का.नि.आ. 7. राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा लेखा विभाग ( समूह ' ग' तथा ' घ ' पद ) भर्ती नियम , 1971 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , रक्षा लेखा विभाग में अनुभाग अधिकारी ( लेखा ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ.( 1 ) इन नियमों का संक्षिप्त नाम रक्षा लेखा विभाग अनुभाग अधिकारी ( लेखा ) भर्ती नियम , 2008 है ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. पदों की संख्या, वर्गीकरण और वेतनमान -उक्त पदों की संख्या , उनका वर्गीकरण और उनसे संबद्ध वेतनमान वे होंगे जो इन नियमोंसे उपाबद्ध अनुसूची के स्तंभ (2 ) से (4 ) में विनिर्दिष्ट हैं ।

5. स्थानांतरण का दायित्व, अनुभाग अधिकारी ( लेखा ) भारत में कहीं भी स्थानांतरण के दायित्वाधीन होंगे ।
6. निरर्हता. वह व्यक्ति ,-
(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या
( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परंतु यदि केन्द्रीय सरकार का समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
8. व्यावृत्ति. इन नियमों की कोई भी बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपाबंध करना अपेक्षित है ।

प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनमें से प्रोन्नति/प्रतिनियुक्ति या आमेलन किया जाएगा

प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति या आमेलन द्वारा और दोनों के न हो सकने पर अधीनस्थ लेखा सेवा शिक्षु के रूप में सीधी भर्ती द्वारा ।
टिप्पण :
1. अधीनस्थ लेखा सेवा शिक्षुओं की सीधी भर्ती रक्षा लेखा महानियंत्रक द्वारा विनिर्दिष्ट प्राधिकारी द्वारा आयोजित प्रवेश परीक्षा के आधार पर की जाएगी ।
प्रोन्नति: ऐसे विभागीय अभ्यर्थियों में से, जिन्होंने विभागीय अधीनस्थ लेखा सेवा परीक्षा उत्तीर्ण की है । प्रतिनियुक्ति/आमेलन किसी अन्य संगठित लेखा काडरों के अधीनस्थ लेखा सेवा उत्तीर्ण कर्मचारीवृंद में से या भारत सरकार के अधीन किसी लेखा संगठन से समरूप अर्हक कर्मचारीवृंद में से ऐसे अनुभाग अधिकारी ( लेखा ) जो वेतन बैंड-2 9300-34800 रुपये ग्रेड वेतन में है । ( प्रतिनियुक्ति की अवधि, साधारणतया तीन वर्ष से अधिक नहीं होगी । इसे समय-समय पर भारत सरकार द्वारा इस संबंध में जारी किए गए आदेशों को ध्यान में रखते हुए, लोकहित में, यदि आवश्यक हो , बढ़ाया जा सकता है । )
2( i ) अधीनस्थ लेखा सेवा में सीधे भर्ती शिक्षुओं के लिए विभागीय अधीनस्थ लेखा सेवा परीक्षा उतीर्ण करना अपेक्षित होगा । अधीनस्थ लेखा सेवा शिक्षु को प्रारंभिक परीक्षा में बैठने की आवश्यकता नहीं है । तथापि , अधीनस्थ लेखा सेवा शिक्षु को नियुक्ति के पश्चात् पहले अधीनस्थ लेखा सेवा भाग-1 परीक्षा में अनिवार्य रूप से बैठना होगा और यदि वह असफल हो जाता है तो दूसरी बार और यदि आवश्यक हो ( रक्षा लेखा महानियंत्रक की विशेष स्वीकृति से ) , तीसरी परीक्षा में भाग लेना होगा, यदि प्रथम परीक्षा उसकी नियुक्ति की तारीख से दस मास की अवधि के भीतर आयोजित हो गयी हो , बाद वाले मामले में, यदि वह उस परीक्षा में भाग नहीं लेता है तो उसे दूसरी , तीसरी और चौथी बार परीक्षा में बैठने की स्वीकृति (रक्षा लेखा महानियंत्रक की विशेष स्वीकृति से ) दी जा सकेगी । वह अधीनस्थलेखा परीक्षा भाग -2 में भाग लेगा जो उसके भाग -1 परीक्षा उत्तीर्ण करने के पश्चात् आयोजित की जाएगी । परीक्षा उत्तीर्ण न करने पर वह सेवोन्मुक्त किए जाने के लिए दायी होगा ।
( ii ) शिक्षु भारत में और भारत के बाहर फील्ड सेवा करने के लिए दायी होंगे । 8

S.R.O. 7. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Defence Accounts Department ( Group ' C ' and ' D ' post) Recruitment Rules , 1971 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Section Officer (Accounts) in the Defence Accounts Department , namely:-
1. Short title and commencement. ( 1 ) These rules may be called the Defence Accounts Department Section Officer(Accounts) Recruitment Rules, 2008.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , classification and scales of pay. The number of the said posts , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .
3. Controlling authority. The post shall be administratively controlled by the Controller General ofDefence Accounts under the Ministry of Defence (Finance).
4. Method of recruitment, age- limit, qualification , etc. The method of recruitment to the said post, age- limit , qualifications and other matters connected therewith shall be as specified in columns (5) to ( 14) of the said Schedule.
5. Liability for transfer. The Section Officer (Accounts) shall be liable to transfer any where in India.
6. Disqualification. No person , shall be eligible for appointment to the said post:
(a) who has entered into or contracted a marriage with a person having a spouse living , or
(b) who , having a spouse living , has entered into or contracted a marriage with any person, [ भाग 1]-खण्ड 4]

9 Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule.
7. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any ofthe provisions of these rules with respect to any class or category ofpersons .
8. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , the other Backward Classes, Ex- servicemen and any other Special Categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation/ absorption
1. The direct recruitment of Subordinate Accounts Service Apprentices will be made on the basis of an Entrance Examination conducted by an authority specified by the Controller General of Defence Accounts .
Section Officers (Accounts ) in the Pay Band 2 Rs . 9300-34800 plus Rs . 4800 grade pay Subordinate Accounts Service passed staff from any other organised accounts cadres or similarly qualified staff from any accounting oragnisation under the Government of India (period of deputation shall ordinarily not exceed three years . This can be extended in public interest, if necessary, in the light of orders issued in this regard by the Government from time to time.)
2. ( i ) The apprentices directly recruited to the Subordinate Accounts Service will be required to pass the Departmental Subordinate Accounts Service Examination . SAS Apprentice need not appear in the Preliminary Test . However , a SAS Apprentice must appear for Part I of the SAS examination atthe first and if he fails , at the second and if necessary (with the special sanction of the CGDA ) in the third examination held after his appointment unless the first examination is held within ten months of the date of his appointment, in the later case, if he does not appear at that examination, he may be allowed to appear at the second, third and fourth ( with the special sanction of the CGDA) examinations instead. He will appear for the part II of the SAS Examination , which is held after he passes Part I of the examination . Failure to pass the Examination will render them liable for discharge from service.
(ii) The apprentices shall be liable for field service in and outof India .
