सा.का.नि. 60.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और चंडीगढ़ शैक्षणिक सेवा ;समूह 'क' राजपत्रिातद्ध राजकीय कला व विज्ञान महाविद्यालय नियमावली, 2000 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, शासकीय कला और विज्ञान महाविद्यालय चंडीगढ़ में प्राचार्य ;समूह 'क'द्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम शासकीय कला और विज्ञान महाविद्यालय चंडीगढ़ प्राचार्य ;समूह 'क' पदद्ध के पद पर भर्ती नियम, 2010 है ।

(2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

(ii) किसी विश्वविद्यालय या महाविद्यालय या अन्य उच्चतर शिक्षा संस्था में अध्यापन या अनुसंधान का दस वर्ष का अनुभव

टिप्प्ण 1 : अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं । टिप्पण 2 : अनुभव संबंध्ी अर्हताएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है । टिप्पण 3 : विश्वविद्यालयों और महाविद्यालयों में अध्यापकों के वेतनमान, नियुक्ति के लिए न्यूनतम अर्हता और स्तर के अनुरक्षण के लिए अन्य उपाय, 1998 के पुनरीक्षण पर विश्वविद्यालय अनुदान आयोग की अध्सिूचना के पैरा 3.3.0 के निबंध्नानुसार और विश्वविद्यालय अनुदान आयोग के पत्रा सं. एपफ. 1-13/99 ;पीएसद्ध/पीटी पफाइल तारीख 27 नवम्बर, 2001 के निबंध्नानुसार मास्टर स्तर पर 55 प्रतिशत की न्यूनतम अपेक्षा पर प्राचार्य, आचार्य, उपाचार्य, रजिस्ट्रार, पुस्तकालयाध्यक्ष, उप-पुस्तकालयाध्यक्ष, व्यायाम शिक्षा के निदेशक, व्यायाम शिक्षा के उपनिदेशक के लिए ऐसे विद्यमान पदधरियों के लिए बल नहीं दिया जाएगा जो पहले से ही विश्वविद्यालय व्यवस्था में हों और उनके मामले में न्यूनतम अपेक्षा मास्टर स्तर पर कम से कम 55 प्रतिशत अंक होगा । तथापि, बाहर से व्यवस्था में प्रवेश करने वाले व्यक्तियों के लिए मास्टर स्तर पर 55 प्रतिशत अंक पर बल दिया जाएगा ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों के साथ, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

G.S.R. 60.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Chandigarh Educational Service (Group 'A' Gazetted) Government Arts and Science College, Rules, 2000, except as respects things done or omitted to be done before such supersession, the President herby makes the following rules regulating the method of recruitment to the post of Principal (Group 'A') in the Government Arts and Science Colleges, Chandigarh, namely :—

1. Short title and commencement.—(1) These rules may be called the Government Arts and Science Colleges Chandigarh (Principal Group 'A' Posts), Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, and scale of pay.— The number of the said posts, their classification, and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules in respect of any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

Note 1: Qualifications are relaxable at the discretion of the Union Public Service Commission in case of candidates otherwise well qualified.

Note 2 : The qualification regarding experience is relaxable at the discretion of the Union Public Service Commission in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note 3 : In terms of para 3.3.0 of the University Grants Commission notification on revision of Pay Scales, Minimum Qualifications for appointment of teachers in Universities and Colleges and other measures for the maintenance of standards 1998 and in terms of University Grants Commission's letter No. F. 1-13/99(PS)/ Pt file dated 27th November, 2001, the minimum requirement of 55% at Master's level shall not be insisted upon for Principals, Professors, Readers, Registrars, Deputy Registrars, Librarians, Deputy Librarians, Director of Physical Education, Deputy Director of Physical Education for the existing incumbents who are already in the University system and the minimum requirement in their case shall be at least 50% of marks at Master's level. However, 55% of marks at Master's level shall be insisted upon for those for entering the system from outside.

1. (1) These rules may be called the Ministry of Mines, Indian Bureau of Mines, Junior Technical Assistant (Chemistry), Group "C" Post Recruitment (Amendment) Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Ministry of Mines, Indian Bureau of Mines, Junior Technical Assistant (Chemistry), Group "C" Post Recruitment Rules, 2007 :

(a) in column (4), for column heading and the entries relating thereto the following shall be substituted, namely: —

"Pay band and grade pay or pay scale

सा.का.नि. 62.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, शहरी विकास और गरीबी उपशमन मंत्राालय, केन्द्रीय लोक निर्माण विभाग, केन्द्रीय वैद्युत इंजीनियरी समूह 'ख' सेवा भर्ती नियम, 2003 में संशोध्न करते हुए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. ;1द्ध इन नियमों का संक्षिप्त नाम शहरी विकास मंत्राालय, केन्द्रीय लोक निर्माण विभाग, केन्द्रीय वैद्युत इंजीनियरी समूह 'ख' सेवा भर्ती ;संशोध्नद्ध नियम, 2010 है ।

(2) ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. शहरी विकास और गरीबी उपशमन मंत्राालय, केन्द्रीय लोक निर्माण विभाग, केन्द्रीय वैद्युत इंजीनियरी समूह 'ख' सेवा भर्ती नियम, 2003 की अनुसूची के स्थान पर निम्नलिखित को रखा जाएगा :

1. (1) These rules may be called the Ministry of Urban Development, Central Public Works Department, Central Electrical Engineering Group 'B' Service Recruitment (Amendment) Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. The Schedule to the Ministry of Urban Development and Poverty Alleviation, Central Public Works Department, Central Electrical Engineering, Group 'B' Services Recruitment Rules, 2003 shall be substituted as under :
