सा.का.नि. 316.—राष्ट्रपति, भारत के संविधन के अनुच्छेद 222 के ख्ांड ;2द्ध के अनुसरण में एतद्‌द्वारा निम्नलिखित आदेश देते हैं, अर्थात्‌ :—

मध्य प्रदेश उच्च न्यायालय के मुख्य न्यायाध्ीश न्यायविद्‌ श्री सैयद्‌ रपफत आलम का इलाहाबाद उच्च न्यायालय में स्थानान्तरण होने पर वह मूल उच्च न्यायालय अर्थात्‌ पटना उच्च न्यायालय के बाहर मुख्य न्यायाध्ीश के रूप में की गई सेवा की अवध् िके लिए, अपने वेतन के अतिरिक्त 9000 रुपये ;रुपये नौ हजार मात्राद्ध प्रतिमाह की दर से प्रतिपूत भत्ता पाने के पात्रा होंगे ।

G.S.R. 316.—In pursuance of Clause (2) of article 222 of the Constitution of India, the President hereby makes the following order :

Shri Justice Syed Rafat Alam, Chief Justice, Madhya Pradesh High Court on transfer to the Allahabad High Court, shall be entitled to receive, in addition to his salary, a compensatory allowance of Rs. 9000 (Rs. Nine thousand only) per month, for the period of his service he performs his duties of Chief Justice outside his Parent High Court i.e. Patna High Court.

सा.का.नि. 317.—केन्द्रीय सरकार, सीमा सुरक्षा बल अध्निियम, 1968 ;1968 का 47द्ध की धरा 141 की उप-धरा ;2द्ध के ख्ांड ;खद्ध और ;गद्ध के साथ पठित उप-धरा ;1द्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सीमा सुरक्षा बल ;योध्क आशुलिपिक काडरद्ध समूह 'क', समूह 'ख' और समूह 'ग' भर्ती नियम, 2005 को, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, सीमा सुरक्षा बल में समूह 'क' और समूह 'ख' के पदों ;योध्क आशुलिपिक काडरद्ध पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल ;योध्क आशुलिपिक काडरद्ध समूह 'क' और समूह 'ख' पद भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम इससे उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पदों पर लागू होंगे ।

3. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उपरोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है, विवाह किया है या विवाह की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की हैऋ उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. अध्विषता.—;1द्ध इन नियमों के अध्ीन नियुक्त किया गया कोई कामक उस मास के, जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है, अंतिम दिन के अपराह्‌न से सेवानिवृत्त होगा :

परन्तु वह व्यक्ति जिसके जन्म की तारीख किसी मास की पहली तारीख होगी, सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराह्‌न में सेवानिवृत्त होगा ।

;2द्ध किसी व्यक्ति को सत्तावन वर्ष की सेवा निवृत्ति की आयु के पश्चात्‌ सेवा विस्तारण प्रदान नहीं किया जाएगा ।

7. चिकित्सकीय दृष्टया योग्यता.—;1द्ध इन नियमों में अन्तवष्ट किसी बात के होते हुए भी, केवल वे व्यक्ति, जो चिकित्सा प्रवर्ग शेप-I में है, इन नियमों के उपबंधें के अध्ीन नियुक्ति के लिए पात्रा होंगे ।

;2द्ध फ्शेप-Iय् से निम्नानुसार परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है :-

;iद्ध कोड अक्षर शेप ;एस एच ए पी ईद्ध, जो निम्नलिखित कृत्यों का प्रतिनिध्त्वि करते हैं द्वारा उपदशत दिए गए कारकों के अध्ीन अध्किारी की उपयुक्तता निर्धरित करने के पश्चात्‌ चिकित्सा अध्किारी द्वारा किया गया चिकित्सीय वर्गीकरण अर्थात्‌ :—

एस — मनोवैज्ञानिक

एच — श्रवण शक्ति

ए — उपांग ;अपैन्डेजेसद्ध

ई. — दृष्टि शक्ति

;iiद्ध प्रत्येक कारक के अध्ीन, किसी अध्किारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता उपदशत करते हुए दर्शाई जाएगी । कोड अक्षर के पश्चात्‌ अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी कारकों में श्रेणी-I में है वहां उसका प्रवर्ग एस1 एच1 ए1 पी1 ई1 लिखने के बजाय शेप-I, लिखकर दर्शाया जा सकेगा । इन अंकों का सामान्य मूल्यांकन निम्नानुसार है :—

;1द्ध कहीं भी सभी कर्त्तव्यों के लिए योग्य ।

;2द्ध सभी कर्त्तव्यों के लिए योग्य किन्तु क्या कर्त्तव्यों में तीव्र कठिनाई या दोनों कानों या आँखों को श्रवण शक्ति या दृष्टि की तीक्षणता की मांग अन्तगर््रस्त है या नहीं, पर निर्भर करते हुए कर्त्तव्यों के प्रकार और नियोजन योग्यता क्षेत्राों के अनुसार परिसीमाएं हो सकती हैं ।

;3द्ध फ्एसय् कारक को छोड़कर, नैमी या निष्क्रिय कर्त्तव्यों के लिए, योग्य किन्तु उच्च स्थान ;2,700 मीटर से अध्किद्ध अत्यध्कि ठंडे क्षेत्राों या पहाड़ी भूख्ांडों पर दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं । ;4द्ध अस्पताल में भर्ती या बीमारी की छुट्‌टी के कारण कर्त्तव्यों के लिए अस्थायी रूप से अयोग्य ।

;5द्ध कर्त्तव्यों के लिए स्थायी रूप से अयोग्य ।

8. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 9. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षणों, और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा प्रोन्नति द्वारा :

वेतनमान वेतन बैंड-2, 9300—34800 रु. + ग्रेड वेतन 4600 रु. में ऐसे निरीक्षक ;निजी सहायकद्ध जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की है और जिनके पास निम्नलिखित अर्हता हैं :

;iiद्ध समय-समय पर महानिदेशक, सीमा सुरक्षा बल द्वारा यथाविहित,

प्रोन्नति पाठ्‌यक्रम या प्रशिक्षण पूरा किया हो ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व-पुनरीक्षित वेतन का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा ;12द्ध

;ऐसे विभागीय अध्किारी जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । प्रतिनियुक्ति की अवध्,ि जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर नियुक्ति की अवध् िहै, साधारणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अध्कि नही होगी ।द्ध ;12द्ध

G.S.R. 317.—In exercise of the powers conferred by sub-section (1) read with clauses (b) and (c) of sub-section (2) of Section 141 of the Border Security Force Act, 1968 (47 of 1968) and in supersession of the Border Security Force (Combatised Stenographers Cadre), Group 'A', Group 'B' and Group 'C' Posts, Recruitment Rules, 2005 except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following Rules regulating the method of recruitment to Group 'A' and Group 'B' posts in the Border Security Force (Combatised Stenographers Cadre), namely :—

1. Short title and commencement.—(1) These rules may be called the Border Security Force (Combatised Stenographers Cadre), Group 'A' and Group 'B' Posts, Recruitment Rules, 2011.

(2) They shall come into Force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification and the pay band and grade pay or pay scale.—The number of the said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit, qualifications, etc.— The method of recruitment to the said posts, age limit, qualifications and other matter relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are grounds for so doing, exempt any person from the operation of this rule.

6. Superannuation. —(1) A person appointed under the provisions of these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty-seven years :

Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month of attaining the age of fifty-seven years.

(2) No person shall be granted extension in service beyond the age of retirement of fifty seven years.

7. Medical Fitness. —(1) Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for appointment under the provisions of these rules.

(2) SHAPE-I means Medical Category defined as under :—

(i) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function :—

S — Psychological

H — Hearing

A — Appendages

P — Physical Capacity

E — Eye-Sight

(ii) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency. The numerals will be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE- I instead of writing S1 H1 A1 P1 E1. General evaluation of these numerals is as under :—

1. Fit for all duties anywhere.

2. Fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears or eyes.

3. Excepting ''S'' factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments.

4. Temporarily unfit for duties on account of hospitalization or sick leave.

5. Permanent unfit for duties.

8. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

9. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1-1-2006 or the date which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation. G.S.R. 319.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Regional Stations for conducting Demonstrations of Forage Production (Class III and Class IV posts) Recruitment Rules, 1968, in so far as they relate to the post of Upper Division Clerk and Storekeeper, the President hereby makes the following rules for the post of Upper Division Clerk in the Regional Station for Forage Production and Demonstration and Central Fodder Seed Production Farm, Hessarghatta, Bengaluru, Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, namely :—

1. Short title and commencement.—(1) These rules may be called the Upper Division Clerk, Regional Station for Forage Production and Demonstration and Central Fodder Seed Production Farm, Hessarghatta, Bengaluru, (Group "C" posts) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and Pay Band, Grade Pay/ or pay scale.—The number of said posts, their classification and the scale of pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that if necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Promotion :

Lower Division Clerk PB-1, Rs. 5200—20200 (G.P. 1900) in the Regional Stations for Forage Production and Demonstration and Central Fodder Seed Production Farm with eight years regular service in the grade failing which by deputation/from Lower Division Clerks with eight years' regular service in the grade wtih grade pay of Rs. 1900 in subordinate offices of Government of India.

Note 1 : The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by transfer on deputation (including short-term contract) shall not be exceeding 56 years as on the closing date of receipt of application.

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण और वेतन बैंड, ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पदों की भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।1514 THE GAZETTE OF INDIA : NOVEMBER 19, 2011/KARTIKA 28, 1933 [PART II—SEC. 3(i)]

1. Short title and commencement.—(1) These rules may be called the Stenographer (Grade 'D'), Regional Station for Forage Production and Demonstration and Central Fodder Seed Production Farm, Hessarghatta, Bengaluru, (Group "C" posts) Recruitment Rules, 2011.
