G.S.R. 3.-In exercise of the powers conferred by Clause (1 ) of article 299 of the Constitution, the President hereby directs that the following further amendments shall be made in the notification of the Government of India in the then Ministry of Law (Department of Legal Affairs) , number G.S.R. 585, dated the 1st day of February, 1966, namely:-

सा.का.नि. 4.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सफदरजंग अस्पताल ( वर्ग III पद ) पद भर्ती नियम , 1973 को जहां तक उनका संबंध दंत स्वास्थ्य विज्ञानी के पद से है उन बातों के सिवायु अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है , सफदरजंग अस्पताल , नई दिल्ली में दंत स्वास्थ्य चिकित्सा विज्ञानी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सफदरजंग अस्पताल , नई दिल्ली ( दंत स्वास्थ्य चिकित्सा विज्ञानी, समूह ' ग ' पद ) भर्ती नियम, 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद- संख्या, वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु- सीमा , अर्हता और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं । 4. निरर्हता.-वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

होगी । ( न कि वह अंतिम तारीख जो असम , मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड , त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )
टिप्पण 2 : रोजगार कार्यालयों के माध्यम से आवेदन करने वाले अभ्यर्थियों की दशा में आयुसीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।
परिवीक्षा की अवधि, यदि कोई हो सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं
सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

टिप्पण 1 : अनुभव संबंधी अर्हता ( अर्हताएं) सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है। [भाग II- खण्ड 3 ( i ) ]

टिप्पण 2 : संसद द्वारा पारित राजभाषा संकल्प ,
1968 के अनुसार , अभ्यर्थी ( अभ्यर्थियों ) को हिन्दी का कार्यसाधक ज्ञान होना चाहिए । यदि वह हिन्दी का ज्ञान नहीं रखता है , तो उसके लिए अपनी परिवीक्षा अवधि के दौरान उसे प्राप्त वह ज्ञान करना अपेक्षित है ।
प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

G.S.R. 4. In exercise ofthe powers conferred by the proviso to article 309 of the Constitution, and in supersession ofthe Safdarjung Hospital ( Class III posts) Recruitment Rules , 1973 , in so far as it relates to the post of Dental Hygienist , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Dental Hygienist in the Safdarjung Hospital, New Delhi , namely:
1. Short title and commencement : (1) These rules may be called the Safdarjung Hospital , New Delhi (Dental Hygienist, Group ' C' post) Recruitment Rules , 2009.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post, classification and scale of pay . The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .
3. Method of recruitment , age limit, qualification etc. The method ofrecruitment , age limit, qualification and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .
4. Disqualification .-No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any personfrom the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1: Qualifications regarding experience is relaxable at the discre- tion of the competent authority in case of candidates belonging to Scheduled Castes or Scheduled Tribes if, at any stage of selection the competent authority is of the opinion that sufficient number of candidates belonging to these com- munities possessing the requisite experience are not likely to be avail- able to fill up the post reserved for them.
Note 2: According to the Official Language Resolution, 1968 passed by the Parliament, the candidate(s) should have the working knowledge ofHindi. Ifhe has not the knowledge ofHindi, he must have to acquire the same during his probation period .

सा.का.नि. 5.-केन्द्रीय सरकार, एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम , 1969 ( 1969 का 54 ) की धारा 8 के साथ पठित धारा 67 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एकाधिकार तथा अवरोधक व्यापारिक व्यवहार आयोग ( समूह ' क ' और समूह ' ख ' पद ) भर्ती नियम, 1997 में निम्नलिखित संशोधन करती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम एकाधिकार तथा अवरोधक व्यापारिक व्यवहार आयोग ( समूह ' क ' और समूह ' ख ' ) भर्ती संशोधन नियम , 2008 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. एकाधिकार तथा अवरोधक व्यापारिक व्यवहार आयोग ( समूह ' क ' और समूह ' ख ' के पद ) भर्ती नियम , 1997 की अनुसूची में कोर्ट मास्टर से संबंधित क्रम संख्यांक 8 पर और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित को रखा जाएगाः-

प्रतिनियुक्ति: ( जिसके अंतर्गत अल्पकालिक संविदा भी है )
प्रतिनियुक्ति जिसके अंतर्गत अल्पकालिक संविदा भी है ।
केन्द्रीय सरकार या राज्य सरकारों या संघ राज्यक्षेत्रों या उच्चतम न्यायालय या उच्च न्यायालयों के अधीन ऐसे अधिकारी:-
(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है : या
( ii ) जिन्होंने मूल काडर या विभाग में 5500-9000/- रुपए या समतुल्य के वेनतमान में नियमित आधार पर उनकी नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष नियमित सेवा की है ; या
( iii ) जिन्होंने मूल काडर या विभाग में 5000-8000/ - रुपए या समतुल्य के वेतनमान में नियमित आधार पर उनकी नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष नियमित सेवा की है; या
( iv ) जिन्होंने मूल काडर या विभाग में 4500-7000/- रुपए या समतुल्य के वेतनमान में नियमित आधार पर उनकी नियुक्ति के पश्चात् उस श्रेणी में आठ वर्ष नियमित सेवा की है ; और
(ख ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखता है ।
( i ) किसी मान्यताप्राप्त विश्वविद्यालय से विधि में डिग्री या समतुल्य ।
(ii ) न्यायालय में विधि व्यवसाय और न्यायालयों के अभिलेखों , प्रदर्शों के अनुरक्षण और समन आदि जारी करने संबंधी कार्य का दो वर्ष का अनुभव ।
प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाहृय पद पर प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) की अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी ।
यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

G.S.R. 5. In exercise of the powers conferred by Section 67, read with Section 8 of the Monopolies and Restrictive Trade Practices Act, 1969 (54 of 1969), the Central Government hereby makes the following amendments in the Monopolies and Restrictive Trade Practices Commission (Group 'A' and Group ' B' ) Recruitment Amendment Rules, 1997, namely: -
1. (1) These rules may be called the Monopolies and Restrictive Trade Practices Commission (Group ' A ' and Group' B' ) Recruitment Amendment Rules ,2008 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Monopolies and Restrictive Trade Practices Commission (Group ' A' and Group ' B ' posts Recruitment Rules, 1997, in the Schedule , for the post at serial number 8 relating to Court Master , and the entries relating there to , the following shall be substitutued, namely : -

Period ofdeputation (Including Short Term Conact) including period ofdeputation (Including Short Term Contract) in another ex -cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years . 2. भारतीय खान ब्यूरो ( ज्येष्ठ फील्ड अर्दली और फील्ड अर्दली ) समूह ' घ ' पद भर्ती नियम 2008 की अनुसूची में:
(क) क्रम संख्या 1 पर वर्णित पद के सामने , स्तंभ 13 के नीचे , मद 3 के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात्:-
" 3. केन्द्रीय सरकार के किसी अन्य मंत्रालय या विभाग का समूह ' क ' अधिकारी - सदस्य" ;
(ख ) क्रम संख्या 2 पर वर्णित पद के सामने , स्तंभ 13 के नीचे , मद 3 के स्थान पर, निम्नलिखित रखा जाएगा , अर्थात्:-
" 3. केन्द्रीय सरकार के किसी अन्य मंत्रालय या विभाग का समूह ' क ' अधिकारी-- सदस्य" ।

G.S.R. 6. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Indian Bureau of Mines (Senior Field Orderly and Field Orderly), Group ' D ' Posts Recruitment Rules , 2008 , namely : -
1. ( 1) These rules may be called the Indian Bureau of Mines (Senior Field Orderly and Field Orderly), Group ' D' Posts Recruitment (Amendment) Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Schedule to the Indian Bureau of Mines (Senior Field Orderly and Field Orderly) , Group 'D ' Posts Recruitment Rules , 2008 ,--
(a) against the post appearing at serial number 1 , under column 13 , for item 3 , the following shall be substituted, namely :-
"3. Group ' A' Officer from any other Ministry or Department ofthe Central Government Member";
(b) against the post appearing at serial number 2, under column 13 , for item 3 , the following shall be substituted, namely:---
