G.S.R. 225 .—In exercise of the powers conferred by rule 1 of Order XXVII of the First Schedule to the Code of Civil Procedure, 1908 (5 of 1908), the Central Government hereby makes the following further amendments in the notification of the Government of India in the Ministry of Law and Justice, Department of Legal Affairs number G.S.R. 167, dated the 14th February, 1990 relating to the appointment of officers for signing and verification of plaints and written statements in suits in any court of civil jurisdiction or in writ proceeding by or against the Central Government, namely :—

सा.का.नि. 226.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वाणिज्य मंत्राालय ;समूह फ्घय् पदद्ध भर्ती नियम, 1986 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, वाणिज्य एवं उद्योग मंत्राालय के वाणिज्य विभाग में बहु-कार्य कमचारीवृंद पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम वाणिज्य एवं उद्योग मंत्राालय, वाणिज्य विभाग, बहु-कार्य कमचारीवृंद, समूह फ्गय् पद भर्ती नियम, 2012 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं, आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता : वह व्यक्ति :—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्‌दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा[भाग IIखण्ड 3(i)] भारत का राजपत्रा : सितम्बर 15, 2012/भाद्र 24, 1934 1405 ;6द्ध

जिले के पांगी उप-खंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है।द्ध

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से उन पदों की बाबत जिन पर नियुक्ति की दशा में प्रत्येक मामले में आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होेगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

G.S.R. 226.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Commerce (Group 'D' Posts), Recruitment Rules, 1986, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Multi Tasking Staff in the Ministry of Commerce and Industry, Department of Commerce, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Commerce and Industry, Department of Commerce, Multi Tasking Staff (Group 'C' Post) Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2 Number of post, classification, pay band and grade pay or pay scale.—The number of said post, its classification attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect the reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 227.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन, समंक विधयन प्रभाग और सर्वेक्षण अभिकल्प और अनुसंधन प्रभाग ;श्रेणी iv पदद्ध भर्ती नियम, 1973, राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन, समंक विधयन प्रभाग और सर्वेक्षण अभिकल्प और अनुसंधन प्रभाग ;जिल्दसाजद्ध भर्ती नियम, 1974, राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन, समंक विधयन प्रभाग और सर्वेक्षण अभिकल्प तथा अनुसंधन प्रभाग ;गैस्टेटनर आपरेटर ;कनिष्ठद्ध और पफराशद्ध भर्ती नियम, 1974 और राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन, समंक विधयन प्रभाग और सर्वेक्षण प्रतिदर्श और अनुसंधन प्रभाग ;अभिलेख पालद्ध भर्ती नियम, 1991 को उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्राालय, राष्ट्रीय प्रतिदर्श सर्वेक्षण कार्यालय, समंक विधयन प्रभाग और सर्वेक्षण प्रतिदर्श और अनुसंधन प्रभाग में बहु कार्य कर्मचारीवृन्द के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सांख्यिकी और कार्यक्रम कार्यान्वयन, राष्ट्रीय प्रतिदर्श सर्वेक्षण कार्यालय, समंक विधयन प्रभाग और सर्वेक्षण प्रतिदर्श और अनुसंधन प्रभाग, बहु कार्य कर्मचारीवृन्द समूह 'ग' पद भर्ती नियम, 2012 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण तथा उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, और अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. प्रारंभिक गठन.—समंक विधयन प्रभाग और सर्वेक्षण अभिकल्प और अनुसंधन प्रभाग के सभी तत्कालीन नियमित समूह 'घ' कर्मचारी तथा कर्मचारी चयन आयोग द्वारा बहुकार्य कर्मचारीवृन्द ;एम.टी.एस.द्ध परीक्षा 2010 और 2011 के आधर पर तत्पश्चात्‌ भर्ती किए गए बहुकार्य कर्मचारीवृन्द समूह 'ग' पद वेतन बैंड-1ग्रेड वेतन 1800 रु. में नियुक्त किए गए समझे जाएंगे । इन नियमों के उपबन्धें के अनुसरण में और उनकी इन नियमों के प्रारंभ से पहले की गयी निरंतर सेवा को प्रोन्नति के लिए अर्हक सेवा की संगणना में लिया जाएगा ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह का करार किया है, या

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 227 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the National Sample Survey Organisation, Data Processing Division and Survey Design and Research Division (Class IV posts), Recruitment Rules, 1973, National Sample Survey Organisation, Data Processing Division and Survey Design and Research Division (Binders), Recruitment Rules, 1974, National Sample Survey Organisation, Data Processing Division and Survey Design and Research Division [Gestetner Operator (Junior) and Farash], Recruitment Rules, 1974 and National Sample Survey Organisation, Data Processing Division (Record Keeper), Recruitment Rules, 1991, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Multi-Tasking Staff in the Ministry of Statistics and Programme Implementation, National Sample Survey Office, Data Processing Division and Survey Design and Research Division, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Statistics and Programme Implementation, National Sample Survey Office, Data Processing Division and Survey Design and Research Division, Multi-Tasking Staff, Group 'C' Post, Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Initial Constitution.—All the erstwhile regular Group 'D' employees of Data Processing Division and Survey Design and Research Division and Multi-Tasking Staff subsequently recruited on the basis of Staff Selection Commission Multi-Tasking Staff (MTS) Examination-2010 and 2011 shall be deemed to have been appointed to the post of Multi-Tasking Staff, Group 'C' posts, in Pay Band-1 with Grade pay of Rs. 1800 in accordance with the provisions of these rules and their continuous service in the posts immediately before the commencement of these rules shall be taken into account for the purpose of qualifying service for promotion.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G. S. R. 230.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Fisheries Operatives (Class I and Class II Technical Posts) Recruitment Rules, 1964, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Instructor (Training) in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Institute of Fisheries, Nautical and Engineering Training, Kochi, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Central Institute of Fisheries, Nautical and Engineering Training, Kochi, Instructor (Training) Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band, grade pay or pay scale.—The number of post, its classification and the pay band, grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person, — (a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contracted a marriage with any other person,

shall be eligible for appointment to the said post:

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Qualifications are relaxable at the discretion of the competent authority, for reasons to be recorded in writing, in the case of candidates otherwise well qualified or sufficient number of candidates are not available.

Note 2 : The qualification regarding experience is relaxable at the discretion of the competent authority, for reasons to be recorded in writing, in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if any stage of selection the competent authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them.

(ii) with six years' of regular service in the grade rendered after appointment thereto on regular basis in the scale of pay of Rs. 5200- 20200 in Pay Band I with Grade Pay of Rs. 2800 or equivalent in the parent cadre or Department; and

(b) possessing the qualifications and experience prescribed for direct recruits under Column 7.
