सा.का.नि. 215. राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, गृह मंत्रालय , राजभाषा विभाग , केंद्रीय हिंदी प्रशिक्षण संस्थान/ हिंदी शिक्षण योजना, संयुक्त निदेशक ( भाषा ) भर्ती नियम, 2004 का संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:

1. ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय , राजभाषा विभाग , केंद्रीय हिंदी प्रशिक्षण संस्थान/हिंदी शिक्षण योजना , संयुक्त निदेशक ( भाषा ) भर्ती ( संशोधन ) नियम , 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. गृह मंत्रालय, राजभाषा विभाग , केंद्रीय हिंदी प्रशिक्षण संस्थान/हिंदी शिक्षण योजना , संयुक्त निदेशक ( भाषा ) भर्ती नियम, 2004 में: -- (i) नियम 2 में : -

( क ) पार्श्व शीर्षक में " वेतनमान " शब्दों के पश्चात्, " वेतन बैंड और ग्रेड वेतन/ वेतनमान " शब्द रखे जाएं (ख ) " वेतनमान " शब्दों के स्थान पर , " वेतन बैंड और ग्रेड वेतन/ वेतनमान " शब्द रखे जाएंगे ;

( ii ) विद्यमान अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी , अर्थात्: -

प्रोन्नत्ति : वेतन बैंड -3 , 15600-39100 रु. + ग्रेड वेतन 6600 रु. के वेतन में ऐसा उप निदेशक ( हिंदी शिक्षण योजना ) , जिसने उस श्रेणी में पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : जहीं ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ

व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा

की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे

कनिष्ठ व्यक्तियों सहितं , जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली

है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए 1 जनवरी , 2006 से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गयी सेवा या ऐसी तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर पुनरीक्षित वेतन की संरचना विस्तारित है , वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्संबंधी श्रेणी वेतन/वेतनमान में की गई सेवा समझी जाएगी । 11 [ भाग II- खण्ड 3 (1) ]

GS.R. 215. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Home Affairs , Department of Official Language , Central Hindi Training Institute/Hindi Teaching Scheme , Joint Director ( Language) Recruitment Rules , 2004 , namely :-

1. ( 1 ) These rules may be called the Ministry of Home Affairs , Department of Official Language , Central Hındı Training Institute /Hindi Teaching Scheme , Joint Director ( Language ) , Recruitment ( Amendment ) Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Ministry of Home Affairs , Department of Official Language , Central Hindi Training Institute/Hindi Teaching Scheme, Joint Director ( Language ) , Recruitment Rules , 2004 , -

(i) In rule 2,-

( a) in the marginal heading , for the words " scale of pay " , the words " Pay Band and Grade Pay/ Scale of pay " shall be substituted;

(b) for the words " scale of pay " , the words " Pay Band and Grade Pay / Scale of pay " shall be substituted :

Promotion : Deputy Director (He di Teaching Scheme ) in Pay Band - 3 , Rs . 15600-39100 plus Grade Pay of Rs . 6600 with five years ' regular Service in the Grade .

Note 1 : Where juniors who have completed their qualifying / eligibility service are being condered for promotion , their seniors would also be considered vided they are not short of the requisite qualifying/ eligibili ervice by more than half of such qualifying / eligibility service or two years , whichever is less , and have successfully comped their probation period for promotion to the next higherade alongwith their juniors who have already completed such qualifying/ eligibility service .

Note 2 : For the purpose of computing minimum qualifying service for promotion the service rendered on a regular basis by an officer prior to 1st January , 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay / pay scale extended based on the recommendations of the Pay Commission .

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री स्तर पर अंग्रेजी विषय के साथ

हिन्दी में मास्टर डिग्री;

या

किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री स्तर पर हिन्दी विषय के साथ अंग्रेजी में मास्टर डिग्री या समतुल्य;

या

किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री स्तर पर अंग्रेजी व हिन्दी विषयों के साथ साथ किसी भी विषय में मास्टर डिग्री;

या

किसी मान्यताप्राप्त विश्वविद्यालय से हिन्दी माध्यम से और डिग्री स्तर पर अंग्रेजी विषय के साथ किसी भी विषय में मास्टर डिग्री;

या

किसी मान्यताप्राप्त विश्वविद्यालय से अंग्रेजी माध्यम से और डिग्री स्तर पर हिन्दी विषय के साथ किसी भी विषय में मास्टर डिग्री;

( ii ) हिन्दी में पारिभाषिक शब्दावली कार्य और/या अंग्रेजी से हिन्दी में अथवा हिन्दी से अंग्रेजी अनुवाद कार्य का पांच वर्ष अनुभव , तकनीकी या वैज्ञानिक साहित्य संबंधी कार्य को वरीयता ,

या

हिन्दी के अध्यापन , अनुसंधान , लेखन या पत्रकारिता का पांच वर्ष का

2. वेतन बैंड 3 , 15600-39100 रु. और ग्रेड वेतन 5400 के वेतनमान में ऐसे विभागीय सहायक निदेशक ( राजभाषा ) भी जिन्होंने श्रेणी में 5 वर्ष नियमित सेवा की हो , विचार किए जाने के पात्र होंगे , और यदि पद पर नियुक्ति के लिए चयन हो जाता है तो उसं प्रोन्नति द्वारा भरा समझा जाएगा । प्रतिनियुक्ति की अवधि जिसकं अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि भी है, साधारणतः चार वर्ष से अधिक नहीं होगी । नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 1 : प्रतिनियुक्ति पर नियुक्ति के प्रयोजन के लिए । जनवरी , 2006 ( वह तारीख से जिसमें छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तारित की गई है ) से पूर्व किसी अधिकारी द्वारा , नियमित आधार पर की गयी सेवा वेतन आयोग की सिफारिश पर आधारित ततस्थानी ग्रेड वेतन/वेतनमान में की गई संवा समझी जाएगी , सिवाय उसके जहां एक या एक से अधिक पुनरीक्षित वेतनमान का एक सामान्य ग्रेड वेतन /वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहां यह फायदा केवल उस पद ( पदों ) पर विस्तारित होगा जिसके लिए बिना किसी उन्नयन के सामान्य प्रतिस्थापन ग्रेड है । 1099 भारत का राजपत्र : दिसम्बर 4 , 2010/अग्रहायण 13 , 1932

( a) (i) holding analogous post on a regular basis in the parent cadre/department ,

( ii) with five years service in the grade rendered after appointment thereto on regular basis in the grade scale ofpay of Rs . 15600-39100 with grade pay of Rs . 5400 in pay band 3 or equivalent in the parent cadre / department; and

(b) possessing the educational qualifications and experience as under :

(i) Master's Degree of a recognized university in Hindi with English as a subject at the degree level ;

Master's Degree of a recognized university in English with Hindi as a subject at the degree level ;

Master's Degree of a recognized university in any subject with Hindi and English as subjects at the degree level;

Master'sDegree of a recognized university in any subject with Hindi medium and English as a subject at the degree level;

Master'sDegree of a recognized university in any subject with English medium and Hindi as a subject at the degree level; and

(ii) Five years experience of terminological work in Hindi and/ or translation work from English to Hindi or vice - versa , preferably of technical or scientific literature ;

Five years ' experience of teaching , research , writing or

journalism in Hindi .

(2) The Departmental Assistant Director ( Official Language ) in the scale of pay of Rs . 15600-39100 with Grade Pay of Rs . 5400 in Pay Band - 3 , with five years regular service in the grade will also be eligible for consideration and in case he is selected for apointment to the post , the same shall be deemed to have been filled by promotion .

(Period of deputation including the period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization /department of the Central Government shall not ordinarily exceed four years . सा.का.नि. 217.-- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और केन्द्रीय भूमिगत जल बोर्ड ज्येष्ठ तकनीकी सहायक ( भूभौतिकी ) भर्ती नियम , 1972 को , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है , जल संसाधन मंत्रालय, केन्द्रीय भूमिगत जल बोर्ड में ज्येष्ठ तकनीकी सहायक ( भूभौतिकी ) के पद पर भर्ती की पद्धति को विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम जल संसाधन मंत्रालय , केन्द्रीय भूमिगत जल बोर्ड , ज्येष्ठ तकनीकी सहायक ( भूभौतिकी ) , समूह ' ख ' पद, भर्ती नियम , 2010 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतन ग्रेड और ग्रेड वेतन या वेतनमान, उक्त पद की संख्या , इसका वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि. भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता, वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

परका पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकारों को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐशा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकंगी । 4547 Gl/10-2 1102

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Ground Water Board Senior Technical Assistant ( Geophysics ) Recruitment Rules , 1972, expect as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Technical Assistant ( Geophysics ) in the Ministry of Water Resources , Central Ground Water Board , namely: -

1. Short title and commencement . ( 1 ) These rules may be called the Ministry of Water Resources , Central Ground Water Board , Senior Technical Assistant ( Geophysics ) , Group ' B ' post Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification, pay band and grade pay or pay scale . The number ofthe posts , its classification , pay band and grade pay or the pay scale attached thereto shall be as specified in columns ( 2 ) to ( 4 ) of the Sch : dule annexed to these rules .

[PART II - SEC. 3 ( i ) ] (a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation, relaxation of age - limit and other concessions requiral to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regar .

( 2 ) ये राजपत्र में प्रकाशन की तारीन्द्र को प्रवृत्त होंगे । यत्र संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान - उक्त पद की संख्या , उसका वर्गीकरण और उसका नगर में गंडावंतनमान वह होगा जो इन नि उपावद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

GS.R. 219. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Ground Water Board ( Sweeper ) Recruitment Rules , 1976, the President hereby niakes the following rules regulating the method of recruitment to the post of Safaiwala in the Ministry of Water Resources , Central Ground Water Board , namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Water Resources , Central Ground Water Board , Safaiwala, Group ' C ' post Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification, pay band and grade pay or pay scale .- The number of the post , its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns ( 2 ) to ( 4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit, qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14) of the said Scheduze .

( ख ) जिसने अपने पति या अपनी पत्नी श्रवित रहते हुए किसी व्यक्ति से विवाह किया है , या विवाह काने की साँवदा को सेवा पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकारों का लागू ग्वाय विन गधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय अरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसक निय का कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध का किसी वर्ग या धवर्ग के व्यक्तियों बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-- इन नियमों की कोई बात ऐसे बारक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेग , जिनका कन्द्रीय एकार द्वारा इस संबंध में समय - समय पर निकाल गाए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजानियों, भूतपूर्व मनिकां और स वशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( iii ) जिन्होंने आई.एस.टी.एम. या. किसी अन्य मान्यताप्राप्त संस्था द्वारा संचालित रोकड़ और लेखा कार्य में सफलतापूर्वक प्रशिक्षण पूरी कर ली है और जिनके पास रोकड़ , लेखा और बजट कार्य का पांच वर्ष का अनुभव है ।

टिप्पण :

( i ) प्रतिनियुक्ति/ आमेलन के आधार पर नियुक्ति के प्रयांजन के लिए किसी अधिकारी द्वारा 1-1-2006 से पहले ( उम तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है ) नियमित आधार पर की गयी सेवा को , सिवाय उस दशा के जहां एक से अनधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन/वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ( उन पदों ) पर विस्तारित होगा जिसके लिए ग्रेड वेतन, वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, वेतन आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान पर की गई सेवा समझी जाएगी ।

( ii ) प्रतिनियुक्ति की अवधि ( आई एस टी सी ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य बाह्य पद पर प्रतिनियुक्ति की अवधि भी है ( आई एस टी सी ) साधारणतया तीन वर्ष से अधिक नहीं होगी।

G.S.R. 220.- In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules for the post of Finance Officer in the Ministry of Water Resources , Farakka Barrage Project, namely :-

1. Short title and commencement.-( 1) These rules may be called the Ministry of Water Resources , the Farakka Barrage Project , Finance Officer , ( Group ' A'post) Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication of this notification in the Official Gazette .

2. Number of post , classification , scale of pay . The number of post , its classification , and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment and age limit and other qualifications , etc. The method of recruitment to the said post, age - limit , qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 14 ) of the said Schedule.

4. Disqualification . No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the service :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so todo , itmay, by order , for reasons to be recorded in writing and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex - servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard .

सा.का.नि. 221.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय जल आयोग समूह ' ग ' और समूह ' घ ' पद भर्ती नियम, 1972 को जहां तक उनका संबंध मशीन सुपरवाइजर अऔर टेप पुस्तकालयाध्यक्ष के पदों से है , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , जल संसाधन मंत्रालय , केन्द्रीय जल आयोग में डाटा प्रविष्टि आपरेटर समूह ' घ ' के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात् : -- 1. संक्षिप्त शीर्षक और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम जल संसाधन मंत्रालय , केन्द्रीय जल आयोग , डाटा प्रविष्टि आपरेटर श्रेणी- घ , समूह ' ख ' पद भर्ती नियम , 2010 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पद की संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वंतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संर्बोधत अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

( क ) जिसने ऐसे व्यक्ति से जिसका पति य।। जसकी पत्नी जीवित है , विवाह किया है , या विवाह की संविदा की है ; या (ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकारों को लागू स्वीय विधि के अधींन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी । [ भाग 11 - खण्ड 3 ( i ) ]

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमो की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन

के लिए , तारीख 1 जनवरी , 2006 से पहले या छठे वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार करने की तारीख से किसी अधिकारी द्वारा नियमित आधार पर की गयी सेवा का विस्तार उक्त वेतन आयोग की सिफारिशों पर आधारित तत्समान ग्रेड वेतन या वेतनमान पर होगा सिवाय इसके कि जहां एक से अधिक पूर्व पुनरीक्षित वेतनमान का विलयन एक ग्रेड में सामान्य ग्रेड वेतन या वेतनमान में किया गया है और जहां इस फायदे का विस्तार केवल ऐसे पद ( पदों ) के लिए किया जाएगा जिनमें बिना किसी उन्नत पद के ग्रेड वेतन या वेतनमान में सामान्य प्रतिस्थापन किया जाता है ।

केन्द्रीय सरकार के ऐसे अधिकारी :

(क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारित किए हुए हैं ; या

( ii ) जिन्होंने मूल काडर या विभाग के वेतन बैंड -1,5200-20200 रु. धन ग्रंड वेतन 2400 रु. या समतुल्य में नियुक्ति के पश्चात् इस ग्रेड में दस वर्ष सेवा की है; और

( ख ) जिनके पास किसी मान्यताप्राप्त विश्वविद्यालय या समतुल्य से स्नातक की डिग्री है और डाटा प्रविष्टि कार्य के लिए 8000 की दवाब प्रति घंटा की गति है ।

टिप्पण 1 : फीडर प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्तिमें हैं वे प्रतिनियुक्ति के आधार पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे औ इसी प्रकार प्रतिनियुक्ति पर नियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार कि उसी या किसी अन्य संगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

Note 1 : Where juniors who have completed their qualifying /

(iii) with ten years ' service in the grade rendered after appointment thereto on a regular basis in Pay Band - 1 Rs . 5200-20200 plus Grade Pay Rs . 2400 or equivalent in the parent cadre or department ; and

(b) possessing Bachelor's degree from a recognised University or equivalent and having a speed 8000 key depressions per hour for data entry work .

Note 1 : The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligibleto consideration for appointment on deputation and similarly, deputationists shall not be cligible for considerable for appointment by promotion.

Note 2: Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years' .

Note 3 : The maximum age limit for appointment by deputation shall be not exceeding fifty - six years as on the closing date of roceipt of applications .

Note 4: For the purpose of appointment on deputation basis ,

सा.का.नि. 222.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय कुक्कुट प्रशिक्षण संस्थान आशुलिपिक श्रेणी- II भर्ती नियम , 1987 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग , केन्द्रीय कुक्कुट विकास संगठन में आशुलिपिक ( अंग्रेजी ) श्रेणी- II के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्य पालन विभाग , केन्द्रीय कुक्कुट विकास संगठन में आशुलिपिक ( अंग्रेजी ) श्रेणी ।। ( समूह ' ग ' पद ) भर्ती नियम, 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान, पद संख्या , उसका वर्गीकरण , वेतन बैंड और ग्रेड वंतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेंगी । 6. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । [ भाग II- खण्ड 3 ( i ) ]

In exercise of the povers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Poultry Traming Institute ( Stenographer Grade 11 ) Recruitment Rules , 1987 , expect as respects things done or omitted to be done beter sach supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer ( English) Grade II in the Ministry of Agriculture , Department of Animal Husbandry , Darying and Fisiceice , in the Central Poultry Development Organization , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry , Dairying and Fisheries , Central Poultry Development Organization Stenographer ( English ) Grade 11 ( Group ' C ' Post ) Recruitment Rules , 2010 ,

(2 ) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification, pay band and grade pay or pay scale . The number of post , its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns ( 2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment to the said post , age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5 ) to ( 14 ) of the said Schedule .

4. Disqualification . No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any persor from the operation of this rule .

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do it may , by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affoct reservation , relaxation of age - limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

प्रारूप नियम

1. ( 1 ) ये नियम कर्मचारी राज्य बीमा ( केन्द्रीय ) ( चतुर्थ संशोधन ) नियम , 2010 कहलायेंगे ।

(2 ) ये शासकीय राजपत्र में अंतिम प्रकाशन की तारीख से लागू होंगे ।

2. कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 में ( अब से प्रधान नियम के रूप में निर्देशित ) , नियम 58 में, उप - नियम ( 1 ) में, खण्ड ( क) में, -

(1 ) उप - खण्ड ( ख ) में, " अठारह वर्ष " शब्दों को " पच्चीस वर्ष " शब्दों से प्रतिस्थापित किया जाएगा;

(2) उप- खण्ड ( ग ) :-

( क ) " अठारह वर्ष की आयु होने अथवा विवाह तक , जो भी पहले हो " शब्दों को हटाया जाएगा:

(ख ) पहले परन्तुक में, निम्नलिखित परन्तुक को प्रतिस्थापित किया जाएगा नामतः-

" बशर्ते कि बीमाकृत व्यक्ति की मृत्यु के समय उसके अर्जन पर पूर्णतया आश्रित निःशक्त वैध अथवा दत्तक अविवाहित पुत्री के मामले में आश्रितजन हितलाभ परिवार रहने तक अदा किया जाता रहेगा । " 3. प्रधान नियमों में , नियम 59 में, " पाँच हजार रुपये " शब्दों को " दस हजार रुपये " शब्दों से प्रतिस्थापित किया जाएगा । 4. प्रधान नियमों में, नियम 61 में,

( 1 ) आरंभिक खण्ड में, " अधिवर्षिता की आयु पूरी करने पर " शब्दों " अधिवर्षिता आयु पूरी करने पर , स्वैच्छिक सेवानिवृत्ति योजना के अंतर्गत सेवानिवृत्त होने वाले अथवा समयपूर्व सेवानिवृत्ति लेने वाले " शब्दों को प्रतिस्थापित किया जाएगा:

(2) मद ( 1 ) में, " उनकी अधिवर्षिता के साक्ष्य " शब्दों के स्थान पर " अथवा स्वैच्छिक सेवानिवृत्ति योजना के अंतर्गत संवानिवृत्ति अथवा जैसा भी मामला हो, समयपूर्व सेवानिवृत्ति " शब्दों को अंतःस्थापित किया जाएगा । [ भाग II- खण्ड 3 ( i ) ]

5. प्रधान नियमों में, नियम 61 के बाद निम्नलिखित नियम अंत:स्थापित किया जाएगा, नामतः-

" 61 क चिकित्सा हितलाभ की पात्रता के लिए आश्रितजन माता- पिता की आय- सीमा चिकित्सा हितलाभ की पात्रता के लिए आश्रितजन माता - पिता की सभी श्रोतों से आय धारा 2 के खण्ड ( 11 ) के उप - खण्ड ( v ) के अंतर्गत पाँच हजार रुपये प्रतिमाह से अधिक न हो । "

The following draft of certain rules further to amend the Employees ' State Insurance ( Central ) Rules , 1950 , which the Central Government, after consultation with the Employees ' State Insurance Corporation, proposes to make in exercise of the powers conferred by Section 95 of the Employees ' State Insurance Act , 1948 ( 34 of 1948 ) , is hereby published as required by sub - section ( 1 ) of the said section, for information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Gazette of India in which this notification is published , are made available to the public :

Objection or suggestions , which may be received from any person in respect of the said draft rules within the period specified above , will be considered by the Central Government ;

DRAFT RULES

1. ( 1 ) These rules may be called the Employees ' State Insurance ( Central ) ( Fourth Amendment ) Rules , 2010 , (2) They shall come into force on the date of their final publication in the Official Gazette .

2. In the Employees ' State Insurance (Central ) Rules , 1950 ( hereafter referred to as the principal rules ) , in ratle Sx in sub - rule ( 1 ) , in clause (A ) ,-

( i) in sub - clause ( b ) , for the words " eighteen years " , the words " twenty- five years " shall be substituted :

(ii) In sub - clause (c) :-

(A) . the words " until she attains the age of eighteen years or until marriage , whichever is earlier " shall be omitted;

(B). for the first proviso , the following proviso shall be substituted namely : -

"Provided that in the case of ligitimate or adopted unmarried daughter who is infirm and is wholly dependent on the earnings of the insured person at the time of his death , dependent's benefit shall continue to be paid while the family lasts . "

3. In the principal rules , in rule 59, for the words " five thousand rupees " , the words " ten thousand rupees " shall be substituted.

4. In the principal rules , in rule 61 ,-

(i) in the opening portion , for the words " on attaining the age of superannuation " , the words " on attaining the age superannuation, who retires under a Voluntary Retirement Scheme or takes premature retirement " shall be substituted;

(ii) in term ( i ) , after the words " proof of his superannuation " , the words " or retirement under a Voluntary Retirement Scheme or as the case may be, premature retirement " shall be inserted .

5. In the principal rules , after rule 61 , the following rule shall be inserted, namely :--

"61A. Income limit of dependent parents for eligibility to medical benefit . The income of dependent parents for eligibility to medical benefit under sub - clause ( v ) of clause ( 11 ) of Section 2 from ail sources shall not exceed five thousand rupees in a month . ".

सा.का.नि. 224.- कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 में और संशोधन करने के कतिपय मसौदा नियम कर्मचारी राज्य बीमा अधिनियम , 1948 ( 1948 का 34 ) की धारा 95 की उप - धारा ( 1 ) के अधीन यथा अपेक्षित भारत के राजपत्र , भाग -2 , खण्ड 3 , उप - खण्ड ( 1 ) , दिनांक 9 सितम्बर , 2010 में भारत सरकार श्रम और रोजगार मंत्रालय संख्या सा.का.नि. 745 ( अ ) , दिनांक 9 सितम्बर , 2010 की अधिसूचना में, उन सभी व्यक्तियों से , भारत के राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की गई है, जनता को उपलब्ध कराने की तारीख से 30 दिन की अवधि की समाप्ति तक आपत्तियां और सुझाव आमंत्रित करने के लिए प्रकाशित किए जाते हैं जिनकी उससे प्रभाक्ति होने की संभावना है । और जबकि उक्त राजपत्र की प्रतियां जनता को 9 सितम्बर , 2010 को उपलब्ध कराई गई थी ;

तथा जबकि इस संबंध में किसी व्यक्ति से कोई आपत्ति या सुझाव प्राप्त नहीं हुआ है ।

अतः , अब , कर्मचारी राज्य बीमा अधिनियम , 1948 की धारा 95 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , कर्मचारी राज्य बीमा निगम के साथ विचार विमर्श करने के पश्चात् कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 में और संशोधन करने के लिए एतद्वारा नियम बनाती है , नामतः-

1. ( 1 ) ये नियम कर्मचारी राज्य बीमा ( केन्द्रीय ) तृतीय संशोधन नियम , 2010 कहे जायेंगे ।

( 2 ) ये शासकीय राजपत्र में प्रकाशन की तारीख से लागू होंगे ।

2. कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम , 1950 , नियम 5 , उप - नियम ( 1 ) में

( 1 ) खण्ड ( 1 ) में, -

(क ) मद ( क ) में " एक अथवा अधिक बैठकों में उपस्थित होने पर प्रत्येक दिन के लिए 50 रुपये " शब्दों को " शहर के भीतर यात्रा के लिए प्रत्येक दिन के लिए एक सौ पचास रुपये " शब्दों से प्रतिस्थापित किया जाएगा:

ख ) मद ( ख ) में , उप मद ( क ) में , " ( पर्यटक ) " शब्द और ब्रैकेट को हटाया जाएगा ।

(

) खण्ड ( 2 ) में मद ( ख ) के लिए निम्नलिखित मद को प्रतिस्थापित किया जाएगा ।

( ख ) बैठक के आयोजन स्थल के अनिवासी गैर - सरकारी सदस्य को यदि सदस्य होटल में ठहराता है , 1500 रुपये प्रतिदिन तथा जलपान व्यय के लिए 200 रुपये प्रतिदिन से अनधिक अदा किया जाएगा : -

बशर्ते कि दैनिक भत्ते की गैर - सरकारी सदस्य की सामान्य आवास स्थान से कैलेण्डर दिन के आधार पर पुर्ण अनुपस्थिति के लिए गणना की जाएगी : अर्थात् निम्नानुसार आधी रात से आधी रात तक :

शून्य 6 घंटे से अनधिक अनुपस्थिति के लिए

12 घंटे से अनधिक किंतु 6 घंटे से अधिक अनुपस्थिति के लिए 70 %

100 % 12 घंटे से अधिक अनुपस्थिति के लिए

GS.R. 224. Whereas certain draft rules further to amend the Employees ' State Insurance ( Central ) Rules , 1950 , were published as required under sub - section ( 1 ) of Section 95 of the Employees ' State Insurance Act . 1948 ( 34 of 1948 ) . in the notification of the Government of India in the Ministry of Labour and Employment number G.S.R. 745 ( E ) , dated the 9thSeptember , 2010 , in the Gazette of India , Part II , Section 3 , sub - section ( i ) , dated the 9th September , 2010 , for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of thirty days from the date on which the copies of the Gazette of India which the said notification was publishxl , were made available to the public;

And whereas , the copies of the said Gazette were made available to the public on the 9th September, 2010 ;

And whereas no objection or suggestion has been received from any person in this regard ;

Now, therefore, in exercise of the powers conferred by Section 95 of the Employees ' State Insurance Act , 1948 , the Central Government , after consultation with Employees ' State Insurance Corporation , hereby makes the following rules further to amend the Employees ' State Insurance ( Central ) Rules , 1950 , namely:-

1. ( 1 ) These rules may be called the Employees ' State Insurance ( Central ) ( Third Amendment ) Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Employees ' State Insurance ( Central ) Rules , 1950 in rule 5 , in sub - rule ( 1 ) ,--

(i) In clause ( i) ,-

(a) .. In item (A) , for the words "rupees fifty for each day on which he attends one or more meetings ", the words " rupees one hundred and fifty for each day for travel within the city " shall be substituted ;

(b) .. In item (B) , in sub - item ( a) , the word and brackets " ( Tourist ) " shall be omitted ;

( ii) In clause ( ii ) , for item ( B ) , the following item shall be substituted , namely :-

"(B )A non - official member , not residing at the place where a mecting is held shall be paid , Rs . 1500 per day if member stays in a hotel and , not exceeding Rs . 200 per day as expensés towards food:

Provided that the daily allowances shall be calculated for the entire absence from the normal place of residence of the non - official metter on calendar day basis ; i.e. ,

Midnight to Midnight as under :

For absence not exceeding 6 hours

Nil

For absence exceeding 6 hours but not exceeding 12 hours . 70 % For absence exceeding 12 hours 100%
