सा.का.नि. 32.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, वेंफद्रीय स्वास्थ्य सेवा नियम, 1996 का और संशोध्न करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. ;1द्ध इन नियमों का संक्षिप्त नाम वेंफद्रीय स्वास्थ्य सेवा ;संशोध्नद्ध नियम, 2009 है ।

(2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

G.S.R. 32.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Health Service Rules, 1996, namely :—

1. (1) These rules may be called the Central Health Service (Amendment) Rules, 2009.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Health Service Rules, 1996 in Schedule-IV, under the heading "A. Departmental Promotion Committee Higher Administrative Grade",—

(i) under the sub-heading "II. Teaching Specialist Sub-Cadre Posts", in item (c), the sub-item (iv) and entries relating thereto shall be omitted;

(ii) under the sub-heading "III. Non-Teaching Specialist Sub-Cadre Posts", in item (c), the sub-item (iv) and entries relating thereto shall be omitted;

(iii) under the sub-heading "IV. Public Health Sub-Cadre Posts", in item (c), the sub-item (iv) and entries relating thereto shall be omitted;

(iv) under the sub-heading "V. General Duty Sub-Cadre Posts",—

(d) in item (d), the sub-item (iv), and the entries relating thereto shall be omitted.

सा.का.नि. 33.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय भूमिगत जल बोर्ड ;भंडारीद्ध भर्ती नियम, 1971 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, जल संसाध्न मंत्राालय केन्द्रीय भूमिगत जल बोर्ड में भंडारी पद की भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम जल संसाध्न मंत्राालय केन्द्रीय भूमिगत जल बोर्ड, भंडारी, समूह 'ग' पद भर्ती नियम, 2010 है ।

(2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, उसका वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या विवाह की संविदा की है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।122 THE GAZETTE OF INDIA : FEBRUARY 13, 2010/MAGHA 24, 1931 [PART II—SEC. 3(i)]

भंडारी 31* ;2009द्ध साधरण केन्द्रीय वेतन बैंड-1 चयन नहीं 18 से 27 वर्ष के बीच *कार्यभार के सेवा समूह 'ग' 5200-20200 रफ. ;केन्द्रीय सरकार द्वारा समय-समय पर जारी किए गए अनुदेशों या आधर पर अराजपत्रिात, + ग्रेड वेतन परिवर्तन किया अननुसचिवीय 2400 रफ. आदेशों के अनुसार सरकारी सेवकों के लिए साधरण अभ्यथयों की दशा जा सकता है। में शिथिल करके 40 वर्ष तक और अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्याथयों की दशा में शिथिल करके 45 वर्ष तक की जा सकती हैद्ध । टिप्पण 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्‌दाख खंड, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है ।द्ध टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए परिवीक्षा की अवध्,ि यदि कोई हो अपेक्षित शैक्षिक और अन्य अर्हताएं विहित आयु और शैक्षिक अर्हताएं प्रोन्नत

टिप्पण 1 : अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में केन्द्रीय सरकार के विवेकानुसार शिथिल की जा सकती है। टिप्पण 2 ः अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध केन्द्रीय सरकार के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा या प्रोन्नति/प्रतिनियुक्ति/अन्तरण द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प(तियों द्वारा भरी प्रतिनियुक्ति/अन्तरण किया जाएगा जाने वाले पदों की प्रतिशतता

G.S.R. 33.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Ground Water Board (Store Keeper) Recruitment Rules, 1971, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Store Keeper in the Ministry of Water Resources, the Central Ground Water Board, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, the Central Ground Water Board, Store Keeper, Group 'C' post, Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification pay band and grade pay or pay scale.—The number of post, its classification pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.— No person,—

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. लागू होना.—ये नियम इन नियमों से उपाब( अनुसूची के स्तम्भ 1 में विनिदष्ट पदों को लागू होंगे । 3. पदों की संख्या, वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( उक्त अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है । 4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि :—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

5. निरर्हताएं.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या विवाह की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 36.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Water Resources Staff Car Driver Recruitment Rules, 2002, in so far as they relate to the posts of Staff Car Driver (Grade-I), Staff Car Driver (Grade-II) and Staff Car Driver (Ordinary Grade), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Staff Car Drivers in the Ministry of Water Resources, namely:

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources Staff Car Drivers Group' C' Posts Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the aforesaid Schedule.

5. Disqualification : No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes and Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. मैनुअल टापराइटर पर अंग्रेजी में 30 शब्द/हिन्दी में 25 शब्द प्रति मिनट न्यूनतम टंकण गति हो, या144 THE GAZETTE OF INDIA : FEBRUARY 13, 2010/MAGHA 24, 1931 [PART II—SEC. 3(i)] कम्प्यूटर पर अंग्रेजी में 35 शब्द प्रति मिनट या हिन्दी में 30 शब्द प्रति मिनट की न्यूनतम टंकण गति ;प्रत्येक शब्द के लिए 5 केजी दबाव की क्षमता पर 10500 केडीपीएच/9000 के डीपीएच मिनट और 30 शब्द प्रति मिनट से तत्संबंध्ी 35 शब्द प्रति मिनट परन्तु यह कि कोई व्यक्ति, जो टंकण में उक्त अर्हता नहीं रखता है, इस शर्त के अध्ीन रहते हुए नियुक्त किया जा सकेगा कि वह वेतनमान में वेतनवृ(ि आहरित करने के लिए तब तक अर्हक नहीं होगा जब तक कि वह टंकण में 30 शब्द प्रति मिनट की गति प्राप्त नहीं कर लेता हैऋ कि शारीरिक रूप से विकलांग कोई व्यक्ति, जो लिपिकीय पद को धरण करने के लिए अन्यथा अर्हक है, किन्तु टंकण में उक्त अर्हता नहीं रखता है, इस शर्त के अधीन रहते हुए नियुक्त किया जा सकेगा कि विकलांगों के लिए विशेष रोजगार कार्यालय से संलग्न चिकित्सा बोर्ड या जहां ऐसा बोर्ड नहीं है, वहां सिविल सर्जन यह प्रमाणित करे कि उक्त विकलांग व्यक्ति टंकण करने योग्य होने की उचित अवस्था में नहीं है ।

G.S.R. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following amendments in the Fishery Survey of India (Assistant, Upper Division Clerk and Lower Division Clerk) Recruitment Rules, 2008, namely :—

1. (1) These rules may be called the Fishery Survey of India (Assistant, Upper Division Clerk and Lower Division Clerk) Recruitment (Amendment) Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Fishery Survey of India (Assistant, Upper Division Clerk and Lower Division Clerk) Recruitment Rules, 2008 in the Schedule, against serial number 3 relating to the post of Lower Division Clerk/Hindi Typist (Lower Division Clerk) in column (8) for the existing entries the following entries shall be substituted, namely :—

"1. 12th Class or equivalent qualification from a recognized Board or University.

2. Minimum typing speed of 30 w.p.m. in English or 25 w.p.m. in Hindi on manual typewriter; or

Minimum typing speed of 35 w.p.m. in English or 30 w.p.m. in Hindi on computer. (35 w.p.m. and 30 w.p.m. correspond to 10500 KDPH/9000 KDPH on a average of 5 key depressions for each word) provided that a person not possessing the said qualification in typewriting may be appointed subject to the condition that he will not be eligible for drawing increments in the pay scale or for quasi-permanency or for confirmation in the grade till he acquires a speed of 30 words per minute in typewriting; that a physically handicapped person who is otherwise qualified to hold a clerical post but does not possess the said qualification in typewriting may be appointed subject to the condition that the Medical Board attached to the Special Employment Exchange for handicapped or where there is no such Board, the Civil Surgeon certified that the said handicapped person is not in a fit condition to be able to type.

Note 1: Qualification(s) is/are relaxable at the discretion of the Staff Selection Commission in the case of candidates otherwise well qualified.

Note 2 : The qualifications regarding experience are relaxable at the discretion of the Staff Selection Commission in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection the Staff Selection Commission is of the opinion that sufficient number of candidates trom these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them."

सा.का.नि. 39.—राष्ट्रपति, संंविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और समाकलित मात्स्यिकी परियोजना में विक्रयकर्ता, कनिष्ठ विपणन सहायक और विपणन सहायक भर्ती नियम, 2008 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय के अध्ीन पशुपालन, डेयरी और मत्स्यपालन विभाग के राष्ट्रीय मत्स्यपालन पोस्ट हार्वेस्ट प्रौद्योगिकी और प्रशिक्षण संस्थान, कोचीन में विक्रयकर्ता और कनिष्ठ विपणन सहायक के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

G.S.R. 39.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Integrated Fisheries Project, Salesman, Junior Marketing Assistant and Marketing Assistant Recruitment Rules, 2008 in so far as they relate to the posts of Salesman and Junior Marketing Assistant except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Salesman and Junior Marketing Assistant in the National Institute of Fisheries Post Harvest Technology and Training, Cochin, under the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, name:-

1. Short title and commencement.—(1) These rules may be called the National Institute of Fisheries Post Harvest Technology and Training, Salesman and Junior Marketing Assistant (Group 'C'), Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. —These rules shall apply to the posts as specified in column (1) of the Schedule annexed to these rules.

3. Number of the posts, their classification and the scales of pay. —The number of the said posts, their classification and the scales of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment to the said posts, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (14) of the aforesaid Schedule.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of these rules.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. —Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

;1द्ध इन नियमाें को भारतीय मृदा एवं भूमि उपयोग सर्वेक्षण, पफोटोग्रापिफक सहायक, भर्ती ;संशोध्नद्ध नियम, 2010 कहा जाएगा । ;2द्ध भारतीय मृदा एवं भूमि उपयोग सर्वेक्षण, पफोटोग्रापिफक, सहायक, भर्ती ;संशोध्नद्ध नियम, 2009 की अनूसूची में,—

G.S.R. 40.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Soil and Land Use Survey of India Photographic Assistant, Recruitment Rules, 2009 namely :—

1. These rules may be called the Soil and Land Use Survey of India Photographic Assistant, Recruitment (Amendment) Rules, 2010.

2. In the Schedule to the Soil and Land Use Survey of India Photographic Assistant, Recruitment Rules,2009 (i) in column 2, for the number and brackets '1 (One)' the number and symbol '1 * (2009) *subject to variation dependent on workload' shall be substituted;

(ii) in column 8, in item number (iii) the words' in a well established printing firm ', shall be deleted.
