का.नि.आ. 64.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा मंत्राालय, स्टापफ कार चालक ;श्रेणी-1, श्रेणी-2 और साधरण श्रेणीद्ध भर्ती नियम, 1994 को, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय में स्टापफ कार चालक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् :—
1. संक्षिप्त नाम और प्रारम्भ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, स्टापफ कार चालक ;श्रेणी-1, श्रेणी-2 और साधारण श्रेणीद्ध भर्ती नियम, 2011 है ।
;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद-संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन/वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेतन, वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है ।
3. भर्ती की प(ति, आयु-सीमा. और अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा अर्हताएं और उनसे संबंधित अन्य बातें वे होगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।
4. निरर्हता.—वह व्यक्ति,—
;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वे किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

चालक *कार्यभार के सेवा समूह 'ग', ;5200-20200 रफ.द्ध ;सरकारी सेवकों के लिए 40 वर्ष तक ;साधरण आधर पर अराजपत्रिात, + ग्रेड शिथिल की जा सकती है । केन्द्रीय सरकार श्रेणी परिवर्तन किया अननुसचिवीय वेतन 1900 रफ. द्वारा जारी किए गए अनुदेशों के अनुसार अनुसूचित जाति/अनुसूचित जनजाति के लिए 45 वर्ष तक शिथिल की जा सकती है ।द्ध टिप्पण 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू और कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले का पांगी उप-खंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई हैद्ध । टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

;ivद्ध किसी मोटरकार के चालन का कम से कम तीन वर्ष का अनुभव । वांछनीय ः होम गार्ड/सिविल वांलटियर का तीन वर्ष का अनुभव । टिप्पण 1 : अर्हताएं अन्यथा सुअहत अभ्यथयों की दशा में , सक्षम प्राध्किारी के विवेकानुसार शिथिल की जा सकती हैं । टिप्पण 2 : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध सक्षम प्राध्किारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनतातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि[भाग II—खण्ड 4] भारत का राजपत्रा : सितम्बर 10, 2011/भाद्र 19, 1933 467 ;7द्ध
उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

प्रतिनियुक्ति/आमेलन/पुननयोजन नहीं हो पाने की स्थिति प्रतिनियुक्ति/आमेलन/पुननयोजन जिसके न हो सकने पर सीध्ी भर्ती द्वाराः नियमित सवार हरकारा ;समूह-गद्ध और ऐसे कर्मचारियों में से जो रक्षा मंत्राालय में सीध्ी भर्ती द्वारा ;सचिवालयद्ध में वेतन बैंड 5200-20200 रफ. में 1800 रफ. ग्रेड वेतन प्राप्त कर रहे हैं जो मोटरकार चालन की क्षमता का पता लगाने के लिए परिवहन कंपनी, रक्षा मुख्यालय, रक्षा मंत्राालय द्वारा संचालित चालन परीक्षण के आधर पर वैध् चालन अनुज्ञप्ति रखते हैं ऐसा न हो सकने पर उन कर्मचारियों से जो नियमित आधर पर सवार हरकारे का पद धरण कर रहे हैं या केन्द्रीय सरकार के अन्य मंत्राालयों में ऐसे नियमित कर्मचारी जो 5200-20200 रफ. के वेतन बैंड में 1800 रफ. का वेतन ग्रेड नियमित आधर पर प्राप्त कर रहे हैं जो स्तम्भ 7 में वणत अपेक्षित अर्हताएं पूरी करते हैं ।
भूतपूर्व सैनिकों के लिए :
प्रतिनियुक्ति और पुननयोजन :
सशस्त्रा बल के ऐसे कामकों के संबंध् में भी विचार किया जाएगा जो एक वर्ष की अवध् िके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना है, तत्पश्चात् उन्हें पुननयोजन पर बने रहने दिया जा सकता है ।
टिप्पण : प्रतिनियुक्ति पर नियुक्ति के प्रयोजन के लिए 1 जनवरी, 2006 या उस तारीख से पहले जिसको छठे वेतन आयोग की सिपफारिशों के आधार पर पुनरीक्षित वेतन ढांचे का विस्तार किया गया था, किसी अध्किारी द्वारा की गई नियमित सेवा को तत्स्थानी ग्रेड वेतन में या विस्तारित वेतनमान में उक्त वेतन आयोग की सिपफारिशों के आधर पर सेवा माना जाएगा । प्रतिनियुक्ति/आमेलन के आधर पर नियोजन के प्रयोजन हेतु, 1 जनवरी, 2006 से पूर्व वह तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों के आधर पर संशोध्ति वेतन संरचना का विस्तार किया गया, किसी अध्किारी द्वारा की गई नियमित सेवा को समनुरूप ग्रेड वेतन/वेतनमान में आयोग की सिपफारिशों के आधर पर की गई सेवा माना जाएगा सिवाए जब के तब सामान्य ग्रेड वेतन या वेतनमान में एक से अध्कि पुनरीक्षण पूर्व वेतनमानों का विलयन हो गया हो और जहां यह पफायदा केवल उस पद ;पदोंद्ध तक विस्तारित होगा जहां ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापन ग्रेड हैं ।

S.R.O. 64.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence Staff Car Drivers (Grade-I, Grade-II and Ordinary Grade) recruitment Rules, 1994, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the post of Staff Car Drivers in the Ministry of Defence, namely :—
1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Staff Car Drivers (Grade-I, Grade-II and Ordinary Grade) Recruitment Rules, 2011.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification and Pay Band and Grade Pay/Pay Scale.—The number of the said post, its classification and the Pay Band and Grade Pay/Pay Scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of Recruitment, Age Limit and other Qualifications, etc..—The method of recruitment, age limit qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the Schedule aforesaid.
4. Disqualifications.—No person; (a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

From amongst the regular Despatch Rider (Group-C) and employees drawing Grade Pay of Rs. 1800 in the Pay Band Rs. 5200-20200 in the Ministry of Defence (Secretariat) who possess valid driving licence for motor cars on the basis of a driving test conducted by Transport Company, Army Headquarters, Ministry of Defence to assess the competence to drive motor cars failing which from officials holding the post of Despatch Rider on a regular basis or regular employees drawing Grade Pay of Rs. 1800 in Pay Band Rs. 5200-20200 in other Ministries of the Central Government who fulfil the necessary qualifications, as mentioned in column 7.
For Ex-Servicemen :
Deputation/Re-employment :
The armed forces personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed in column 7 shall also be considered. Such persons would be given deputation terms up to the date on which they are due for release from the Armed Forces, thereafter, they may be continued on re-employment.

For purposes of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation.
