सा.का.नि. 114.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और केन्द्रीय जल आयोग अननुसचिवीय समूह ' ग ' पद ( इंजीनियरी सर्विसेज ) भर्ती नियम , 2002 को , अधिक्रांत करते हुए , जहां तक इनका संबंध कनिष्ठ इंजीनियर (सिविल और मैकेनिकल ) के पद से है , उन बातों के सिवाय जहां ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , जल संसाधन मंत्रालय , केन्द्रीय जल आयोग में कनिष्ठ इंजीनियर ( सिविल और मैकेनिकल ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और आरंभ. ( 1 ) इन नियमों का संक्षिप्त नाम जल संसाधन मंत्रालय , केन्द्रीय जल आयोग , कनिष्ठ इंजीनियर ( सिविल और मैकेनिकल ) , समूह ' ख ' पद, भर्ती नियम , 2010 होगा ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद की संख्या , वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण , उससे संबंधित उनका वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

[PART II-SEC . 3 ( i ) ] 3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति-
( क ) जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है , विवाह किया है , या
( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचौन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 2 : आयु-सीमा के निर्धारण के लिए निर्णायक तारीख भारत में आवेदकों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम , मेघालय , अरुणाचल प्रदेश , मिजोरम , मणिपुर , नागालैंड , त्रिपुरा , सिक्किम , जम्मू व कश्मीर राज्य के लद्दाख खंड , हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप अथवा लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । ) [ भाग II- खण्ड 3 ( i) ]

किसी मान्यताप्राप्त विश्वविद्यालय अथवा संस्थान से सिविल अथवा मैकेनिकल इंजीनियरी में डिग्री अथवा डिप्लोमा ।
टिप्पणी : आवेदकों के अन्यथा सुअर्हित होने की दशा में कारणों को लेखबद्ध करके कर्मचारी चयन आयोग के विवेकानुसार अर्हताओं में छूट दी जा सकती है ।
भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति या आमेलन द्वारा और विभिन्न पद्धतियों के आधार पर भरी जाने वाली रिक्तियों की प्रतिशतता

कर्मचारी चयन आयोग द्वारा आयोजित की जाने वाली अखिल भारतीय प्रतियोगी परीक्षा के माध्यम से सीधी भर्ती ।
टिप्पणी : पदधारी के प्रतिनियुक्ति या लंबी बीमारी या अध्ययन छुट्टी पर होने या किन्हीं अन्य परिस्थितियों में एक वर्ष या इससे अधिक अवधि के लिए हुई रिक्तियों को केन्द्रीय सरकार के निम्नलिखित अधिकारियों से प्रतिनियुक्ति के आधार पर भरा जा सकता है-
( क ) ( i ) जो मूल संवर्ग अथवा विभाग में नियमित आधार पर सदृश पद धारण कर रहे हों; अथवा
( ii ) जिन्होंने मूल संवर्ग अथवा विभाग में वेतन बैंड -2 5200-20200 रूपए + ग्रेड वेतन 2800 रूपए अथवा समतुल्य में नियमित आधार पर नियुक्ति के पश्चात् श्रेणी में छः वर्ष की नियमित सेवा की हो ; और
(ख ) स्तंभ ( 8 ) के अधीन सीधी भर्ती के लिए विहित शैक्षणिक अर्हताएं रखता हो ।

G.S.R. 114. In exercise of the powers conferred by the proviso to article 309 of the constitution , and in supersession of the Central Water Commission Non - Ministerial Group ' C ' posts ( Engineering services ) Recruitment Rules , 2002 , in so far as they relate to the post of Junior Enginer ( Civil and Mechanical ) , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Engineer ( Civil and Mechanical ) in the Ministry of Water Recources , Central Water Commission , namely :--
1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Water Recourses , Central Water Commission , Junior Engineer (Civil and Mechanical ) , Group ' B ' Post , Recruitment Rules , 2010.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification , Pay band and Grade pay or Pay Scale . The number of the said post , its classification , pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .
3.Method of recruitment , age limit , qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14) of the said schedule .
4. Disqualification . No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living , or (b) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commieesion , relax any of the provisions of these rules with respect of any class or category of persons .
6. Saving.-Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 115. जबकि कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 में और संशोधन करने के लिए केन्द्रीय सरकार द्वारा , कर्मचारी राज्य बीमा अधिनियम , 1948 ( 1948 का 34 ) की धारा 95 की उप - धारा ( 1 ) की अपेक्षानुसार इससे प्रभावित होने वाले संभावित व्यक्तियों के बारे में कतिपय मसौदा नियमों को जिनका प्रकाशन श्रम एवं रोजगार मंत्रालय , भारत सरकार की दिनांक 10 मई , 2010 की अधिसूचना संख्या सा. का.नि. 87 , के माध्यम से भारत के राजपत्र के भाग II , खण्ड 3 , उप - खण्ड ( i ) में किया गया था , जिसके लिए 15 मई, 2010 को उक्त मसौदा नियमों के सरकारी राजपत्र में प्रकाशन की तिथि से तीस दिनों की अवधि समाप्त होने तक इससे प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव आमंत्रित किये गये थे , सार्वजनिक रूप से उपलब्ध करा दिया गया था ।
और जबकि उक्त राजपत्र की प्रतियां 15 मई , 2010 से सार्वजनिक उपयोग के लिए उपलब्ध करा दी गयी थीं । और जबकि , इस संबंध में किसी भी व्यक्ति से कोई आपत्ति अथवा सुझाव प्राप्त नहीं हुए हैं ।
अतः , अब , केन्द्रीय सरकार, कर्मचारी राज्य बीमा अधिनियम , 1948. ( 1948 का 34 ) की धारा 95 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कर्मचारी राज्य बीमा निगम से परामर्श के बाद कर्मचारी राज्य बीमा ( केन्द्रीय ) निमय , 1950 में और संशोधन करते हुए निम्नलिखित नियम बनाती है; अर्थात्: -
( 1 ) इन नियमों को कर्मचारी राज्य बीमा ( केन्द्रीय ) ( द्वितीय संशोधन ) नियम , 2010 कहा जाए ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख से प्रभावी माने जाएंगे । ( 3) कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 के नियम 20 में , " 14,300-18,300 " अंकों के स्थान पर " 37,400-67,000-8900 रुपये के ग्रेड वेतन के साथ " अंक एवं शब्द प्रतिस्थापित किये जाएंगे । पाद

Whereas certain draft rules further to amend the Employees' State Insurance (Central) Rules , 1950, were published as required under sub - section (1 ) of Section 95 ofthe Employees ' State Insurance Act, 1948 (34 of 1948), in the notification of the Government of India in the Ministry of Labour and Employment No. G.S.R. 87, dated the 10th May, 2010 , in the Gazette of India, Part II , Section 3 , sub - section ( i ), dated 15th May, 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period ofthirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public .
And whereas , the copies of the said Gazette were made available to the public on the 15th May, 2010 ;
Andwhereas no objection or suggestion has been received from any person in this regard ;
Now, therefore , in exercise of the powers conferred by Section 95 of the said Employees' State Insurance Act, 1948 , the Central Government, after consultation with Employees ' State Insurance Corporation , hereby makes the following rules further to amend the Employees' State Insurance ( Central), Rules , 1950, namely:--
1. These Rules may be called the Employees ' State Insurance (Central ) ( 2nd Amendment ) Rules , 2010.
2. They shall come into force on the date of their publication in the Official Gazette .
3. In the Employees' State Insurance (Central) Rules , 1950, in rule 20, for figures " 14,300-18,300 " , the words and figures " 37,400-67,000 with Grade Pay of Rs . 8900 " shall be substituted.
