सा.का.नि. 16. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत के महारजिस्ट्रार का कार्यालय और राज्यों एवं संघ राज्यक्षेत्रों में स्थित जनगणना कार्य निदेशकों के कार्यालयों में ( मानचित्र अधिकारी ) भर्ती नियम, 2001 में संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1) इन नियमों का नाम भारत के महारजिस्ट्रार का कार्यालय और राज्यों एवं संघ राज्यक्षेत्रों में स्थित जनगणना कार्य निदेशकोंका कार्यालय ( मानचित्र अधिकारी ) भर्ती ( संशोधन ) नियम , 2009 होगा ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. भारत के महारजिस्ट्रार का कार्यालय और राज्यों एवं संघ राज्यक्षेत्रों में स्थित जनगणना कार्य निदेशकों के कार्यालय ( मानचित्र अधिकारी ) भर्ती नियम , 2001 की अनुसूची में ,-

G. S. R. 16. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Office of the Registrar General , India and the Offices of the Directors of Census Operations in States and Union Territories (Map Officer) Recruitment Rules , 2001 , namely :-
1. ( 1 ) These rules may be called the Office of the Registrar General , India and the Offices of the Directors of Census Operations in States and Union Territories (Map Officer) Recruitment (Amendment) Rules ,2009.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Office of the Registrar General , India and the Offices of the Directors of Census Operations in States and Union Territories (Map Officer) Recruitment Rules , 2001,-
(a) under column 5, for the heading and entries , the following heading and entries shall be substituted, namely:-
'Whether selection post or non-selection post.

(b) in the heading of column 11, for the words "percentage of the post", the words "percentage of vacancies" shall be substituted;

सा.का.नि. 19.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय अनुसूचित जनजाति आयोग में लेखाकार के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इस नियमों का संक्षिप्त नाम राष्ट्रीय अनुसूचित जनजाति आयोग (लेखाकार) भर्ती नियम , 2008 है । (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद - संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा , अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
4. निरर्हताएं. वह व्यक्ति,
(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं , विवाह किया है , या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 49 [भाग II-खण्ड 3 (1) ]

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ii ) केन्द्रीय सचिवालय लिपिकीय सेवा के ऐसे व्यक्ति, जिन्होंने उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक की श्रेणियों में, कुल मिलाकर दस वर्ष सेवा की है ; और (ख ) जिन्होंने सचिवालय प्रशिक्षण और प्रबंध संस्थान या समतुल्य में रोकड़ और लेखा कार्य में प्रशिक्षण प्राप्त किया है और जिनके पास रोकड़ , लेखा और बजट कार्य का तीन वर्ष का अनुभव है , जिसके न होने पर;
आ. ( क ) केन्द्रीय सरकार के ऐसे अधिकारी जो नियमित आधार पर सदृश पद धारण किए हुए हैं और जिन्होंने सचिवालय प्रशिक्षण और प्रबंध संस्थान या समतुल्य में रोकड़ और लेखा कार्य में प्रशिक्षण प्राप्त किया है और जिनके पास रोकड़ , लेखा और बजट कार्य का तीन वर्ष का अनुभव है ; या
(ख) केन्द्रीय सरकार के किसी संगठित लेखा विभाग से अधीनस्थ लेखा सेवा उत्तीर्ण

(प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 19. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method ofrecruitment to the post of Accountant in the National Commission for Scheduled Tribes , namely :
1. Short title and commencement.---( 1) These rules may be called the National Commission for Scheduled Tribes (Accountant) Recruitment Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post, its classification and scale of pay. The number of the said post, its classification and the scale ofpay attached hereto shall be as specified in Columns 2 to 4 of the Schedule annexed to these rules .
3. Method of recruitment, age limit and other qualifications , etc.-The method ofrecruitment, age limit, qualifi- cations and other matters relating to the said post shall be as specified in Columns 5 to 14 of the said Schedule.
4.Disqualifications. No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living has entered into or contracted a marriage with any person,
shall be eligible for appointmentto the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .
5.Power to relax .--Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respectto any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 20.-मूल नियमावली के नियम 45 के प्रावधानों के अनुसरण में राष्ट्रपति सरकारी आवास आबंटन ( दिल्ली में सामान्य पूल) नियमावली , 1963 में और संशोधन करके एतद्द्वारा निम्नलिखित नियम बनाते हैं, यथा:--
1. संक्षिप्त शीर्षक व लागू होना.(i ) इन नियमों को सरकारी आवास आबंटन ( दिल्ली में सामान्य पूल ) संशोधन नियमावली, 2009 के नाम से जाना जाएगा ।
(ii ) ये नियम 1 अप्रैल , 2009 से लागू होंगे ।
2. अनु. नियम 317- बी-5 के स्थान पर प्रतिस्थापित नया अनु. नियम, सरकारी आवास (दिल्ली में सामान्य पूल ) आबंटन नियमावली , 1963 के अनुपूरक नियम , एस आर - 317- बी-5 , में निम्नलिखित नियमों को प्रतिस्थापित किया जाएगा, यथा :
आवासों का वर्गीकरण अनु, नियम- 317- बी- 5.-( 1 ) इन नियमों में जैसा अन्यथा उपबंधित है उसके सिवाय , कोई भी अधिकारी निम्न तालिका के कॉलम ( 1 ) में दर्शाए गए टाइप के आवास के आबंटन हेतु पात्र होगा/होगी:-

अखिल भारतीय सेवा के वे अधिकारी जिनका ग्रेड वेतन रु. 12,000 हो वे भी टाइप- VII आवास हेतु पात्र हो जाएंगे बशर्ते कि उनका वेतन जमा ग्रेड वेतन रु. 75000/- अथवा अधिक हो
( 2) हॉस्टल आवास :
इन नियमों में जैसा अन्यथा उपसंबंधित है उसके सिवाय , कोई भी अधिकारी निम्न तालिका के कालॅम ( 1 ) में दर्शाए गए टाइप के हॉस्टल आवास के आबंटन हेतु पात्र होगा/होगी :

सभी महिला अधिकारी , परिलब्धियों की सीमा के बगैर , पात्र होंगी स्पष्टीकरण :
(ए) किसी प्रकार के शक को दूर करने के लिए एतद्वारा यह घोषित किया जाता है कि सरकारी आवास हेतु किसी अधिकारी की पात्रता भारत सरकार में अधिकारी के मौजूदा पद के ग्रेड वेतन के अनुरूप निर्धारित की जाएगी ।
( बी ) निचले टाइपों अर्थात्टाइप- I से टाइप- IV के संबंध में पूर्विकता तारीख सरकारी सेवा में आने की तारीख होगी तथा उच्चतर टाइप हेतु वह तारीख होगी जब से अधिकारी ने केन्द्रीय सरकार में संगत ग्रेड वेतन लेना शुरू किया है । समान ग्रेडों में परस्पर वरिष्ठता- क्रम , मौजूदा प्रैक्टिस अर्थात् मूल वेतन के अनुसार निर्धारित किया जाएगा । यदि मूल वेतन भी समान है तो सेवानिवृत्ति की तारीख पर इस सिद्धांत के आधार पर विचार किया जाएगा जो अधिकारी पहले सेवानिवृत्त हो रहे हैं उन्हें बाद में सेवानिवृत्त होने वाले अधिकारी से उच्चतर वरिष्ठता क्रम में रखा जाएगा ।
(सी) जहां टाइप- V तथा टाइप- VI आवास को क्रमशः टाइप- V-ए तथा V- बी में तथा टाइप- VI-ए तथा VI-बी में वर्गीकृत नहीं किया गया है , टाइप- V हेतु सभी पात्र अधिकारियों को एक ग्रुप में तथा इसी प्रकार टाइप- VI हेतु पात्र सभी अधिकारियों को एक ग्रुप में रखा जाएगा । (डी) भारत सरकार के सचिवों तथा अपर सचिवों के मामले में दिल्ली में भारत सरकार की सेवा में आने की तारीख से उनकी अंतःपरस्पर वरिष्ठता निर्धारित की जाएगी । जिन मामलों में सेवा में आने की तारीख समान हो , सेवानिवृत्ति की तारीख उनकी परस्पर वरिष्ठता - क्रम इस सिद्धांत पर सुनिश्चित करेगी कि पहले आने वाली तारीख को बाद की तारीख से वरियता दी जाएगी । अखिल भारतीय सेवाओं ( ए आई एस ) से इतर अधिकारियों के मामले में तैनाती के स्थान को दरकिनार करते हुए उनके भारत सरकार में सेवा में आने की तिथि से अंतः परस्पर वरिष्ठता निर्धारित की जाएगी ।
( ई ) टाइप- V तथा उच्चतर आवास के पात्र अधिकारी पात्रता से निचले आवास हेतु आवेदन करने के भी पात्र होंगे बशर्ते कि ऐसा आवास टाइप- IV स्पैशल आवास से कम न हो ।
(एफ) समान सेवा के किसी कनिष्ठ बैच अधिकारी को उसी सेवा के किसी वरिष्ठ बैच अधिकारी से ऊपर वरीयता नहीं दी जाएगी ।

G.S.R. 20. In pursuance of the provisions of rule 45 of the Fundamental Rules, the President hereby makes the following rules further to amend the Allotment of Government Residences (General Pool in Delhi ) Rules , 1963 , namely :-
1. Short Title & Commencement :- ( 1 ) These rules may be called the Allotment of Government Residences (General Pool in Delhi) Amendment Rules , 2009.
(2) They shall come into force from the 1st day ofApril , 2009.
2. Substitution of new SR for SR- 317 -B- 5 .-- In the Allotment ofGovernment Residences (General Pool in Delhi ) Rules, 1963 for Supplementary Rule SR- 317-B -5 , the following rule shall be substituted, namely :-
CLASSIFICATION OF RESIDENCES SR - 317 - B-5.-( 1) Save as otherwise provided by these rules , an officer shall be eligible for allotment of a residence of the type shown in column- 1 of the Table below :--

55 Explanation:
(a) For the removal of doubt it is , hereby, declared that the eligibility of an officer for Government accommodation shall be determined as per the Grade Pay of such officer in his present post held in the Government of India, (b) the date ofpriority in respect of lower type accommodation i.e. Type -I to Type - IV shall be the date of joining the Government service and for the higher type the date on which the officer starts drawing the relevant Grade Pay in the CentralGovernment. Inter- se seniority, among the same Grade shall be determined as per the present practice i.e. the basicpay. Ifbasic pay is also the same then the date of retirement may be considered on the principle that the officer retiring earlier may be accorded higher priority over the officer retiring later,
(c) where Type - V and Type - VI accommodation has not been classified as Type -V -A and Type V-B and Type- VI -A and type-VI -B respectively, all the officers eligible for type -V shall be grouped together and similarly those eligible for type -VI shall also be grouped together ,
(d) in the case of Secretaries to the Government of India and Additional Secretaries to the Government of India, the date ofjoining in theGovernment of India at Delhi shall determine their inter - se seniority subject to ( f) below . Provided that where the date ofjoining is the same , the date ofretirement shall determine their inter - se seniority on the principle that the earlier date shall be given priority over the later date. Other than All India Services (AIS) , the date ofjoining the Government of India , irrespective of the place ofposting shall determine the inter - se seniority,
(e) officer entitled for Type-V and above accommodation shall also be eligible to apply for accommodation below entitlement subject to the condition that such accommodation shall not be below Type - IV Special accommodation, (f) nojunior batch officer of the same service shall get priority over senior batch officer of the same service .
