These rules may be called the National Tuberculosis Institute, Bangalore (Senior Public Health Nurse Group B post) Recruitment Rules,2008.

2. Number of posts , classification and scale of pay. The number of post. its classification and the seale of pay attached thereto , shall be as specified in Columns (2 ) to ( 4) of the Schedule annexed to these rules .

3.Method of recruitment , age limit and qualifications, etc.-The method of recruitment, age limit qualification and the other matters relating to the said posts shall be as specified in columns (5 ) to ( 14 ) of the said Schedule.

4. Disqualification . No persons-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living has entered into or contracted a marriage with any person .

shall be eligible for said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so. exempt aus person from the operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may,by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the other Backward Classes , Ex- servicemen , and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

हाँ, केवल सीधे भर्ती किए गए व्यक्तियों के लिए , परंतु यह सुविधा तब अनुज्ञेय नहीं होगी , यदि ऐसे सीधे भर्ती किए जाने वाले व्यक्ति ने महानियंत्रक के पद पर नियुक्त होने से पूर्व केंद्रीय सरकार या किसी, राज्य सरकार या संघ राज्य क्षेत्र प्रशासन या स्वायत निकाय के अधीन ऐसे पद धारण किया है जिसमें उसे केंद्रीय सिविल सेवा ( पेंशन) नियम, 1972 के नियम 30 के अधीन सेवा में जोड़े गए वर्षों का फायदा दिया गया है या उसे केंद्रीय या राज्य सरकार या संघ राज्य क्षेत्र प्रशासन या स्वायत निकाय के अधीन भारत सरकार की सेवा में की गई सेवा की अवधि संगणित करने का फायदा दिया गया है ।

परंतु उसी अधिकारी को फायदा अनुज्ञेय होगा जो सरकारी सेवा में 31 दिसंबर , 2003 को या उससे पूर्व आया था और जो अपनी अधिवर्षिता की तारीख तक लगातार केंद्रीय सिविल सेवा ( पेंशन ) नियम, 1972 द्वारा शासित होते रहता है ।

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं (8)

( i ) किसी मान्यताप्राप्त विश्वविद्यालय , संस्थान से खनन इंजीनियरी या खनिज इंजीनियरी या खनिज प्रसंस्करण या रसायन इंजीनियरी या रसायन प्रौद्योगिकी या धातुकर्म विज्ञान में स्नातक उपाधि या समतुल्य ।

किसी मान्यताप्राप्त विश्वविद्यालय से भूगर्भ विज्ञान , अनुप्रयुक्त भूगर्भ विज्ञान , अयस्क ड्रेसिंग या रसायन या भौतिकी में स्नातकोत्तर उपाधि या समतुल्य । ( ii ) धातुमय खानों या धातुमय खानों के संबंध में कार्य करने वाले सरकारी विभाग में पर्यवेक्षीय हैसियत में इक्कीस वर्ष का अनुभवः

अयस्क ड्रेसिंग या खनिज परिष्करण या खनिज संचस कार्य का संचालन करने वाले किसी प्रयोगशाला में या संयंत्र में अनुसंधान कार्य को मार्गदर्शन करने का इक्कीस वर्ष का अनुभव ।

टिष्पपा 1 : अर्हताएं , अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक पात्रता संवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अहंक/ पात्रता सेवा , अपेक्षित अर्षक पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंन ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर लो है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

1. Short title and commencement.(1 ) These rules may be called the Ministry of Mines, Indian Bureau ofMines.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number ofposts , classification and scale of pay. The number of posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4) ofthe Schedule annexed to these rules .

4.Disqualification.-No person,-

(a ) who has entered into or contacted a marriage with a person having a spouse living. or ( h ) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said post:

सा.का. नि. 179 ,- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय भू- वैज्ञानिक सर्वेक्षण , जिसके अंतर्गत खोज खंड ( वर्ग । और वर्ग 2 पद ) भी सम्मिलित हैं, भर्ती नियम, 1967 को, जहां तक उनका संबंध ज्येष्ठ उप महानिदेशक ( वित्त ) के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है, खान मंत्रालय , भारतीय भू- वैज्ञानिक सर्वेक्षण में उप महानिदेशक ( विस ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस नियमों का संक्षिप्त नाम खान मंत्रालय , भारतीय भू- वैज्ञानिक सर्वेक्षण , उप महानिदेशक (वित्त ) , समूह ' क ' पद भर्ती नियम , 2008 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं , आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्द्धता. वह व्यक्ति-

(क ) जिसने ऐसे व्यक्ति से , जिसका पत्ति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेंगी ।

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति

प्रतिनियुक्ति : केन्द्रीय सरकार/ राज्य सरकार संघ राज्यक्षेत्रों के अधीन ऐसे अधिकारी. जिसमें अखिल भारतीय सेवा के अधिकारी भी सम्मिलित हैं :-…

( क ) ( i ) जिन्होनें मूल काडर/विभाग में निमित आधार पर सदृश पद धारण किया

हुआहै; या

( ii ) जिन्होनें मूल काडर/विभाग में 16,400 20000/- रुपए या समतुल्य के वेतनमान आले पदों में नियमित अग्धार पर नियुक्ति के पश्चात् उस श्रेणी में दो वर्ष संत्रा की हो; या

( iis ) जिन्होनें मूल काडर या विभाग में 14.300-08.300/- रुपए या समतुल्य अं वेतनमान वाले पदों में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तोम वर्ष सेवा की हो; और

( ख ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों:-

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक उपाधि या समतुल्य; और

( ii ) वित्त प्रबंध, बजट तैयार करने , स्कीम के विश्लेषण और मंजूरी तथः अय्य प्रस्तावों , लेखा और स्थापना मामलों में । व्ये का अनुभव ।

टिप्पण 1 : प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत कंन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से टीक पहले धारित किसी अन्य काडर बाइस पद पर प्रतिनियुक्ति की अवधि भी है , साधारणतया पांच वर्ष से अधिक नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 179. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Geological Survey of India including Exploration Wing (Class I and Class II posts ) Recruitment Rules , 1967, in so far as they relate to the post of Senior Deputy Director General (Finance ), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the post ofDeputy Director General (Finance ) in the Ministry of Mines , Geological Survey of India, namely:

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Mines , Geological Survey of India, Deputy Director General (Finance) , Group ' A ' Post, Recruitment Rules , 2008.

(2)They shall come into force on the date of their publication in the Official Gazette.

2.Number of posts , classification and scale of pay. The number ofthe said posts , its classification and the scale of pay attached thereto , shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3.Method of recruitment, age-limit, qualifications , etc.-The method of recruitment, age-limit, qualifications and other matters realting thereto shall be as specified in columns (5) to ( 14) of the said Schedule.

4. Disqualification . No person,

(a)who has entered into or contracted a marriage with a person having a spouse living, or (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category ofpersons .

6. Saving. Nothing in these rules shall effect reservations, relaxation of age- limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

( ii ) 15 years experience ofmanagement of finance, budgeting, analysis and sanction of schemes and expenditure porposals, accounts and establishment matters.

Note : Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization/ department ofthe Central Government shall not exceed five years .

Note 2 : The maximum age - limit for appointment by deputation shall be not exceeding 56 years , as on the closing date of the receipt of applications .
