का.नि.आ. 5.-केन्द्रीय सरकार , तटरक्षक अधिनियम, 1978 ( 1978 का 30 ) की धारा 123 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तटरक्षक ( साधारण ) नियम, 1986 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक ( साधारण ) संशोधन नियम , 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. तटरक्षक (साधारण ) नियम , 1986 के नियम 4 में,-

(1 ) उपनियम (2 ) के खंड ( घ ) में विद्यमान प्रविष्टि के स्थान पर " कमांडर तटरक्षक क्षेत्र , उत्तर- पश्चिम " प्रविष्टि रखी जाएगी ;

(2) उपनियम (3 ) में, -

(i ) खंड (क) में " गुजरात " एवं " दीव " शब्दों का लोप किया जाएगा ;

(ii ) खंड (ख ) में विद्यमान प्रविष्टि के स्थान पर " तटरक्षक क्षेत्र , उत्तर - पश्चिम में गुजरात राज्य और संघ राज्य क्षेत्र दीव के तटीय क्षेत्रों के साथ- साथ भारत के तटीय क्षेत्र और सामुद्रिक क्षेत्र समाविष्ट होंगे " प्रविष्टि रखी जाएगी ।

S.R.O. 5.-In exercise of the powers conferred by sub- section ( 1) of Section 123 of the Coast Guard Act, 1978 (30 of 1978), the Central Government hereby makes the following rules , to amend the Coast Guard (General ) Rules , 1986, namely:--

1. ( 1) These rules shall be called the Coast Guard (General ) Amendment Rules , 2010 .

(2) They shall come into force on the date of publication in the Official Gazette .

2. In the Coast Guard (General ) Rules, 1986 , in rule 4 ,-

(1) in sub - rule (2) , in clause (d) for the existing entry the entry "The Commander, Coast Guard Region , North West" , shall be substituted ;

(2) in sub - rule (3)-

(i) in clause ( a) , the words " Gujarat " and " Diu " , shall be omitted;

(ii) in clause (d) , for the existing entry , the entry " The Coast Guard Region, North West , shall comprise of the coastal areas and the maritime zones of India along the coastal areas of the State ofGujarat and the Union Territory of Diu " , shall be substituted .

का.नि.आ. 6.-केन्द्रीय सरकार, रक्षा संकर्म अधिनियम , 1903 ( 1903 का 7 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि नीचे दी गई अनुसूची में वर्णित भूमि के उपयोग और उपभोग पर जो वायुवाहित प्रणाली केन्द्र बेलूर , येमलूर पोस्ट, बेंगलोर-560037 के पास की भूमि है, उक्त अधिनियम की धारा 7 के खंड (ग ) में विनिर्दिष्ट निर्बधनों को अधिरोपित करना आवश्यक है , ताकि उक्त भूमि को भवन निर्माण और अन्य अवरोधों से मुक्त रखा जा सके ।

2. उक्त भूमि के रेखाचित्र का उपायुक्त ( राजस्व ) बेंगलोर , शहरी जिला, बेंगलोर, कर्नाटक कार्यालय में निरीक्षण किया जा सकेगा ।

2. A sketch plan of the said land may be inspected in the office of the Deputy Commissioner ( Revenue) Bangalore, UrbanDistrict, Bangalore , Karnataka.

का.नि.आ. 7.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा मंत्रालय ( वर्ग III पद) भर्ती नियम , 1969 जहां तक उनका संबंध लेखाकार के पद से है उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , रक्षा मंत्रालय सैनिक प्रशिक्षण निदेशालय के अधीन सैनिक प्रशिक्षण स्थापना में लेखाकार के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ.( 1 ) इन नियमों का संक्षिप्त नाम सैनिक प्रशिक्षण निदेशालय लेखाकार समूह ' ग ' पद भर्ती नियम, 2010है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतन बैंड और ग्रेड वेतन/वेतनमान.-उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतन बैंड और ग्रेड वेतन /वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगाः

परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति द्वारा , जिनके न हो सकने पर प्रतिनियुक्तिया आमेलन द्वारा ।

प्रोन्नति: ऐसे उच्च श्रेणी लिपिक, खजांची और लेखाकार जिन्होंने वेतन बैंड-1 के वेतनमान रुपए 5200-20200 रुपए 2400 ग्रेड वेतन की उस श्रेणी में पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए पात्रता की सूची उनके संबंधित श्रेणी या पद में विहित अर्हता सेवा में विहित अधिकारियों द्वारा उस तारीख को पूरा करने के संदर्भ में तैयार की जाएगी ।

प्रतिनियुक्ति: 1. केंन्द्रीय सरकार के ऐसे अधिकारी-

(क) जो नियमित आधार पर सदृश पद धारण किया हुआ है ;

(ख) जिन्होंने वेतनमान रुपए 5200-20200 रुपए 2400 ग्रेड वेतन के पद पर रक्षा लेखा विभाग में या केन्द्रीय सरकार के किसी अन्य लेखा विभाग में समतुल्य पद पर पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : पोषक वर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि साधारणतया 3 वर्ष से अधिक नहींहोगी ।

टिप्पण 3 : प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना

S.R.O. 7. In exercise of the powers conferred by the proviso to article 309 of the supersession ofthe Ministry ofDefence (Class - III posts ) Recruitment Rules , 1969 , in so far as they relate to the post ofAccountant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accountant in the Military Training Establishments under Military Training Directorate ofMinistry of Defence , namely:-

1. Short title and commencement. ( 1 ) These rules may be called Military Training Directorate Accountant, Group ' C' Posts Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number of post , classification and Pay band and grade pay/pay scale . The number of the post, its classifica- tion and the Pay band and grade pay /pay scale attached thereto , shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment, age limit and other qualifications . The method ofrecruitment, age limit , qualifications and other matters relating to the said post , shall be as specified in columns (5 ) to ( 14) of the said Schedule.

4. Disqualification . No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted marriage with any person;

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category ofpersons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors , who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered , provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service .

Note 2: The eligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in their respective grade/post.

Deputation:

1. officers of the Central Government :

(a) holding analogous post on regular basis;

(b) with five years regular service in post in the pay scale of Rs . 5200-20200 + Rs . 2400 Grade Pay or equivalent in Defence Accounts Department or any other Accounts Department of the Central Government .

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation . Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

Note 2: Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organization/Department of the Central Government shall ordinarily not exceed three years .

Note 3 : The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of the receipt of applications .

3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि-उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए, किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, संघ लोक सेवा आयोग के परामर्श से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

In exercise of the powers conferred by the proviso of article 309 of the Constitution and in supersession of theMilitary Engineer Services (Principal Barrack Stores Officer) Recruitment Rules , 1978 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Principal Barrack Stores Officer in the Military Engineer Services , namely :----

1. Short title and commencement . ( 1 ) These rules may be called the Military Engineer Services Principal Barrack StoresOfficer Group ' A ' Post Recruitment Rules , 2010 .

(2).They shall come into force on the date of their publication in the Official Gazette.

2.Number of post, classification and scale of pay . The number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment, age limit and other qualifications , etc.-The method ofrecruitment, age limit and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification .-No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient to do so , it mayby order , and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , the Other Backward Classes , the Ex -servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

का.नि.आ. 10.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा मंत्रालय, सेना चिकित्सा कोर , वार्ड सहायिका ( सिविलियन ) समूह ' घ ' पद भर्ती नियम , 2006 को, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, सेना चिकित्सा कोर में वार्ड सहायिका के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

[PART II-SEC. 4] 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सेना चिकित्सा कोर , वार्ड सहायिका ( सिविलियन ) , समूह ' ग ' पद भर्ती नियम, 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण , उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 1 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु-सीमा और अन्य अर्हताएं आदि उक्त पद पर भर्ती की पद्धति , आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए सलाह दी गई है ।

S.R.O. 10. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution and in supersession ofthe Army Medical Corps , Ward Sahayika ( Civilian ) Group ' D ' Post Recruitment Rules , 2006 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Ward Sahayika in the Army Medical Corps , namely : ---

1. Short title and commencement. ( 1 ) These rules may be called the Army Medical Corps , Ward Sahayika (Civilian) Group ' C ' post, Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number ofpost, classification and Scale of Pay.-- The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the aforesaid Schedule.

4. Disqualification. No person ,- (a)Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who , having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time.
