का.नि.आ. 33.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा मंत्राालय, रक्षा लेखा विभाग में आशुलिपिक श्रेणी-2 ;तत्कालीन आशुलिपिक श्रेणी-3द्ध, के पद पर भर्ती की प(ति को विनियमित करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—

;iद्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, रक्षा लेखा विभाग में ;आशुलिपिक श्रेणी-2द्ध भर्ती नियम, 2011 है । ;iiद्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड एवं ग्रेड वेतन/वेतनमान.—

उक्त पदों की संख्या, इसका वर्गीकरण और वेतन बैंड एवं ग्रेड वेेतन/वेतनमान वे होंगे, जो इन नियमों के साथ संलग्न अनुसूची केे स्तंभ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की विध्,ि आयु सीमा, अर्हताएं आदि .—

4. निरर्हताएं.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई भी बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिन पर सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 33.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade-II (erstwhile Steno-III) Ministry of Defence in the Defence Accounts Department, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Defence Accounts Department (Stenographer Grade II) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and the pay band and grade pay/scale of pay.—The number of the said post, its classification and the pay band and grade pay/scale of pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification, etc.—The method of recruitment to the said post, age limit, qualifications and other matters connected therewith shall be as specified in columns (5) to (14) of the aforesaid Schedule.

4. Disqualifications. —No person, shall be eligible for appointment to the said post :

(a) who has entered into or contracted a marriage with a person having a spouse living,

or

(b) who, having a spouse living, has entered into or contracted a marriage with any person :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, and any other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

1. Short title and commencement.—(1) These rules may be called the Directorate General of Artillery (Store Keeper Grade-I, Store Keeper Grade-II, Mess Supervisor and Jamadar Safaiwala) (Group 'C' and Group 'D' posts) Recruitment (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Directorate General of Artillery (Store Keeper Grade-I, Store Keeper Grade-II, Mess Supervisor and Jamadar Safaiwala) (Group 'C' and Group 'D' posts) Recruitment Rules, 2009 :—

(a) For the post at Sl. No. 2, under column 12, for the existing word ''Transfer'', the word ''Absorption'' shall be substituted.

का.नि.आ. 35.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सेना कैडेट कालेज, भारतीय सैन्य अकादमी, देहरादून प्राचार्य भर्ती नियम, 1989 को, जहां तक उनका संबंध् प्राचार्य के पदों से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के अध्ीन सेना कैडेट कालेज खंड, भारतीय सैन्य अकादमी, देहरादून में प्राचार्य, समूह 'क' राजपत्रिात, अननुसचिवीय के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह करने की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह करने की संविदा की है, उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

43000 रु. से नीचे टिप्पण : आयु-सीमा अवधरित करने नियत नहीं किया के लिए निर्णायक तारीख भारत में जाएगा+प्रत्येक मास अभ्यथयों से आवेदन प्राप्त करने के विशेष भत्ता 2000 रु. लिए नियत की गई अंतिम तारीख और उसकी हकदारी होगी । ; और न कि वह अंतिम का मुफ्रत असुसज्जित तारीख जो असम, मेघालय, आवासन । अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपख्रंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई हैद्ध

टिप्पण 1 : अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में उसके लिए जो कारण हैं उन्हें लेखब( करके, संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध, उसके लिए जो कारण हैं उन्हें लेखब( करके संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है ;हैंद्ध जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

टिप्पण 3 : न्यूनतम पचपन प्रतिशत अंक ;या बदु मापमान में समतुल्य ग्रेड जहां कहीं ग्रेडग प्रणाली का अनुसरण किया जाता हैद्ध, मास्टर स्तर पर, उद्योगों और अनुसंधन संस्थाओं से किसी भी स्तर पर अध्यापकों के रूप में भर्ती किए जाने वाले व्यक्तियों और सहायक आचार्य के प्रवेश स्तर के लिए अपेक्षित होंगे ।

टिप्पण 4 : पात्राता के प्रयोजन के लिए और अध्यापन स्थिति पर सीध्ी भर्ती के दौरान तथा अच्छे शैक्षणिक रिकार्ड के निर्धरण के लिए अनुसूचित जातियों या अनुसूचित जनजातियों या विभिन्न रूप से असमर्थ ;शारीरिक और आंखों से असमर्थद्ध प्रवर्गों के लिए, स्नातक तथा मास्टर स्तर पर पांच प्रतिशत शिथिल करने की व्यवस्था की जाएगी । पात्राता अंक, जो पचपन प्रतिशत अंक होंगे ;या बिन्दु मापमान में समतुल्य ग्रेड जहां कहीं ग्रेडग प्रणाली का अनुसरण किया जाता हैद्ध और किन्ही्र ग्रेस अंकों के प्रक्रियाओं को सम्मिलित किए बिना, केवल अहत अंकों पर आधरित उपर वणत प्रवर्गों को पांच प्रतिशत की शिथिलता अनुज्ञेय है ।

टिप्पण 5 : ऐसे पी. एच. डी. डिग्री धरकों को जिन्होंने 19 सितंबर 1991 से पहले स्नातकोत्तर परीक्षा उत्तीर्ण कर ली है उन्हें अंकों में पचपन प्रतिशत से कम करके पचास प्रतिशत करके पांच प्रतिशत की छूट प्रदान की जा सकेगी ।

टिप्पण 6 : सुसंगत ग्रेड, जिसे पचपन प्रतिशत के समतुल्य रूप में माना गया है, जहां कहीं मान्यताप्राप्त विश्वविद्यालय द्वारा ग्रेडग प्रणाली का अनुसरण किया जाता है, वहां ऐसे व्यक्तियों के संबंध् में भी पात्राता के लिए विचार किया जाएगा ।

S.R.O. 35.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of Army Cadet College, Indian Military Academy, Dehradun Principal Recruitment Rules, 1989 in so far as they relate to the posts of Principal except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Principal in Army Cadet College Wing, Indian Military Academy, Dehradun Group 'A' Gazetted, Non-Ministerial under Ministry of Defence namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Army Cadet College Wing, Indian Military Academy, Dehradun, Principal Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and Pay band and Grade Pay/scale of pay.—The number of the post, their classification and the Pay band and Grade Pay/scale of pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment, age limit, qualification and other matters relating to the said post, shall be as specified in columns (5) to (14) of the aforesaid Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2: The qualification(s) regarding experience is/are relaxable at the discretion of the Union Public Service Commission for reasons to be recorded in writing in the case of candidates belonging to Scheduled Castes or Scheduled Tribes, if at any stage of selection, the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them. ;iiद्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. रक्षा अनुसंधन तथा विकास सेवा नियम, 1979 ;जिसे इसमें इसके पश्चात्‌ उक्त नियम कहा गया हैद्ध, के नियम 8 में ऋ—

;कद्ध उप नियम ;1द्ध के खंड ;खद्ध में ''वैज्ञानिक 'ज' ;उत्कृष्ट वैज्ञानिकद्ध अथवा'' शब्दों, अक्षर और कोष्ठकों का लोप किया जाएगा ।

1. (1) These Rules may be called the Defence Research and Development Service (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Defence Research and Development Service Rules, 1979 (hereinafter referred to as the said Rules), in rule 8;—

(a) In sub-rule (1) clasue (b) the words, letter and brackets ''Scientist 'H'(Outstanding Scientist) or'' shall be ommitted.

(b) In sub-rule (2) in clause (b) after sub-clause (iii), the following sub-clause shall be inserted, namely :—

''(iv) The Peer Committee as specified in Schedule 1D shall assess suitability for appointment of Scientist 'H', Outstanding Scientist in Defence Research and Development Service''.

3. In the said rules, in rule 9, sub-rule (1) after the word and letters Scientist 'F', the words, letter and brackets ''Scientist 'G' Scientist 'H' (Outstanding Scientist)'' shall be inserted.

4. In scheduled 1D, the heading shall be substituted as ''the Peer Committee for assessing suitability of Scientist 'F' and Scientist 'G' for promotion to the next higher grade and for assessing suitability for appointment of Scientist 'H' (Outstanding Scientist) in the Defence Research and Development Service.''

का.नि.आ. 37.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा मंत्राालय ;पंचरद्ध भर्ती नियम, 1986 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय में पंचर के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय ;पंचरद्ध भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से स्तंभ;4द्ध में विनिदष्ट हैं । 3. भर्ती की प(ति, आयु-सीमा, और अन्य अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय पर सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence (Puncher) Recruitment Rules, 1986, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Puncher in the Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence (Puncher) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or the pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

S. R.O. 38.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence, Despatch Riders Recruitment Rules, 1986, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Despatch Rider in the Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence Despatch Riders Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualifications. —No person ;

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : The qualifications regarding experience are relaxable at the discretion of the competent authority for reasons to be recorded in writing in the case of candidates belonging to the Scheduled Castes and the Scheduled Tribes if at any stage of selection, the competent authority is of the opinion that sufficient number of candidates possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

For Ex-Servicemen

Deputation/re-employment :

The Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and educational qualifications prescribed for direct recruits shall also be considered. Such persons would be given deputation terms up to the date on which they are due to release from the Armed Forces, thereafter they may be continued on re-employment.

(The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation/Department of the Central Government shall ordinarily not exceed three years).
