[सांविधिक निकायों द्वारा जारी की गई विविध अधिसूचनाएं जिसमें कि आदेश, विज्ञापन और सूचनाएं सम्मिलित है। [Miscellaneous Notifications including Notifications , Orders , Advertisements and Notices issued by Statutory Bodies ]

(सी) में निम्नलिखित उपखंड प्रतिस्थापित किया जाएगा , यथा : -- वित्त मंत्रालय इंडियन बैंक चेन्नै, दिनांक12 मार्च 2010

" (सी) पुत्र या पुत्री जिसमें विधवा या तलाकशुदा पुत्री शामिल है, जब तक वे पच्चीस साल के होते हैं या विवाह या पुनर्विवाह कर लेते हैं जो भी पहले हो , और इसमें विधिक रूप से दत्तक पुत्र या पुत्री भी शामिल हैं । "

3. कथित विनियमनों में उप विनियम ( 3 ) के बाद विनियम 8 में निम्नलिखित उप-विनियम लगा दिया जाएगा यथाः-- एस. ओ. बैंकिंग कम्पनी ( उपक्रमों का अधिग्रहण एवं अंतरण ) अधिनियम, 1970 ( 1970 का 5 ) की धारा 19, जो धारा12 की उप धारा ( 2 ) के साथ पठित है, के अधीन प्रत्यायोजित अधिकारों के प्रयोग में इंडियन बैंक के निदेशक मंडल ने भारतीय रिज़र्व बैंक के साथ परामर्श के बाद केन्द्रीय सरकार की पूर्व मंजूरी के साथ इंडियन बैंक (कर्मचारी ) पेंशन विनियमन 1995 में आगे संशोधन करने के लिए निम्नलिखित विनियमन किया है, यथा--

1. ( 1 ) ये विनियमन इंडियन बैंक ( कर्मचारी ) पेंशन ( संशोधन ) विनियमन 2009 कहे जाएंगे ।

" (4) न्यासी की नियुक्ति की अवधि तीन वर्षों के लिए होगी तथा बैंक ऐसे न्यासी को भी पुनः नियुक्त कर सकता है जिन्होंने अपनी सेवावधि की पूर्ति कर ली है, बशर्ते कि किसी भी न्यासी को दो सेवा काल से अधिक अवधि के लिए नियुक्त नहीं किया जाए । "

(2) सरकारी राजपत्र में इनके प्रकाशन की तिथि से ही यह प्रभाव में आएंगे।

4. कथित विनियमनों में , विनियम 9 में निम्नलिखित परंतुक को लगा दिया जाएगा, यथा

5. कथित विनियमनों में, विनियम 10 के उप विनियम ( 2 ) में प्रारंभिक अंश में " प्रत्येक वित्तीय वर्ष की समाप्ति के एक सौ अस्सी दिनों के अंदर " की जगह में " बैंक के तुलन पत्र के प्रकाशन की तारीख से साठ दिनों के अंदर " शब्द प्रतिस्थापित किये जाएं ।

संख्या ए -12 (11 ) /11/2009-चि.4- कर्मचारी राज्य बीमा अधिनियम , 1948 (1948 का 34) की धारा 97 की उप धारा (2 क) के साथ पठित उक्त धारा की उप धारा ( 1 ) और धारा 17 की उप धारा ( 3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निगम एतद्वारा दन्त्य शिक्षण संकाय की भर्ती प्रक्रिया को विनियमित करने हेतु निम्नलिखित विनियम बनाता है , अर्थात्: -

संक्षिप्त नाम और प्रारम्भ: - 1.

( i ) ये विनियम कर्मचारी राज्य बीमा निगम (दन्त्य शिक्षण संकाय पद) भर्ती विनियम , 2009 कहे जायेंगे ।

(ii) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

2. अनुप्रयोज्यता:

ये विनियम इसके साथ संलग्न अनुसूची के कालम 1 में विनिर्दिष्ट पदों पर लागू होंगे । 3. पदों की संख्या , वर्गीकरण एवं वेतनमान :

उक्त पदों की संख्या, उनका वर्गीकरण और उनसे सम्बद्ध वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कालम 2 से 4 में यथा विनिर्दिष्ट होंगे ।

4. भर्ती की पद्धति, आयु सीमा , अर्हताएं तथा अन्य मामले आदि:

भर्ती की पद्धति, आयु सीमा , अर्हताएं और उक्त पद से संबंधित अन्य मामले उक्त अनुसूची के कालम 5 से 13 में यथा विनिर्दिष्ट होंगे । भाग III-खण्ड4]

5. जिन पदों के संबंध में सीधी भर्ती विहित की गई है उनके संबंध में चयन बोर्ड का गठन , चयन की प्रक्रिया आदि:

(1) चयन बोर्ड:

(!) चयन बोर्ड में निम्नलिखित शामिल होंगे : -

(क) भारत सरकार के सचिव या अपर सचिव स्तर का अंशकालिक अध्यक्ष जिसे सचिव , श्रम और रोजगार मंत्रालय या महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा अध्यक्ष , कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व-अनुमोदन से नियुक्त किया जाएगा ।

(ख) दो दन्त्य विशेषज्ञ जिन्हें महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा इस प्रयोजन के लिए अनुरक्षित विशेषज्ञों के पैनल में से , चयन बोर्ड के अध्यक्ष द्वारा चुना जाएगा ।

(ग) नई दिल्ली में चिकित्सा आयुक्त , कर्मचारी राज्य बीमा निगम विभागीय प्रतिनिधि होगा तथा अन्य राज्यों के मामलों में संबंधित राज्य का वरिष्ठ राज्य चिकित्सा आयुक्त अथवा राज्य चिकित्सा आयुक्त विभागीय प्रतिनिधि होगा । इन अधिकारियों के किसी कारणवश उपलब्ध न होने की स्थिति में महानिदेशक विभागीय प्रतिनिधि के रूप में किसी अन्य अधिकारी को नामित कर सकता है ।

(i ) अंशकालिक अध्यक्ष की पदावधि सामान्यतः चयन बोर्ड के गठन की तारीख से एक वर्ष के लिए होगी । परन्तु, अध्यक्ष , कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व अनुमोदन से महानिदेशक द्वारा उनकी पदावधि कम अथवा बढ़ाई जा सकती है ।

(ii ) अंशकालिक अध्यक्ष और दन्त्य विशेषज्ञ , समय - समय पर महानिदेशक द्वारा सरकार द्वारा विहित दरों को ध्यान में रखते हुए , नियत दरों पर यात्रा भत्ता, बैठक शुल्क आदि के हकदार होंगे ।

चयन की प्रक्रिया तथा रीति :

(क) अनुसूची में शामिल पदों पर सीधी भर्ती, साधारणतः उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी !

यदि भर्ती हेतु भिन्न तरीका अंगीकृत करना आवश्यक हो जाता है तो अध्यक्ष , कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन प्राप्त करने के पश्चात महानिदेशक द्वारा इसे अंगीकृत किया जा सकेगा । तथापि , भर्ती की 2018

[भाग III-खण्ड 4 रीति विज्ञापन में अधिसूचित कर दी जाने के पश्चात कोई अनुवर्ती परिवर्तन नहीं किया जा सकेगा ।

(ख) साक्षात्कार के लिए आमंत्रित किए जाने वाले उम्मीदवारों की संख्या का निर्णय अध्यक्ष , चयन बोर्ड द्वारा रिक्तियों की संख्या और विहित अपेक्षाओं को पूरा करने वाले आवेदकों की संख्या को ध्यान में रखते हुए किया जाएगा । (ग) आयु , अर्हता, अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक को साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दावे का अधिकार प्राप्त नहीं होगा ।

(घ) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष , चयन बोर्ड को प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक , कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा किया जाएगा ।

(ड.) चयन बोर्ड को आवश्यक सचिवीय सहायता, महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी ।

6. निरर्हता:

ऐसा कोई व्यक्ति: -

(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है : अथवा

(ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह करने का करार किया है उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि महानिदेशक इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह की दूसरी पार्टी पर लागू वैयक्तिक कानून के अन्तर्गत अनुमेय है और ऐसा करने के अन्य आधार भी हैं तो वे किसी व्यक्ति को इस विनियम से छूट दे सकते हैं । भाग III-खण्ड4]

2019 7. दील देने की शक्ति:

जहाँ निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा कालोचित है तो वह अध्यक्ष कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन लेने के पश्चात, कारणों को लेखबद्ध करके आदेश द्वारा किसी श्रेणी अथवा व्यक्तियों के वर्ग के लिए इन विनियमों के किसी भी उपबंध में ढ़ील दे सकते हैं ।

8. अपवाद:

इन विनियमों की कोई बात आरक्षणों , आयु सीमा में ढील और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिकों और व्यक्तियों के अन्य विशेष वर्गों के लिए उपबंध कराना अपेक्षित है ।

दन्त्य शल्य चिकित्सा निष्णात (एम.डी.एस. ) की अर्हता डिग्री या इसके समकक्ष मान्यता प्राप्त अर्हता प्राप्त करने के बाद विशेषज्ञा के विषय में मान्यता आयु सीमा निर्धारित करने की निर्णायक तारीख भारत में उम्मीदवारों से आवेदन प्राप्त करने की अन्तिम तारीख होगी (और न कि असम , मेघालय, अरुणाचल प्रदेश,मिजोरम, मणिपुर, नागालैण्ड, त्रिपुरा,

प्राप्त संस्थान में शिक्षण और /या अनुसंधान में 14 वर्षों का अनुभव

Chennai , the 12th March 2010

S.O: - In exercise of the powers conferred by Section 19 , read with Sub-section (2) ofSection 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970) , the Board of Directors of the Indian Bank in consultation with the Reserve Bank of India and with the previous sanction of the Government hereby makes the following regulations further to amend the Indian Bank ( Employees ') Pension Regulations , 1995, namely: -

1. ( 1 ) These Regulations may be called the Indian Bank (Employees' ) Pension (Amendment) Regulations , 2009 .

(2) They shall come into force or the date of their publication in the Official Gazette.

2. In the Indian Bank (Employees ' ) Pension Regulations , 1995 , ( hereinafter referred as the said Regulation ) , in Regulation 2, in Clause (o) , for Sub-clause (c) , the following Sub- clause shall be substituted , namely: -

"(c) son or daughter including widow or divorced daughter till he or she attains the age of twenty-five years or upto his or her marriage or re- marriage , whichever is earlier including such son or daughter adopted legally.'

3 . In the said Regulations , in Regulation 8 after Sub- regulation (3) , the following Sub- regulation shall be inserted namely: -

"(4) The term of appointment of Trustee shall be for a period of three years and the Bank may re - appoint a Trustee who has already completed his term; provided that no Trustee shall be appointed for more than two terms."

4. In the said Regulations , in Regulation 9 , the following proviso shall be inserted , namely: -

"Provided that all such direction shall be given in writing and shall specify the purpose or objective . "

5. In the said Regulations , Regulation 10, in Sub- regulation (2) , in the opening portion for the words "Within one hundred and eighty days from the closing of each financial year " , the words "Within sixty days from the date of publication ofthe Balance Sheet of the Bank " shall be substituted .

1. Short title and commencement: (1) TheseRegulations may be called the Employees' State Insurance Corporation (Dental Teaching Faculty Posts) , Recruitment Regulations , 2009.

4.Method of recruitment , age limit, qualifications and other matters etc.- Themethod of recruitment , age limit , qualifications and others matters relating to the said post shall be as specified in columns 5 to 13 of the said Schedule.

5. Composition of Selection Board , procedure of Selection etc. in respect of postforwhich direct recruitment is prescribed:

(1) Selection Board:

(i ) The selection Board shall consist of: -

(a) A part - time Chairman of the status of Secretary or Additional Secretary to the Government of India, who may be appointedby Secretary , Ministry of Labour & Employment or the Director General , Employees ' State Insurance Corporation , with the specific prior approval of the Chairman , Employees ' State Insurance Corporation.

(b) Two Dental experts who may be chosen by the Chairman , Selection Board from the panel of experts maintained for the purposepur by the Director General , Employees' State Insurance Corporation .

(c) TheMedical Commissioner , Employees ' State Insurance Corporation will be the departmental representative in New Delhi and in case of other States , the Senior State Medical Commissioner or State Medical Cominissioner of the respective States will be departmental representatives . In case these officers are not available for some reason , then the Director General can nominate someother officer as the departmental representative .

(i) The term of office of the part - time Chairman shall ordinarily be one year from the date of constitution of the Selection Board . His term may, however , be curtailed or extended by the Director General , with the specific prior approval of the Chairman , Employees ' State Insurance Corporation .

( ii ) The part- time Chairman and the Medical Experts shall be entitled to travelling allowances , sitting fees etc. at such rates as may be fixed by the Director PART III-SEC. 4]

General from time to time , keeping in view the rates prescribed by the Government.

(2)Procedureand manner of Selection:-

(a) Direct recruitment to the post included in the schedule shall ordinarilybe made on the basis of an interview of eligible candidates .

In case, itbecomes necessary to adopt a different mode of recruitment , the same maybe adopted by the Director General after obtaining specific prior approval of the Chairman , Employees' State Insurance Corporation . However , once a mode of recruitment is notified in the advertisement , no change shall be madesubsequently.

(b) The number of candidates to be invited for interview shall be decided by the Chairman, Selection Board , keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement .

(c)Merefulfillment of the prescribed requirement of age , qualification , experience etc. will not confer any right on the applicant to be called for interview or to any claim over the post advertised.

(d)All work relating to issue of advertisement in respect of applications and processing of applications for submission to the Chairman , Selection Board will be handled by the office of the Director General , Employees' State Insurance Corporation.

(e) The Selection Board will be provided necessary Secretarial assistant by the officeof the Director General , Employees' State Insurance Corporation .

6. Disqualification - No person : -

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b)Who, having a spouse living , has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post:

Provided that the Director General may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this Regulation .

7. Power to relax: - Where the Director General of the Corporation is of the opinion that it is necessary or expedient to do so, he may, by order , for reasons to be recorded in writing and after obtaining specific prior approval of the Chairman , Employees ' State Insurance Corporation , relax any of the provisions ofthese regulations with respect to any class or category of persons.

8. Savings: - Nothing in these regulations shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
