सा.का.नि. 39.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मात्स्यिकी क्रियात्मक संस्थान ;वर्ग 1 और वर्ग 2 तकनीकी पदद्ध भर्ती नियम, 1964 को, जहां तक उनका संबंध् पफोरमैन के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्यपालन विभाग के केंद्रीय मत्स्य नौचालन और इंजीनियरी प्रशिक्षण संस्थान कोचीन में अनुदेशक ;कर्मशालाद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, केंद्रीय मत्स्य नौचालन और इंजीनियरी प्रशिक्षण संस्थान कोचीन अनुदेशक ;कर्मशालाद्ध भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड, ग्रेड वेतन या उसका वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

आवश्यक : ;iद्ध किसी मान्यताप्राप्त विश्वविद्यालय से यांत्रिाक इंजीनियरी या नौ इंजीनियरी में डिग्रीऋ ;iiद्ध किसी मान्यताप्राप्त यांत्रिाक या नौ कर्मशाला या संस्था में पम्प, सम्पीडक, वॉयलर आदि जैसे विभिन्न मशीनों के वैल्डग या मशीनरी या विरचना, ओवरहालग या पिफटग कार्य के पर्यवेक्षण का एक वर्ष का अनुभव । वांछनीय ः डीजल इंजनों की ओवरहालग में एक वर्ष का अनुभव । टिप्पण 1 : अर्हताएं अन्यता सुअहत अभ्यथयों की दशा में उनके लिए जो कारण हैं उन्हें लेखब( करके कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती है । टिप्पण 2 : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध उनके लिए जो कारण हैं उन्हें लेखब( करके कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनतातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है ;हैंद्ध जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिये अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

50 प्रतिशत प्रोन्नति द्वारा जिसके न हो प्रोन्नति : सकने पर प्रतिनियुक्ति ;जिसके अंतर्गत वेतन बैंड 1, 5200-20200 रफपए के वेतनमान में और ग्रेड वेतन 2800 रफपए में ऐसा अल्पकालिक संविदा भी हैद्ध द्वारा यांत्रिाक पर्यवेक्षक, जिसने उस श्रेणी में छह वर्ष नियमित सेवा की है ।

50 प्रतिशत सीध्ी भर्ती द्वारा

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, किसी अध्किारी द्वारा, नियमित आधर पर की गई सेवा को, उक्त वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध : केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्राों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधन संस्थानों या पब्लिक सेक्टर संगठनों या अर्ध् सरकारी या स्वशासी या कानूनी संगठनों के ऐसे अध्किारी—

;कद्ध;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैंऋ या

;iiद्ध जिन्होंने मूल काडर या विभाग में वेतन बैंड 1, वेतनमान 5200-20200 रफपए के वेतनमान और ग्रेड वेतन 2800 रफपए या समतुल्य वाले पदों पर नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में छह वर्ष सेवा की होऋ और

;खद्ध जिनके पास स्तंभ ;8द्ध के अध्ीन सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव है :

पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति, प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

[प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।]

टिप्पण : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा को, सिवाय उसके जहां एक से अध्कि पूर्व पनुरीक्षित वेतनमान का साधरण ग्रेड या वेतनमान वाले एक ग्रेड में विलय हो गया है और जहां यह केवल उस पद पर, जिसके लिए ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना सामान्य प्रतिस्थापन ग्रेड है, विस्तारित होगा, उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयेाग से परामर्श किया जाएगा ;13द्ध

G. S. R. 39.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Fisheries Operatives (Class I and Class II Technical Posts) Recruitment Rules, 1964, in so far as they relate to the post of Foreman, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Instructor (Workshop) in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Institute of Fisheries, Nautical and Engineering Training, Cochin, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Instructor (Workshop) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band, grade pay or pay scale.—The number of post, its classification and the pay band, grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. .— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the aforesaid Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Qualifications are relaxable at the discretion of the Staff Selection Commission for reasons to be recorded in writing, in the case of candidates otherwise well qualified.

Note 2 : The qualification regarding experience is relaxable at the discretion of the Staff Selection Commission for reasons to be recorded in writing, in case of candidates belonging to the Scheduled Castes or the Scheduled Tribes if, at any stage of selection, the Staff Selection Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also

be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the

recommendations of the said Pay Commission.

Deputation (including short-term contract) :

Officers of the Central Government or State Governments or Union Territories or Universities or recognized research institutions or Public Sector Organizations or Semi Government or Autonomous or Statutory organizations :

(ii) with six years' service in the grade rendered after appointment thereto on a regular basis in posts in pay band-1 in the scale of Rs.5200-20200 with Grade Pay of Rs.2800 or equivalent in the parent

cadre or department; and

(b) possessing the educational qualifications and experience prescribed for direct recruits under column (8).

The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. similarly, deputationists shall not be eligible for consideration for appointment by promotion.

[Period of deputation (including short-term contract) including period of deputation in another ex-cadre post held immediately preceding

this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation (including short- term contract) shall not be exceeding 56 years as on the closing date of receipt of applications.]

Note : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or

the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay

scale, and where this benefit will extend only for the post, for which that grade pay or pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 40.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रादेशिक कुक्कुट पफार्म ;वर्ग-III और वर्ग-IV अराजपत्रिात पदद्ध भर्ती नियम, 1965 को, जहां तक उसका संबंध् पफार्म सुपरवाइजर, के पद से है, यादृच्छिक निदेर्श अंड-जनन परख एकक, भुवनेश्वर, बम्बई, हैसरघट्‌टा और गुड़गांव ;समूह 'ख' और समूह 'ग' द्ध पद भर्ती नियम, 1983 को, जहां तक उसका संबंध् पफार्म सुपरवाइजर के पद से है, केंद्रीय बत्तख प्रजनन पफार्म हैसरघट्‌टा समूह 'ग' पद भर्ती नियम, 1977 को, जहां तक उसका संबंध् पफार्म सुपरवाइजर के पद से है और सहायक प्रबंध्क, केंद्रीय कुक्कुट प्रजनन पफार्म 'ग' पद भर्ती नियम, 1987 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्राालय ;पशुपालन डेयरी और मत्स्यपालन विभागद्ध के अध्ीन केंद्रीय कुक्कुट विकास संगठन और यादृच्छिक निदर्श कुक्कुट पालन परीक्षण केंद्र में पफार्म प्रबंध्क के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम गृह मंत्राालय केंद्रीय कुक्कुट विकास संगठन और यादृच्छिक निदर्श कुक्कुट पालन परीक्षण केंद्र, पफार्म प्रबंध्क ;समूह 'ग'द्ध पद भर्ती नियम, 2010 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेतन या उसका वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं । 3. भर्ती की प(ति, आयु-सीमा, शैक्षिक अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, शैक्षिक अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

R. 40.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in super- session of the Regional Poultry Farms, (Class-III and Class-IV Non-Gazetted posts) Recruitment Rules, 1965 in so far as they relate to the post of Farm Supervisor, the Random Sample Laying Test Units Bhubaneswar, Bombay, Hessarghatta and Gurgaon (Group C and Group D posts) Recruitment Rules, 1983 in so far as they relate to the post of Farm Supervisor, the Central Duck Breeding Farm, Hessarghatta (Group C posts) Recruitment Rules, 1977 in so far as they relate to the post of Farm Supervisor, and the Assistant Manager, Central Poultry Breeding Farm, Group C post Recruitment Rules, 1987, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Farm Manager in the Central Poultry Development Organizations and Random Sample Poultry Performance Testing Centre under the Ministry of Agriculture, (Department of Animal Husbandry, Dairying and Fisheries), namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Central Poultry Development Organizations and Random Sample Poultry Performance Testing Centre, Farm Manager (Group C) Post Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, Classification and Pay Band and Grade Pay or Pay Scale.—The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit, educational qualifications, etc.—The method of recruitment to the said post, age limit, educational qualifications and other matters relating thereto shall be as specified in Columns 5 to 14 of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen and other special categories or persons in accordance with the orders issued by the Central Government from time to time in this regard.

पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 1 : प्रतिनियुक्ति आमेलन के आधर पर नियुक्ति के प्रयोजनों के लिए, 1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा आयोग की सिपफारिशों पर आधरित तत्स्थानी ग्रेड वेतन/वेतनमान में की गई सेवा समझी जाएगी सिवाए इसके जहां एक या इससे अध्कि पूर्व पुनरीक्षित वेतनमान का सामान्य ग्रेड वेतन/वेतनमान सहित एक ग्रेड में विलय किया गया है और जहां यह पफायदा केवल उन पदों के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन/वेतनमान बिना किसी उदीयन के सामान्य प्रतिस्थापन ग्रेड है ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया 3 वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।द्ध

G. S. R. 41.—In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to Group 'C' posts in the Regional Reference Standard Laboratory, Ahmedabad in the Ministry of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs, namely:—

1. Short title and commencement.—(1) These rules may be called the Regional Reference Standard Laboratory, Ahmedabad (Group 'C' posts), Recruitment Rules, 2011.

(2). They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification and pay band and grade pay/scale of pay.—The number of said posts, their classification and pay band and grade pay/scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Initial constitution.—(1) The employees holding the posts mentioned in the Schedule to these rules in the Regional Reference Standard Laboratory, Ahmedabad on the date of commencement of these Rules shall be deemed to have been appointed to the posts corresponding to those which they were holding on regular basis on that date at the initial constitution.

(2) The inter-se-seniority of the officers in each grade who are appointed at the initial constitution shall be determined as per date of regular appointment to the respective grades subject to the condition that their inter-se- seniority within their respective grades shall not be disturbed.

(3) The regular continuous service of officers mentioned in Sub-rule 1 of rule 5 on the post corresponding to those which they were holding on regular basis prior to their appointment at the initial constitution under these rules, shall count for the purpose of probation period, qualifying service for promotion, confirmation and pension.

6. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such. person and the other party to the-marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

8. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January of 2006/the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission.

in the Pay Band 1 of 5200-20200 plus Grade Pay Rs. 1900 or in its equivalent grade.

Note I : For purposes of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1st January of 2006 the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/ pay scale is the normal replacement grade without any upgradation.

Note II : Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed three years.

सा.का.नि. 42.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय शैक्षिक अनुसंधान और प्रशिक्षण परिषद्‌ ;निदेशकद्ध भर्ती नियम, 2009 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, मानव संसाध्न विकास मंत्राालय, स्कूल शिक्षा और साक्षरता विभाग, राष्ट्रीय शैक्षिक अनुसंधान और प्रशिक्षण परिषद्‌ में निदेशक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम राष्ट्रीय शैक्षिक अनुसंधान और प्रशिक्षण परिषद्‌ ;निदेशकद्ध भर्ती नियम, 2010 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन/वेतनमान.—पद संख्या, उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेतन/वेतनमान वह होगा जो अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा अर्हताएं आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

पूर्वोक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।67 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : जनवरी 15, 2011/पौष 25, 1932

G.S.R. 42.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the National Council of Educational Research and Training (Director) Recruitment Rules, 2009, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Director in the Ministry of Human Resource Development, Department of School Education and Literacy, in the National Council of Educational Research and Training, namely :—

1. Short title and commencement.—(1) These rules may be called the National Council of Educational Research and Training (Director) Recruitment Rules, 2010.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and Pay Band and Grade Pay/ Scale of Pay.—The number of post, its classification and Pay Band and Grade Pay/ Scale of Pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the aforesaid post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
