का.नि.आ. 12.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा संपदा ;समूह 'ग' तथा समूह 'घ' पदद्ध भर्ती नियम, 1988 को, जहां तक उसका संबंध् उच्च श्रेणी लिपिक के पद से है, उन बातों के सिवाए अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के अध्ीन रक्षा संपदा संगठन में उच्च श्रेणी लिपिक के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम तथा प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा संपदा सेवा, उच्च श्रेणी लिपिक, समूह 'ग' भर्ती नियम, 2012 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं । 3. भर्ती की प(ति, आयु-सीमा, अन्य अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

(49)50 THE GAZETTE OF INDIA : MARCH 3, 2012 /PHALGUNA 13, 1933 [PART II—SEC. 4] 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण ः आयु-सीमा अवधरित करने की निर्णायक तारीख वह होगी जो नियुक्ति प्राध्किारी द्वारा विज्ञापित की जाए । सीध्े भर्ती के लिए अपेक्षित शैक्षिक अन्य अर्हताएं सीध्े भर्ती किए जाने वाले व्यक्तियों के परिवीक्षा की अवध्,ि यदि

लागू नहीं होता सीध्ी भर्ती के लिए 2 वर्ष आवश्यक : किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री या समतुल्य वांछनीय : कम्प्यूटर में एम एस वर्ड/एम एस ऑपिफस/एक्सेल में स्वतंत्रा रूप से कार्य करने में निपुणता होनी चाहिए ।

तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो । टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख जिसको छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा, वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी वेतन/वेतनमान में की गई सेवा समझी जायेगी । यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

New Delhi, the 22nd February, 2012

S. R. O. 12.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in the supersession of the Defence Estates (Group 'C' and Group 'D' posts) Recruitment Rules, 1988, in so far as they relate to the post of Upper Division Clerk except as respect of things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk, in Defence Estates Organization, under the Ministry of Defence, namely :—

1. Short title and commencement.— (1) These rules may be called the Defence Estates Service Upper Division Clerks, Group 'C', Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of Post, Classification and Pay band and Grade pay or Scale of pay.—The number of post, its classifications and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method. of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualification and other matters relating thereto, shall be as specified in columns (5) to ( 13) of the said Schedule.

4. Disqualifications.— No person,

(a) Who has entered into or contracted a marriage with a person having a spouse living, or

(b) Who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provision of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other Concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Class, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Examination of such Hindi Typist who have rendered Note 1 : Where juniors who have completed their qualifying or five years regular service provided that they have not eligibility service are being considered for promotion, their seniors would also be considered provided they are not short crossed the age of 45 years. of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay/pay scale extended based on the recommendations of the Pay Commission.

उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करवेफ, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

;चयन श्रेणीद्ध *कार्यभार के सेवा, समूह 'ग', 5200— ;केन्द्रीय सरकार द्वारा समय-समय पर जारी आधर पर अराजपत्रिात, 20200 रु. किए गए अनुदेशों या आदेशों के अनुसार परिवर्तन किया अननुसचिवीय ध्न ग्रेड वेतन विभागीय अभ्यथयों के लिए, साधरण जा सकता है । 2800 रफ. अभ्यथयों की दशा में शिथिल करके 40 वर्ष तक और अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में शिथिल करके 45 वर्ष तक की जा सकती है द्ध । टिप्पण 1 : विभागीय अभ्यथयों के लिए आयु-सीमा में छूट वहां अनुज्ञेय होगी जहां कर्मचारी ने केंद्रीय सरकार के अध्ीन कम से कम तीन वर्ष की नियमित सेवा की है । टिप्पण 2 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्‌दाख[भाग II—खण्ड 4] भारत का राजपत्रा : मार्च 3, 2012/पफाल्गुन 13, 1933 55 (6)

खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले का पांगी उप-खंड, अंदमान एवं निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई हैद्ध ।

टिप्पण 3 : ऐसे पदों की बाबत जिन पर नियुक्ति रोजगार कार्यालयों के माध्यम से की जाती है, आयु-सीमा अवधरित करने के लिए निर्णायक तारीख प्रत्येक मामले में, वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित, शैक्षिक सीध्े भर्ती किए जाने वाले परिवीक्षा की अवध्,ि यदि और अन्य अर्हताएं

किसी मान्यताप्राप्त संस्थान से भेषज में दो वर्ष का डिप्लोमा लागू नहीं होता सीध्े भर्ती किए गए अभ्यथयों या समतुल्य और राज्य भेषज परिषद्‌ में रजिस्ट्रीकृत होने के के लिए दो वर्ष साथ 12वीं कक्षा उत्तीर्ण ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति प्रोन्नति या प्रतिनियुक्ति या अन्तरण द्वारा भर्ती की दशा में वे श्रेणियां, जिनसे प्रोन्नति या द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प्रतिनियुक्ति या अंतरण किया जाएगा प(तियों द्वारा भरी जाने वाली पदोंं की प्रतिशतता

O. 13.—In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Department of Defence Production and Supplies, Director General Quality Assurance Group 'C' and Group 'D' Paramedical Posts [Pharmacist (Selection Grade), Pharmacist (Ordinary Grade) and Dresser (Ordinary Grade)] Recruitment Rules, 2000 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment of Group 'C' Paramedical posts in the Department of Defence Production, (Directorate General of Quality Assurance) under the Ministry of Defence, namely:—

1. Short title and Commencement.—(i) These rules may be called the Ministry of Defence, Department of Defence Production, Directorate General of Quality Assurance, Group 'C' Paramedical posts Recruitment Rules, 2012.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit, other qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualification.—No person,

(a) Who has entered into or contracted a marriage with a person having spouse living, or;

(b) Who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए, 1 जनवरी, 2006 या वह तारीख जिसे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा, आयोग की सिपफारिशों पर आधरित तत्स्थानी ग्रेड वेतन/वेतन में की गई सेवा समझी जाएगी ।

S. R.O. 14.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Coast Guard Organisation (Civilian Motor Transport Drivers) Recruitment Rules, 2007 in respect of Civilian Motor Transport Driver 'Special Grade' except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Civilian Motor Transport Driver 'Special Grade' in the Coast Guard Organisation, Ministry of Defence, namely:—

1. Short title and commencement.—( 1) These rules may be called the Coast Guard Organisation Civilian Motor Transport Driver 'Special Grade' Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay.—The number of the said post, their classification and the pay band and grade pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualification, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be specified in columns (5) to (13) of the Schedule aforesaid.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing in consultation with Union Public Service Commission to relax any of the provisions of these rules with respect to any class or category of persons.

Note 1 : Where juniors who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying/eligibility service by more than half of such qualifying/eligibility service or two years whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006/the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission.
