सा.का.नि. 161.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय अन्वेषण ब्यूरो , कार्मिक, लोक शिकायत और पेंशन मंत्रालय , कार्मिक तथा प्रशिक्षण विभाग की तकनीकी सलाहकार यूनिट ( विदेशी मुद्रा या विदेशी व्यापार ) में पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम कार्मिक, लोक शिकायत और पेंशन मंत्रालय , कार्मिक तथा प्रशिक्षण विभाग , केन्द्रीय अन्वेषण ब्यूरो , तकनीकी सलाहकार यूनिट ( विदेशी मुद्रा या विदेशी व्यापार ) समूह ' क ' और समूह ' ख ' पद भर्ती नियम , 2009 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू नहीं, ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ । में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो उक्त अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि.-उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता.-वह व्यक्ति,-

[PART II-SEC. 3 (i ) ] (क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । पद का नाम

(ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं :-

आवश्यक:

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से बैचलर डिग्री या समतुल्य ।

( ii ) विदेशी व्यापार या विदेशी मुद्रा के क्षेत्र में निरीक्षण या सतर्कता या परिचालन कार्य का बारह वर्ष का अनुभव ।

वांछनीय:

किसी मान्यताप्राप्त विश्वविद्यालय से विधि में बैचलर डिग्री या समतुल्य या भारतीय चार्टड एकांउटेंट संस्थान के सदस्यों के रजिस्टर में नामांकन के लिए मान्यताप्राप्त अर्हता; या किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से कराधान , विधि में डिप्लोमा या समतुल्य या

किसी मान्यताप्राप्त विश्वविद्यालय से विदेशी व्यापार या अंतरराष्ट्रीय कारबार में स्नातकोत्तर डिग्री या एक वर्षीय डिप्लोमा या इसके समतुल्य ।

( क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

( ii ) जिन्होंने मूल काडर या विभाग में वेतन बैंड -3 ( 15600-39100 रु. + ग्रेड वेतन 6600

रु. ) या समतुल्य में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की हो; और

G.S.R. 161. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to posts in the Technical Advisory Unit ( Foreign Exchange or Foreign Trade) of the Central Bureau of Investigation, Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training , namely :-

1. Short title and commencement .( 1) These rules may be called the Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training, Central Bureau of Investigation , Technical Advisory Unit ( Foreign Exchnage or Foreign Trade) Group ' A' and Group ' B ' Posts Recruitment Rules, 2009.

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. Applicaton. These rules shall apply to the posts specified in column 1 ofthe Schedule annexed to these rules .

3. Number of post, classification and scale of pay. The number of post, their classification and the scale ofpay attachedthereto , shall be as specified in columns 2 to 4 of the said Schedule .

4.Method of recruitment, age limit, qualifications, etc.-The method of recruitment age limit, qualifications and other matters relating to the post shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Disqualification .-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons , to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect of any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - Serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 162.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल , चंडीगढ़ में ज्येष्ठ प्राध्यापक ( रेडियोनिदान ) , उपाचार्य ( रेडियोनिदान ) और आचार्य ( रेडियोनिदान ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सरकारी आयुर्विज्ञान महाविद्यालय और अस्पताल , चंडीगढ़ में ज्येष्ठ प्राध्यापक ( रेडियोनिदान ) , उपाचार्य ( रेडियोनिदान ) और आचार्य ( रेडियोनिदान ) भर्ती नियम , 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 676

2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होगा , जो इन नियमों से उपाबद्ध की अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , और अन्य अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिडछे वर्गों , भूतभूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

आवश्यकः ( 1 ) भारतीय आयुर्विज्ञान परिषद् अधिनियम , 1956 ( 1956 का 102 ) की अनुसूची में सम्मिलित कोई एक मूल विश्वविद्यालय या समतुल्य अर्हता और किसी राज्य आयुर्विज्ञान रजिस्टर या भारतीय आयुर्विज्ञान रजिस्टर में रजिस्ट्रीकृत होना चाहिए ।

(2 ) किसी मान्यताप्राप्त विश्वविद्यालय/संस्था से एम.डी. ( रेडियोनिदान ) /एम. डी. ( रेडियोलोजी )/एम. एस. (रेडियोलोजी) या समतुल्य ।

(3 ) स्नातकोत्तर अर्हता प्राप्त करने के पश्चात् वृत्ति में 10 वर्ष का अनुभव जिसमें 4 वर्ष का अनुभव किसी मान्यताप्राप्त आयुर्विज्ञान महाविद्यालय/शिक्षण संस्था में उपाचार्य/सहयुक्त आचार्य के रूप में होना चाहिए ।

टिप्पण 1 : अर्हताएं , अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

2. उपाचार्य ( रेडियोनिदान ) की श्रेणी में ऐसे विभागीय अधिकारी पर भी जिन्होंने उस श्रेणी में दो वर्ष नियमित सेवा की है , बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति, प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

(प्रतिनियुक्तिकी अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाहय पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

श्रेणी में दो वर्ष नियमित सेवा की है , बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसका पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्त के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

In exercise of the powers conferred by the proviso to article 309 of the constitution , the President hereby makes the following rules regulating the method of recruitment to the posts of Professor ( Radiodiagnosis) , Reader (Radiodiagnosis) and Senior Lecturer ( Radiodiagnosis ) in the Government Medical College & Hospital, Chandigarh , namely:-

[PART II-SEC. 3 (1 ) ] 1. Short title and commencement .-( i) These rules may be called the Government Medical College & Hospital, Chandigarh, Professor (Radiodiagnosis ), Reader (Radiodiagnosis) and Senior Lecturer (Radiodiagnosis ) , (Group ' A' Gazetted Posts) Recruitment Rules , 2009.

( ii) They shall come into force on the date of their publication in the Official Gazette.

2. These rules shall apply to the posts as specified in Column No. ( 1) of the Schedule annexed to these rules .

3. Number of posts , Classification and Scale of Pay. The number of the said posts , their classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the said schedule.

4.Method of recruitment, age limit , qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule.

5. Disqualification : No persons ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:

Provided that the Central Government, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any ofthe provisions of these rules with respect to any class or category of persons .

7. Savings . Nothing in these rules shall affect reservations , relaxations of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2 : The qualificalion(s) regarding experience is/ are relaxable at the discretion of the Union Public Service Commission inthe case of candidates belonging to the Scheduled Castes or the Scheduled Tribes . If at any stage ofselection, the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जां कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिंडछे वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 163. In exercise of the powers conferred by the proviso to article 309 of the constitution, the President herebymakes the following rules regulating the method ofrecruitment to the posts of Professor (Psychiatry) , Reader (Psychiatry) and Senior Lecturer (Psychiatry) in the Government Medical College & Hospital , Chandigarh , namely :--

1. Short title and Commencement .--( i) These rules may be called the Government Medical College & Hospital , Chandigarh , Professor (Psychiatry) , Reader (Psychiatry) and Senior Lecturer (Psychiatry) , (Group ' A' Gazetted Posts) Recruitment Rules , 2009.

( ii) They shall come into force on the date of their publication in the official Gazette .

2.These rules shall apply to the posts as specified in Column No. ( 1 ) of the Schedule annexed to these rules .

3.Number ofposts, Classification and Scale of Pay. The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said schedule.

4.Method of recruitment, age limit, qualifications etc. The method ofrecruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 14) of the said Schedule .

5.Disqualification : No persons:

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living has entered into or contracted a marriage with any person

shall be eligible for appointment to the said post :

Provided that the Central Government , may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

Savings . Nothing in these rules shall affect reservations, relaxations ofage limit and other concessions required to be provided for the Scheduled Caste, the Scheduled Tribes , Other Backward Classes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Note 1 : Qualifications are relaxable at the discretion of the Union Public Service Commission in case of candidates otherwise well qualified.

Note 2 : The qualification( s) regarding experience is/ are relaxable at the discretion ofthe Union Public Service Commission inthe case of candidates belonging to the Scheduled Castes or the Scheduled Tribes . सा.का.नि. 164.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मात्स्यिकी क्रियात्मक संस्थान ( वर्ग 3 और वर्ग 4 पद ) भर्ती नियम , 1968 , समाकलित मात्स्यिकी परियोजना ( समूह ' ग ' और ' घ ' पद ) भर्ती नियम , 1977 और केन्द्रीय मत्स्यउद्योग नाविक और इंजीनियरी प्रशिक्षण संस्थान ( समूह ' ग ' और ' घ ' पद ) भर्ती नियम , 1985 , को , जहां तक उनका संबंध विद्युत पर्यवेक्षक , नौ बिजली मिस्त्री और ज्येष्ठ बिजली मिस्त्री के पदों से है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग के अधीन केन्द्रीय मत्स्य नौचालन और इंजीनियरी प्रशिक्षण संस्थान , कोचीन में विद्युत पर्यवेक्षक और नौ बिजली मिस्त्री के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-

1 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय , केन्द्रीय मत्स्य नौचालन और इंजीनियरी प्रशिक्षण संस्थान, कोचीन, विद्युत पर्यवेक्षक और नौ बिजली मिस्त्री ( समूह ' ग ' पद ) भर्ती नियम, 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना. ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.-इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

4.Methodof recruitment, age limit, qualifications, etc.-The method ofrecruitment to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.

5.Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule.

7. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Schedules Tribes , the Other Backward Classes , the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम खान मंत्रालय , भारतीय खान ब्यूरो में उप निदेशक ( राजभाषा ) , समूह ' क' पद भर्ती नियम , 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे। 2. पद- संख्या, वर्गीकरण और वेतनमान -पद संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से हिन्दी में मास्टर डिग्री या समतुल्य और साथ ही डिग्री स्तर पर अंग्रेजी एक विषय के रूप में रहा हों;

किसी मान्यताप्राप्त विश्वविद्यालय से अंग्रेजी में मास्टर डिग्री या समतुल्य और साथ ही डिग्री स्तर पर हिन्दी एक विषय के रूप में रहा हो; या

किया जाएगा जिन्होंने उस श्रेणी में दस वर्ष नियमित सेवा की है यदि उस पद पर नियुक्ति के लिए उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

टिप्पण 1 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन से, किसी अधिकारी द्वारा , 1-1-2006 से पहले उस तारीख से, जिससे छठे केंद्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विचार किया गया है , नियमित आधार पर की गई सेवा को उक्त आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान पर की गई सेवा समझी जाएगी और प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन से किसी अधिकारी द्वारा 1-1-2006 से पहले उस तारीख से , जिससे छठे केंद्रीय वेतन आयोग के सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है , नियमित आधार पर की गई सेवा को , सिवाय उस दशा के जहां एक से अनधिक पूर्व पुनरीक्षित ग्रेड वेतन/ वेतनमान सहित एक श्रेणी में वेतनमान विलय हो गया है और वहां यह लाभ केवल उस पद ( उन पदों ) पर विस्तारित होगा जिसके लिए ग्रेड वेतन/वेतनमान बिना किसी उन्नयन के साधारण प्रतिस्थापन ग्रेड है । उक्त आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान पर की गई सेवा समझी जाएगी ।

टिप्पण 2 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 3 : प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) साधारणतया 3 वर्ष से अधिक नहीं होगी ।

टिप्पण 4 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा ।

(ii) Ten years experience of terminological work in Hindi or translation work from English to Hindi or vice- versa preferably of technical or scientific litera- ture; or

Ten years ' experience of teaching , research , writing or journalism in Hindi .

Desirable:

( i ) Knowledge of Sanskrit or any other language specified in the Eighth Schedule to Constitution .

(ii) Administrative experience;

(iii ) Experience of organising Hindi classes or workshop for noting and drafting; and

(iv) Knowledge of application ofcomputers in office work .

2.The departmental Assistant Director (Rajbhasha ) with ten years regular ser- vice rendered in that grade will also be considered alongwith outsiders and in case he is selected for appointment to the post, the same shall be deemed to havebeen filled by promotion.

Note 1 : For the purposes of computing minimum qualifying service for promo- tion, the service rendered on a regular basis by an officer prior to 1-1-2006 the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the said Corumission and for the purposes of appoint- ment on deputation basis , the service rendered on a regular basis by an officer 712

prior to 1-1-2006 the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the said Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay /pay scale and where this benefit will extend only for the post (s) for which that grade pay/pay scale is the normal replacement grade without any upgradation .

Note 2 : The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment by deputation, similarly deputationist shall not be eligible for consideration for appointment by promotion:

Note 3 : The period of deputation (including short term contract ) including period of deputation ( including short term contract ) in another ex - cadre post held immediately preceeding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not ex- ceed three years .

Note 4 : The maximum age limit for appointment by deputation ( including short term contract ) shall be not exceeding 56 years as on the closing date of receipt ofapplications .
