' आंध्र प्रदेश राज्य में अनंतपुर जिले में स्थित ' धर्मवरम ' के नगरपालिका क्षेत्र के अन्तर्गत आने वाले सभी क्षेत्र । '

संख्याः 15 / यू/11/ पीटीएमआर-नियुक्ति/ एसएमसी / 08 कर्मचारी राज्य बीमा (साधारण ) विनियम , 1950 के विनियम 105 के अधीन निगम की शक्तियां महानिदेशक को प्रदान करने के संबंध में कर्मचारी राज्य बीमा निगम की दिनांकः 25 अप्रेल, 1951 को हुई बैठक में पारित किए गए संकल्प के अनुसरण में मुख्यालय के पत्र संख्या Pt . File No. U- 13 / 12/ 13/2005 - med.1 /PTMR dated 09-09-08 द्वारा ये शक्तियां आगे मुझे सौंपी जाने पर मैं , इसके द्वारा निम्नलिखित डाक्टरों को मानकों के अनुसार देय पारिश्रमिक पर निम्नलिखित तिथि तक (एक वर्ष के लिए) या पूर्णकालिक चिकित्सा निर्देशी के कार्यग्रहण करने तक, जो भी पूर्व हो , को राज्य चिकित्सा आयुक्त, जयपुर (राजस्थान) द्वारा निर्धारित क्षेत्र के लिए बीमाकृत व्यक्तियों की स्वास्थ्य परीक्षा करने तथा मूल प्रमाण पत्र की सत्यता संदिग्ध होने पर उन्हें आगे प्रमाण पत्र जारी करने के प्रयोजन के लिए अंशकालीन चिकित्सा निर्देशी के रूप में कार्य करने के लिए प्राधिकृत करती हूं ।

सं . क.भ.नि / रा . कार्या./अ. कें .आ.( त.नाडु एवं केरल / मि.सं. टी.एन/01/2009 दिनांक : 23.06.2009 जहाँ अनुसूची । में उल्लिखित नियोक्ताओं ने जिसमें इसके पश्चात उक्त स्थापना कहा गया है ( कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम , 1952) 1952 का 19 { की धारा 17 की उप धारा 2 (क) के अंतर्गत छूट के विस्तार के लिए आवेदन किया है । जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है ।

चूकिं केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रुप में भारतीय जीवन बीमा निगम की सामूहिक बीमा स्कीम का लाभ उठा रहा है जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबद्ध बीमा स्कीम, 1976 के अंतर्गत स्वीकार्य लाभों से अधिक अनुकूल है ( जिसे इसमें इसके पश्चात स्कीम कहा गया है ) ।

अतः उक्त अधिनियम की धारा 17 की उप धारा 2 ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा श्रम मंत्रालय , भारत सरकार / केन्द्रीय सरकार / केन्द्रीय भविष्य निधि आयुक्त की अधिसूचना सं . तथा तिथि जो प्रत्येक स्थापना के नाम के सामने दर्शायी गयी है , के अनुसरण में तथा संलग्न अनुसूची ।। की निर्धारित शर्तों के रहते हुए केन्द्रीय भविष्य निधि आयुक्त ने उक्त स्कीम के सभी उपबंधों के संचालन से प्रत्येक उक्त स्थापना को आगे तीन वर्षों की अवधि के लिए छूट प्रदान कर दी है ( जैसा कि संलग्न अनुसूची एक में उनके नाम के सामने दर्शाया गया है ) ।

सा.का. जहाँ अनुसूची । में उल्लिखित नियोक्ताओं ने (जिसमें इसके पश्चात उक्त स्थापना कहा गया है ) कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम 1952 (1952का नियम19 ) की धारा 17 की उप धारा 2 (क) के अंतर्गत छूट के लिए आवेदन किया है जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है ।

चूकिं केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रुप में भारतीय जीवन बीमा निगम की सामूहिक बीमा योजना का लाभ उठा रहे हैं जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबद्ध बीमा योजना , 1976 के अंतर्गत स्वीकार्य लाभों से अधिक अनुकूल है ( जिसे इसमें इसके पश्चात योजना कहा गया है ) ।

अतः उक्त अधिनियम की धारा 17 की उप धारा 2 ( क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हए तथा इसके साथ संलग्न अनुसूची में उल्लिखित शर्तों के अनुसार केन्द्रीय भविष्य निधि आयुक्त ने प्रत्येक के सामने उल्लिखित पिछली तारीख से प्रभावी तिथि से उक्त स्थापना को क्षेत्रीय भविष्य निधि आयुक्त, चेन्नै ने स्कीम की धारा 28 (7 ) के अंतर्गत ढील प्रदान की है तीन वर्ष की अवधि के लिए संचालन को छूट प्रदान कर दी गयी है । 4062

अनुसूची - ।।

1 . उक्त स्थापना के संबंध में प्रत्येक नियोक्ता ( जिसे इसके पश्चात नियोक्ता कहा गया ) केन्द्रीय भविष्य निधि आयुक्त द्वारा समय समय पर निर्दिष्ट ऐसी विवरणियों संबंधित क्षेत्रीय भविष्य निधि आयुक्त को भेजेंगे तथा ऐसी राशि रखेंगें तथा निरीक्षण के लिए ऐसी सुविधाएँ प्रदान करेंगे ।

2. नियोक्ता केन्द्रीय सरकार द्वारा उक्त अधिनियम की धारा 17 की उप धारा ( 2 क ) के खण्ड ( क ) के अंतर्गत समय समय पर निर्दिष्ट ऐसे निरीक्षण प्रभार प्रत्येक माह की समाप्ति के 15 दिन के भीतर भुगतान करेंगे ।

3. लेखाओं का रखरखाव , रिटर्न प्रस्तुत करना ,बीमा किस्तों का भुगतान , लेखाओं का अंतरण , निरीक्षण प्रभार के भुगतान सहित सामूहिक बीमा योजना में सम्मिलित प्रशासन संबंधी सभी व्ययों को नियोक्ता द्वारा वहन किया जाएगा ।

4. नियोक्ता केन्द्रीय सरकार / केन्द्रीय भविष्य निधि आयुक्त द्वारा अनुमोदित्त तथा यथासंशोधित एवं अधिकांश कर्मचारियों की भाषा मे उसके प्रमुख बातों के अनुवाद सहित सामूहिक बीमा योजना के नियमों की प्रति स्थापना के सूचना पटल पर प्रदर्शित करेंगें । 5. यदि कोई कर्मचारी जो कर्मचारी भविष्य निधि या उक्त अधिनियम के अंतर्गत छूट प्राप्त स्थापना की भविष्य निधि के पहले से ही सदस्य हैं और उनकी स्थापना में नियोजित किया जाता है नियोक्ता उन्हें तत्काल सामूहिक बीमा योजना का सदस्य बनाकर भारतीय जीवन बीमा निगम को उसकी आवश्यक किश्त का भुगतान करेंगें ।

6. यदि उक्त योजना के अधीन कर्मचारियों को उपलब्ध लाभों में वृद्धि की जाती है तो नियोक्ता अपने कर्मचारियों को सामूहिक बीमा योजना के अंतर्गत उपलब्ध लाभों में वृद्धि की व्यवस्था करेंगे जिसमें उक्त योजना के अंतर्गत स्वीकार्य लामों से भी सामूहिक बीमा योजना के अत्तर्गत उपलब्ध लाभ अधिक अनुकूल होंगे ।

7 . सामूहिक बीमा योजना में निहित किसी बात के होते हुए भी यदि कर्मचारी की मृत्यु हो जाने पर योजना के अंतर्गत देय राशि कर्मचारियों को उक्त योजना के अंतर्गत व्याप्त करने पर देय राशि से कम हो तो नियोक्ता, शेष भुगतान राशि कर्मचारी के नामिति( यों ) विधिक वारिस ( सों ) को हरजाने के रुप में भुगतान करेंगें ।

8. संबंधित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना सामूहिक बीमा योजना के प्रावधानों में कोई सेशोधन नहीं किया जाएगा तथा जहाँ किसी भी संशोधन से कर्मचारी के पक्ष में कोई प्रतिकूल प्रभाव पड़ने की संभावना हो तो क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने से पूर्व कर्मचारियों को उनका दृष्टिकोण समझाने का यथोचित अवसर देंगे । 9. अतः किसी कारणवश उक्त स्थापना के नियोक्ता भारतीय जीवन बीमा निगम के सामूहिक बीमा योजना के जिसको उक्त स्थापना द्वारा पहले से अपनाया गया है के अधीन नहीं रहते और योजना के अंतर्गत दिए जाने वाले लाभों को किसी भी तरह से कम किए जाने पर छूट को रद्द किया जा सकता है ।

10. यदि बिना किसी कारण के भारतीय जीवन बीमा द्वारा नियत तिथि के भीतर नियोक्ता बीमा किस्त आदि का भुगतान न कर सके तथा पॉलिसी समाप्त की जाए तो छूट को रद्द किया जा सकता है ।

11. यदि नियोक्ता द्वारा बीमा किस्त के भुगतान में चूक होने पर मृत सदस्य जो उक्त योजना के अंतर्गत व्याप्त किया जा सकता था परंतु छूट देने के कारण उसके नामिति( यों ) विधिक वारिस( सों ) को बीमा लाभों के भुगतान का दायित्त्व नियोक्ता का होगा ।

12. सामूहिक बीमा योजना के अंतर्गत व्याप्त सदस्य की मृत्ये होने पर भारतीय जीवन बीमा निगम मृत सदस्य के नामिति ( यों ) तथा विधिक वारिस ( सों ) जो बीमाकृत राशि के हकदार है को उस राशि को तथा किसी भी हाल में सभी प्रकार से पूर्ण दावों के प्राप्त होने के एक माह के भीतर शीघ्र भुगतान सुनिश्चित करें ।

( त.नाडु एवं केरल ) मि.सं. के.आर./02/2009 दिनांक : 25.06.2009 जहाँ अनुसूची । में उल्लिखित नियोक्ताओं ने जिसमें इसके पश्चात उक्त स्थापना कहा गया है ( कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम , 1952 ) 1952 का 19 ( की धारा 17 की उप धारा 2 (क) के अंतर्गत छूट के विस्तार के लिए आवेदन किया है । जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है ।

चूकिं केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रुप में भारतीय जीवन बीमा निगम की सामूहिक बीमा स्कीम का लाभ उठा रहा है जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबद्ध बीमा स्कीम , 1976 के अंतर्गत स्वीकार्य लाभों से अधिक अनुकूल है ( जिसे इसमें इसके पश्चात स्कीम कहा गया है ) ।

अतः उक्त अधिनियम की धारा 17 की उप धारा 2 ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा श्रम मंत्रालय , भारत सरकार / केन्द्रीय सरकार / केन्द्रीय भविष्य निधि आयुक्त की अधिसूचना सं. तथा तिथि जो प्रत्येक स्थापना के नाम के सामने दर्शायी गयी है , के अनुसरण में तथा संलग्न अनुसूची ।। की निर्धारित शर्तों के रहते हुए केन्द्रीय भविष्य निधि आयुक्त ने उक्त स्कीम के सभी उपबंधों के संचालन से प्रत्येक उक्त स्थापना को आगे तीन वर्षों की अवधि के लिए छूट प्रदान कर दी है ( जैसा कि संलग्न अनुसूची एक में उनके नाम के सामने दर्शाया गया है ) ।

सा.का. जहाँ अनुसूची में उल्लिखित नियोक्ताओं ने (जिसमें इसके पश्चात उक्त स्थापना कहा गया है ) कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम 1952 (1952का नियम 19 ) की धारा 17 की उप धारा 2 (क) के अंतर्गत छूट के लिए आवेदन किया है जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है ।

चूकिं केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रुप में भारतीय जीवन बीमा निगम की सामूहिक बीमा योजना का लाभ उठा रहे हैं जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबद्ध बीमा योजना 1976 के अंतर्गत स्वीकार्य लामों से अधिक अनुकूल है ( जिसे इसमें इसके पश्चात योजना कहा गया है ) ।

अत्तः उक्त अधिनियम की धारा 17 की उप धारा 2 ( क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हए तथा इसके साथ संलग्न अनुसूची में उल्लिखित शर्तों के अनुसार केन्द्रीय भविष्य निधि आयुक्त ने प्रत्येक के सामने उल्लिखित पिछली तारीख से प्रभावी तिथि से उक्त स्थापना को क्षेत्रीय भविष्य निधि आयुक्त , चेन्नै ने स्कीम की धारा 28(7) के अंतर्गत ढील प्रदान की है , तीन वर्ष की अवधि के लिए संचालन को छूट प्रदान कर दी गयी है । 4069

अनुसूची- ।।

1. उक्त स्थापना के संबंध में प्रत्येक नियोक्ता ( जिसे इसके पश्चात नियोक्ता कहा गया ) केन्द्रीय भविष्य निधि आयुक्त द्वारा समय समय पर निर्दिष्ट ऐसी विवरणियों संबंधित क्षेत्रीय भविष्य निधि आयुक्त को भेजेंगे तथा ऐसी राशि रखेंगें तथा निरीक्षण के लिए ऐसी सुविधाएँ प्रदान करेंगे ।

3. लेखाओं का रखरखाव रिटर्न प्रस्तुत करना ,बीमा किस्तों का भुगतान , लेखाओं का अंतरण , निरीक्षण प्रभार के मुगतान सहित सामूहिक बीमा योजना में सम्मिलित प्रशासन संबंधी सभी व्ययों को नियोक्ता द्वारा वहन किया जाएगा ।

4. नियोक्ता केन्द्रीय सरकार / केन्द्रीय भविष्य निधि आयुक्त द्वारा अनुमोदित तथा यथासंशोधित एवं अधिकांश कर्मचारियों की भाषा मे उसके प्रमुख बातों के अनुवाद सहित सामूहिक बीमा योजना के नियमों की प्रति स्थापना के सूचना पटल पर प्रदर्शित करेंगें ।

5. यदि कोई कर्मचारी जो कर्मचारी भविष्य निधि या उक्त अधिनियम के अंतर्गत छूट प्राप्त स्थापना की भविष्य निधि के पहले से ही सदस्य हैं और उनकी स्थापना में नियोजित किया जाता है नियोक्ता उन्हें तत्काल सामूहिक बीमा योजना का सदस्य बनाकर भारतीय जीवन बीमा निगम को उसकी आवश्यक किश्त का भुगतान करेंगें ।

6. यदि उक्त योजना के अधीन कर्मचारियों को उपलब्ध लाभों में वृद्धि की जाती है तो नियोक्ता अपने कर्मचारियों को सामूहिक बीमा योजना के अंतर्गत उपलब्ध लामों में वृद्धि की व्यवस्था करेंगे जिसमें उक्त योजना के अंतर्गत स्वीकार्य लाभों से भी सामूहिक बीमा योजना के अतर्गत उपलब्ध लाभ अधिक अनुकूल होंगे ।

7. सामूहिक बीमा योजना में निहित किसी बात के होते हुए भी यदि कर्मचारी की मृत्यु हो जाने पर योजना के अंतर्गत देय राशि कर्मचारियों को उक्त योजना के अंतर्गत व्याप्त करने पर देय राशि से कम हो तो नियोक्ता , शेष भुगतान राशि कर्मचारी के नामिति( यों ) विधिक वारिस ( सों ) को हरजाने के रुप में भुगतान करेंगें ।

8. संबंधित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना सामूहिक बीमा योजना के प्रावधानों में कोई सेशोधन नहीं किया जाएगा तथा जहाँ किसी भी संशोधन से कर्मचारी के पक्ष में कोई प्रतिकूल प्रभाव पड़ने की संभावना हो तो क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने से पूर्व कर्मचारियों को उनका दृष्टिकोण समझाने का यथोचित अवसर देंगे । 9. अतः किसी कारणवश उक्त स्थापना के नियोक्ता भारतीय जीवन बीमा निगम के सामूहिक बीमा योजना के जिसको उक्त स्थापना द्वारा पहले से अपनाया गया है , के अधीन नहीं रहते और योजना के अंतर्गत दिए जाने वाले लाभों को किसी भी तरह से कम किए जाने पर छूट को रद्द किया जा सकता है ।

11. यदि नियोक्ता द्वारा बीमा किस्त के भुगतान में चूक होने पर मृत सदस्य जो उक्त योजना के अंतर्गत व्याप्त किया जा सकता था परंतु छूट देने के कारण उसके नामिति( यों ) , विधिक वारिस( सों ) को बीमा लाभों के भुगतान का दायित्व नियोक्ता का होगा ।

Whereas the employers of the establishment mentioned in Schedule - 1 ( Hereinafter referred to as the said establishment) have applied for exemption under Sub Section 2(A) of Section 17 of the EPF & MP Act , 1952 ( 19 of 1952 ) hereinafter referred to as the said Act .

And whereas the Central Provident Fund Commissioner is satisfied that the employees of the said establishments are without making any separate contribution or payment of premium in enjoyment of benefits under theGroup Insurance Scheme of the respective Life Insurance Corporation of India in the nature of Life Insurance which are more favourable to such employees than the benefits admissible under the Employees Deposit Linked Insurance Scheme, 19765 ( hereinafter referred to as the said Scheme) .

Now, therefore , in exercise of the power conferred by Sub -Section 2(A) of Section 17 of the said Act in continuation of Govt . Of India , the Ministry of Labour/C.P.F.C Notification No. and dated shown against the name of each of the said establishment from the conditions specified in Schedule- il annexed hereto the Central Provident Fund Commissioner hereby exempt each of the said establishment from the operation of all the provisions of the said Scheme & further period of 3 years as indicated in attached Schedule - I against their names .

whereas the employers of the establishment mentioned in Schedule- l ( Hereinafter referred to as the said establishment) have applied for exemption under Sub- Section 2( A) of Section 17 of the Employees Provident Fund & Miscellaneous Provisions Act, 1952 ( 19of 1952) herein after referred to as the said Act .

And whereas the Central Provident Fund Commissioner, is satisfied that the employees of the said establishments are , without making any separate contribution or payment of premium in enjoyment of benefits under the Group Insurance Scheme of the respective Life Insurance Corporation of India in the nature of Life Insurance which are more favourable to such employees than the benefits admissible under the Employees' Deposit Linked Insurance Scheme , 1976 ( hereinafter referred to as the said scheme) .

Now therefore, in exercise of the power conferred by Sub -Section 2(A) of Section 17 of the said Act and subject to the conditions specified in Schedule - ll annexed here to , the Central Provident Fund Commissioner hereby exempt each of the said mentioned establishments in Schedule -1 from the date mentioned against each from which date relaxation order under Para 28(7) of the said scheme has been granted by the Regional Provident Fund Commissioner concerned from the operation of the said scheme for a period of 3( three) years .

SCHEDULE - II

1. The employer in relation to each of the said establishment (hereinafter referred to as the employer ) shall submit such returns to theRegional P.F. Commissioner concerned and maintain such amount and provide such facilities for inspection , as the Central P.F. Commissioner may direct from time to time .

2. The employer shall pay such inspection charges as the Central Govt . May from time to time, direct under clause (A) Sub - Section (2A ) of Section 17 of the said Act , within 15 days from the close of every month.

3. All expenses involved in the administration of the Group Insurance Scheme, including maintenance of account , submission of returns , payment of insurance premia , transfer accounts , payment of inspection charges etc. , shall be borne by the employer .

4. The employer shall display on the Notice Board of the establishment ,. copy of the rules of the Group Insurance Scheme as approved by the Central Government/Central Provident Fund Commissioner as and whenamended alongwith translation of salient feature thereof in the language of the majority of the employees .

5. Where as an employee , who is already a member of the Employees Provident Fund or the Provident Fund of an establishment exempted under the said Act, is employed in his establishment the employer shall immediately admit him as a member of the Group Insurance Scheme and pay necessary premium in respect of him to the respective Life Insurance Corporation of India .

6. The employer shall arrange to enhance the benefits available to the employees under the Group Insurance Scheme appropriately if the benefits available to the employees under said scheme are enhanced so that the benefits available under Group Insurance Scheme are more favourable to the employees than the benefits admissible under the said Scheme.

7. Notwithstanding anything contained the Group Insurance Scheme, if on the death of an employee the amounts payable under the Scheme be less than the amount that would be payable had the employees been covered under the said Scheme, the employer shall pay the difference to the nominee( s) legal heir(s) of the employees as compensation .

8. No amendment of the provisions of the Group Insurance Scheme shall be made without the prior approval of the Regional Provident Fund Commissioner concerned and where any amendment is likely to effect adversely the interest of the employees his approval , give a reasonable opportunity to the employees to explain point of view.

9. Therefore any reason the employer of the said establishment do not remain covered under the Group Insurance Scheme of the respective LifeInsurance Corporation of India as a ready adopted by the said establishment , for the benefits to the employees under this scheme are reduced in any manner, the exemption shall be liable to be cancelled.

10.Where for any reason , the employer fails to pay the premium etc. , within the due date , as fixed by the respective Life Insurance Corporation of India , and the policy is allowed to lapse , the exemption shall be liable to be cancelled .

11. In case of default, if any made by the employer in payment of premiurn the responsibility for payment of assurance benefits to the nominee (s ) legal heir( s ) of deceased member who would have been covered under the said Scheme but for grant of this exemption shall be that of the employer.

12. Upon the death of the member covered under the Group Insurance Scheme, the respective Life Insurance Corporation of India shall ensure prompt payment of the sum assured to the nominee( s ) and Legal Heir( s) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in all respect
