आदि सम्मिलित हैं )

General Statutory Rules (Including Orders, Bye- laws etc. of a general character) issued by the Ministries of the Government of India (other than the Ministry of Defence) and by the Central Authorities (other than the Administrations of Union Territories )

सा.का. मि. 123: केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम , 1968 ( 1968 का 47 ) की धारा 141 की उपधारा ( 2 ) के खंड ( ख ) और ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सीमा सुरक्षा बल में पैराचिकित्सक समूह ' ग ' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ.( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल बोद्धक पैराचिकित्सक समूह " ग " भर्ती नियम, 2009है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि, उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अईत्ताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

[PART II-SEC. 3(i)] (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्तनियमों के अधीन नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकारका पद समाचान हो जाता है कि ऐसा विवाह ऐसे व्याधित और विवाह को अन्य पक्षकार को लाप स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अब आधार हैं तो वह किती कि को इस नियम के धन से छूट दे सकेगी । 5. अधिवर्षिता. इन नियमों के उपबंधों के अधीन नियुक्त किया क्या कोई व्यक्ति उम्र मास की अन्तिम तारीख को अपराह्न में सेवा से निवृत्त हो आएगा जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है :

परन्तु ऐसा व्यक्ति , जिसकी जन्म की तारीख किसी मास के पहले दिन होती है , सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अन्तिम दिन के अपराहन को सेवा से निवृत्त हो जाएगा ।

6. चिकिवाक दृष्ट्या योग्यता. इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप -1 में है, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।

शेप -1 से निम्नवत परिभाषित चिकित्सा प्रवर्ग अभिप्रेत हैं-

( I ) ' ए ' से कूट अक्षर शेष द्वारा उपदर्शित विद्यमान कारकों के अधीन अधिकारी की स्वस्थता का मूल्यांकन करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सीय वर्गीकरण , जो निम्नलिखित कृत्यों को व्यक्त करता है , अर्थात्:-

एस - मनोवैज्ञानिक

एच - श्रवण

ए - संलग्नक

पी शारीरिक क्षमता

ई- नेत्र दृष्टि

( ii ) प्रत्येक कारक के अधीन किसी अधिकारी की कार्यात्मक क्षमता प्रत्येक छूट अक्षर के सम्भये संख्यांक 1 से 5 तक द्वारा घटती हुई कार्यात्मक दक्षता को उपदर्शित करते हुए निर्दिष्ट किया जाएगा , संख्यांक उसके सिवाय जहां कोई अधिकारी सभी कारकों में श्रेणी । है, कूट अक्षर के पश्चात् लिखे जाएंगे उसका प्रवर्ग S, H, A, P, E, लिखने के बजाय शेप 1 लिखकर निर्दिष्ट किया जा सकेगा । इन संख्यांकों का साधारण मूल्यांकन निम्नवत् है :-

( 1 ) किसी भी स्थान पर सभी कर्तव्यों के लिए उपयुक्त ।

(2) सभी कर्त्तव्यों के लिए उपयुक्त परन्तु इस पर निर्भर करते हुए कि क्या कर्त्तव्यों में भारी तनाव या दोनों कानों/आंखों के/ श्रवण शक्ति/ दृष्टि तीक्ष्ण मांग अन्तर्वलित पर है , नियोजनीयता के कर्त्तव्य और क्षेत्रों के बारे में परिसीमाएं हो सकेंगी । (3) ' एस ' कारक के सिवाय, नैत्विक या अभ्रमणशील कर्त्तव्यों के लिए उपयुक्त परन्तु ऊंचे स्थानों ( 2700 मीटर से ऊपर) अत्यधिक ठण्डे क्षेत्र या पहाड़ी क्षेत्र में तथा दीर्घकालिक हस्तांतरण के लिए नियोजनीयता की परिसीमाएं हो सकेंगी । (4) अस्पताल में रहने या बीमारी कौं छुट्टी के कारण कर्त्तव्यों के लिए अस्थायी रूप से अनुपयुक्त ।

( 5 ) कर्त्तव्यों के लिए स्थायी रूप से अनुपयुक्त ।

7. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । [भाग II- खण्ड 3 ( i) ]

1. किसी मान्यताप्राप्त शिक्षा बोर्ड या संस्था से उच्चतर माध्यमिक विद्यालय प्रमाणपत्र ( 10 + 2 ) परीक्षा या इण्टरमीडिएट या समतुल्य । 2. किसी मान्यताप्राप्त संस्थान से साधारण नर्सिंग कार्यक्रम या साधारण नर्सिंग और सेविका में डिप्लोमा और केन्द्रीय या राज्य सरकार नर्सिंग परिषद् के रूप में रजिस्ट्रीकृत । ,

सेवा में जोड़े गए वर्षों का फायदा केन्द्रीय सिविल सेवा (पेंशन ) मियम, 1972 के नियम 30 के अधीन अनुज्ञेय है या नहीं

महिला अभ्यर्थियों के लिए 18-25 वर्ष के बीच ।

(केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए अनु- देशों के अनुसार सरकारी सेवकों अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए शिथिल की जा सकती है )

टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न किवह अंतिम तारीख जो असम , मेघालय , अरूणाचल प्रदेश , मिजोरम, मणिपुर, नागालैंड , त्रिपुरा , सिक्किम, जम्मू-कश्मीर राज्यके लद्दाख खंड , हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )

3. शारीरिक मानक:

(क) ऊंचाई : 157 सें.मी.

(ख) सीना: सुविकसित होना चाहिए ।

( क) भार : ऊंचाई के अनुरूप ।

टिप्पण 1 : न्यूनतम मानक जहां तक इसका संबंध ऊंचाई से है , अर्थात् गढ़वालियों, कुमाठनियों , गोरखाओं, डोगरों, मराठाभों, सिविकमियों जैसी जातियों के अभ्यर्थियों, लेह और लद्दाख , कश्मीर काटी , पूणोत्तर राज्योंऔर हिमांचल प्रदेश राज्य के व्यक्तियों की कबत शिथिल करके 155 सें.मी. तक की जा सकती है ।

टिप्पण 2 : न्यूनतम मानक , जहां तक इसका संबंध ऊंचाई से है , आदिवासियों या जनजातियों जिसके अंतर्गत मिजो और नागा भी है , की बाबत शिथिल करके 152.5 सें.मी. तक की जा सकती है ।

4. पूर्णतया चिकित्सक दृष्टया योग्य होना चाहिए ( बिना सुधार किए हुए अर्थात् चश्मा लगाए बिना न्यूनतम नेत्रदृष्टि 6/6 दाहिनी आंख और 6/12 बाई आंख अथवा 6/9 दोनों आंखों की नेत्रदृष्टि होनी चाहिए ।

5. अभ्यर्थियों को अंतर्वक्र जानु , सपाट पांव , बड़ी हुई पसली या वक्र दृष्टिका नहीं होना चाहिए और उनकी उच्च रंग दृष्टि होनी चाहिए । उन्हें अच्छे मानसिक और शारीरिक रूप से स्वस्थ होना चाहिए और ऐसे शारीरिक दोषों से मुक्त होना चाहिए जिनसे उनके कर्तव्यों के दक्ष निष्पादन में व्यवधान की संभावना हो ।

6. शारीरिक दक्षता और लिखित परीक्षाणों में अवश्य उत्तीर्ण होना चाहिए।

प्रोन्नति या प्रतिनियुषित या आमेलन द्वारा पर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति या प्रतिनियुक्ति का आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरी जाने वाली रिक्तियोंकी प्रतिशतता

प्रतिनियुक्ति या संविदात्मक आधार पर नियुक्ति :

50% सीधी भर्ती द्वारा , 50 % प्रतिनियुक्ति द्वारा या संविदात्मक आधार पर

(क) सेना, केन्द्रीय अर्द्ध सैनिक बल , केन्द्रीय या राज्य पुलिस संगठनों के :-

ऐसे हैड कांस्टेबल ( नर्स/ सहायक नर्सिंग और सेविका ) , जिन्होंने उस श्रेणी में दो वर्ष न्यूनतम नियमित सेवा की हो और जिनके पास स्तंभ 8 के अधीन यथा विहित अहंताएं हैं ।

या

ऐसे हैड कांस्टेबलों पर , जिनके पास सेना या केन्द्रीय अर्द्धसैनिक बलों के मान्यताप्राप्त अस्पताल/संस्था से अर्थित नर्सिंग/सहायक नर्सिंग तथा सेविका पाठ्यक्रम सफलतापूर्वक उत्तीर्ण करने का प्रमाणपत्र हो और सेषा केन्द्रीय अर्द्धसैनिक बलों के ट्रेड में केन्द्रीय राज्य पुलिस संगठनों में पिछले पांच वर्ष का अनुभव भी हो , आवश्यकता होने के आधार पर रिक्तियां भरने के लिए भी विचार किया जा सकेगा । ऐसे हैड कांस्टेबल ( नर्स/सहायक नर्सिंग और सेनिका) से रिक्तियां केवल उन परिस्थितियों में जब ऐसे हैड कांस्टेबल (नर्स/ सहायक नर्स और सेविका) जिनके पास साधारण नर्सिंग कार्यक्रम या साधारण नर्सिंग और सेविका का डिप्लोमा तुरन्त उपलब्ध नहीं है , जो अस्थाई प्रकृति के होंगे और जब उन्हें राष्ट्रीय आपदा मोचन बल से प्रत्यावासित कर दिया जाता है तो वे अपने मूल काडरट्रेड/विभाग में प्रतिवर्तित हो जाएंगे । (ख ) राज्य और केन्द्रीय सरकार के अस्पतालों के अधिकारी: -

राज्यऔर केन्द्रीय सरकार के अस्पतालों के ऐसे अधिकारी , जो उस ट्रेड में न्यूनतम दो वर्ष के अनुभव के साथ सदृश पद धारण किए हुए हैं और जिनके पास स्तंभ 8 में यथा विहित अर्हताएं हैं । 459 [ भाग II- खण्ड 3 (i ) ]

टिप्पण: ऐसे सेना कार्मिक भी जिनके पास ऐसी अर्हताएं हैं या जिन्होंने सेना द्वारा मान्यताप्राप्त ऐसे पाठ्यक्रम सफलतापूर्वक उत्तीर्ण किए हैं, जो इन पदों के लिए विहित शैक्षिक अर्हताओं के समतुल्य हों , ऐसे पदों के लिए पात्र होंगे , परन्तु यह तब जब कि ऐसे पाठ्‌यक्रम/अर्हताएं अखिल भारतीय तकनीकी शिक्षा परिषद् जैसे किसी केन्द्रीय/ राज्य प्राधिकरण द्वारा समतुल्य रूप में सम्यकत् अनुमोदित और मान्यताप्राप्त हों ।

टिप्पण 2 : किसी भी स्त्रोत से प्रतिनियुक्ति/ संविदात्मक/पुनर्नियोजन आधार पर भर्ती किए गए कार्मिकों की दशा में, राष्ट्रीय आपदा मोचन बल बटालियनों में प्रवेश की आयु 5 वर्ष तक बढ़ा दीजाएगी ।

टिप्पण 3 : सीधी भर्ती या प्रतिनियुक्ति के माध्यम से विभाग द्वारा हैड कांस्टेबल ( नर्स/सहायक नर्सिंग और सेविका ) के पदों को भरने में आई समस्या की दशा में , आपदा की अवधि के दौरान या तो पूर्ण- कालिक या अंशकालिक अपेक्षा का ध्यान रखने के लिए संविदात्मक आधार पर किसी नर्स/सहायक नर्सिंग और सेविका को नियोजित करने/नियुक्त करने के लिए प्रयास किए जाएंगे ।

टिप्पण 4: किन्हीं अन्य कारणों से, केन्द्रीय अर्द्ध सैनिक बलों में हैड कांस्टेबल (नर्स/सहायक नर्सिंग सेविका ) की अनुपलभ्यता की दशा में, सेना/केन्द्रीय अर्द्ध सैनिक बलों के मान्यताप्राप्त अस्पताल या संस्थाओं से नर्सिंग/ सहायक नर्सिंग सेविका के प्रशिक्षित और अर्हित और जिनके पास पिछले 8 वर्ष का अनुभव है , पर भी स्थिति में सुधार हो जाने तक , रिक्तियों को भरने के लिए विचार किया जाएगा ।

टिप्पण 5 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रति- नियुक्ति की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए दो वर्ष । 1. किसी मान्यताप्राप्त शिक्षा बोर्ड या संस्था से उच्चतर माध्यमिक विद्यालय प्रमाणपत्र ( 10 +2 ) परीक्षा या इण्टरमीडिएट या समतुल्य ।

2. किसी सरकारी मान्यताप्राप्त संस्थान से भेषजी में डिप्लोमा और भेषजी अधिनियम , 1948 के अधीन भेषजज्ञ के रूप में रजिस्ट्रीकृत ।

3. शारीरिक मानक :

(क) ऊंचाई : सभी राज्यों के साधारण अनुसूचित जाति/अनुसूचित जनजाति/अन्य पिछड़े वर्गों के अभ्यर्थियों के लिए 165 सें.मी. ।

(ख) सीना : 77 सें.मी. ( फुलाने के पश्चात् 82 सें.मी. )

(ग ) भार: ऊंचाई के अनुरूप ।

टिप्पण 1 : न्यूनतम मानक जहां तक इसका संबंध ऊंचाई से है , आदिवासियों या जनजातियों जिसके अंतर्गत मिजो और नागा भी हैं , की बाबत शिथिल करके 162.5 सें.मी. तक की जा सकती है ।

टिप्पण 2 : सीने की माप से सम्बन्धित न्यूनतम मानक आदिवासी/ जनजातियों के लिए क्रमशः 77 सें.मी. बिना फुलाव के और फुलाव के साथ 82 सें.मी. और बिना फुलाव के 76 सें.मी. तथा फुलाव के साथ 81 सें.मी. शिथिल किया जा सकता है ।

4. पूर्णतया चिकित्सक दृष्टया योग्य होना चाहिए ( बिना सुधार किए हुए अर्थात् चश्मा लगाए बिना न्यूनतम नेत्रदृष्टि 6/6 दाहिनी आंख और 6/12बाई आंख अथवा 6/9 दोनों आंखों की होनी चाहिए ।

5. अभ्यर्थियों को अंतर्वक्र जानु , सपाट पांव , बढ़ी हुई पसली या वक्र दृष्टि का नहीं होना चाहिए और उनकी उच्च रंग दृष्टि होनी चाहिए । उन्हें अच्छे मानसिक और शारीरिक रूप से स्वस्थ होना चाहिए और ऐसे शारीरिक दोषों से मुक्त होना चाहिए जिनसे उनके कर्त्तव्यों के दक्ष निष्पादन में व्यवधान की संभावना हो ।

ऐसे हैड कांस्टेबलों पर , जिनके पास सेना केन्द्रीय अर्द्धसैनिक बलों के मान्यताप्राप्त अस्पताल/ संस्थाओं से अर्हित नर्सिंग सहायक नर्सिंग या उच्च चिकित्सा पाठ्यक्रम को सफलतापूर्वक उत्तीर्ण करने का प्रमाणपत्र हो और केन्द्रीय अर्द्धसैनिक बलों केन्द्रीय /राज्य पुलिस बलों के ट्रेड में पिछले पांच वर्ष का अनुभव भी हो , आवश्यकता होने पर रिक्तियों को भरने के लिए विचार किया जा सकेगा । ऐसे हैड कांस्टेबल ( पैराचिकित्सा ) से रिक्तियां केवल उन परिस्थितियों में जब ऐसे हैड कांस्टेबल ( पैराचिकित्सा ) जिनके पास भेषजी विज्ञान का डिप्लोमा है तुरन्त उपलब्ध नहीं है , जो कि अस्थाई प्रकृति के होंगे और जब उन्हें राष्ट्रीय आपदा मोचन बल से प्रत्त्यावासित कर दिया जाता है तो वे अपने मूल काडर/ट्रेड/विभाग में परिवर्तित हो जाएंगे । ( ख ) राज्य और केन्द्रीय सरकार के अस्पतालों के अधिकारी:-.

राज्य और केन्द्रीय सरकार के अस्पतालों के ऐसे अधिकारी , जो उस ट्रेड में न्यूनतम दो वर्ष के अनुभव के साथ सदृश पद धारण किए हुए हैं और जिनके पास स्तंभ 8 में यथा विहित अर्हताएं हैं ।

टिप्पण 1 : ऐसे सेना कार्मिक भी जिनके पास ऐसी अर्हताएं हैं या जिन्होंने सेना द्वारा मान्यताप्राप्त ऐसे पाठ्यक्रम सफलतापूर्वक उत्तीर्ण किए हैं , जो इन पदों के लिए विहित शैक्षिक अर्हताओं के समतुल्य हों, ऐसे पदों के लिए पात्र होंगे , परन्तु यह तब जब कि ऐसे पाठ्यक्रम / अर्हताएं अखिल भारतीय तकनीकी शिक्षा परिषद् जैसे किसी केन्द्रीय राज्य प्राधिकरण द्वारा समतुल्य रूप में सम्यकत् अनुमोदित और मान्यताप्राप्त हो ।

टिप्पण 3 : सीधी भर्ती या प्रतिनियुक्ति के माध्यम से विभाग द्वारा हैड कांस्टेबल (पैराचिकित्सा) के पदों को भरने में आई समस्या की दशा में , आपदा की अवधि के दौरान या तो पूर्णकालिक या अंशकालिक अपेक्षा का ध्यान रखने के लिए संविदात्मक आधार पर किसी हैड कांस्टेबल (पैराचिकित्सा) को नियोजित/नियुक्त करने के लिए प्रयास किए जाएंगे ।

टिप्पण 4 : किन्हीं अन्य कारणों से , केन्द्रीय अर्द्धसैनिक बलों में हैड कांस्टेबल ( पैराचिकित्सा की अनुपलभ्यता की दशा में , सेना/केन्द्रीय अर्द्धसैनिक बलों के मान्यताप्राप्त अस्पताल या संस्थाओं से पैराचिकित्सा में प्रशिक्षित और अर्हित कांस्टेबल और जिनके पास पिछले 8 वर्ष का उस ट्रेड में अनुभव है, पर भी स्थिति में सुधार हो जाने तक , रिक्तियों को भरने के लिए विचार किया जाएगा ।

टिप्पण 5 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी ।

G.S.R. 123. In exercise of the powers conferred by clauses (b) and ( c) of sub-section (2) of Section 141 of the Border Security Force Act, 1968 (47 of 1968) , the Central Government hereby makes the following rules regulating the method of recruitment to the Paramedics Group ' C' posts in Border Security Force, namely:-

1. Short title and commencement-( 1 ) These rules may be called the Border Security Force, Combatised ParamedicsGroup ' C' Posts Recruitment Rules ,2009 .

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Number of posts, classification and scale of pay. The number of said posts , their classification and scale ofpay attached thereto , shall be as specified in columns (2) to(4) of the Schedule annexed to these rules .

3.Method of recruitment, age limit qualifications, etc. The method ofrecruitment age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.

4.Disqualification. No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment under these rules:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation ofthis rule.

5. Superannuation . A person appointed under the provisions of these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty seven years :

Provided that the person whose date of birth is the first day ofa month shall retire from service on the afternoon ofthe last day of the preceding month of attaining the age of fifty seven years.

6. Medical Fitness -Notwithstanding any thing contained in these rules , only those persons who are in medical category SHAPE - 1 , shall be eligible for appointment under the provisions of these rules.

SHAPE - I means Medical Category defined as under:--

(i) medical classification done by Medical Officer after assessing fitness ofthe officer under given factors indicated bythe code letters SHAPE, which represent the following functions , namely:-

S - Psychological

H-Hearing

A- Appendages

P-Physical Capacity

E- Eye- Sight

(ii) functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter , indicating declining functional efficiency, The numerals will be written next to the code letter, except that where an officer is in Grade- I in all factors , his category may be denoted by writing SHAPE - I instead of writing S , H, A, P, E,. General evaluation of these numerals is as under :--

( 1) Fit for all duties anywhere .

(2) Fitfor all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing /vision of both ears/eyes .

(3) Excepting " S" factor , fit for routine or sedentary duties but may have limitations of employability at high altitude ( above 2,700 meters) extreme cold areas or hilly terrain and for long assignments .

(4) Temporarily unfit for duties on account ofhospitalization or sick leave.

(5) Permanently unfit for duties .

7. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons , to be recorded in writing, relax any of the provisions of these rules in respect ofany class or category of persons .

8. Saving.-Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex-Servicemen and ether special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The Army personnel who possess qualifications or successfully completed courses recognized by Army as equivalent to the educational qualifications prescribed for these posts will also be eligible for such posts provided that such courses/qualifications are duly approved and recognized as equivalent by any Central/State authority like All India Council ofTechnical Education.

Note 2. In case of personnel recruited through deputation/ contractual/ re-employment basis from any source , the age of induction to National Disaster Response Force Battalions will be increased by 5 years .

Note 3. In case of problem faces in filling the posts of Head Constable (Nurse/ Assistant Nursing and Midwifery) by the department either through direct entry or by deputation , efforts will be made to employ/ engage some Nurse/ AssistantNursing and Midwifery on contractual basis either to take care of full time or part time requirement during the period of disaster .

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम संथ लोक सेवा आयोग स्वागतकर्ता समूह ' ख ' पद भर्ती नियम, 2009है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , दसका बर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

प्रतिनियुक्तिया आमेलन ।

प्रतिनियुक्ति या आमेलन केन्द्रीय सरकार के अधीन ऐसे अधिकारी :-

(क) ( i ) जो मूल काडर या विभाग में नियमितः आधार पर सदृश पद धारण किए हुए हैं ; या (ii ) जिन्होंने मूल काडर या विभाग में 2800/रु. के ग्रेड वेतन वाले 5200-20200/-रु. के वेतन बैंड या समतुल्य में उस पद पर नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष की नियमित

सेवा की हो; या

( ख ) जो किसी मान्यताप्राप्त विश्वविद्यालय से बैचेलर डिग्री या समतुल्य रखते हों ।

टिप्पण 1 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अधिक नहींहोगी ।

टिप्पण 2: प्रतिनियुक्ति या आमेलन पर नियुक्ति के प्रयोजन के लिए-1-1-2006 उस तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिफारिश पर आधारित पुनरीक्षित वेतन संरचना विस्तारित की गई है , से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा आयोग की सिफारिशों पर आधारित तत्स्थानी ग्रेड वेतन या विस्तारित वेतनमान में इसके सिवाय सेवा समझी जाएगी जहां सामान्य ग्रेड वेतन या वेतनमान वाले एक ग्रेड में एक से अधिक पूर्व पुनरीक्षित वेतनमान का विलयन किया गया है और जहां यह फायदा केवल ऐसे पद ( पदों ) पर विस्तारित किया गया हो जिनके लिए वह ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना प्रसामान्य प्रतिस्थापन ग्रेड है । 470

G.S.R. 124. In exercise ofthe powers conferred by the proviso to article 309 of the Constitution and in supersession oftheUnion Public Service Commission , Receptionist Group ' B' Post Recruitment Rules, 2004 , in so far as they relate tothe post of Receptionist, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Receptionist in the Office of Union Public Service Commission, namely:---

1. Short title and commencement.--( 1 ) These rules may be called the Union Public Service Commission Receptionist Group ' B' Post Recruitment Rules, 2009.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of post, its classification and the scale ofpay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Method of recruitment, age limit and qualifications,etc. The method of recruitment age limit, qualifications and other matters relating to the post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification . No person ,- (a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing , exempt anyperson from the operation ofthis rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient to do so, itmay, by order , for reasons , to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons .

6. Saving.-Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(b) possessing aBachelors Degree from a recognised University or equivalent.

Note 1 Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or other organization or Department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications .

Note 2 : For the purpose appointment on deputation or absorption . The service rendered on a regular basis by an officer prior to 1-1-2006 the date from which the revised pay structure based on the 6th CPC recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre -revised scale ofpay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post ( s ) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 125.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा कार्मिक, लोक शिकायत तथा पेंशन मंत्रालय , कार्मिक और प्रशिक्षण विभाग , विभागीय कैंटीन , समूह ' ग' और ' घ' पद भर्ती नियमावली , 1999 , को अधिक्रान्त करते हुए , सिवाए उन बातों के जो ऐसे अधिक्रमण से पहले की गई हो या किए जाने हेतु विलोपित की गई हो, राष्ट्रपति , कार्मिक, लोक शिकायत तथा पेंशन मंत्रालय, कार्मिक और प्रशिक्षण विभाग , विभागीय कैंटीन में समूह ' ग ' और ' घ ' पदों में भर्ती की पद्धति को विनियमित करते हुए एतद्वारा निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों को कार्मिक , लोक शिकायत तथा पेंशन मंत्रालय , कार्मिक और प्रशिक्षण विभाग , कैंटीन (समूह ' ग' और समूह ' घ' ) पद भर्ती नियमावली , 2009 कहा जाए ।

(2) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख को प्रवृत होंगे ।

2. प्रयुक्ति.-ये इन नियमों में अनुबंधित अनुसूची के कालम 1 में विनिर्दिष्ट पदों के लिए लागू होंगे ।

3. पदों की संख्या , वर्गीकरण और वेतनमान, उपर्युक्त पदों की संख्या , उनका वर्गीकरण तथा उनके साथ सलंग्न वेतनमान उपर्युक्त अनुसूची के कालम 2 से 4 में यथा विनिर्दिष्ट होंगे ।

4. भर्ती की पद्धति आयु सीमा , अहंताएं इत्यादि, अन्य मामले उपर्युक्त अनुसूची के कालम 5 से 14 में यथा विनिर्दिष्ट होंगे । 5. अनर्हताएं: -कोई व्यक्ति

(क) जिसने किसी ऐसे व्यक्ति जिसकी पत्नी या पति जीवित हो , से विवाह किया है या करने का अनुबंध किया है ; या ( ख) जिसने जीवित पत्नी या पति के होते हुए किसी व्यक्ति से विवाह किया है या करने का अनुबंध किया है ।

उपर्युक्तपदों में नियुक्ति के लिए पात्र नहीं होगा ।

बशर्ते कि केन्द्रीय सरकार, यदि वह इस बात से संतुष्ट हो कि ऐसा विवाह ऐसे व्यक्ति और विवाह से जुड़ी हुई अन्य पार्टी स्वीय विधि के अंतर्गत अनुमेय है और ऐसा करने के अन्य आधार हैं, तो वह ऐसे किसी व्यक्ति को इस नियम से छूट दे सकती है ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार का यह मत हो कि ऐसा करना आवश्यक या उचित है तो यह लिखित रिकार्ड किए गए जाने वाले कारणों की वजह से आदेश द्वारा तथा व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के किसी प्रावधान को शिथिल कर सकती है ।

7. व्यावृत्तिः- इन नियमों से आरक्षण, आयु सीमा में छूट तथा केन्द्रीय सरकार द्वारा समय- समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जन जातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष श्रेणियों को दी जाने वाली अन्य अपेक्षित रियायतों पर कोई प्रभाव नहीं पड़ेगा ।

नोट : जहां पर कनिष्ठ जिन्होंने अपनी योग्यता या पात्रता सेवा पूरी कर ली है, के नामों पर पदोन्नित के लिए विचार किया जा रहा है , उनके वरिष्ठों के नामों पर भी विचार किया जाएगा बशर्ते कि उनके पास ऐसी योग्यता या पात्रता सेवा के आधे से या दो वर्ष , जो भी कम हो , से कम सेवा अनुभव न हो तथा जिन्होंने अपने कनिष्ठ अभ्यर्थियों जिन्होंने ऐसी योग्यता या पात्रता सेवा पहले ही पूरी कर ली है ; सहित उच्चतर ग्रेड में पदोन्नति के लिए परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है ।

( 1 ) जो नियमित आधार पर सदृश पद धारित किए हों, अथवा

(2) विभागीय कैंटीन में लिपिक/सेल्समैन 5200-20200/- रु. के पे- बैंड ( वेतन बैंड-1 ) + 1900 रु. के ग्रेड वेतन ( 3050-4590 रु. के संशोधन पूर्व वेतनमान में ) कम से कम आठ वर्ष की नियमित सेवा की हो और निम्नलिखित शैक्षिणक योग्यताएं और अनुभव रखते हों; (क) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान अथवा उसके समकक्ष से स्नातक, बुक कीपिंग/स्टोर कीपिंग में एक वर्षीय डिप्लोमा सहित ।

(ख) किसी सरकारी विभाग अथवा सरकारी उपक्रम में स्टोर कीपर के तौर पर तीन वर्ष का अनुभव हो ।

नोट 1 : अनुसूचित जातियों/अनुसूचित जनजातियों से जुडे हुए अभ्यर्थियों के मामले में अनुभव संबंधी योग्यता में छूट सक्षम प्राधिकारी के विवेक पर निर्भर है , यदि चयन के किसी स्तर पर सक्षम प्राधिकारी का यह मत हो कि इन समुदायों के अपेक्षित अनुभव रखने वाले उम्मीदवार पर्याप्त संख्या में संभवतया उनके लिए आरक्षित रिक्तियों को भरने के लिए उपलब्ध न हों

नोट 2 : केन्द्र सरकार के ऐसे ही अथवा किसी अन्य संगठन/विभाग में इस नियुक्ति के तत्काल पहले धारित अन्य संवर्ग बाह्य पद में प्रतिनियुक्ति की अवधि सहित नियुक्ति की अवधि सामान्यतया तीन वर्षों से अधिक नहीं होगी । विभागीय पदाधिकारियों जो पदोन्नति के सीधे क्रम में हैं, प्रतिनियुक्ति पर नियुक्ति हेतु विचार करने के पात्र नहीं होंगे । इसी तरह प्रतिनियुक्त भी पदोन्नति द्वारा नियुक्ति के लिए विचार करने के पात्र नहीं होगें ।

चाय/कॉफी बनाने वाला और बैरा जिसकी रु. 5200-20200 के वेतन बैंड में ( वेतन बैंड-1 ) और 1800 रुपए के ग्रेड वेतन (2610-3540 रु. ) का संशोधन पूर्व वेतनमान में छः वर्ष की नियमित सेवा पूरी हो और किसी मान्यताप्राप्त विद्यालय अथवा संस्थान से मैट्रिकुलेशन अथवा समकक्ष की अर्हता रखता हो ।

टिप्पणी: जहां ऐसे कनिष्ठ कर्मचारियों, जिन्होंने अपनी अर्हक अथवा पात्रता सेवा पूरी कर ली है तो के नाम पर पदोन्नति के लिए विचार किया जा रहा है तो उनसे वरिष्ठों के नामों पर भी विचार किया जाएगा बशर्ते कि उनकी अर्हक अथवा पात्रता सेवा , ऐसी अर्हक अथवा पात्रता सेवा के आधे अथवा 2 वर्ष , इनमें से जो भी कम हो, से कम नहीं होनी चाहिए तथा उन्होंने अपने से उन कनिष्ठ कर्मचारियों जिन्होंने पहले ही अर्हक अथवा पात्रता सेवा पूरी कर ली हो , के साथ अगले उच्चतर ग्रेड में पदोन्नति के लिए अपनी परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हों ।

( ii ) चाय/कॉफी बनाने वाला और बैरा जिसने रु. 5200-20200 के वेतन बैंड में ( वेतन बैंड-1 ) और 1800 रु. ग्रेड वेतन (2610-3540 रु. पूर्व संशोधित वेतनमान ) में छः वर्ष की नियमित सेवा की हो और कॉलम 8 के अंतर्गत सीधी भर्ती वालों के लिए निर्धारित अनुभव रखते हों ।

टिप्पणी 1 : केन्द्र सरकार के किसी अन्य संगठन/विभाग में, इस नियुक्ति से ठीक पूर्व धारित किसी अन्य संवर्ग बाह्य पद में प्रतिनियुक्ति की अवधि सहित , इस प्रतिनियुक्ति की अवधि सामान्यतः तीन वर्ष से अधिक नहीं होगी । विभागीय कर्मचारी जो पदोन्नति के सीधे चरण में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं हैं । इसी प्रकार प्रतिनियुक्त पर चल रहे कर्मचारी भी पदोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं हैं ।

G.S.R. 125.-In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training , Department Canteen, Group ' C ' and ' D ' posts Recruitment Rules , 1999 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to Group 'C' and ' D ' posts in the Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training , Department Canteen, namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training , Departmental Canteen ( Group ' C ' and Group ' D' ) Posts Recruitment Rules,2009 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3.Number of posts , classification and scale of pay. The number ofthe said posts, their classification and scale ofpay attached thereto, shall be as specified in columns (2 ) to (4 ) of the said Schedule.

[PART II-SEC. 3 ( 1 )] 4. Method of recruitment, age limit, qualifications,etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule .

5. Disqualification.--No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

6. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any ofthe provisions ofthese rules with respect to any class or category of persons.

7. Saving-Nothing in these rules shall affect reservations, relaxations ofage - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , Ex- servicemen and other special categories ofpersons in accordance with the orders issuedby the Central Government from time to time in this regard.

G.S.R. 126-In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Homoeopathic Pharmacopoeia Laboratory, Ghaziabad (Group 'C ' and Group ' D' ) posts Recruitment Rules , 1976, in so far as it relates to the post of Scientific Assistant (Chemistry), except as respects things done or omitted tobe done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post ofScientific Assistant (Chemistry) in the Homoeopathic Pharmacopoeia Laboratory, Ghaziabad namely:---

1. Short title and commencement. ( 1 ) These rules may be called the Homoeopathic Pharmacopoeia Laboratory, Ghaziabad, Scientific Assistant ( Chemistry) Recruitment Rules,2009.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of the said post, its classification and the scale. of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules ,

3. Method of recruitment, age-limit and qualifications, sta The method ofrecruitment, age- limit, qualifications and other matters relating to the said post shall be as specified in columns ( 5) to(14) of the said Schedule.

4. Disqualification. No person,-

सा.का.फि. 127.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और होम्योपैथिक भेवजसंहित्ता प्रयोगशाला , गाजियाबाद ( समूह ' ग ' और समूह ' घ ' पद ) भर्ती नियम, 1976 को, जहां तक उनका संबंध वैज्ञानिक सहायक ( भेषज अभिज्ञान ) के पद से है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अभिक्रमण से पहले किया गया है या करने का लोप किया गया है , होम्योपैथिक भेषजसंहिता प्रयोगशाला , गाजियाबाद में वैज्ञानिक सहायक ( भेषज अभिज्ञान ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है अर्थात्:-

1. संक्षिप्त नाम और प्रारंभः ( 1 ) इन नियमों का संक्षिप्त नाम होम्योपैत्रिक भेषमसंहिता प्रयोगशाला , गाजियाबाद , वैज्ञानिक सहायक ( भेष्ज अभिज्ञान ) भर्ती नियम , 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद संख्या , वर्गीकरण और वेतनमान उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों *से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति , आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं । [ भाग II- खण्ड 3 (i) ]

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 127. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Homoeopathic Pharmacopoeia Laboratory, Ghaziabad (Group ' C ' and Group ' D ' posts Recruitment Rules , 1976, in so far as it relates to the post of Scientific Assistant ( Pharmacognosy) , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Scientific Assistant (Pharmacognosy) in the Homoeopathic Pharmacopoeia Laboratory, Ghaziabad namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Homoeopathic Pharmacopoeia Laboratory , Ghaziabad, Scientific Assistant ( Pharmacognosy ) Recruitment Rules , 2009.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay.--The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age - limit and qualifications , etc. The method of recruitment , age - limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification .-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

: 5. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall effect reservation, relaxation of age- limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

( ए) सरकारी आवास हेतु किसी अधिकारी की पात्रता भारत सरकार में अधिकारी के मौजूदा पद के ग्रेड वेतन के अनुरूप निर्धारित कीजाएगी ।

(बी ) निचले टाइपों अर्थात् टाइप -1 से टाइप- IV के संबंध में पूर्विकता तारीख भारत सरकार में सेवा में आने की तारीख होगी । (सी) उच्चतर टाइप के आवास में अंतः परस्पर वरिष्ठता निम्नलिखित सिद्धांतों के अनुरूप निर्धारित की जाएगी , यथाः (i ) प्रथमतः , अधिकारी का ग्रेड वेतन;

( ii ) इसके बाद समान ग्रेड वेतन के भीतर पूर्विकता तिथि । इस संबंध में पूर्विकता तिर्थि चह तिथि हौंगी जबसे आवेदक विद्यमान ग्रेड वेतन सतत रूप से आहरित कर रहा हो;

(iii ) जब दो अथवा दो से अधिक अधिकारियों की पूर्विकता तिथि सम्मान हो तो अधिकारियों की अंतः परस्पर वरिष्ठता उनके मूल वेतन के आधार पर निर्धारित की जाएगी अर्थात् उच्चतर अधिक मूल वेतन वाला अधिकारी प्रतीक्षा सूची में वरिष्ठ माना जाएगा;

( iv) जब दो अथवा दो से अधिक अधिकारियों की पूर्विकता तिथि व मूल वेतन समान हों तो अंतः परस्पर वरिष्ठता निर्धारण हेतु अगला सिद्धांत भारत सरकार की सेवा में पहले कार्यभार ग्रहण करने की तिथि है ;

( v ) जब दो अथवा दो से अधिक अधिकारियों की पूर्विकता तिथि , मूल वेतन तथा सरकारी सेवा ज्वाइन करने की तिथि समान हो तो पहले सेवानिवृत्त हो रहे अधिकारी को बाद में सेवानिवृत्त हो रहे अधिकारी से उच्चतर प्राथमिकता दी जाएगी ;

(डी) दो अथवा दो से अधिक अधिकारियों की अंतः परस्पर वरिष्ठता के निर्धारण का सिद्धांत जैसाकि खण्ड ( सी ) के उप खण्ड ( ii ) में विनिर्दिष्ट है 1 जनवरी , 2010 से लागू किया जाएगा ।

(ई ) जहां पर टाइप V व टाइप VI आवास को क्रमशः टाइप Vए तथा टाइप V बी एवं टाइप VI ए व टाइप VI बी के रूप में वर्गीकृत नहीं किया गया है वहां टाइप V हेतु पात्र सभी अधिकारियों को एक साथ रखा जाएगा तथा इसी प्रकार टाइप VI हेतु पात्र अधिकारियों को भी एक साथ कर दिया जाएगा;

( एफ ) भारत सरकार के सचिवों तथा अपर सचिवों के मामले में दिल्ली में भारत सरकार की सेवा में आने की तारीख से उनकी अंतः परस्पर वरिष्ठता निर्धारित की जाएगी बशर्ते उसी सेवा में अधिकारी के बैच के किसी कनिष्ठ अधिकारी को उसके बैच के वरिष्ठ अधिकारी से प्राथमिकता प्रदान न की गई हो । जिन मामलों में सेवा में आने की तारीख समान हो , सेवा निवृत्ति की तारीख उनकी परस्पर वरिष्ठता - क्रम इस सिद्धांत पर सुनिश्चित करेगी कि पहले आने वाली तारीख को बाद की तारीख से वरियता दी जाएगी । अखिल भारतीय सेवाओं ( ए आई एस ) से इतर अधिकारियों के मामले में तैनाती के स्थान को दरकिनार करते हुए उनके भारत सरकार में सेवा में आने की तिथि से अंतः परस्पर वरिष्ठता निर्धारित की जाएगी ।

(जी) टाइप- V तथा उच्चतर आवास के पात्र अधिकारी पात्रता से निचले आवास हेतु आवेदन करने के भी पात्र होंगे बशर्ते कि ऐसा आवास टाइप- IV स्पैशल आवास से कम न हों । तथापि , डी- II और टाइप- IV स्पै. के लिए पात्र अधिकारी टाइप- IV आवास हेतु आवेदन करने के लिए भी पात्र होंगे /होंगी ।

G.S.R. 128. In pursuance of the provisions of rule 45 of the Fundamental Rules , the President hereby makes the following rules further to amend the Allotment of Government Residences (General Pool in Delhi ) Rules , 1963 , namely:-

1. Short title and commencement-

(1) These rules may be called the Allotment of Government Residences (General Pool in Delhi ) Amendment Rules, 2009.

(2) They shall come into force from the date of publication in the Official Gazette .

2. Substitution of new Supplementary Rules for Supplementary Rules- 317-B- 5 :--In the Allotment ofGovernment Residences (General Pool in Delhi ) Rules , 1963 , for Supplementary Rule - 317-B - 5 , the following Supplementary Rules shall be substituted , namely :- "Classification of residences , S.R. 317 -B- 5

(1 ) Save as otherwise provided by these rules , an officer shall be eligible for allotment of residence of the type shown in column ( 1 ) of the Table below:

All lady officers without limit ofemolument shall be eligible Explanation: For the removal of doubt it is, hereby, clarified that,-

(a) the eligibility of an officer for Government accommodation shall be determined as per the Grade Pay of such officer in his present post held in the Government of India,

(b) the date ofpriority in respect of lower type accommodation i.e. Type - I to Type - IV shall be the date ofjoining inthe service of the Government of India,

(c) the inter -se seniority for the higher type accommodation shall be considered on the basis of following principles, namely:

(i) firstly the Grade Pay of the officer ;

(ii) secondly the priority date within the same Grade -Pay. In this case the priority date shall be the date from which the applicant continuously drawing his existing Grade Pay ;

(iii) where the priority date of two or more officers is the same , the inter- se seniority of the officers shall be determined on the basis of the basic pay i.e. the officers who have a higher pay shall be senior in the waiting list,

(iv) where the priority date and the basic pay of two or more officers are the same, the earlier date ofjoining inthe service of the Government of India shall be the next determining principle of inter-se seniority, (v) where the priority date, basic pay and date ofjoining in the service of the Government of India of two or more officers are the same, the officer retiring earlier may be accorded higher priority over the officer retiring later,

(d) the principle of determining the inter- se seniority of two or more officers as specified in sub - clause ( ii ) of clause(c) shall be implemented from the 1st January, 2010 .

(e) where Type- V and Type - VI accommodation has not been classified as Type V-A and Type V- B and Type-VI - A and Type- VI- B respectively, all the officers eligible for Type -V shall be grouped together and similarly those eligible for type -VI shall also be grouped together,

(f) in the case of Secretary to the Government of India and Additional Secretary to the Government of India, the date ofjoining in the Government of India at Delhi shall determine their inter - se seniority subject to condition that no junior batch officer of the same service shall get priority over his senior batch officer . Where the date ofjoining is the same, the date of retirement shall determine their inter-se seniority on the principle that the earlier date shall be given priority over the later date . Other than All India Services (AIS) , the date ofjoining the Government of India, irrespective of the place ofposting and service/batch seniority, shall determine the inter- se seniority,

(g) officers entitled for Type- V and above accommodation shall also be eligible to apply for accommodation below their entitlement subject to the condition that such accommodation shall not be below Type - IV Spl . accommodation . However, the officers eligible for D- II and Type- IV Spl . shall also be eligible to apply for Type- IV accommodation."
