सं. एनएचबी. एचएफसी . निर्देश 27/सीएमडी/2009--राष्ट्रीय आवास बैंक ने सार्वजनिक हित में आवश्यक समझते हुए, राष्ट्रीय आवास बैंक अधिनियम , 1987 ( 53/1987 ) के तहत् प्रदत्त शक्तियों का प्रयोग करते हुए आवास वित्त कंपनी ( रा.आ. बैंक ) निर्देश, 2001 जारी किये हैं ।
अतः अब, राष्ट्रीय आवास बैंक सार्वजनिक हित में आवश्यक समझते एवं संतुष्ट होते हुए कि देश में आवास वित्त प्रणाली को उसके लाभार्थ नियमित करने हेतु राष्ट्रीय आवास बैंक को समर्थ करने के लिए, ऐसा करना आवश्यक है, राष्ट्रीय आवास बैंक अधिनियम, 1987 ( 53/1987 ) की धाराओं 30ए और 31 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इस बारे में कार्रवाई करने के लिए समर्थ करने वाली सभी शक्तियों के अन्तर्गत एतद् द्वारा निर्देश देता है कि आवास वित्त कंपनी ( रा.आ.बैंक ) निर्देश , 2001 , तुरंत प्रभाव से निम्नानुसार पुनः संशोधित किये जाते हैं, यथा-
1. भाग घ में, अनुसूची II में
(i ) III (ई ) ( ii ) में दिये भद विवरण, मद कोड और जोखिम भार के लिए, निम्नलिखित प्रतिस्थापित किया जाएगा , यथा-

सं.कभनिसं/ अकेआ(क &गो)/नि.स.बी.-छूट (२ )/२८३ /2009-10 दिनांक २७.०८.२०० ९ जहाँ अनुसूची -1 में उल्लिखित नियोत्ताओं ने (जिसमें इसके पश्चात उक्त स्थापना कहा गया है ) कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम 1952 ( 1952 का 19) की धारा 17 की उप धारा २ (क) के अंतर्गत छूट के लिए आवेदन किया है जिसे इसमें इसके पश्चात अधिनियम कहा गया है।
चूंकि केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थपना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रूप में भारतीय जीवन बीमा निगम की सामूहिक बीमा योजना का लाभ उठा रहे हैं जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबद्ध बीमा योजना, 1976 के अंतर्गत स्वीकार्य लाभों से अधिक अनुकूल है (जिसे इसमें इसके पश्चात योजना कहा गया है) । अतः उक्त अधिनियम की धारा 17 की उप धारा 2 (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इसके साथ संलग्न अनुसूची में उल्लिखित शनों के अनुसार केन्द्रीय भविष्य निधि आयुक्त ने प्रत्येक के सामने उल्लिखित पिछली तारीख से प्रभावी तिथि से उक्त स्थापना को क्षेत्रीय भविष्य निधि आयुक्त, गोवा , एवं मंगलूर ने स्कीम की धारा 28 (7) के अंतर्गत ढील प्रदान की है, तीन वर्ष की अवधि के लिए संचालन को छूट प्रदान कर दी गयी है !
अनुसूची - ॥
2. उक्त स्थापना के संबंध में नियोक्ता ( जिसे इसके पश्चात नियोक्ता कहा गया ) केन्द्रीय भविष्य निधि आयुक्त द्वारा समय - समय पर निर्दिष्ट ऐसी विवरणियाँ संबंधित क्षेत्रीय भविष्य निधि आयुक्त को भेजेंगे तथा ऐसी राशि रखेंगे तथा निरिक्षण के लिए ऐसी सुविधाएँ प्रदान करेंगे । २. नियोक्ता केन्द्रीय सरकार द्वारा उक्त अधिनियम की धारा १७ की उप- धारा ( २क ) के खण्ड (क ) के अंतर्गत समय- समय पर निर्दिष्ट ऐसे निरिक्षण प्रभार प्रत्येक माह की समाप्ति के १५ दिन के भीतर भुगतान करेंगे ।
३. लेखाओं का रखरखाव, रिटर्न प्रस्तुत करना, बीमा किस्तों का भुगतान, लेखाओं का अंतरण , निरिक्षण प्रभार के भुगतान सहित सामूहिक बीमा योजना में सम्मिलित प्रशासन संबंधी सभी व्ययों को नियोक्ता द्वारा वहन किया जाएगा।
४. नियोक्ता केन्द्रीय सरकार/ केन्द्रीय भविष्य निधि आयुक्त द्वारा अनुमोदित तथा यथासंशोधित एवं अधिकांश कर्मचारियों की भाषा में उसके प्रमुख बातों के अनुवाद सहित सामूहिक बीमा योजना के नियमों की प्रति स्थापना के सूचना पटल पर प्रदर्शित करेंगे ।
4. यदि कोई कर्मचारी जो कर्मचारी भविष्य निधि या उक्त अधिनियम के अंतर्गत छूट प्राप्त स्थापना की भविष्य निधि के पहले से ही सदस्य हैं और उनकी स्थापना में नियोजित किया जाता है नियोक्ता उन्हें तत्काल सामूहिक बीमा योजना का सदस्य बनाकर भारतीय जीवन बीमा निगम निगम को उसकी आवश्यक किस्त का भुगतान करेंगे ।
६. यदि उक्त योजना के अधीन कर्मचारीयों को उपलब्ध लाभों में वृद्दि की जाती है तो नियोक्ता अपने कर्मचारीयों को सामूहिक बीमा योजना के अंतर्गत उपलब्ध लाभों में वृद्धि की व्यवस्था करेंगे जिसमें उक्त योजना के अंतर्गत स्वीकार्य लाभों से भी सामूहिक बीमा योजना के अंतर्गत उपलब्ध लाभ अधिक अनुकूल होंगे।
७. सामूहिक बीमा योजना में निहित किसी बात के होते हुए भी यदि कर्मचारी की मृत्यु हो जाने पर योजना के अंतर्गत देय राशि कर्मचारियों को उक्त योजना के अंतर्गत व्याप्त करने पर देय राशि से कम हो तो नियोक्ता, शेष भुगतान राशि कर्मचारी के नामिति (यों ) विधिक वारिस(सों) को हरजाने के रूप में भुगतान करेंगे ।
८ . संबंधित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना सामूहिक बीमा योजना के प्रावधानों में कोई संशोधन नहीं किया जाएगां तथा जहाँ किसी भी संशोधन से कर्मचारी के पक्ष में कोई प्रतिकूल प्रभाव पड्ने की संभावना हो तो क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने से पूर्व कर्मचारियों को उनका दृष्टिकोण समझाने का यथोचित अवसर देंगे ।
९. अतः किसी कारणवश उक्त स्थापना के नियोक्ता भारतीय जीवन बीमा निगम के सामूहिक बीमा योजना के, जिसको उक्त स्थापना द्वारा पहले से अपनाया गया है , के अधीन नहीं रहते और योजना के अंतर्गत दिए जाने वाले लाभों को किसी भी तरह से कम किए जाने पर छूट को रद्द किया जा सकता है । 6106

१०. यदि बिना किसा कारण के भारतीय जीवन बीमा निगम द्वारा नियत तिथि के भीतर नियुक्ति बीमा किस्त आदि का भुगतान न कर सके तथा पॉलिसी समाप्त की जाए तो छूट को रद्द किया जा सकता है ।
११. यदि नियोक्ता द्वारा बीमा किस्त के भुगतान में चूक होने पर मृत सदस्य जो उक्त योजना के अंतर्गत व्याप्त किया जा सकता था परंतु छूट देने के कारण उसके नामिति( यों ) , विधिक वारिस( सों) को बीमा लाभों के भुगतान का दायित्व नियोक्ता का होगा ।
१२. सामूहिक बीमा योजना के अंतर्गत व्याप्त सदस्य की मृत्यु होने पर भारतीय जीवन बीमा निगम मृत सदस्य के नामिति (यों ) तथा विधिक वारिस (सों ) जो बीमाकृत राशि के हकदार हैं को उस राशि को तथा किसी भी हाल में सभी प्रकार से पूर्ण दावों के प्राप्त होने के एक माह के भीतर शीघ्र भुगतान सुनिश्चित करें ।

संख्या: ए-12/11/1/2002- स्था .1- कर्मचारी राज्य बीमा अधिनियम, 1948(1948 का 34) की धारा 97 की उप- धारा (1 ) और उप- धारा(2) के खण्ड(21) और उप- धारा(2 क) तथा धारा 17 की उप- धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कर्मचारी राज्य बीमा निगम केन्द्र सरकार के अनुमोदन से कर्मचारी राज्य बीमा निगम ( निम्न श्रेणी लिपिक/एड्रिमा ऑपरेटर/ टेलीफोन ऑपरेटर/कम्प्यूटर) भर्ती विनियम , 2006 में संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है, अर्थात्: -
1. (1) ये विनियम कर्मचारी राज्य बीमा निगम ( निम्न श्रेणी लिपिक/एड्रिमा ऑपरेटर/टेलीफोन ऑपरेटर/ कम्प्यूटर) भर्ती (संशोधन) विनियम , 2009 कहे जायेंगे ।
(2) वे शासकीय राजपत्र में प्रकाशन की तारीख से लागू होंगे ।
2 . कर्मचारी राज्य बीमा निगम ( निम्न श्रेणी लिपिक/एड्रिमा ऑपरेटर/ टेलीफोन ऑपरेटर/ कम्प्यूटर) भर्ती विनियम, 2006 की अनुसूची में: -
(i) कॉलम 8 के अन्तर्गत प्रविष्टियों के लिए निम्नलिखित प्रविष्टियाँ प्रतिस्थापित की जाएंगी , नामतः:-
"(1) मान्यता प्राप्त बोर्ड से उच्चतम माध्यमिक उत्तीर्ण ( 12वें स्तर में उत्तीर्ण) या समतुल्य । (2) अंगरेजी में 40 शब्द प्रति मिनट अथवा हिन्दी में 35 शब्द प्रति मिनट की टंकण गति के साथ ऑफिस सुइट्स तथा डाटाबेस सहित कम्प्यूटर का कार्यसाधक ज्ञान । "
कॉलम 11 में शीर्षक के लिए निम्नलिखित शीर्षक प्रतिस्थापित किया जाए , नामतः:- (ii)
"भर्ती की पद्धति क्या सीधी भर्ती या पदोन्नति द्वारा अथवा प्रतिनियुक्ति/आमेलन द्वारा और विभिन्न पद्धतियों द्वारा भरी जाने वाली रिक्तियों की प्रतिशतता" ;
(iii ) कॉलम 12 में , " पदोन्नति " शीर्षक के अन्तर्गत प्रविष्टियों के उपरान्त निम्नलिखित टिप्पणी अंतःस्थापित की जाएगी: -
"टिप्पणी : जहाँ पदोन्नति के लिए कनिष्ठों जिन्होंने अर्हता/पात्रता सेवा पूरी कर ली है , पर विचार किया जा रहा है , वहाँ वरिष्ठों पर भी विचार किया जाएगा बशर्ते कि उनकी अपेक्षित अर्हता/पात्रता सेवा ऐसी अर्हता/पात्रता सेवा से आधे से अधिक कम अथवा दो वर्ष जो भी कम हो , से कम न हो और अगले उच्चतर ग्रेड में पदोन्नति के लिए अपनी परिवीक्षा अवधि, अपने कनिष्ठों , जो ऐसी अर्हता/पात्रता सेवा पूरी कर चुके है , के साथ सफलतापूर्वक पूरी कर ली है । "

Whereas , having considered it necessary in the public interest, the National Housing Bank had issued Housing Finance Companies ( NHB ) Directions , 2001 in exercise of the powers conferred on it under the National Housing Bank Act , 1987 ( 53 of 1987 ) ;
And Whereas the said Directions have been amended further by Direction No. NHB.HFC . DIR.24 / CMD/2008 dated December 02 , 2008 and Direction No. NHB . HFC.DIR.25 / CMD / 2008 dated December 02 , 2008 whereby changes were made with regard to categorisation of housing loans , the extent of risk weights to be assigned after such categorisastion as also risk weights to be assigned to fund based and non fund based exposures to commercial real estates necessitating corresponding changes in half yearly return specified under paragraph 39 of the Directions ;
Now therefore , the National Housing Bank having considered it necessary in the public interest and being satisfied that , for the purpose of enabling the National Housing Bank to regulate the housing finance system in the country to its advantage , it is necessary to do so , hereby in exercise of the powers conferred by section 30A and 31 of the National Housing Bank Act, 1987 (53 of 1987 ) and all the powers enabling it in this behalf, directs that the Housing Finance Companies Directions , 2001 , shall with immediate effect , be further amended in the following manner , namely :
1.In Schedule II , in Part D
(i) For item description, item code and risk weight given in III ( e)( ii) , the following shall be substituted, namely : -

No.EPFO /ACC ( K & G ) / DLI - Exm ( 2) /283/2009-10 dated 27.08.09 Whereas the employers of the establishment mentioned in the Schedule -l ( hereinafter referred to as the said establishment ) have applied for exemption under sub - Section 2( A) of Section 17 of the Employees' Provident Funds & Miscellaneous Provisions Act. 1952(19 of 1952 ) herein after referred to as the said Act.
And whereas the Central Provident Fund Commissioner , is satisfied that the employees of the said establishment are , without making any separate contribution or payment of premium , in enjoyment of benefits under the Group Insurance Scheme of the Life Insurance Corporation of India in the nature of Life Insurance which are more favourable to such employees than the benefits admissible under the Employees' Deposit Linked Insurance Scheme, 1976 ( hereinafter referred to as the said Scheme)
Now therefore, in exercise of the power conferredby Sub - Section 2( A) of the Section 17 of the said Act and subject to the conditions specified in Schedule - II annexed here to , the Central Provident Fund Commissioner hereby exempts each of the said mentioned establishments in Schedule -I from the date mentioned against each from which date relaxation order under Para 28 (7 ) of the said scheme has been granted by the Regional Provident Fund Commissioners , Goa & Mangalore from the operation of the said scheme for a period of 3 ( three) years.
Schedule-!!
1. The employer in relation to each of the said establishment ( hereinafter referred to as employer ) shall submit such returns to the Regional PF Commissioner concerned and maintain such amount and provide such facilities for inspection , as the Central P.F. Commissioner may direct from time to time.
2. The employer shall pay such inspection charges as the Central Govt . may from time to time , direct under Clause( A) Sub - Section (2A) of Section 17 of the said Act, within 15 days from the close of every month .
3. All expenses involved in the administration of the Group Insurance Scheme , including maintenance of account , submission of returns , payment of insurance premia , transfer accounts , payment of inspection charges etc. , shall be borne by the employer.
4. The employer shall display on the Notice Board of the establishment , copy of the rules of the Group Insurance Scheme as approved by the Central Government/Central Provident Fund Commissioner as and when amended alongwith translation of salient feature thereof in the language of the majority of the employees .
5. Where as an employee , who is already a member of Employees ' Provident Fund or the Provident Fund of an establishment exempted under the said Act , is employed in his establishment the employer shall immediately admit him as a member of the Group Insurance Scheme and pay necessary premium in respect of himto Life Insurance Corporation of India.
6. The employer shall arrange to enhance the benefits available to the employees under the Group Insurance Scheme appropriately if the benefit available to the employees under said scheme are enhanced so that the benefits available under Group Insurance Scheme are more favourable to the employees than the benefits admissible under the said Scheme .
7. Not withstanding anything contained the Group Insurance Scheme , if on the death of an employee the amountpayable under the Scheme be less than the amount that would be payable had the employees been covered under the said Scheme, the employer shall pay the difference to the nominee( s) legal heir( s ) of the employees as compensation .
8. No amendment of the provisions of the Group Insurance Scheme shall be made without the prior approval of Regional Provident Fund Commissioner concerned and where any amendment is likely to affect adversely the interest of the employees , the Regional PF Commissioner shall , give a reasonable . opportunity to the employees to explain their point of view, before according such approval .
9. Wherefore any reason , the employees of the said establishment do not remain covered under the Group Insurance Scheme of the Life Insurance Corporation of India as already adopted by the said establishment or the benefits to the employees under this scheme are reduced in any manner, the exemption shall be liable to becancelled.
10. Where for any reason , the employer fails to pay the premium etc. , within the due date , as fixed by the Life Insurance Corporation of India , and the policy is allowed to lapse , the exemption shall be liable to be cancelled.
11. In case of default , if any , made by the employer in payment of premium , the responsibility for payment of assurance benefits to the nominees ( s) legal heir( s) of deceased member who would have been covered under the said Scheme but for grant of this exemption shall be that of the employer .
12. Upon the death of the member covered under the Group Insurance Scheme , this Life Insurance Corporation of india shall ensure prompt payment of the sum assured to the nominees( s) and Legal Heir( s ) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in ali respect

I--In exercise of the powers confered by sub - section ( 1 ) and clause (xxi ) of sub - section (2) and sub - section (2A) of section 97 and sub - section (2) of section 17 of the Employees ' State Insurance Act , 1948 (34 of 1948) , the Employees' State Insurance Corporation hereby makes , with the approaval of the Central Government, the following regulations to amend the Employees' State Insurance Corporation ( Lower Division Clerk/ Adrema Operator /Telephone Operator/Computor) Recruitment Regulations , 2006, namely:-
1. ( 1 ) These reulations may be called the Employees' State Insurance Corporation (Lower Division Clerk/Adrema Operator/Telephone Operator/ Computor) Recruitment (Amendment) Regulations , 2009 .
(2) They shall come into force on the date of their publication in the Official Gazette .
"Note : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considred provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service ."

(i) for the entries under column 8, the following entries shall be substituted, namely : ---
" ( 1) Higher Secondary Pass (pass in 12th Standard) or equivalent from a recognised Board.
