सा.का.नि. 212.-भारतीय बॉयलर विनियम , 1950 का और संशोधन करने के लिए कतिपय विनियमों का प्रारूप , जिसे भारतीय बॉयलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 31 की उप - धारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र, भाग II , खंड 3 , उपखंड ( i ) , तारीख 12 अप्रैल , 2008 में भारत सरकार के वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) ( केन्द्रीय बॉयलर बोर्ड ) की अधिसूचना सं. सा.का.नि. 62 , तारीख 10 अप्रैल , 2008 द्वारा प्रकाशित किया गया था , जिसमें ऐसे उन व्यक्तियों से जिनके उनसे प्रभावित होने की संभावना है , उस तारीख से जिसको उक्त राजपत्र अधिसूचना की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति तक आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां जनता को तारीख 5 जून , 2008 को उपलब्ध करा दी गई थीं;
और इस अधिसूचना में अंतर्विष्ट संशोधनों की बाबत विनिर्दिष्ट अवधि के भीतर कोई आक्षेप और सुझाव प्राप्त नहीं हुए हैं;
अतः , अब केन्द्रीय बॉयलर बोर्ड, भारतीय बॉयलर अधिनियम , 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बॉयलर विनियम, 1950 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्:-

G. S. R. 212.---Whereas , certain draft regulations further to amend the Indian Boiler Regulations , 1950 were published , as required by sub- section ( 1 ) of Section 31 of the Indian Boilers Act, 1923 (5 of 1923 ) , in Part- II , Section 3 , sub- section (i ) of the Gazette of India dated the 12th day of April , 2008 , vide notification of the Government of India in the Ministry of Commerce and Industry ( Department of Industrial Policy and Promotion ) (Central Boilers Board) , number G.S.R. 62, dated the 10th day of April , 2008 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of forty- five days from the date on which the copies of the said Gazette notification were made available to the public;
And whereas, the copies of the said Gazette were made available to the public on the 5th June, 2008 ;
And whereas , no objections or suggestions have been received within the specified period in respect of the ameridments contained in this notification ;

Now, therefore, in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely :-
1. ( 1 ) These regulations may be called the Indian Boiler (Second Amendment ) Regulations, 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Indian Boiler Regulations , 1950 , in regulation 47, for clause (iv) , the following shall be substituted, namely:--

सा.का.नि. 213. केन्द्रीय सरकार , भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 27क , की उपधारा ( 2 ) के खंड (क ) , खंड ( ख ) , खंड ( ग ) और खंड ( घ ) के साथ पठित धारा 28क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय बॉयलर बोर्ड ( सदस्यों का नामनिर्देशन ) नियम, 2003 को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय बॉयलर बोर्ड ( सदस्यों का नामनिर्देशन ) नियम , 2008 है । ( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं- इन नियमों में जब तक कि संदर्भ से अन्यथा परिभाषित न हो---
(क) " अधिनियम " से भारतीय बॉयलर अधिनियम , 1923 ( 1923 का 5 ) अभिप्रेत है ;
( ख ) " बोर्ड" से अधिनियम की धारा 27क के अधीन गठित केन्द्रीय बॉयलर बोर्ड अभिप्रेत है ;
(ग) " तकनीकी सलाहकार " से अधिनियम की धारा 4क की उपधारा ( 1 ) के अधीन नियुक्त तकनीकी सलाहकार अभिप्रेत है;
(घ) " सदस्य" से बोर्ड का सदस्य अभिप्रेत है;

3. पदेन अध्यक्ष- भारत सरकार का सचिव , जो केन्द्रीय सरकार के विभाग का भारसाधक है , जिसके पास बोर्ड का प्रशासनिक नियंत्रण है, अधिनियम की धारा 27क की उपधारा (2 ) के खंड ( क) के अनुसार पदेन अध्यक्ष होगा ।
4. पदेन सदस्य सचिव- तकनीकी सलाहकार, अधिनियम की धारा 27क की उपधारा ( 2 ) के खंड ( घ ) के अनुसार सदस्य सचिव होगा ।
5. अन्य सदस्यों के नामनिर्देशन की रीति- ( i ) ज्येष्ठ तकनीकी अधिकारी जो बॉयलरों के निरीक्षण और परीक्षा से अवगत हो जिससे प्रत्येक राज्य की सरकार द्वारा ( संघ राज्यक्षेत्र से भिन्न ) अधिनियम की धारा 27क की उपधारा ( 2 ) के खंड ( ख ) के अनुसार नामनिर्दिष्ट किया जाए ;
( ii ) ऊपर उपनियम ( i ) में नामनिर्दिष्ट समान संख्या में अन्य सदस्य जो 28 से अधिक नहीं होंगे , अधिनियम की धारा 27 क की उपधारा ( 2 ) के खंड ( ग ) के अनुसार निम्नलिखित रीति में नामनिर्दिष्ट किए जाएंगे :-
(क ) भारी उद्योग विभाग का प्रतिनिधित्व करने के लिए एक सदस्य जिसे भारी उद्योग और लोक उद्यम मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(ख ) इस्पात विभाग का प्रतिनिधित्व करने के लिए एक सदस्य जिसे इस्पात मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(ग ) पेट्रोलियम और प्राकृतिक गैस मंत्रालय का प्रतिनिधित्व करने के लिए एक सदस्य जिसे उस मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(घ ) श्रम मंत्रालय का प्रतिनिधित्व करने के लिए एक सदस्य जिसे उस मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(ड. ) सूक्ष्म , लघु और मध्यम उद्यम मंत्रालय का प्रतिनिधित्व करने के लिए एक सदस्य जिसे उस मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(च ) केन्द्रीय विद्युत प्राधिकरण का प्रतिनिधित्व करने के लिए एक सदस्य जिसे विद्युत मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(छ) भारतीय मानक ब्यूरो का प्रतिनिधित्व करने के लिए एक सदस्य जिसे ब्यूरो के परामर्श से नामनिर्दिष्ट किया जाए ;
(ज) संघ राज्यक्षेत्रों का प्रतिनिधित्व करने के लिए एक सदस्य जिसे गृह मंत्रालय के परामर्श से नामनिर्दिष्ट किया जाए ;
(झ) कानफेडरेशन ऑफ इंडियन इंडस्ट्री या फेडरेशन ऑफ इंडियन चैंबर्स ऑफ कामर्स एंड इंडस्ट्री या एसोसिएटिड चैंबर्स ऑफ कामर्स एंड इंडस्ट्री ऑफ इंडिया से एक सदस्य ;
(अ ) बॉयलर मैन्यूफेक्चर एसोसिएशन से एक सदस्य ;
(ट) बॉयलर कंपोनेंट मेन्यूफेक्चरर एसोसिएशन से एक सदस्य ;
(ठ ) बॉयलर और बॉयलर कंपोनेंट मेन्यूफेक्चरिंग इंडस्ट्री का प्रतिनिधित्व करने के लिए चार सदस्य ;
(ड) राष्ट्रीय प्रयोगशाला का प्रतिनिधित्व करने के लिए दो सदस्य;
(ढ) इंजिनियरी परामर्शी संगठन/निरीक्षण अभिकरण का प्रतिनिधित्व करने के लिए दो सदस्य ;
( ण ) बॉयलर यूजर उद्योग का प्रतिनिधित्व करने के लिए चार सदस्य ; और
(त ) किसी अन्य हित का प्रतिनिधित्व करने के लिए पांच से अनधिक सदस्य जो केन्द्रीय सरकार की राय में जिनका बोर्ड पर प्रतिनिधित्व होना चाहिए ।
6. नाम निर्देशित सदस्यों की पदावधि ( 1 ) नियम 5 के अधीन नामनिर्देशित प्रत्येक सदस्य राजपत्र में अधिसूचना के प्रकाशन की तारीख से सामान्यतया तीन वर्ष की अवधि के लिए केन्द्रीय बॉयलर बोर्ड के परामर्श के लिए तब तक पद धारण करेगा जब तक कि केन्द्रीय सरकार द्वारा अन्यथा निदेश न दिया जाए ।
(2) नामनिर्देशित सदस्य , बोर्ड के अध्यक्ष को पत्र संबोधन करके अपने पद से त्याणपत्र दे सकेगा ।

In exercise ofthe powers conferred by Section 28A reaed with clause ( a) , (b) , ( c) and (d) of sub -section 2 of Section 27A of the Indian Boilers Act, 1923 (5 of 1923 ) , and in supersession of the Central Boilers Board (Nomination of Members ) Rules , 2003 , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules , namely:-
1. Short title and commencement.- ( 1 ) These rules may be called the Central Boilers Board (Nomination of Members) Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions . In these rules , unless the context otherwise requires , -
(a) " Act" means the Indian Boilers Act , 1923 (5 of 1923 ) ;
(b) "Board " means the Central Boilers Board constituted under Section 27A of the Act ;
(c) "Technical Adviser" means the Technical Adviser appointed under sub - section ( 1 ) of section 4A of the Act;
(d) "member " means a member of the Board.
3.Ex-officio Chairperson.- The Secretary to the Government of India incharge of the Department of the Central Government having administrative control of the Board shall be the ex - officio Chairperson as per clause (a) of the sub- section (2) of section 27A of the Act .
4.Ex- officioMember - Secretary.- The Technical Advisor shall be the ex - officio Member - Secretary as per clause (d) of the sub-section (2 ) of Section 27A of the Act .
5. Manner of nomination of other members .-( i) a senior technical officer conversant with the inspection and examination ofboilers to be nominated by the Government of each State (other than Union territory) as per clause (b) ofsub- section ( 2 ) of Section 27A of the Act;
(ii) Equal number of other members nominated in sub - rule (i ) above , not exceeding twenty eight , shall be nominated as per clause (c) of sub - section (2) of section 27A of the Act in the following manner: -
(a) one member to represent Department of Heavy Industry to be nominated in consultation with the Ministry of Heavy Industries and Public Enterprises;
(b) one member to represent Department of Steel to be nominated in consultation with the Ministry of Steel ;
(c) one member to represent Ministry of Petroleum and Natural Gas to be nominated in consultation with that Ministry;
(d) one member to represent Ministry of Labour to be nominated in consultation with that Ministry;
(e) one member to represent Ministry of Micro , Small and Medium Enterprises to be nominated in consultation with that Ministry;
(f) one member to represent Central Electricity Authority to be nominated in consultation with Ministry of Power;
(g) one member to represent the Bureau of Indian Standards to be nominated in consultation with that Bureau;

सा.का.नि. 214. राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इंदिरा गांधी राष्ट्रीय वन अकादमी ( हिन्दी प्रशिक्षण अधिकारी ) भर्ती नियम , 1991 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है , पर्यावरण और वन मंत्रालय के अधीन इंदिरा गांधी राष्ट्रीय वन अकादमी , प्रशिक्षण अधिकारी हिन्दी के पद पर भर्ती की पद्धति का विनिमय करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1) इन नियमों का संक्षिप्त नाम इंदिरा गांधी राष्ट्रीय वन अकादमी ( हिन्दी प्रशिक्षण अधिकारी ) भर्ती नियम, 2008 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद-संख्या , वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु-सीमा एवं अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है कि ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 971 [ भाग II- खण्ड 3 ( i) ]

1. बाहरी व्यक्तियों के साथ 5000-8000/- रु. वेतनमान वाले ऐसे विभागीय हिन्दी अनुवादक के संबंध में भी विचार किया जाएगा जिसने उस श्रेणी में छः वर्ष नियमित सेवा कर ली है और इस पद पर नियुक्ति के लिए उसका चयन होने की दशा में, यह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

G.S.R. 214. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Indira Gandhi National Forest Academy, ( Training Officer Hindi ) Recruitment Rules , 1991 , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Training Officer Hindi in the Indira Gandhi National Forest Academy under the Ministry of Environment and Forests , namely:-
1. Short title and commencement .( 1 ) These rules may be called the Indira Gandhi National Forest Academy, (Training Officer Hindi) Recruitment Rules, 2008.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.Number of posts , classification and scale of pay. The number of the posts , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .
3. Method of recruitment, age - limit and other qualifications , etc. The method of recruitment , age- limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.
4. Disqualification .--No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
5. Power to relax .--Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order and for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required to be provided for the persons belonging to the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons , in accordance with the orders issued by the Central Government, from time to time in this regard.
