का.नि.आ. 11.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सेना ;समूह 'ग' आशुलिपिक श्रेणी-II और आशुलिपिक श्रेणी-IIIद्ध भर्ती नियम, 2004 को, जहां तक उनका संबंध् मुख्यालय एकीकृत रक्षा स्टापफ, रक्षा मंत्राालय के अध्ीन स्थापनाओं में समूह 'ग' आशुलिपिक श्रेणी-III के पदों से है, उन बातों के सिवाय आंशिक रूप से अध्क्रिान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के मुख्यालय एकीकृत रक्षा स्टापफ के अध्ीन स्थापनाओं में आशुलिपिक श्रेणी-II के समूह 'ग' के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;iद्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, मुख्यालय एकीकृत रक्षा स्टापफ के अध्ीन स्थापनाओं में, समूह 'ग' पद आशुलिपिक श्रेणी-II भर्ती नियम, 2011 है ।

;iiद्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हता आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. आरंभिक गठन.—इन नियम में किसी बात के होते हुए, ऐसे अध्किारी जो निम्नलिखित सारणी के स्तंभ ;iद्ध में उल्लिखित पद धरण किए हुए हैं, इन नियमों के अध्ीन सारणी के स्तंभ ;iiद्ध में दशत तदस्थानी पदों पर नियुक्त किए गए समझे जायेंगे । उनकी ज्येष्ठता, केन्द्रीय सरकार द्वारा समय-समय पर यथा कथित ज्येष्ठता के साधरण सि(ान्तों के अनुसार नियत की जायेगी ।

S.R.O. 11.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in partial supersession of the Army (Group 'C' Stenographer Grade II and Stenographer Grade III) Recruitment Rules, 2004, in so far as they relate to Group 'C' post of Stenographer Grade III in the Establishments under Headquarters Integrated Defence Staff, Ministry of Defence, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment to the Group 'C' post of Stenographer Grade II in the Establishments under Headquarters Integrated Defence Staff, Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, the Group 'C' post Stenographer Grade II, Recruitment Rules, 2011. (2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay/Pay Scale.—The number of post, its classification and the Pay Band and Grade Pay/Pay Scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualification, etc.—The method of recruitment to the said post, age limit and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Initial Constitution.—Notwithstanding anything contained in these rules, officers holding the following posts mentioned in column (i) of the following table shall be deemed to have been appointed to the posts correspondingly shown in column (ii) of the table under these rules. Seniority shall be fixed according to the general principles of seniority laid down by the Government from time to time.

टिप्पण 1 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख से जिसको छठे केंद्रीय वेतन आयोग पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, आयोग की सिपफारिशों पर आधरित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति/आमेलन के आधर पर नियुक्ति के प्रयोजनों के लिए

1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग पर आधरित

पुनरीक्षित वेतन संरचना विस्तारित की गई है से पूर्व किसी अध्किारी द्वारा

नियमित आधार पर की गई सेवा आयोग की सिपफारिशों पर आधरित तत्स्थानी

ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी सिवाए इसके जहां किसी

सामान्य ग्रेड या वेतनमान के साथ एक श्रेणी में पूर्व पुनरीक्षित वेतनमान का

विलय किया गया है और जहां यह पफायदा केवल उन पदों को विस्तारित होगा

जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उयन के सामान्य प्रतिस्थापन

ग्रेड है ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या

पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे

ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जब कि

उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा

से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे

कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर

ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि

सपफलतापूर्वक पूरी कर ली हो ।

S.R.O. 12.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence, Department of Defence Production, Directorate General of Quality Assurance, [Civilian Motor Driver (Special Grade)/Civilian Motor Driver (Test and Proof) (Special Grade), Civilian Motor Driver Grade-I/Civilian Motor Driver Grade-I (Test and Proof), Civilian Motor Driver Grade-II/Civilian Motor Driver Grade-II (Test and Proof) and Civilian Motor Driver (Ordinary Grade)] Group 'C' posts Recruitment Rules, 2007, in so far as they relate to the posts of Civilian Motor Driver Grade-I/Civilian Motor Driver Grade-I (Test and Proof), Civilian Motor Driver Grade-II/Civilian Motor Driver Grade-II (Test and Proof) and Civilian Motor Driver (Ordinary Grade), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' [Civilian Motor Driver Grade-I/Civilian Motor Driver Grade-I (Test and Proof), Civilian Motor Driver Grade-II/Civilian Motor Driver Grade-II (Test and Proof) and Civilian Motor Driver (Ordinary Grade)] posts in the Department of Defence Production, Directorate General of Quality Assurance, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Department of Defence Production, Directorate General of Quality Assurance, Group 'C' (Civilian Motor Drivers) posts Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or the pay scale.—The number of the said posts, their classification, the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Grade-II (Test and Proof) in the Pay Band-1 Rs. 5200—20200 and Grade Pay Rs. 2400 having five years regular service in the grade and after passing the proficiency test for driving heavy vehicles.

Note 1 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which

officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except where there has been merger of more than

one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post for which that grade pay/pay scale is the normal replacement grade without any upgradation.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short

of the requisite qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

का.नि.आ. 13.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और रक्षा उत्पादन विभाग, क्वालिटी आश्वासन महानिदेशालय, समूह 'ग' ;दमकल चालकद्ध भर्ती नियम, 2006 को, जहां तक उनका संबंध् दमकल चालक श्रेणी-1, दमकल चालक श्रेणी-2 और दमकल चालक ;सामान्य श्रेणीद्ध के पदों से है, उन बातों के सिवाय अध्क्रिान्त करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय ;रक्षा उत्पादन विभागद्ध, क्वालिटी आश्वासन महानिदेशालय में समूह 'ग' [दमकल चालक श्रेणी-1, दमकल चालक श्रेणी-2 और दमकल चालक ;सामान्य श्रेणीद्ध], के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय ;रक्षा उत्पादन विभागद्ध, क्वालिटी आश्वासन महानिदेशालय, समूह 'ग' ;दमकल चालकद्ध भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम, इन नियमों से उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन/वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो उक्त अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अन्य अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसीं उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 13.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Defence Production, Directorate General of Quality Assurance, Group 'C' (Fire Engine Drivers) Recruitment Rules, 2006, in so far as they relate to the posts of Fire Engine Driver Grade-I, Fire Engine Driver Grade-II and Fire Engine Driver (Ordinary Grade), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment Group 'C'Fire Engine Driver Grade-I, Fire Engine Driver Grade-II and Fire Engine Driver (Ordinary Grade) posts in the the Ministry of Defence (Department of Defence Production) Directorate General of Quality Assurance, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence (Department of Defence Production) Directorate General of Quality Assurance, Group 'C' (Fire Engine Drivers) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The number of said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule.

4. Method of recruitment, age limit, other qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (14) of the said Schedule.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
