सा.का.नि. 119.- राष्ट्रपति, संविधान के अनुच्छेद , 299 के खंड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निदेश देती हैं कि भारत सरकार के तत्कालीन विधि मंत्रालय ( विधि कार्य विभाग ) की अधिसूचना संख्यांक सा. का. नि. 585 तारीख 1 फरवरी , 1966 में निम्नलिखित और संशोधन किए जाएंगे , अर्थात्:-

उक्त अधिसूचना के भाग 30 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:--

" 30 इसमें पूर्व में विनिर्दिष्ट नहीं की गई संविदाओं के विषय में अंदमान और निकोबार द्वीप समूह के उप राज्यपाल या प्रशासक के प्रशासन के अधीन राज्यक्षेत्र :-

1. पंद्रह करोड़ रुपये से अधिक के सभी विलेख , संविदाएं और अन्य लिखत , उप राज्यपाल या प्रशासक के पूर्व अनुमोदन से , यथास्थिति , संबंधित विभाग के मुख्य सचिव , प्रधान सचिव , आयुक्त- सह- सचिव या सचिव द्वारा निष्पादित किए जाएंगे ।

3. दो करोड़ रुपये से अनधिक मूल्य के किन्तु दस लाख रुपये से अधिक के अपने-अपने विभागों के सभी विलेख , संविदाएं और अन्य लिखत , यथास्थिति , संबंधित विभाग के प्रमुख द्वारा निष्पादित किए जाएंगे ।

4. दस लाख रुपये से अनधिक मूल्य के अपने-अपने विभागों के सभी विलेख , संविदाएं और अन्य लिखत संबंधित कार्यालय प्रमुख द्वारा निष्पादित किए जाएंगे ।

5. ऊपर पैरा 1 से पैरा 4 में निर्दिष्ट सभी विलेख , संविदाएं और अन्य लिखत , केवल ऐसे व्यय को स्वीकृत करने के लिए सक्षम प्राधिकारी से प्राप्त व्यय स्वीकृति तथा साधारण वित्तीय नियम , 2005 के अनुसार संहिता औपचारिकताओं का अनुपालन करने के पश्चात् ही निष्पादित किए जाएंगे ।

6. अंदमान लोक निर्माण विभाग की संविदाओं की बाबत , केन्द्रीय लोक निर्माण विभाग संकर्म निर्देशिका और केन्द्रीय लोक निर्माण विभाग लेखा संहिता में अंतर्विष्ट प्रक्रिया लागू होगी । " ।

G.S.R. 119. In exercise of the powers conferred by clause ( 1 ) of article 299 of the Constitution , the President hereby directs that the following further amendments shall be made in the notification of the Government of India in the then Ministry of Law ( Department of Legal Affairs ) , number G.S.R.585 , dated the 1st day of February , 1966 , namely :--

In the said notification , for Part XXX and the entries relating thereto, the following shall be substituted , namely : ---

"XXX . IN THE TERRITORIES UNDER THE ADMINISTRATION OF THE LIEUTENANT GOVERNOR OR THE ADMINISTRATOR OF ANDAMAN AND NICOBAR ISLANDS , AS REGARDS CONTRACTS , NOT HEREIN BEFORE SPECIFIED :-

1. All deeds , contracts and other instruments exceeding Rupees Fifteen Crore shall be executed by the Chief Secretary, Principal Secretary, Commissioner- cum-Secretary or Secretary ofthe concerned Department , as the case may be , with the prior approval of the Lieutenant Governor or the Administrator .

2. All deeds , contracts and other instruments of respective Departments upto the value of Rupees Fifteen Crore but exceeding Rupees Two Crore shall be executed by the Head of Department with the prior approval of the ChiefSecretary, Principal Secretary , Commissioner- cum-Secretary or Secretary of the concerned Department .

3. All deeds , contracts and other instruments of respective Departments upto the value not exceeding Rupees Two Crores but exceeding Rupees Ten Lakhs shall be executed by the concerned Heads of Department, as the case may be.

4. All deeds , contracts and other instruments of respective Departments of the value not exceeding Rupees Ten Lakhs shall be executed by the concerned Head of Office .

5. All deeds , contracts and other instruments referred to in paras 1 to 4 above , shall be executed only after expenditure sanction has been obtained from the Authority Competent to sanction such expenditure and codal formalities have been complied with as per the General Financial Rules , 2005 .

6. In respect of Andaman Public Works Department contracts , procedures contained in Central Public Works Department Works Manual and Central Public Works Department Accounts Code shall apply " .

सा.का.नि. 120. केन्द्रीय सरकार राष्ट्रीय सुरक्षा अधिनियम , 1986 ( 1986 का 47 ) की धारा 139 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा राष्ट्रीय सुरक्षा गारद ( समूह ' क ' पद ) भर्ती नियम , 1993 , को उन बातों के सिवाए अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , राष्ट्रीय सुरक्षा गारद , गृह मंत्रालय में समूह ' क' के कुछ पदों पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाती है , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय सुरक्षा गारद ( समूह ' क ' पद ) भर्ती नियम , 2010 हैं । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन/वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण, तथा इनसे संबंधित वेतन बैंड तथा ग्रेड वेतन /वेतनमान वे होगें जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. अनुरक्षण-वर्तमान में न भरा गया प्रत्येक पद तथा प्रत्येक रिक्ति जो इन नियमों के प्रारंभ के पश्चात् उद्भूत हो सकती है , को इन नियमों के उपबंधों के अनुसार भरा जाएगा ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या पत्नी के जीवित रहते हुए , किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकारों को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के मर्तजसे छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्र सरकार की यह राय है कि ऐसा किया जाना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों को आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भारतीय पुलिस सेवा के ऐसे अधिकारियों से प्रतिनियुक्ति जो-

प्रतिनियुक्तिद्वारा

(i ) नियमित आधार पर सदृश पद धारण किए हो; या

( ii ) केन्द्रीय सरकार में महानिदेशक का पद धारण करने के लिए पैनलित हो ।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत इसी या केन्द्रीय सरकार के किसी अन्य संगठन या विभाग में इस नियुक्ति से तत्काल पहले धारण किए गए अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि हैं , साधारणतः 5 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर स्थानांतरण द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण: प्रतिनियुक्ति/आमेलन के आधार पर नियुक्ति के प्रयोजन के लिए अधिकारी द्वारा 01 जनवरी , 2006 /वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर पुनरीक्षत वेतन संरचना विस्तारित की गई है , से पहले किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा को आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थाई श्रेणी वेतन/वेतनमान में की गई सेवा समझी जाएगी सिवाय इसके जहां एक से अधिक पूर्व संशोधित वेतनमान को एक समान ग्रेड वेतन/वेतनमान के साथ एक ग्रेड में समामेलन किया गया है और जहां यह फायदा केवल उन पदों के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन/वेतनमान बिना किसी उन्नयन के समान प्रतिस्थापन ग्रेड है ।

प्रतिनियुक्तिद्वारा

प्रतिनियुक्ति:

( क ) दो पद प्रतिनियुक्ति आधार पर सेना में मेजर जनरल का रैंक धारण कर रहे सेना के अधिकारियों में से भरे जाने हैं ।

(ख ) एक पद प्रतिनियुक्ति आधार पर भारतीय पुलिस सेवा के उन अधिकारियों में से भरा जाना है जो-

( i ) नियमित आधार पर सदृश पद धारण कर रहे हों; या

( ii ) जो केन्द्र में महानिरीक्षक या समतुल्य पद धारण करने के लिए पैनलित में हों ।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, सामान्यतः सेना अधिकारियों के मामले में 3 वर्ष तथा भारतीय पुलिस सेवा के अधिकारियों के मामले में 5 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर स्थानांतरण के माध्यम से नियुक्ति के मामले में अधिकतम आयु सीमा आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

(क) दो पद प्रतिनियुक्ति आधार पर ब्रिगेडियर का रैंक धारण कर रहे अधिकारियों में से भरे जाने हैं ।

( ख ) तीन पद प्रतिनियुक्ति आधार पर केन्द्रीय पुलिस संगठन या भारतीय पुलिस सेवा के उन अधिकारियों में से भरे जाने हैं-

G.S.R. 120. In exercise ofthe powers conferred by Section 139 of the National Security Guard Act, 1986 (47 of 1986) and in supersession of the National Security Guard (Group - ' A' posts ) Recruitment Rule 1993 , except as respect things done or omitted to be done before such supersession , the Central Government hereby makes the following rules regulating the method of recruitment to certain Group ' A ' posts in the National Security Guard, Ministry of Home Affairs , namely: ---

1. Short title and commencement .-( 1 ) These rules may be called the National Security Guard (Group 'A' posts) Recruitment Rules , 2010 .

(2) They shall come inte force on the date of their publication in the Official Gazette .

2. Number of posts , classification and pay band and grade pay/ scale of pay . The number of said posts their classification and the pay band and grade pay/ pay scale attached thereto , shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules .

3.Method of recruitment , age limit , qualifications , etc. --The method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule.

4. Maintenance . Every post , presently unfilled and every vacancy that may arise after the commencement of these rules , shall be filled in accordance with the provisions of these rules .

5.Disqualification. No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living , has catered into or contracted a marriage with any person ,

shallbe eligible for appointment to any of the said posts:

Provided that the Centrai Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rules .

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class of category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , exservicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

सा.का.नि. 121. राष्ट्रपति , संविधान के अनुच्छेद, 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त संयालय, आर्थिक कार्य विभाग , वरिष्ठ आर्थिक सलाहकार , भर्ती नियम , 1997 का अधिक्रमण करते हुए आर्थिक कार्य विभाग में वरिष्ठ आर्थिक सलाहकार के पद पर भर्ती की पद्धति का विनियमन करने के लिए एतद्वारा निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों को वित्त मंत्रालय , आर्थिक कार्य विभाग , वरिष्ठ आर्थिक सलाहकार भर्ती नियम, 2010 कहा जाएगा ।

(2) ये सरकारी राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पदं की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा और अन्य अर्हताएं आदि. उक्त पदों की भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , और संघ लोक सेवा आयोग से परामर्श करने के बाद इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग या व्यक्तियों के संबंध में आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.-इन नियमों की कोई बात ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( i ) मान्यताप्राप्त विश्वविद्यालय से अर्थशास्त्र में डाक्टरेट की उपाधि

( ii ) अर्थशास्त्र के क्षेत्र में प्रतिष्ठित अंतरराष्ट्रीय/राष्ट्रीय पत्र- पत्रिकाओं में प्रकाशित अनुसंधान कार्य ।

टिप्पण 1 : प्रतिनियुक्ति पर नियुक्त के लिए व्यक्ति केवल केन्द्र/ राज्य/संघ शासित क्षेत्र सरकारों से ही होंगे । संविदा पर नियुक्त किए जाने वाले व्यक्ति प्रतिष्ठित निजी संस्थानों/वित्तीय संस्थानों से होंगे । शेष अल्पावधिक संविदा द्वारा नियुक्त अधिकारी होंगे ।

टिप्पण 2 : संविदा पर नियुक्त किए जाने वाले व्यक्ति केवल उपर्युक्त ' ख' में सूचीबद्ध शैक्षिक और अन्य अर्हताएं और अनुभव प्राप्त व्यक्ति होंगे तथा उनके मामले में उपर्युक्त ' क ' में दी गई अपेक्षाएं संगत नहीं होंगी ।

In exercise ofthe powers conferred by the proviso to article 309 ofthe Constitution and in supersession oftheMinistry of Finance , Department of Economic Affairs Senior Economic Adviser Recruitment Rules, 1997, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Economic Adviser in the Department ofEconomic Affairs , namely : -

1. Short Title and Commencement. ( 1 ) These rules may be called the Ministry of Finance , Department of Economic Affairs , Senior Economic Adviser Recruitment Rules , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2.Number of posts , classification and scale of pay. The number of said post , its classification and the scale of pay attached thereto , shall be as specified in column 2 to 4 of the Schedule hereto annexed.

3.Method of recruitment, age limit and other qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating to the said post, shall be specified in columns 5 to 14 of the said schedule .

4.Disqualifications . No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living, has entered into or contracted a marriage with any person ;

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any persons from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category or persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पद संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा और अन्य अर्हताएं आदि. उक्त पदों की भर्ती की पद्धति , आयु-सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है , विवाह किया है, या

( ख ) . जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्र सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , और संघ लोक सेवा आयोग से परामर्श करने के बाद इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग या व्यक्तियों के संबंध में आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.-इन नियमों की कोई बात ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 610

1. लघु शीर्षक और आरंभ.( 1 ) ये नियम मानव संसाधन विकास मंत्रालय , उच्चतर शिक्षा विभाग ( लेखा लिपिक ) भर्ती नियम, 2010कहलाएंगे ।

(2) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से प्रभावी होंगे ।

2. पद संख्या, वर्गीकरण एवं वेतनमान, उक्त पद की संख्या, इसका वर्गीकरण और संबद्ध वेतन बैंड तथा ग्रेड वेतन/वेतनमान इन नियमों के साथ संलग्न अनुसूची के कालम ( 2 ) से ( 4 ) में विनिर्दिष्ट किए जाएंगे ।

3. भर्ती का तरीका , आयु सीमा , अर्हताएं आदि. उक्त पद पर भर्ती , आयु- सीमा, अर्हताएं और अन्य मामले उक्त अनुसूची के कालम 5 से 14 में यथाविनिर्दिष्ट होंगे ।

4. अयोग्यता.-ऐसा कोई व्यक्ति-

( क ) जो ऐसे व्यक्ति से विवाह करता /करती है जिसका पति/पत्नी जीवित है , अथवा

(ख ) जो अपने पति/पत्नी के जीवित रहते किसी व्यक्ति से विवाह करता /करती है ,

बशर्ते यदि केन्द्र सरकार इस बात से संतुष्ट है कि ऐसा विवाह उस व्यक्ति अथवा विवाह के दूसरे पक्ष के लिए लागू वैयक्तिक कानून के तहत अनुमत्य है और ऐसा करने के अन्य कारण हैं , तो किसी व्यक्ति पर इस नियम को लागू करने से छूट दे सकती है । 5. छूट देने की शक्ति.-यदि केन्द्र सरकार का यह विचार है कि ऐसा करना आवश्यक है तो वह किसी वर्ग अथवा श्रेणी के व्यक्तियों के मामले में इन नियमों के सभी अथवा किसी प्रावधान से आदेश द्वारा छूट प्रदान कर सकती है, जिसके लिए कारणों को लिखित में दर्ज किया जाएगा । 6. बचत. ये नियम अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़ा वर्गों , पूर्व सरकारी कर्मचारी और अन्य विशेष श्रेणी के व्यक्तियों को इस संबंध में समय- समय पर केन्द्र सरकार द्वारा जारी आदेशों के अनुसार प्रदान किए जाने वाले आरक्षणों , आयु- सीमा में छूट और अन्यरियायतों पर दुष्प्रभाव नहीं डालेंगे ।

(ख) कालम 8 के तहत विनिर्दिष्ट अर्हताएं रखते हों ।

(केन्द्र सरकार के किसी अन्य संगठन/विभाग में अथवा इसी विभाग में इस नियुक्ति से ठीक पहले धारित अन्य संवर्ग इतर पद पर प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति की अवधि सामान्यतः तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदनों की प्राप्ति की अंतिम तारीख को छप्पन वर्ष से अधिक नहींहोगी । )

G.S.R. 123. In exercise ofthe powers conferred by the proviso to article 309 of the Constitution , and in supersession ofthe Ministry of Human Resource Development , Department of Education (Accounts Clerk ) Recruitment Rules , 1999 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accounts Clerk in the Ministry of Human Resource Development , Department ofHigher Education , namely :---

1. Short title and commencement ( 1 ) These rules may be called the Ministry of Human Resource Development, Department ofHigher Education [Accounts Clerk] Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of the said post, its classification and the Pay Band and Grade Pay/Pay Scale attached thereto shall be specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Method of recruitment , age - limit , qualifications, etc. The method ofrecruitment , age - limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4.Disqualification.---No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax .-- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax all or any of the provisions ofthese rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - servicemen and other Special Categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : For the purpose of computing minimum qualifying service for promotion , the service rendered on a regular basis by an officer prior to the 1stday of January 2006/the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission . For purposes of appointment on deputation/absorption basis , the service rendered on a regular basis by an officer prior to the 1st day of January 2006/ the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay/ pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre -revised scale of pay into one grade with a common grade pay/pay scale , and where this benefit will extend only for the post (s ) for which that grade pay /pay scale is the normal replacement grade without any upgradation .

3. पंचायती राज मंत्रालय ( अभिरक्षक ) समूह ' ग ' पद भर्ती नियम , 2008 की अनुसूची में,-

(i) स्तंभ (4) में,

( क ) शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा , अर्थात्:-

( ख ) प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:-

1. These rules maybe called the Ministry of Panchayati Raj ( Caretaker) Group ' C ' Post (Amendment ) Recruitment Rules , 2010 .

2. They shall come into force on the date of their publication in the Official Gazette .

3. Irn the Ministry of Panchayati Raj ( Caretaker) Group ' C ' Post Recruitment Rules , 2008 , in the Schedule,

(a) for the heading, the following heading shall be substituted, namely :--

(b) for the entry, the following entry shall be substituted , namely:- "Rs.5200-20200+Grade Pay of Rs . 2800. " ;

(ii) in column 12 ,-

(a) for the entry against item (a ) the following entry shall be substituted, namely :-
