सा.का.नि. 50.—केन्द्रीय सरकार, भारत के संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विभागीय परीक्षा ;केन्द्रीय उत्पाद शुल्क और सीमाशुल्कद्ध नियम, 2008 का और संशोध्न करने के निम्नलिखित नियम बनाती है, अर्थात्‌ :—

1. ;1द्ध इन नियमों का संक्षिप्त नाम विभागीय परीक्षा ;केन्द्रीय उत्पाद शुल्क और सीमाशुल्कद्ध संशोध्न नियम, 2010 है । ;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. विभागीय परीक्षा ;केन्द्रीय उत्पाद शुल्क और सीमाशुल्कद्ध नियम, 2008 में :—

;कद्ध नियम 2 के उप-नियम ;2द्ध के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्‌ :—

फ्;2द्ध हिन्दी में परीक्षा : इस नियम में निदष्ट राजपत्रिात और अराजपत्रिात सभी अध्किारी जिनको विभागीय परीक्षा उत्तीर्ण करना अपेक्षित है, परिशिष्ठ फ्कय् से फ्छय् में विनिदष्ट पाठ्‌यक्रम के अनुसार हिन्दी में परीक्षा भी उत्तीर्ण करेंगेय्ऋ ;खद्ध नियम 5 में,

G.S.R. 50.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the Central Government hereby makes the following rules further to amend the Departmental Examination (Central Excise and Customs) Rules, 2008, namely :—

1. (1) These rules may be called the Departmental Examination (Central Excise and Customs) Amendment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Departmental Examination ( Central Excise and Customs) Rules, 2008:—

(a) in rule 2, for sub-rule (2), the following sub-rule shall be substituted, namely :—

"(2) Test in Hindi :—All officers, Gazetted and non-Gazetted referred in this rule, who are required to pass the departmental examination shall also pass the test in Hindi as per the syllabus specified in Appendices A to G".;

(b) In rule 5,

(i) in sub-rule (I), in clause (c), for the proviso the following proviso shall be substituted, namely :—

" Provided that in case where an officer is not able to pass the departmental examination within the specified period, the Central Board of Excise and Customs (hereinafter referred to as the 'Board') may, for reasons to be recorded in writing, extend the period.";

(ii) in sub-rule (2), in clause (b) after the words "two years" the words "for reasons to be recorded in writing, extend the period" shall be inserted;

(iii) in sub-rule (2), in clause (c) after the words "for further chance" the words "for reasons to be recorded in writing, extend the period" shall be inserted;

(c) in rule 7, for sub-rule (6), the following sub-rule shall be substituted, namely :—

"(6) The Board may, for any special reasons, to be recorded in writing, exempt an officer from passing either the whole or a part of the examination.";

(d) Under the heading APPENDIX-D, the following shall be inserted, namely: "[ See rule 2( 1)( d)]"; and (e) In APPENDIX-F, under Paper-III-COMPUTER APPLICATION AND PROFICIENCY IN USE OF INTERNET, the following shall be inserted, namely :—

"(Time allowed: 3 hours)".

सा.का.नि. 51.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय भेड़ प्रजनन पफार्म, हिसार में ;समूह 'ग' और 'घ' पदद्ध भर्ती नियम, 1985 को, जहां तक उसका संबंध् बढ़ई-सह-लुहार के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अक्रिमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्य पालन विभाग, केन्द्रीय भेड़ प्रजनन पफार्म, हिसार में बढ़ई-सह-लुहार के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, पशु पालन, डेयरी और मत्स्य पालन विभाग, केन्द्रीय भेड़ प्रजनन पफार्म, हिसार बढ़ई-सह-लुहार ;समूह 'ग' पदद्ध भर्ती नियम, 2010 है । (2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान.—पद संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह करने की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किन्हीं उपबंधें को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और भूतपूर्व-सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।198 THE GAZETTE OF INDIA : MARCH 13, 2010/PHALGUNA 22, 1931 [PART II—SEC. 3(i)]

टिप्पणी 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से ;उनसे भिन्न जो अंदमान और निकोबार द्वीप तथा लक्षद्वीप में हैंद्ध आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ।

टिप्पण 2 : रोजगार कार्यालय के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा गया है ।

G.S.R. 51.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Group 'C' and 'D' posts in Central Sheep Breeding Farm, Hissar Recruitment Rules, 1985 in so far as they relate to the post of Carpenter-cum-Blacksmith except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Carpenter- cum-Blacksmith in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Sheep Breeding Farm, Hissar namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Central Sheep Breeding Farm, Hissar, Carpenter-cum-Blacksmith (Group "C" Post) Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay.—The number of post, its classification and the scales of pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications etc. .—The method of recruitment to the said post, age limit, qualifications and other matters relating there to shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall effect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 52.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Ground Water Board, Driller-cum-Mechanic Recruitment Rules, 2004 namely :—

1. (1) These rules may be called the Central Ground Water Board, Driller-cum-Mechanic Recruitment (Amendment) Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Ground Water Board, Driller-cum-Mechanic Recruitment Rules, 2004, for the Schedule, the following Schedule shall be substituted, namely :—

The maximum age limit for eligibility for examination shall be 45 years for general candidates and 50 years of age for the Scheduled Castes and the Scheduled Tribes.
