सा.का.नि. 214.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विध्,ि न्याय और कंपनी कार्य मंत्राालय, विध् िकार्य विभाग, समूह 'ग' भर्ती नियम, 2001 का संशोध्न करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध्,ि न्याय और कंपनी कार्य मंत्राालय, विध् िकार्य विभाग, समूह 'ग' पद भर्ती ;संशोध्नद्ध नियम, 2011 है ।

G..S.R. 214.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Law, Justice and Company Affairs, Department of Legal Affairs, Group 'C' posts Recruitment Rules, 2001, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Law, Justice and Company Affairs, Department of Legal Affairs, Group 'C' posts Recruitment (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Law, Justice and Company Affairs, Department of Legal Affairs, Group 'C' posts Recruitment Rules, 2001,—

(A) in rule 1, in sub-rule (1), for the words, "the Ministry of Law, Justice and Company Affairs", the words "the Ministry of Law and Justice" shall be substituted;

(B) in the Schedule,

(i) in the heading of column 4, for the words "Scale of Pay", the words "Pay Band and Grade Pay or Pay Scale" shall be substituted;

(ii) in serial number 1, against the post of the Senior Court Clerk Grade I,[भाग IIखण्ड 3(i)] भारत का राजपत्रा : जुलाई 23, 2011/श्रावण 1, 1933 885 (a) in column 4, for the entry, the following entry shall be substituted, namely:—

सा.का.नि. 215.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केंद्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान, बैंगलुरू ;उच्च श्रेणी लिपिक-सह भंडारपालद्ध भर्ती नियम, 2010 को, जहां तक इसका संबंध् उच्च श्रेणी लिपिक-सह भंडारपाल पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय ;पशुपालन, डेयरी और मत्स्यपालन विभागद्ध के अध्ीन केंद्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान, बैंगलुरू में उच्च श्रेणी लिपिक-सह भंडारपाल के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम केंद्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान, बैंगलुरू ;उच्च श्रेणी लिपिक-सह भंडारपालद्ध भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता : वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।886 THE GAZETTE OF INDIA : JULY 23, 2011/SRAVANA 1, 1933 [PART II—SEC. 3(i)] 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

वर्ष तक शिथिल की जा सकेगी । टिप्पण 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू और कश्मीर राज्य के लद्‌दाख खंड, हिमाचल प्रदेश के लाहौल एवं स्पीति जिले तथा चम्बा जिले का पांगी उप-खंड, अंदमान एवं निकोबार द्वीप या लक्ष्य द्वीप के अभ्यथयों के लिए विहित की गई हैद्ध । टिप्पण 2 : आयु सीमा अवधरित करने के लिए अंतिम तारीख कर्मचारी चयन आयोग द्वारा विज्ञापित की जाएगी । भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक सीध्े भर्ती किए जाने वाले परिवीक्षा की अवध्,ि यदि कोई हो और अन्य अर्हताएं

व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

टिप्पण 1 ः अर्हताएं अन्यथा सुअहत अभ्यथयों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 : अनुभव संबंध्ी अर्हताएं केंद्रीय सरकार के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां, जिनसे प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न प(तियों प्रोन्नति या प्रतिनियुक्ति या आमेलन किया जाएगा

टिप्पण : उच्च श्रेणी लिपिक और भंडारपाल को चक्रानुक्रम से प्रत्येक तीन वर्ष में अंतर्बदल किया जाएगा ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

G.S.R. 215.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Coastal Engineering for Fishery, Bangalore (Upper Division Clerk-cum Store Keeper and Lower Division Clerk), Recruitment Rules, 2010, in so far as they relate to the post of Upper Division Clerk-cum-Store Keeper, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk-cum-Store Keeper in the Central Institute of Coastal Engineering for Fishery, Bengaluru, under the Ministry of Agriculture (Department of Animal Husbandry, Dairying888 THE GAZETTE OF INDIA : JULY 23, 2011/SRAVANA 1, 1933 [PART II—SEC. 3(i)] and Fisheries), namely :—

1. Short title and commencement.—(1) These rules may be called the Central Institute of Coastal Engineering for Fishery, Bengaluru (Upper Division Clerk-cum-Store Keeper), Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc..—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 216.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और समाकलित मात्स्यिकी परियोजना ;वर्ग 3द्ध भर्ती नियम, 1973 को, जहां तक इसका संबंध् वैज्ञानिक सहायक पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्यपालन विभाग के अध्ीन, राष्ट्रीय मात्स्यिकी पोस्ट हार्वस्ट प्रौद्योगिकी तथा प्रशिक्षण संस्थान, कोच्चि में वैज्ञानिक सहायक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम राष्ट्रीय मात्स्यिकी पोस्ट हार्वस्ट प्रौद्योगिकी तथा प्रशिक्षण संस्थान, कोच्चि, ;वैज्ञानिक सहायकद्ध भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और वेतन बैंड, ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है ।

4. निरर्हता : वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

G.S.R. 216.—in exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Integrated Fisheries Project (Class III) Recruitment Rules, 1973, in so far as they relate to the post of Scientific Assistant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Scientific Assistant in the National Institute of Fisheries Post Harvest Technology and Training, Kochi in the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries), namely:—

1. Short title and commencement.—(1) These rules may be called the National Institute of Fisheries Post Harvest Technology and Training, Kochi (Scientific Assistant) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of the post, its classification, pay band and grade pay or pay scale.—The number of the said post, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment to the said post, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,

(i) who has entered into or contracted a marriage with a person having a spouse living, or

(ii) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of these rules.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 217.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Sheep Breeding Farm, Hisar (Class III and Class IV posts) Recruitment Rules, 1972, in so far as they relate to the posts of Tractor Driver-cum- Mechanic, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Tractor Driver-cum- Mechanic in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Sheep Breeding Farm, Hisar, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Central Sheep Breeding Farm, Hisar Tractor Driver-cum- Mechanic (Group 'C' Post) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. .—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

( a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note-1 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department or the Central Government shall ordinarily not exceed three years.

Note-2 : The maximum age limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of receipt of applications.
