का.नि.आ. 34. केन्द्रीय सरकार , तटरक्षक अधिनियम , 1978 की धारा 123 की उप-धारा ( 2 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तटरक्षक में सहायक कमांडेंट ( साधारण कर्त्तव्य ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:
2009 है । 1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम सहायक कमांडेंट महिला साधारण कर्त्तव्य-अल्प सेवा भर्ती नियम , (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद- संख्या , वर्गीकरण तथा वेतनमान उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा तथा अर्हताएं आदि. अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं । उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित 4. नियुक्तिकी अवधि, सहायक कमांडेंट साधारण कर्त्तव्य शाखा-महिला- अल्प सेवा भर्ती के रूप में चयनित महिला अभ्यर्थियों की नियुक्ति निम्नलिखित शर्तों के अध्यधीन होगी , अर्थात्:-
(क) महिला अधिकारियों की नियुक्ति की अवधि आठ वर्ष होगी , जिसे दस वर्ष तक बढ़ाया जा सकेगा और केन्द्रीय सरकार द्वारा उरो और चौदह वर्ष तक बढ़ाया जा सकेगा ।
(ख) महिला अधिकारियों के पास स्थायी भर्ती स्कीम में परिवर्तित होने का विकल्प नहीं होगा ।
(ग ) केंद्रीय सरकार का अनुमोदन प्राप्त करने के पश्चात् ही अपवादात्मक परिस्थितियों में महिला अधिकारियों को आठ वर्ष की सेवा पूरी करने से पूर्व पद त्याग करने के लिए अनुज्ञात किया जाएगा अन्यथा नहीं ।
5. वैवाहिक प्रास्थिति.-महिला प्रशिक्षणार्थियों को प्रशिक्षण पूरा करने या परिवीक्षा अवधि जो भी बाद में हो , के पूरा होने जाने तक विवाह करने के लिए अनुज्ञात किया जाएगा ।
परन्तु यह कि महिला अधिकारी के मामलें में, नियुक्ति आगे निम्नलिखित मर्यादाओं के आधार पर समाप्त कर दी जाएगी , अर्थात्;
(क ) यदि प्रशिक्षण पूरा होने की तारीख से 3 वर्षों के भीतर गर्भ धारण हो जाता है ।
( ख ) यदि नियुक्ति की निबन्धन के दौरान वह दो से अधिक गर्भधारण करती है ।
6. निरर्हता. वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है से विवाह किया है; या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह या विवाह का इकरार किया है, उक्त पद पर नियुक्ति के लिए पात्र नहीं होगाः
परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों तथा अन्य पिछड़े वर्गों और दूसरे विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

S.R.O. 34. In exercise of the powers conferred by clause ( b) ofsub - section ( 2) of Section 123 of the Coast Guard Act, 1978, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Commandant ( General Duty) in the Coast Guard, namely :-
1. Short title and commencement . These rules may be called the Assistant Commandant Women (General Duty) - Short Service Recruitment Rules , 2009.

[PART IISEC .4] (2) They shall come into force on the date of their publication in the Official Gazette.
2.Number of post, classification and the scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .
3. Method of recruitment, age limit and qualifications etc .---The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the aforesaid schedule .
4. Tenure of appointment. The appointment of selected women candidates as Assistant Commandant General DutyBranch - Short Service Women entry shall be subject to the following conditions , namely: --
(a) The tenure of appointment of women officers shall be eight years , which may be extended to ten years and may be further extended up to fourteen years by the Central Government .
(b) The women officers shall not have the option for change over to Permanent Entry Scheme.
(c) The women officers will not be permitted to resign before completion of eight years of service except in exceptional circumstances after approval of the Central Government .
5. Marital status . The women trainees shall not be permitted to enter into or contract a marriage till the completion oftraining or completion of probation whichever is later .
Provided that her appointment shall be terminated subject to the following further restrictions, namely (a) In case of pregnancy within three years from the date of completion of training .
(b) In case ofmore than two pregnancies during the entire term of appointment .
6. Disqualification.-No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(h) who, having a spouse living , has entered into or contracted a marriage with any person ,
Shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax.-Where the Central Government is of opinion that it is necessary or expedient so to do , it may by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions requirců to be provided for the Scheduled Castes , the Scheduled Tribes and other backward classes and other categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.
