सा.का.नि. 155.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए योजना आयोग ज्येष्ठ पुस्तकालय परिचर ( समूह ' घ ' पद ) भर्ती नियम , 1999 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व करने या करने का लोप किया गया है , योजना आयोग में ज्येष्ठ पुस्तकालय परिचर के पद की भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम योजना आयोग ज्येष्ठ पुस्कालय परिचर ( समूह ' ग ' पद ) भर्ती नियम , 2009 है ।.

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

उक्त पद की संख्या , उनका वर्गीकरण और उनका वेतन बैंड तथा ग्रेड 2. पद-संख्या , वर्गीकरण और वेर्तन बैंड तथा ग्रेड वेतन. वेतन वह होगा , जो'इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति, आयु - सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने कीशक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इनं नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिडछे वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार द्वारा जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों के लिए 40 वर्ष तक (अनुसूचित जातियों/अनुसूचित जनजातियों की बाबत 45 वर्ष तक) शिथिल की जा सकती हैं ।

टिप्पण 1 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है।

G.S.R. 155. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Planning Commission Senior Library Attendant ( Group ' D ' Post) Recruitment Rules , 1999 , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method ofrecruitment to the post of Senior Library Attendant in the Planning Commission , namely :---

PART II SEC. 3 ( i )] 1. Short title and commencement . ( 1 ) These rules may be called the Planning Commission Senior Library Attendant ( Group ' C ' Post ) Recruitment Rules , 2009 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, elassification , pay band and grade pay. The number of the said post , its classification , pay band and the grade pay applicable thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3.Method ofrecruitment, age and other qualifications , ete .--The method ofrecruitment age limit , qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the said Schedulc .

4. Disqualification. No person ,

( a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any other person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Schedule Tribes , other Backward Classes , Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 156.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कृषि मंत्रालय, पशुपालन, डेयरी और मत्स्यपालन विभाग के अधीन , राष्ट्रीय पशु स्वास्थ्य संस्थान , बागपत में आशुलिपिक श्रेणी -1 के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

2. पद-संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

सीधे भर्ती किए जाने वाले व्यक्तियों और प्रोन्नत किए जाने वाले व्यक्तियों के लिए दो वर्ष ।

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में , वहां उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , केन्द्रीय सरकार के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 : अनुभव संबंधी अर्हताएं केन्द्रीय सरकार के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में, वहां उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर केन्द्रीय सरकार की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा/प्रतिनियुक्ति/आमेलन द्वारा और विभिन्न पद्धतियों द्वारा भरी जाने वाली रिक्तियों की प्रतिशतता

प्रोन्नति:

प्रोन्नति, जिसके ने होने पर , प्रतिनियुक्ति द्वारा और दोनों के न हो सकने पर सीधी भर्ती द्वारा । 5200-20200 रुपए वेतन बैंड 2400 रुपए ग्रेड वेतन में, राष्ट्रीय पशु स्वास्थ्य संस्थान का, ऐसा आशुलिपिक श्रेणी 3 , जिसने उस श्रेणी में 10 वर्ष नियमित सेवा की है । टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी 636

अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति:

केन्द्रीय सरकार के अधीन ऐसे अधिकारी:-

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर या विभाग में 5200-20200 वेतन बैंड-1 और 2400 रुपए ग्रेड वेतन या समतुल्य में , उस पद पर नियुक्ति के पश्चात्, नियमित आधार पर , आशुलिपिक की श्रेणी में दस वर्ष सेवा की है। पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

In exercise of the powers conferred by the proviso to article 309 ofthe Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade I in the National Institute of Animal Health , Baghpat under the Ministry of Agriculture , Department of Animal Husbandry, Dairying and Fisheries namely:-

1. Short title and commencement. ( 1 ) These rules may be called the National Institute of Animal Health , Group 'B ' Post Recruitment Rules , 2009 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of post , its classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment, age limit , qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification . No person ,

(a) who has entered into or contracted marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall effect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Schedule Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Note : Wherejuniors who have completed their qualifying /eligibility service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ eligibility service.

Deputation : Officers under the Central Government;

( a) ( i ) holding analogous post on regular basis in the parent cadre , or department; or

(ii ) with 10 years ' service in the stenographer grade rendered after appointment thereto on a regular basis in the Pay Band - I of Rs . 5200-20200 Garde Pay Rs .2400 or equivalent in the parent cadre /Department. The departinental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.

Similarly deputationists shall not be eligible for consideration for appointment by promotion . Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of application .

सा.का.नि. 157.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पशुपालन डेयरी और मात्स्यिकी के अधीन , राष्ट्रीय पशु स्वास्थ्य संस्थान , बागपत में भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय पशु स्वास्थ्य संस्थान , बागपत ( समूह ' ग ' ) पद भर्ती नियम , 2009है ।

(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ). से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति ,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिडछे वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 640

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . सा.का.नि. 158.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और एकीकृत मछली उद्योग परियोजना ( सहायक फोरमैन ) भर्ती नियम , 1987 को, जहां तक उनका संबंध सहायक फोरमैन ( इंजन और उपस्कर ) और सहायक फोरमैन ( संरचनात्मक ) के पदों से है उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग के अधीन भारतीय मात्स्यिकी सर्वेक्षण , मुंबई में सहायक फोरमैन ( इंजन और उपस्कर ) और सहायक फोरमैन ( संरचनात्मक ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय , भारतीय मात्स्यिकी सर्वेक्षण , मुंबई, सहायक फोरमैन (इंजन और उपस्कर ) और सहायक फोरमैन ( संरचनात्मक ) समूह ' ग ' पद भर्ती नियम , 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागूहोना. ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ । में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद संख्या, वर्गीकरण एवं वेतनमान -उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो पूर्वोक्त अनुसूची के स्तंभ (2 ) से (4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हताएं. वह व्यक्ति ,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 649 [ भाग II- खण्ड 3 ( i ) ]

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Integrated Fisheries Project (Assistant Foremen ) Recruitment Rules , 1987 in so far as they relate to the posts of Assistant Foreman (Engine and Equipment ) and Assistant Foreman (Structural ), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Foreman (Engine and Equipment) and Assistant Foreman (Structural ) in the Ministry of Agriculture , Department of Animal Husbandry , Dairying and Fisheries , in the Fishery Survey of India, Mumbai , namely :-

1. Short title and commencement .- ( 1 ) These rules may be called the Ministry of Agriculture , the Fishery Survey of India, Mumbai , Assistant Foreman (Engine and Equipment ) and Assistant Foreman ( Structural ) Group ' C' PostRecruitment Rules, 2009 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the post specified in column ( 1 ) of the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the posts, their classification and the scales of pay attached thereto, shall be as specified in columns (2 ) to (4 ) of the Schedule aforesaid.

4. Method of recruitment, age limit, qualifications , etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto , shall be as specified in columns (5) to ( 14 ) of the Schedule.

5.Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any other person , shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule.

सा.का.नि. 159.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय भू- वैज्ञानिक सर्वेक्षण महानिदेशक , ज्येष्ठ उपमहानिदेशक ( संक्रियाएं ) और ज्येष्ठ उपमहानिदेशक ( वैज्ञानिक और तकनीकी समर्थन सेवाएं ) भर्ती नियम , 2002 को, जहां तक वे महानिदेशक पद से संबंधित हैं, सिवाए उन बातों के, जो ऐसे अधिक्रमण से पूर्व की गई हैं या जिनके करने का लोप किया गया है अधिक्रांत करते हुए, भारतीय भू- वैज्ञानिक सर्वेक्षण , खान मंत्रालय में महानिदेशक के पद पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम खान मंत्रालय भारतीय भू-वैज्ञानिक सर्वेक्षण महानिदेशक, समूह 'क' पद भर्ती नियम , 2009 है ।

(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतन बैंड , ग्रेड वेतन अथवा वेतनमान-उक्त पद की संख्या, उसका वर्गीकरण और उससे संबंधित वेतनमान इन नियमों से संलग्न अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में यथाविनिर्दिष्ट होंगे ।

3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , और संघ लोक सेवा आयोग के पसमर्श से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति:ज्येष्ठ उपमहानिदेशक ( संक्रियाएं ) और ज्येष्ठ उपमहानिदेशक (वैज्ञानिक और तकनीकी समर्थन सेवाएं ) , जिन्होंने उक्त श्रेणी में दो वर्ष की नियमित सेवा की हो , जिसके न होने पर ज्येष्ठ उपमहानिदेशक ( संक्रियाएं ) और ज्येष्ठ उपमहानिदेशक ( वैज्ञानिक और तकनीकी समर्थन सेवाएं ) और उपमहानिदेशक ( भू-विज्ञान ) अथवा उपमहानिदेशक ( भू- भौतिकी ) अथवा उपमहानिदेशक (भू- रसायन ) अथवा उप महानिदेशक ( इंजीनियरी ) की श्रेणियों में पांच वर्ष की सम्मिलित सेवा की हो ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो तो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए पात्रता सूची , संबंधित ग्रेड या पद में विहित अर्हित सेवा अधिकारी द्वारा समापन की तारीख से तैयार की जाएगी ।

प्रतिनियुक्ति(अल्पकालिक संविदा ) केन्द्रीय सरकार अथवा राज्य सरकारों अथवा संघ राज्य क्षेत्रों अथवा पब्लिक सेक्टर उपक्रम अथवा स्वायत निकाय अथवा अर्द्धसरकारी संगठन के अधीन ऐसे अधिकारी-

(क) ( i ) जिन्होंने मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है ; या

(ii ) जिन्होंने मूल काडर या विभाग में 6700-79000 रु. या समतुल्य वेतनमान में नियमित आधार पर वहां नियुक्ति के पश्चात् उक्त श्रेणी में दो वर्ष सेवा की' हो; और

(ख) स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित किए गए शैक्षिक अर्हताएं और अनुभव रखता है ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि , ( अल्पकालिक संविदा सहित ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि (अल्पकालिक संविदा ) है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

G.S.R. 159.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Geological Survey of India, Director General , Senior Deputy Director General (Operations) and Senior Deputy Director General ( Scientific and Technical Support Services) Recruitment Rules , 2002 , in so far as they relate to the post of Director General , except as respects things done or omitted to be done before such the supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director General in the Ministry of Mines , the Geological Survey of India , namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Ministry ofMines , the Geological Survey of India , Director General , Group 'A' Post , Recruitment Rules , 2009 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number ofpost, classification , pay band and grade pay or pay scale. The number of post, its classification , pay band and grade pay or pay scale attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Method of recruitment , age limit , qualifications , etc. The method of recruitment , age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person ,-

(a) who , has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for sodoing , exempt any person from the operation this rule .

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी की ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

G.S.R. 160. -In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Investigator in Central Institute for Research and Training in Employment Service under the Directorate General of Employment and Training , namely:-

1. Short title and commencement. -( 1 ) These rules may be called the Central Institute for Research and Training inEmployment Service ( Junior Investigator) , Group ' C' post Recruitment Rules, 2008:

(2) They shall come into force on the date of their publication in the Official Gazette.

2.Number of post, classification and seale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Méthod of recruitment, age limit and qualifications, etc.-The method of recruitment, age - limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule .

4. Disqualification .-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. -Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex -servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.
