नई दिल्ली, दिनांक 28 जनवरी 2009 2. उक्त पदोन्नति , रिट पिटिशन ( सिविल ) सं. 1755/08 में माननीय दिल्ली उच्च न्यायालय के दिनांक 21.11.2008 के आदेश में दिये गये निदेशों के अनुपालन में किया जाता है और यह रिट पिटिशन सं. 1755/08 मेंमाननीय सर्वोच्च न्यायालय तथा विविध न्यायालयों में लम्बित मामलों में अंतिम निर्णय के अधीन होगी ।

3. यह भी स्पष्ट किया जाता है कि उक्त पदोन्नति पूर्णतया तात्कालिक आवधिक व्यवस्था के रूप में दिया जाता है तथा इसे बिना कोई कारण बताए किसी भी समय वापिस लिया रद्द किया जा सकता है । यह पदोन्नति द्वारा उन्हें नियमित नियुक्तिका कोई हक नहीं मिलता तथा तदर्थ सेवा से ग्रेड में वरीयता तथा पदोन्नति की पात्रता प्राप्त नहीं होती ।

(i) यह पद स्थायी है किन्तु वह नियुक्ति की तिथि से 2 वर्ष की अवधि के लिए परिवीक्षा पर रहेंगे जिसे सक्षम अधिकारी के विवेक पर बढ़ाया जा सकता है । परिवीक्षा की अवधि के दौरान उन्हें उन प्रशिक्षण कार्यक्रमों में भाग लेना होगा और परीक्षाएं देनी होंगी जिसे सरकार द्वारा निर्धारित किया जाएगा । परिवीक्षा अवधि के भीतर निर्धारित परीक्षा उत्तीर्ण न करने पर उन्हें यथास्थिति या तो सेवामुक्त कर दिया जाएगा या उस मूल पद पर प्रत्यावर्तित कर दिया जाएगा , जिस पद पर वे लियन पर हैं ।

(vi ) उक्त नियुक्ति के तहत अधिकारी को भारत के किसी भी भाग में तैनात किया जा सकता है ।

4. यह आबंटन अनंतिम है और यह माननीय उच्च न्यायालय , मद्रास द्वारा डब्ल्यूपी संख्या 1814-1815/2008 में जारी आदेश के विरुद्ध माननीय उच्चतम न्यायालय में दायर एसएलपी संख्या 13571-13572/ 2008 में निर्णय के अध्यधीन है ।

(vii ) सेवा की अन्य शर्तें उपर्युक्त विषय पर समय - समय पर जारी किए गए नियमों और आदेशों द्वारा अभिशासित होंगी ।
