The Central Public Information Officer (CPIO) shall deal with requests from persons seeking information and render reasonable assistance to the persons seeking such information. Any officer, whose assistance has been sought under the above mentioned Act, shall render all assistance to the Central PIOs and for the purposes of any contravention of the provisions of this Act, such other officer shall be treated as Central PIO under Section 5(5) of the Right to Information Act, 2005.

सा.का.नि. 55.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्यपालन विभाग में उपायुक्त ;डेयरी विकासद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम पशुपालन, डेयरी और मत्स्यपालन विभाग, उपायुक्त ;डेयरी विकासद्ध समूह 'क' भर्ती नियम, 2010 है ।

(2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, उसका वर्गीकरण और वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह अथवा कांट्रेक्ट विवाह किया है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह या कांट्रेक्ट विवाह किया है, उक्त पद पर नियुक्ति का पात्रा नहीं होगाः

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

;iiiद्ध डेयरी विकास में, सरकारी या सहकारी क्षेत्रा मान्यताप्राप्त अनुसंधन और विकास संस्थान में ज्येष्ठ पद पर दस वर्ष का अनुभव ।

टिप्पण : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

G.S.R. 55.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Commissioner (Dairy Development) in the Ministry of Agriculture, Department of Animal Husbandry Dairying and Fisheries, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry Dairying and Fisheries, Deputy Commissioner (Dairy Development) Group 'A' Post, Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, its classification and scale of pay.—The number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualifications.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation (including short term contract ) : Officers under the Central Government or State Governments or Union Territories or Public Sector Undertakings or Autonomous or Statutory Organisations or Agricultural Universities or recognised Research Institutions or Councils :

(ii) with five years' service in the grade rendered after appointment therto on a regular basis in the scale of pay of

Rs. 15600-39100 (PB-3) with grade pay of Rs. 6600 or equivalent in the parent cadre or department; and

(b) possessing the following educational qualifications and experience :

(i) Degree in Dairy Technology or Deiry Science from a

recognised University or Institute.

(ii) Post Graduate Degree in Dairying with specialisation in Dairy Technology or Dairy Science from a recognised University or Institute.

(iii) Possessing ten years' experience in a senior capacity

in Dairy Development or Research in the Government or Co-operative Sector or in a recognised Research and Development Institution.

Note : The departmental officers in the feeder categories

who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.

Similarly, deputationist shall not be eligible for consideration for appointment by promotion.

Period of deputation including the period of deputation

(ISTC) in another ex-cadre post held immediately preceding this appointment in same or some other organisation or department of the Central Government shall ordinarily not

exceed four years. The maximum age limit for appointment by deputation (ISTC) shall be not exceeding 56 years as on the closing date of the receipt of application.

2. पद-संख्या, वर्गीकरण और वेतनमान.—पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह करने की संविदा की है या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, उक्त पदों पर नियुक्ति का पात्रा नहीं होगाः

परंतु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 56.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Sheep Breeding Farm, Hisar (Group 'C' and 'D') Recruitment Rules 2005, in so far as they relate to the post of Electrician except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Electrician in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Sheep Breeding Farm Hisar, namely :—

1. Short title and commencement. —(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Central Sheep Breeding Farm Hisar, Electrician (Group 'C' Post) Recruitment Rules, 2010.

(2). They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. —The number of the posts, their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit qualifications etc. —The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

5. Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from operation of this rule.

6. Power to relax. —Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 57.—वायुयान नियम, 1937 का और संशोध्न करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जो केन्द्रीय सरकार, वायुयान अध्निियम, 1934 ;1934 का 22द्ध की धरा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है, उक्त अध्निियम की धरा 14 द्वारा अपेक्षित तथा उन सभी व्यक्तियों की जानकारी के लिए जिनके उनसे प्रभावित होने की संभावना है, प्रकाश्ति किया जाता है और सूचना दी जाती है कि भारत के राजपत्रा में प्रकाशित अध्सिूचना की प्रतियों को सार्वजनिक रूप से उपलब्ध् कराये जाने की तारीख से तीस दिन की अवध् िके पश्चात्‌ उक्त प्रारूप पर विचार किया जाएगा ऋ

2. वायुयान नियम, 1937 में,

; iद्ध नियम 3 में, खंड ;33कद्ध के पश्चात्‌, निम्नलिखित खंड अंतः स्थापित किया जाएगा, नामशः :—

'';33खद्ध ''अनुरक्षण'' से ओवरहॉल, निरीक्षण, प्रतिस्थाप, दोष सुधर तथा उपांतरण या मरम्मत या जाँच में से कोई एक या इनके संयोजन सहित, किसी विमान की सतत उड़नयोग्यता सुनिश्चित करने के लिए अपेक्षित कार्यो का निष्पादन अभिप्रेत है ऋ''ऋ

; iiद्ध नियम 61 के लिए, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, नामशः—

''61. वायुयान अनुरक्षण इंजीनियरों का अनुज्ञापन.— ;1द्ध केन्द्रीय सरकार उन व्यक्तियों को, जो इस नियम में विनिदष्ट अपेक्षाओं को पूरा करते हैं, इस नियम के प्रावधन के अनुसार अनुज्ञप्तियां, प्राध्किार पत्रा या अनुमोदन या सक्षमता प्रमाणपत्रा प्रदान कर सकेगी ।

;2द्ध वायुयान अनुरक्षण इंजीनियर अनुज्ञापन या प्राध्किार पत्रा, अनुमोदन या सक्षमता प्रमाणपत्रा प्रदान करने हेतु या उसके विस्तारण हेतु महानिदेशक ;घद्ध ख 1.1 विमान टर्बाइन

;चद्ध ख 1.2 विमान पिस्टन

;छद्ध ख 1.3 हेलीकॉप्टर पिस्टन

;जद्ध ख 1.4 हेलीकॉप्टर पिस्टन

;खद्ध उसने मान्यताप्राप्त बोर्ड या विश्वविद्यालय से भौतिकी, रसायन और गणित के साथ 10 2 या उसके समकक्ष परीक्षा उत्तीर्ण की होऋ

;गद्ध उसने महानिदेशक द्वारा विनिदष्ट एक लिखित परीक्षा उत्तीर्ण की होऋ

परन्तु महानिदेशक ऐसी शर्तों के अध्ीन जो वे लगाना उचित समझे, किसी आवेदक को लिखित परीक्षा से छूट दे सकेगा, यदि आवेदक को संविदाकारी देश द्वारा वायुयान अनुरक्षण इंजीनियर की हैसियत से कार्य करने के लिए अनुज्ञप्ति प्रदान की गई होऋ और ;घद्ध उसके पास कम से कम निम्नलिखित व्यावहारिक अनुभव होना चाहिए, नामशः :—

परन्तु उपर्युक्त ;iद्ध और ; iiद्ध में विनिदष्ट अनुभव अपेक्षाएं ऐसे आवेदक के मामले में एक वर्ष तक कम होंगी जिसने नियम 133ख के अंतर्गत अनुमोदित किसी प्रशिक्षण संगठन में संतोषजनक रूप से प्रशिक्षण पूर्ण किया हो या जिसने मान्यता प्राप्त विश्वविद्यालय से अभियांत्रिाकी में डिग्री प्राप्त की होः

परन्तु यह और कि सिविल वायुयान अनुरक्षण पर्यावरण से बाहर अजत बारह वर्षों के व्यावहारिक वायुयान अनुरक्षण अनुभव को उपर्युक्त ;iद्ध और ;iiद्ध में निहित अपेक्षाओं के समकक्ष माना जाएगाऋ बशर्ते कि सिविल वायुयान अनुरक्षण पर्यावरण में न्यूनतम एक वर्ष का अभिनव अनुभव होऋ

; iiiद्ध बड़े वायुयान के मामले में प्रवर्ग घ के लिए—

;कद्ध बड़े वायुयान पर प्रवर्ग ख 1.1, ख 1.3 या ख 2 के विशेषाध्किारों का प्रयोग करते हुए या नियम 133 ख या उसके समायोजन के अंतर्गत अनुमोदित संगठन में बेस अनुरक्षण में सहायक स्टापफ के रूप में तीन वर्षों का अनुरक्षण अनुभवऋ या

;खद्ध बड़े वायुयान पर प्रवर्ग ख 1.2, या ख 1.4 के विशेषाध्किारों का प्रयोग करते हुए या नियम 133 ख या उसके समायोजन के अंतर्गत अनुमोदित संगठन में बेस अनुरक्षण में सहायक स्टापफ के रूप में पाँच वर्षों का अनुरक्षण अनुभवऋ

;ivद्ध प्रवर्ग ग के लिए बड़े वायुयान के अतिरिक्त वायुयान के संबंध् में प्रवर्ग ख 1 या ख 2 के विशेषाध्किारों का प्रयोग करते हुए या नियम 133 ख या उसके समायोजन के अंतर्गत अनुमोदित संगठन में बेस अनुरक्षण में सहायक स्टापफ के रूप में तीन वर्षों का अनुरक्षण अनुभवऋ

;घद्ध आवेदक को महानिदेशक या उनकी तरपफ से प्राध्कृित किसी व्यक्ति के समक्ष, अनुज्ञप्ति के प्रवर्ग या उप-प्रवर्ग, जिसके लिए आवेदन किया गया है, के विशेषाध्किारों का प्रयोग की योग्यता का प्रदर्शन करना होगा ।

स्पष्टीकरण :—इस उप-नियम के प्रयोजन के लिए,—

;iद्ध ''बड़ा वायुयान'' से अभिप्रेत है 5700 कि.ग्रा. से अध्कि के भार वाला कोई विमान या बहु-इंजन युक्त कोई हेलीकॉप्टरऋ और

;iiद्ध ''सहायक स्टापफ'' से अभिप्रेत है वे अनुज्ञप्तिधरी इंजीनियर या अनुमोदन धरक जो सवस रिलीज प्रमाणपत्रा जारी करने के लिए प्राध्कृित नहीं हैं, परन्तु बेस अनुरक्षण पर्यावरण में अनुरक्षण कार्य करते हैं ।

;6द्ध आवेदक के वायुयान अनुरक्षण इंजीनियर के लाइसेंस में विस्तार प्रदान करने के लिए अपेक्षित होगा—

;कद्ध महानिदेशक द्वारा विनिदष्ट उपयुक्त विषय माडयूल में ज्ञान के स्तर के प्रदर्शन के लिए लिखित परीक्षा उत्तीर्ण करनाऋ और

;खद्ध किसी अतिरिक्त प्रवर्ग या उप-प्रवर्ग की अनुज्ञप्ति प्रदान करने के लिए महानिदेशक द्वारा विनिदष्ट संगत प्रशिक्षण प्राप्त करना, अनुरक्षण अनुभव अजत करना और कुशलता प्रदशत करना ।

;7द्ध जो आवेदक किसी परीक्षा में असपफल रहता है, उसे समुचित क्षेत्रा में तीन माह का या अन्य ऐसे किसी अवध् िका जो महानिदेशक विनिदष्ट करें, अतिरिक्त अनुभव प्राप्त करने के पश्चात्‌ ही ऐसी परीक्षाओं में पिफर से बैठने की अनुज्ञा दी जाएगी । ;8द्ध केन्द्रीय सरकार वायुयान अनुरक्षण इंजीनियर अनुज्ञप्ति धरक को, किसी नए वायुयान, इंजिन या प्रणाली, जिसे संगठन में लाया गया है और जो उसकी अनुज्ञप्ति या उसके रिलीज प्रमाणपत्रा जारी करने की परिध् ि के अंतर्गत नहीं आती, का अनुरक्षण करने के लिए प्राध्कृित कर सकती है, बशर्ते कि महानिदेशक इस बात से संतुष्ट हो कि आवेदक को पर्याप्त ज्ञान, अनुभव और प्रशिक्षण प्राप्त है, और उसने महानिदेशक द्वारा यथाविनिदष्ट ऐसी परीक्षाएं पास कर ली हैं ।

;9द्ध इस बात से संतुष्ट होने पर कि आवेदक को पर्याप्त ज्ञान, अनुभव, प्रशिक्षण और कुशलता प्राप्त है और उसने महानिदेशक द्वारा यथा विनिदष्ट ऐसी परीक्षाएं पास कर ली हैं, केन्द्रीय सरकार महानिदेशक द्वारा विनिदष्ट प्रक्रियाओं के अनुसार वायुयान, इंजिन या संघटकों पर अनुरक्षण कार्य प्रमाणित करने के लिए महानिदेशक द्वारा अनुमोदित संगठन में कार्यरत व्यक्तियों को अनुमोदन प्रदान कर सकती है ।

;10द्ध इस बात से संतुष्ट होने पर कि आवेदक को पर्याप्त ज्ञान, अनुभव, प्रशिक्षण, सक्षमता और कुशलता प्राप्त है और उसने महानिदेशक द्वारा यथा विनिदष्ट ऐसी परीक्षाएं पास कर ली है, तो केन्द्रीय सरकार महानिदेशक द्वारा अनुमोदित पफर्म में कार्यरत आवेदक को विशिष्ट प्रक्रियाएं जो वायुयान की उड़नयोग्यता को प्रभावित कर सकती है, निष्पादित करने के लिए सक्षमता प्रमाणपत्रा प्रदान कर सकती है । ;11द्ध जब तक निलम्बित, प्रत्यावतत या निरस्त न हो,— ;कद्ध अनुज्ञप्ति उसमें विनिदष्ट अवध् िके लिए प्रत्येक मामले में पांच वर्ष की अध्कितम अवध् ि के अध्ीन रहते हुए, विध्मिान्य बनी रहेंगी, और[भाग IIखण्ड 3(i)] भारत का राजपत्रा : मार्च 20, 2010/पफाल्गुन 29, 1931 223 नवीकरण हेतु आवेदन प्राप्ति के समय और पांच वर्षों की अवध् िके लिए नवीकृत की जा सकेंगी :

परन्तु समाप्त अनुज्ञप्ति का नवीकरण केवल तभी किया जाएगा जब आवेदक ने ऐसी परीक्षाएं पास कर ली हों, जिन्हें महानिदेशक द्वारा विनिदष्ट किया गया हो ।

;खद्ध प्रत्येक मामले में एक वर्ष की अध्कितम अवध् िके अध्ीन प्राध्किार, अनुमोदन या सक्षमता प्रमाण-पत्रा विनिदष्ट अवध् ि के लिए विध्मिान्य रहेेंगे और नवीकरण के लिए आवेदन प्राप्त होने पर एक समय पर और एक वर्ष की अवध् िके लिए नवीकृत किया जाएगा बशर्ते कि आवेदक पिछले एक वर्ष में तीन माह की अवध् िके लिए कार्यों के निष्पादन में लगा हो ।

;12द्ध वायुयान अनुरक्षण इंजीनियर अनुज्ञापनों के विभि प्रवर्गों के धरकों को निम्नलिखित विशेषाध्किार होंगे, नामश :

;iद्ध प्रवर्ग क अनुज्ञापन धरकों को अनुज्ञापन पर पृष्ठांकित वायुयान के टाइप के लिए नियम 133ख के अंतर्गत अनुमोदित संगठन के द्वारा जारी प्राध्-ि कार पर विशेष रूप से पृष्ठांकित किए गए अनुरक्षण कार्यों की सीमाओं के भीतर लघु अनुसूचित लाइन अनुरक्षण तथा साधरण दोष सुधर के पश्चात्‌ प्रमाण-पत्रा जारी किया जाए । प्रमाणन विशेषाध्किार अनुज्ञापन धरक द्वारा स्वयं किए गए कार्य तक प्रतिबंध्ति होंगे ।

;iiद्ध प्रवर्ग ख1 अनुज्ञापन धरकों को अनुज्ञापन पर पृष्ठांकित वायुयान टाइप के संबंध् में उनकी प्रयोज्यता सि( करने के लिए साधरण परीक्षणों की आवश्यकता वायुयान संबंध्ी लाइन प्रतिस्थापनीय यूनिटों के प्रतिस्थापना सहित वायुयान संरचना, विद्युत संयंत्रा, यांत्रिाक इलेक्ट्रिकल प्रणालियों सहित अनुरक्षण के पश्चात्‌ सवस रिलीज प्रमाण-पत्रा जारी किया जाए । प्रमाणन विशेषाध्किार अनुज्ञापन धरक द्वारा स्वयं किए गए कार्य तक प्रतिबंध्ति होंगे । स्पष्टीकरण,—

;कद्ध प्रवर्ग ख1 प्रवर्ग क का उपयुक्त उप-प्रवर्ग स्वतः ही शामिल हो जाएगाऋ

;खद्ध माइक्रोलाइट वायुयान, ग्लाइडर, बैलून या वायु-प्रोत को प्रवर्ग क या प्रवर्ग ख1 में अनुज्ञापन धरक वायुयान अनुरक्षण इंजीनियर के द्वारा प्रमाणित किया जाए ।

;iiiद्ध प्रवर्ग ख2 अनुज्ञापन धरकों को अनुज्ञापन पर पृष्ठांकित वायुयान टाइप के वायुयान संबंध्ी एवं इलेक्टिकल प्रणालियों के अनुरक्षण के पश्चात्‌ सवस रिलीज प्रमाण-पत्रा जारी किए जाए । और ;ivद्ध प्रवर्ग ग अनुज्ञापन धरकों को अनुज्ञापन पर पृष्ठांकित वायुयान के संबंध् में बेस अनुरक्षण के पश्चात्‌ सवस रिलीज प्रमाण-पत्रा जारी किये जाएं । विशेषा- ध्किार तभी प्रणालियों सहित समूचे विमान पर लागू होते हैं :

13. सीमाएं-प्रमाणन विशेषाध्किारों का प्रयेाग केवल तभी किया जाएगा यदि

;कद्ध विशिष्ट वायुयान टाइप पर प्रवर्ग क अनुज्ञापन धरक ने इस प्रयोजन के लिए अनुमोदित अनुरक्षण या वायुयान अनुरक्षण इंजीनियर प्रशिक्षण संगठन द्वारा किए गए संगत प्रवर्ग के वायुयान टाइप कार्य प्रशिक्षण को संतोषजनक रूप से पूरा कर लिया है और प्रदशत किया हैऋ

;खद्ध महानिदेशक द्वारा अनुमोदित या अनुमोदित अनुरक्षण प्रशिक्षण संगठन द्वारा आयोजित संगत प्रवर्ग ख1, ख2 या ग वायुयान टाइप प्रशिक्षण में परीक्षा के संतोषजनक रूप से पूरा करने के पश्चात्‌ प्रवर्गों ख1, ख2 या ग लाइसेंस के मामले उपयुक्त वायुयान टाइप रेटग को लाइसेंस में पृष्ठांकित किया जाता हैऋ

;गद्ध बड़े वायुयान की अपेक्षा वायुयान के लिए प्रवर्ग ख1, ख2 एवं ग को महानिदेशक द्वारा यथाविनिदष्ट उपयुक्त समूह रेटग या विनिर्माता समूह रेटग सहित पृष्ठांकित किया जाता है ऋ और

;घद्ध पूर्ववर्ती चौबीस महीनों के भीतर वायुयान अनुरक्षण अनुज्ञापन धरक ने वायुयान अनुरक्षण इंजीनियर अनुज्ञापन के अंतर्गत विशेषाध्किार के अनुसार या तो छह माह का अनुरक्षण अनुभव अजत कर लिया हो या पहली बार अनुज्ञापन अजत किया है। ;14द्ध ;iद्ध इस नियम के प्रभावी होने की तारीख से वैध् वायुयान अनुरक्षण इंजीनीयर अनुज्ञापन धरक अपने अनुज्ञापन के विशेषाध्किार का प्रयोग करना जारी रख सकता है एवं इस नियम के अंतर्गत महानिदेशक द्वारा यथा विनिदष्ट ऐसी शर्तों के अध्ीन उपयुक्त प्रवर्ग में वायुयान अनुरक्षण इंजीनियर अनुज्ञापन को सीमा सहित या बिना सीमा के एवं अगली परीक्षा के बिना जारी किया जाएगा।224 THE GAZETTE OF INDIA : MARCH 20, 2010/PHALGUNA 29, 1931 [PART II—SEC. 3(i)] बशर्ते कि विशेषाध्किारों का ऐसा प्रयोग महा- निदेशक, नागर विमानन द्वारा विनिदष्ट तारीख के बाद जारी नहीं रखा जाएगाऋ और

;iiद्ध कोई व्यक्ति जिसने इस नियम की अध्सिूचना की तारीख से पूर्व मौजूदा नियमों एवं प्रक्रियाओं के अन्तर्गत वायुयान अनुरक्षण इंजीनियर अनुज्ञापन को प्राप्त करने के लिए योग्यता प्रक्रिया प्रारंभ की थी, वह 31 दिसम्बर, 2012 तक इस प्रक्रिया को जारी रख सकता है और उसे उपर्युक्त प्रवर्ग में वायुयान अनुरक्षण इंजीनियर अनुज्ञापन जारी किया जा सकता है।

;15द्ध नियम 19 के उप-नियम ;3द्ध के उपबंधें पर प्रतिकूल प्रभाव डाले बिना केन्द्रीय सरकार, ऐसी जांच के पश्चात्‌ जैसी वह ठीक समझे, और सुनवाई का युक्तियुक्त अवसर देने के पश्चात्‌, इस नियम के अध्ीन प्रदान की गई किसी अनुज्ञप्ति, प्राध्किार, प्रमाण-पत्रा, अनुमोदन या सक्षमता प्रमाण-पत्रा को प्रत्यावतत निरस्त, निलंबित या पृष्ठांकित कर सकती है या चेतावनी या भत्र्सना जारी कर सकती है या व्यक्ति को अस्थाई रूप से या स्थाई रूप से लाइसेंस प्राप्त करने से वंचित कर सकती है, जैसे भी वह संतुष्ट है

;कद्ध आवेदक ने योग्यता प्रक्रिया के दौरान अनुचित या छलपूर्ण साध्नों का प्रयोग किया थाऋ या ;जद्ध धरक ने मद्यसार या किसी अन्य मादक या किसी मनोसक्रिय पदार्थ के प्रभाव में रहते हुए अनुरक्षण किया है या सवस रिलीज प्रमाण-पत्रा जारी किया हैऋ या

;16द्ध केन्द्रीय सरकार यदि किसी कारण से ऐसा करना वांछनीय समझे तो अनुज्ञप्ति या प्राध्किार पत्रा या अनुमोदन या सक्षमता प्रमाण-पत्रा की मंजूरी या नवीकरण को रोक सकती है यदि, लिखित में रिकार्ड किए गए कारणों हेतु वह मानती है कि ऐसा करना जनहित में उचित है ।''

G.S.R. 57 .—The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act for information of all persons likely to be affected thereby, and a notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which the copies of the Gazette of India in which this notification is published, are made available to the public;

Objections or suggestions, if any may be addressed to the Director-General of Civil Aviation, opposite Safdarjung Airport, New Delhi-110003;

Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government.

1. (1) These rules may be called the Aircraft (.........

Amendment) Rules, 2010.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Aircraft Rules, 1937,—

(i) in rule 3, after clause (33A) , the following clause shall be inserted, namely:—

"(33B) " Mantenance" means the performance of tasks required to ensure the continuing airworthiness of an aircraft, including anyone or combination of overhaul, inspection, replacement, dafect rectification and the embodiment of a modification or repair or test,", (ii) for rules 61, the following rule shall be substituted, namely:—

(5) An applicant for the grant of Aircraft Maintenance Engineer's Licence shall satisy the following requirements, namely:—

(a) he shall not be less than 18 years of age;

(b) he shall have passed 10+2 examination with Physics,Chemistry and Mathematics from a recognised Board or University or its equivalent;

(c) he shall have passed a written examination as specified by the Director-General :—

Provided that the Director-General may, subject to such conditions as he may deem fit to impose, exempt any applicant from the written examination if the applicant holds a licence granted by a Contracting State to act in the "61. Licensing of Aircraft Maintenance Engineers—(1) The Cental Government may grant licences, authorisations or approvals or certificats of competency as provided in this rule, to persons who meet the requirements specified in this rule.

(2) The application for the grant of an Aircraft Maintenance Engineer's Licence or an authorisation, approval or certificate of competency, or for extension thereof , shall be made in the form and manner specified by the Director-General.

(3) The Aircraft Maintenance Engineer's licence may be granted in the following categories, namely:—

(a) Category A

(b) Category B1

(c) Category B2

(d) Category C.

(4) The licences in categories A and B1, in relation aeroplanes, helicopters, turbine and piston engines, may be granted in the following sub-categories, namely:—

(a) A1 Aeroplanes Turbine

(b) A2 Aeroplanes Piston

(c) A3 Helicopter Turbine

(d) A4 Helicopter Piston

(e) B1.1 Aeroplanes Turbine

(f) B1. 2 Aeroplanes Piston

(g) B1.3 Helicopter Turbine

(h) B1.4 Helicopter Piston.

capacity of an aircraft maintenance engineer, and (d) he shall have the following minumum practical experience, namely:—

(i) for Category A (any sub-category) and Category B1 (sub-categories B1.2 and B1. 4) four years of practical maintenance experience on an operating aircraft; and (ii) for Category B2 and sub-categories B1.1 and B1. 3—five years of practical maintenance experience on an operating aircraft:

Provided that the experience requirement specified at (i) and (ii) above shall be reduced by one year in case of an applicant who has satisfacrtorily completed training in any training organisation approved under rule 133B or who has acuired a Degree in Engineering from a recognised University:

Provided further that twelve years of practical aircraft maintenance experience, acquired outside a civil aircarft maintenance enviroment shall be treated as equivalent to the reuirements laid down in (i) and (ii) above, so long as at least one year of recent experience shall be in civil maintenance environment;

(iii) for Category C with respect to large aircraft—

(A) three years of maintenance experience exercising privileges of Categories B1.1, B1.3 or B2 on larges aircraft or as support staff in a base maintenance in an organisation approved under rule 133B or a combination thereof; or

(B) five years of maintenance experience226 THE GAZETTE OF INDIA : MARCH 20, 2010/PHALGUNA 29, 1931 [PART II—SEC. 3(i)] exercising the privileges of Categories B1.2 or B1.4 on large aircraft or as support staff in base maintenance in an organisation approved under rule 133B, or a combination thereof;

(iv) for Category C with respect to aircraft other than large aricraft—three years of maintenance experience of exercising privileges of category B1or B2 or support staff in an organisation approved under rule 133B, or a combination thereof;

(e) the applicant shall have demonstrated to the Director- General or any other person authorised by him in his behalf, the ability to exercise the privileges of the category and sub-category of the licence for which the application has been made.

Explanation.- For the purposes of this sub-rule,—

(i) "large aircraft" means any aeroplane with a maximum mass of more than 5700 kg or any multi- engined helicopter, and

(ii) "support staff" means those licensed engineers or approval holders who are not authorised to issue certificate of release to service, but perform maintenance in the base maintenance environment.

(6) The applicant for grant of extension of Aircraft Maintenance Engineer's licence shall be required—

(a) to pass a written examination so as to demonstrate a level of knowledge in the appropriate subject modules as specified by the Director-General; and (b) to undergo relevant training, acquire maintenance experience and demonstrate skill as specified by the Director-General for grant of any additional category or sub category of licence.

(7) An applicant who fails in any examination shall be permitted to appear again for such examination only after acquiring additional experience of three months or such other period in the appropriate field as may be specified by the Director-General.

(8) The Central Government may grant authorisation to the holders of an Aircraft Maintenance Engineer's Licence to carry out maintenance of an any new aircraft, engine or system which has been brought into the organisation and which is not within the scope of his lecence, and to issue a certificate of release therefor, provided that the Director-General is satisfied that the applicant has suffcient knowledge, experience and training and has passed such examinations as specified by the Director-General.

(9) Upon being satisfied that the applicant was sufficient knowledge, experience, training and skill and has passed such examinations as specified by the Director General the Central Government may grant approvals to persons employed in an organisation approved by Director-Gerneral to certify maintenance work carried out on aircraft, engine or components, in accordance with the procedures specified by the Director-General.

(10) Upon being satisfied that the applicant has sufficient knowledge, experience, training, competency and skill and has passed such examinations as specified by the Director-General the Cental Government may grant a Certificate of Competency to an applicant employed in a firm approved by Director-General to perform specialised processes which may affect the airworthiness of an aircraft.

(11) Unless suspended, revoked or cancelled,—

(a) a licence shall remain valid for the period specified therein, subject to a maximum period of five years in each case, and may be renewed for another five years at a time on receipt of the application for renewal:

Provided that an expired licence shall be renewed only after the applicant has passed such examinations as may be specified by the Director-General.

(b) an authorisation, approval or certificate of compentency shall remain valid for a period specified therein , subject to a maximum period of one year in each case, and may be renewed for another one year at a time on receipt of application for renewal, provided the applicant has engaged himself in the performance of the tasks for a period of three months in the preceding one year.

(12) The holders of various categories of Aircraft Maintenance Engineer's Licenses shall have the following privileges, namely:—

(i) Category A licence holders to issue certificates for release to service after minor scheduled line maintenance and simple defect rectification within the limits of maintenance tasks specifically endorsed on the authorisation issued by an organisation approved under rule 133B for the type of aircraft endorsed on the licence. The certification privileges shall be restricted to the[भाग IIखण्ड 3(i)] भारत का राजपत्रा : मार्च 20, 2010/पफाल्गुन 29, 1931 227 work carried out by the licence holder himself.

(ii) Category B1 licence holders to issue certificates for release to service after maintenance, including aircraft structure, power-plant, mechanical and electrical systems, including replacement of avionic line replaceable units requiring simple tests to prove their serviceability, in respect of an aircraft type endorsed on the licence. The certification privileges shall be restricted to the work carried out by the licence holder himself.

Explanation.—

(a) Category B1 shall automatically include the appropriate sub-category of Category A; (b) Microlight aircraft, glider, balloon or an airship may be certified by an aircraft maintenance engineer holding a licence in Category A or Category B1.

(iii) Category B2 licence holders to issue certificates of release to service after maintenance on avionic and electrical systems of aircraft type endorsed on the licence; and (iv) Category C licence holders to issue certificates of release to service after base maintenance in respect of an aircraft of the type endorsed on the licence. The privileges apply to the aircraft in its entirety including all systems:

(13) Limitations—The certification privileges shall be exercised only if—

(a) the holder of a Category A licence on a specific aircraft type has satisfactorily completed and demonstrated the relevant Category A aircraft type task training carried out by an approved maintenance or AME training organisation approved for the purpose;

(b) the licence is endorsed with the appropriate aircraft type rating in case of a Categories B1, B2 or C licence after satisfactory completion of an examination in the relevant Category B1, B2 or C aircraft type training approved by Director-General or conducted by an approved maintenance training organisation;

(c) categories B1, B2 and C license for aircraft other than large aircraft, is endorsed with the appropriate group rating or manufacturer group ratings as specified by the Director-General; and

(d) within the preceding twenty-four months, the holder of an Aircraft Maintenance Licence has either acquired six months of maintenance experience in accordance with the privileges under the Aircraft Maintenance Engineer's Licence or has acquired the licence for the first time.

(14) (i) The holder of a valid Aircraft Maintenance Engineers Licence on the date of coming into force of this rule may continue to exercise the privileges of his licence and shall be issued, with or without limitation and without further examination, an Aircraft Maintenance Engineer's Licence in the appropriate category under this rule subject to such conditions as may be specified by the Director- General:

Provided that such exercise of privileges shall not be continued beyond a date specified by DGCA; and (ii) Any person who began a qualification process for obtaining an Aircraft Maintenance Engineer's Licence under the rules and procedures existing prior to the date of notification of this rule, may continue the process till 31 December, 2012 and may be issued an Aircraft Maintenance Engineer's licence in the appropriate category.

(15) Without prejudice to the provisions of sub-rule (3) of rule 19 of these rules, the Central Government may, after such inquiry as it may deem fit and after giving a reasonable opportunity of being heard, revoke, cancel, suspend or endorse any licence or authorisation or approval or certificate of competency granted under this rule or issue a warning or an admonition or debar a person from acquiring a licence temporarily or permanently, where it is satisfied that—

(a) the applicant had used unfair or fraudulent means during the qualification process; or (b) the holder has obtained the certification privileges by adopting fraudulent means; or (c) the holder has failed to carry out required maintenance resulting from own inspection combined with failure to report such fact to the organisation or person for whom the maintenance was intended to be carried out; or

(d) the holder has performed work or granted a certificate in respect of work which has not been performed in a careful and competent manner or was responsible in any manner that compromised airworthiness of the aircraft; or (e) the holder has signed a certificate in respect of any matter in contravention of this rule; or (f) the holder has issued a certificate of release to service knowing that the maintenance specified on the certificate of release to service has not been carried out or. without verifying that such maintenance has been carried out; or228 THE GAZETTE OF INDIA : MARCH 20, 2010/PHALGUNA 29, 1931 [PART II—SEC. 3(i)] (g) the holder has falsified the maintenance

records; or

certificate of competency if, for reasons to be recorded in writing, it considers it expedient to do so in public interest.".

(h) the holder has carried out maintenance or has issued a certificate of release to service while under the influence of alcohol or any other intoxicating or any psychoactive substance; or

(i) it is undesirable for any other reason that the holder should continue to exercise his privileges granted under this rule.

(16) The Central Government may withhold the grant or renewal of a licence or authorisation or approval or
