सा.का.नि. 240. चूंकि, वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 14 कीअपेक्षानुसार भारत सरकार , नागर विमानन मंत्रालय के दिनांक 14 सितम्बर , 2010 की अधिसूचना संख्या सा.का.नि. 151 के द्वारा , वायुयान नियम , 1937 में और संशोधन करने के लिए , वायुयान (संशोधन ) नियम , 2010 का प्रारूप प्रकाशित कर दिया गया था , उस तारीख से जब भारत के राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित की गई थी , तीस दिन की अवधि की समाप्ति से पूर्व ऐसे सभी व्यक्तियों से आक्षेप और सुझाव मांगते हुए , जिनके उससे प्रभावित होने की संभावना थी , उन्हें सार्वजनिक रूप से उपलब्ध करा दी गई थीं;

और चूंकि उक्त अधिसूचना की प्रतियां , दिनांक 4 नवम्बर , 2010 को सार्वजनिक रूप में उपलब्ध करा दी गई थीं ;

और चूंकि प्रारूप नियमों पर उक्त अधिसूचना में विनिर्दिष्ट अवधि में किसी भी व्यक्ति से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं;

अतः , अब , केन्द्रीय सरकार , उक्त वायुयान अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियम , 1937 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:

G.S.R. 240. Whereas the draft ofAircraft (Amendment) Rules , 2010 further to amend the Aircraft Rules , 1937 , was published as required by section 14 of the Aircraft Act , 1934 (22 of 1934 ) , vide notification of the Government of India in the Ministry of Civil Aviation number G.S.R. 151 , dated 14th September , 2010, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in which the said notification was published , were made available to public:

Andwhereas copies of the said notification were made available to the public on the 4th November , 2010 :

And whereas no objections or suggestions have been received from any person in respect of the draft rules within the period specified in the said notification;

Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely :--

1. Short title and commencement . These rules may be called the Aircraft (5th Amendment ) Rules , 2010 .

2. Amendment of Section Pof Schedule II .--In the Aircraft Rules , 1937 , in Schedule II , in Section P, - (i) in paragraph 1 , in clause (e), for the words " two instrument flight tests to the satisfaction of two different Examiners ", the words " an instrument flying test to the satisfaction of an Examiner " shall be substituted;

(i) in paragraph 3 , in clause ( a) , the proviso shallbe omitted .

सा.का.नि. 241. राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय मात्स्यिकी सर्वेक्षण ( महानिदेशक ) भर्ती नियम , 2003 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या किए जाने कालोप किया गया है, कृषि मंत्रालय में पशुपालन , डेयरी एवं मत्स्यपालन विभाग के अधीन भारतीय मात्स्यिकी सर्वेक्षण , मुम्बई में महानिदेशक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय मात्स्यिकी सर्वेक्षण ( महानिदेशक ) भर्ती नियम , 2010 है । [ भाग 11- खण्ड 3 (i ) ]

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण , और वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा , शैक्षिक अर्हताएं और उक्त पद से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग के परामर्श से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों , और अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या विश्वविद्यालयों या पब्लिक सेक्टर उपक्रमों या मान्यताप्राप्त अनुसंधान संस्थानों या परिषदों या अर्थ सरकारी या कानूनी या स्वायत्त संगठनों के अधीन ऐसे अधिकारी जो :

(क) ( i ) मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण कर रहे

हैं; या

( ii ) मूल काडर या विभाग में वेतन बैंड -4,37,400 67,000 रुपए । ग्रेड वेतन 8700 रुपए या समतुल्य के पदों पर अपनी नियुक्ति के पश्चात् नियमित आधार पर ग्रेड में दो वर्ष सेवा कर चुके हों ।

( ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों अर्थात् :-

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से समुद्रीय जीव विज्ञान या जन्तु विज्ञान

या समुद्र विज्ञान या मात्स्यिकी विज्ञान या औद्योगिक मात्स्यिकी में मास्टर डिग्री या समतुल्य, या केन्द्रीय मात्स्यिकी शिक्षा संस्थान मुम्बई से मात्स्यिकी विज्ञान में डिप्लोमा,

( ii ) समुद्री मात्स्यिकी अनुसंधान और विकास में बारह वर्ष का अनुभव जिसमें से कम से कम पांच वर्ष का वास्तविक अनुभव योजना, कार्य क्रमण , क्रियान्वयन और अन्वेषणात्मक मात्स्यिकी जलयान के बेड़ों द्वारा मात्स्यिकी स्रोतों में सर्वेक्षण की मॉनिटरिंग में होना चाहिए ।

टिप्पण : श्रेणी में दो वर्ष की नियमित सेवा के साथ उक्त ( ख ) में दी गई अर्हता और अनुभव रखने वाले वेतन बैंड -4 ( 37,400-67,000 रुपए, और ग्रेड वेतन 8700 रुपए ) के विभागीय उपमहानिदेशक ( मात्स्यिकी ) पर भी विचार किया जाएगा और यदि उनका इस पद पर नियुक्ति के लिए चयन हो जाता है तो इस पद को प्रोन्नति द्वारा भरा हुआ समझा जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

प्रतिनियुक्ति ( अल्पकालिक संविदा सहित ) की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है . साधारणतया पांच वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति द्वारा नियुक्ति ( अल्पकालिक संविदा सहित ) के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा (13)

GS.R. 241. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Fishery Survey of India, (Director General) Recruitment Rules , 2003 , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director General in the Fishery Survey of India, Mumbai under the Ministry ofAgriculture ( Department of Animal Husbandry, Dairying and Fisheries , namely:-

1. Short title and commencement . (1 ) These rules may be called the Fishery Survey of India (Director General) Recruitment Rules , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and the pay band, grade pay or pay scale , The number of the said posts , its classification and the pay band and grade pay or pay scales attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment, age limit and qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 14) of the aforesaid Schedule .

4. Disqualification .- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient to do so, it may , by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any classes or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex - Servicemen , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

(ii ) twelve years experience in Marine Fisheries Research and Development out of which at least five years must be actual experience in the planning , programming . implementation and monitoring of fisheries resources survey by exploratory fishing , deploying a fleet ofvessels .

Note : The Depatrmental Deputy Director General (Fisheries ) in Pay Band -4 (Rs . 37,400 67.000 with grade pay of Rs . 8700 ) possessing the qualification and experience at ( b ) above with two years regular service in the grade will also be considered and in case he is selected for appointment to the post , the same shall be deemedto have been filled by promotion .

The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation .

Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

Period of deputation (including short - term contract) including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed five years . The maximum age limit for appointment by deputation (including short - term contract ) shall be not exceeding 56 years as on the closing date of the receipt of application.

सा.का.नि. 244.राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और श्रम ब्यूरो ( महायक निदेशक ) भर्ती नियम , 1992 को , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है श्रम और रोजगार मंत्रालय के संलग्न कार्यालय श्रम ब्यूरो में सहायक निदेशक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम श्रम ब्यूरो ( सहायक निदेशक ) भर्ती नियम , 2010 है । 1.

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । [ भाग II- खण्ड 3 (i ) ]

2. पद की संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेतन वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , अन्य अर्हताएं आदि. क्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता : वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों कीबाबत, आदेश द्वारा शिथिल कर सकेंगी ।

6. व्यावृत्ति : इन नियमों की कोई बात , ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के अधीन ऐसा अधिकारी

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण कर रहा है; या

( ii ) जो मूल काडर या विभाग में वेतन बैंड-2 , 9300-34800 रु. और ग्रेड वेतन 4600 रु. में नियमित आधार पर अपनी नियुक्ति के पश्चात् तीन वर्ष सेवा कर चुका हो; या

( iii ) जो मूल काडर या विभाग में वेतन बैंड-2, 9300 34800 रु. और ग्रेड वेतन 4200 रु. में नियमित आधार पर अपनी नियुक्ति के पश्चात् आठ वर्ष सेवा कर चुका हो; और

( ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखता होः

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से अर्थशास्त्र या सांख्यिकी में बेचलर डिग्री या समतुल्य,

( ii ) अर्थशास्त्र और सांख्यिकीय आंकड़ों के संग्रहण या संकलन और उसमें विश्लेषण में तीन वर्ष का अनुभव सशस्त्र बलों के कार्मिकों के लिए प्रतिनियुक्ति या पुनः नियोजनः कैप्टन या मेजर या समतुल्य रैंक के मशस्त्र बल के ऐसे कार्मिकों जो एक वर्ष की अवधि के भीतर संवा निवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और स्तंभ 12 के अधीन प्रतिनियुक्त व्यक्तियों के लिए विहित अर्हता और अनुभव रखते हों, पर भी विचार किया जाएगा । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बलों से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ( सिविल पदों के प्रतिनिर्देश से अधिर्वार्षता की आयु तक पुनर्नियोजन ) प्रतिनियुक्ति की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति में ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु-सीमा आवेदनों की प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण : प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के लिए । - 1-2006 (वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित वेतन संरचना विस्तारित की गई थी ) से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा वेतन आयोग की सिफारिशों पर आधारित ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी सिवाए इसके जहां एक या अधिक पुनरीक्षित वेतनमान का सामान्य ग्रेड वेतन या वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहां यह फायदा केवल उन पद ( पदों ) के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापना ग्रेड है । 1209 भारत का राजपत्र : दिसम्बर 18 , 2010/ अग्रहायण 27; 1932

GS.R. 244. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Labour Bureau ( Assistant Director ) Recruitment Rules , 1992 , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director in the Labour Bureau , an attached office of the Ministry of Labour and Employment , namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Labour Bureau ( Assistant Director ) Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said posts , its classification and the pay band and grade pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed thereto .

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment , age - limit , qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification.- No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living , or (b) who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage , and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex - Servicemen , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from timeto time in this regard.

ForArmed Forces Personnel;

Deputation or on re - employment:

The Armed Forces Personnel of the rank of Captian or Major or equivalent rank who are due to retire or to be transferred to reserve within a period of one year and having the qualifications and experience prescribed for deputationists under column 12 shall also be considered. Such officers shall be given deputation terms upto the date on which they are due for release from the armed forces ; thereafter they may be continued on re - employment (re-employment up to the age of superannuation with reference to civil posts ) .

Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation or department ofthe Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of applications .

Note: For the purpose of appointment on deputation basis ,

the service rendered on a regular basis by an officer prior to 1-1-2006 (Date from which the revised pay structure based on the 6th Central Pay Commission recommendation has been extended ) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended , based on the recommendations of the pay commission . except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post ( s ) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम श्रम ब्यूरो, श्रम एवं रोजगार मंत्रालय , स्टाफ कार ड्राइवर भर्ती नियम, 2010 है ।

34 भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट है ।

5. निरर्हता : वह व्यक्ति, --

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है , उक्त पद पर नियुक्ति का पात्र नहीं होगा :

टिप्पण :-1. आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गयी अंतिम तारीख होगी न कि वह अंतिम तारीख जो असम , मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैण्ड, त्रिपुरा , सिक्किम , जम्मू कश्मीर राज्य के लद्दाख खण्ड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उप- खण्ड, अंडमान और निकोबार द्वीप समूह या लक्षद्वीप के लिए विहित की गयी है ।

प्रोन्नति या आमेलन या प्रतिनियुक्ति या स्थानांतरण की दशा में भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरी जाने वाली रिक्तियों की प्रतिशतता

प्रतिनियुक्ति या आमेलन

(क) केन्द्रीय सरकार में कार्य कर रहे व्यक्तियों में से 1 पद ( 50 % ) सीधे भर्ती द्वारा जिसके न हो सकने पर प्रतिनियुक्ति या आमेलन द्वारा और 1 पद ( 50 % ) प्रतिनियुक्ति या आमेलन द्वारा जिसके न हो सकने पर सीधे भर्ती द्वारा

( i ) श्रम और रोजगार मंत्रलाय में कार्यरत नियमित सवार हरकारा या स्कूटर ड्राइवर जिसके पास मोटर कार चलाने के लिए सक्षमता का निर्धारण करने के लिए चालन परीक्षण के आधार पर मोटर कार के लिए विधिमान्य चालक अनुज्ञप्ति हो; या

( ii ) ऐसे पदधारी जो नियमित आधार पर सवार हरकारा का पद धागण कर रहे हों; या

( iii ) केन्द्रीय सरकार के अन्य मंत्रालयों में से नियमित कर्मचारी जो स्तंभ 8 में यथा उल्लिखित अर्हताएं और अनुभव रखते हैं ।

( ख ) भूतपूर्व सैनिकों के लिए प्रतिनियुक्ति या पुनः नियोजन सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उभ तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें नियुक्त किया जाता है । तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।

टिप्पण: 1 ( प्रतिनियुक्ति की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस प्रतिनियुक्ति से ठीक पहले भारित किसी अन्य काडर बाहय पद पर प्रतिनियुक्ति की अवधि है , साधारणतयः 4 वर्ष से अधिक नहीं होगी ) ।

टिप्पण: 2 ( प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ) । यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना

GS.R. 245. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Labour Bureau , Ministry of Labour and Employment, Staff Car Driver, Recruitment Rules , 2006 , except as respects things done or omitted to be done before such supersession , the President hereby - inakes the following rules regulating the method of recruitment to the post of Staff Car Driver in the Labour Bureau , Ministry of Labour and Employment, namely:- 1. Short title and commencement. ( 1 ) These rules may be called the Labour Bureau Ministry of Labour and Employment, Staff Car Driver , Recruitment Rules , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.These Rules shall apply to the post specified in column ( 1 ) of the Schedule annexed to these rules.

3. Number of posts , classification and scale of pay.----The number of the said posts , its classification and the pay band and grade pay attached thereto shall be as specified in columns ( 2) to (4 ) of the Schedule annexed to these rules .

4. Method of recruitment , age limit , qualifications , etc. The method of recruitment age limit , qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the said Schedule.

5. Disqualification.- No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b)who , having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order , for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- servicemen , and other special categories of persons in accordance with the orders issued by the Central Government from timeto time in this regard .

Essential : ( i ) Possession of a valid driving license for Motor Cars .

( ii ) Knowledge of motor mechanism ( The candidate should be able to remove minor defects in vehicles ) ; and

( iii ) Experience of driving a motor car for three years .

Desirable : ( i ) 8th Standard pass from recognised school ; and

( ii ) three year's service as Home Guard or Civil Defence Volunteers .

Note : The qualification regarding experience is relaxable at the discretion of the competent authority in the case of candidates belonging to Scheduled Castes and Scheduled Tribes , ifat any stage of selection , the competent authority is of the opinion that the sufficient number of candidates with the requisite experience are not likely to be available to fill up the vacancies reserved for them .

Deputation or Absorption:

(a) From amongst the persons working in the Central Government .

(i) the regular Despatch Rider or Scooter Driver working in the Ministry of Labour and Employment who possess valid Driving License for Motor Cars on the basis of a Driving Test to assess the competence to drive Motor- Cars; or

(ii) officials holding the post of Despatch Rider on regular basis; or

(iii ) regular employees in other Ministries of Central Goverment who fulfill the qualifications and experience as mentioned in colum ' 8 ' .

(b) For Ex- servicemen : Deputation or Re - employment The Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered . Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces ; thereafter they may be continued on re - employment .

Note 1 : (The period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed four years ) .

Note 2 : The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date or receipt of applications .
