सा.का.नि. 306.-संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा सरकारी अफीम तथा क्षारोद कार्य , नीमच ( सुरक्षा अधिकारी ) भर्ती नियमावली , 2006 के अतिक्रमण में इस प्रकार के अतिक्रमण से पूर्व किए गए कार्य अथवा विलोमित किए जाने वाले कार्यों को छोड़कर, राष्ट्रपति एत‌द्वारा सरकारी अफीम तथा क्षारोद कारखाना , नीमच , वित्त मंत्रालय ( राजस्व विभाग ) में सुरक्षा अधिकारी के पद पर भर्ती की पद्धति को विनियमित करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम लागू होने की तिथि (1 ) इन नियमों को सरकारी अफीम एवं क्षारोद कारखाना , नीमच ( सुरक्षा अधिकारी ) भर्ती नियम , 2012 कहा जाएगा ।

( 2 ) ये सरकारी राजपत्र में उनके प्रकाशन की तारीख से लागू होंगे ।

2. पदों की संख्या , वर्गीकरण और वेतन बैंड , ग्रेड वेतन अथवा वेतनमान. पदों की संख्या तथा उनका वर्गीकरण और वेतन बैंड , ग्रेड वेतन अथवा वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम ( 2 ) से ( 4 ) में विनिर्दिष्ट अनुसार होंगे ।

3. भर्ती की पद्धति, आयु-सीमा , योग्यता आदि. इन पदों से संबंधित भर्ती पद्धति, आयु सीमा , योग्यता तथा अन्य मामले उपर्युक्त अनुसूची के कॉलम ( 5 ) से ( 13 ) में विनिर्दिष्ट होंगे ।

4. अयोग्यता, कोई व्यक्ति :-

( क) जो किसी ऐसे व्यक्ति से विवाह अथवा उसका करार करता है जिसका पति अथवा पत्नी जीवित हो; अथवा

(ख ) जो , जीवित पति अथवा पत्नी के होते हुए , किसी अन्य व्यक्ति से विवाह अथवा उसका करार करता है ।

उपर्युक्त पद पर नियुक्ति का पात्र नहीं होगा :

इसके अतिरिक्त प्रावधान है कि यदि केन्द्र सरकार ऐसे व्यक्ति पर लागू होने वाले निजी नियमों के अंतर्गत ऐसे विवाह तथा विवाह के दूसरे पक्ष से तथा ऐसे कृत्य हेतु अन्य कारणों से संतुष्ट हो , तो वह इस नियम के लागू होने से किसी व्यक्ति को छूट प्रदान कर सकती है ।

5. छूट प्रदान करने का अधिकार.- यदि केन्द्र सरकार की राय में ऐसा करना अपेक्षित अथवा आवश्यक हो , तो वह किसी वर्ग अथवा श्रेणी के व्यक्ति को आदेश द्वारा लिखित में रिकार्ड किए गए कारणों के लिए संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी प्रावधान से छूट प्रदान कर सकती है ।

6. इसके अतिरिक्त. इन नियमों में, केन्द्र सरकार द्वारा समय - समय पर जारी किए गए आदेशों के अनुसरण में अनुसूचित जाति अथवा अनुसूचित जनजाति अथवा भूतपूर्व सैनिक तथा अन्य पिछड़ा वर्ग तथा अन्य विशेष श्रेणियों अथवा व्यक्ति को दी जाने वाली आयु - सीमा तथा अन्य छूट आरक्षण को प्रभावी नहीं करेगा ।

(ii) सुरक्षा अभियांत्रिकी के क्षेत्र में पर्यवेक्षक के रूप में कम-से- कम

तक की छूट । नोट 1 : केन्द्र सरकार द्वारा जारी आदेशों तथा अनुदेशों के अनुसार सरकारी सेवकों के लिए 5 वर्ष

दो वर्ष का व्यावहारिक अनुभव । अथवा

नोट 2 : आयु सीमा निर्धारण करने की निर्णायक तारीख भारत में 1863 [ भाग II-खंड 3 (i ) ]

I. (i ) भौतिक या रसायन में मान्यता प्राप्त विश्वविद्यालय से स्नातक उपाधिः तथा

( ii ) सुरक्षा अभियांत्रिकी के क्षेत्र में कारखाने में पर्यवेक्षक के रूप में कार्य करने का कम-से- कम पांच वर्ष का व्यावहारिक अनुभव अथवा

( i ) मान्यता प्राप्त विश्वविद्यालय अथवा संस्थान से अभियांत्रिकी अथवा प्रौद्योगिकी की किसी शाखा में डिप्लोमा; तथा

आवेदन प्राप्त होने की अंतिम तारीख होगी ( और असम, मेघालय , अरुणाचल प्रदेश , मिजोरम , मणिपुर , नागालैण्ड, त्रिपुरा , सिक्किम , तथा जम्मू एवं कश्मीर राज्य का लद्दाख प्रभाग और हिमाचल प्रदेश के चम्बा जिले के लाहौल तथा स्पीति जिला तथा पांगी उप- प्रभाग अंडमान , निकोबार द्वीप समूह अथवा लक्ष्य द्वीप के लिए निर्धारित अंतिम तारीख नहीं होगी ) ।

(ii) सुरक्षा अभियांत्रिकी के क्षेत्र में कारखाने में पर्यवेक्षक के रूप में कम-से -कम छः वर्ष का कार्य करने का व्यावहारिक अनुभव । अथवा

( i) मान्यता प्राप्त विश्वविद्यालय अथवा संस्थान से अभियांत्रिकी अथवा प्रौद्योगिकी डिप्लोमा अथवा स्नातक उपाधि; तथा

(ii ) फैक्ट्री अधिनियम , 1948 ( 1948 का 63 ) के प्रशासन से जुड़े केन्द्र सरकार अथवा राज्य सरकार के किसी विभाग में अथवा डॉक वर्कर ( सुरक्षा स्वास्थ तथा कल्याण ) अधिनियम , 1986 (1986 का 54 ) में पांच वर्ष का अनुभव ।

अथवा

(i ) अभियांत्रिकी अथवा प्रौद्योगिकी में मान्यता प्राप्त विश्वविद्यालय से डिग्री अथवा डिप्लोमा; तथा

( ii ) उद्योग में अथवा किसी संस्थान में एक्सीडेंट निवारण के क्षेत्र में प्रशिक्षण शिक्षा परामर्श अथवा अनुसंधान क्षेत्र में पांच वर्ष का ( पूर्णकालिक) अनुभव ।

II. इस संबंध में किसी राज्य सरकार द्वारा औद्योगिक सुरक्षा मे मान्यता प्राप्तडिग्री अथवा डिप्लोमा

नोट 2 : अनुसूचित जाति तथा अनुसूचित जनजाति से संबंध रखने वाले उम्मीदवारों के मामले में संघ लोक सेवा आयोग , को लिखित कारण दर्शाकर अनुभव में छूट प्रदान करने का विवेकाधिकार है , यदि चयन के किसी स्तर पर संघ लोक सेवा आयोग को यह लगता है कि इन समुदायों से अपेक्षित संख्या में आरक्षित रिक्तियों को भरने के लिए उम्मीद्वार उपलब्ध नहीं होंगे ।

समूह ' क ' विभागीय पदोन्नति समिति ( सम्पुष्टि पर विचार हेतु ) में निम्न होंगे :

(i ) सरकारी अफीम तथा क्षारोद कारखाने के प्रभारी अपर सचिव अथवा सदस्य , केन्द्रीय उत्पाद एवं सीमा शुल्क बोर्ड- अध्यक्ष

प्रतिनियुक्ति ( लघु अवधिं संविदा सहित ) अथवा संविलियन केन्द्र सरकार अथवा राज्य सरकारों अथवा संघ शासित प्रशासनों अथवा सार्वजनिक क्षेत्र के उपक्रमों अथवा संवैधानिक अथवा स्वायत्त निकायों के अधिकारी ( क ) ( i ) मूल संवर्ग अथवा विभागों में नियमित आधार पर सादृश अधिकारी ।

( ii ) सदस्य अथवा अपर सचिव , अथवा संयुक्त सचिव , केन्द्रीय उत्पाद शुल्क एवं सीमा शुल्क बोर्ड, राजस्व विभाग , जो केन्द्रीय उत्पाद कर एवं सीमा शुल्क बोर्ड के अंतर्गत आने वाले विभागों में कार्मिक प्रबन्धन का कार्य देखते

हैं-सदस्य

( iii ) मुख्य नियंत्रक, सरकारी अफीम तथा क्षारोद कारखाने - सदस्य

( ii ) मूल संवर्ग अथवा विभाग में नियमित आधार पर 4800 रुपये अथवा समकक्ष ग्रेड वेतन के साथ वेतन बैण्ड-2 में नियुक्ति के पश्चात् दो वर्ष की सेवा , अथवा नोट : संपुष्टि के संबंध में विभागीय पदोन्नति समिति की कार्यवाही अनुमोदनार्थ आयोग को भेजी जाएगी । हालांकी यदि इन्हें उपर्युक्त आयोग द्वारा अनुमोदित नहीं किया जाता है ,

( iii ) मूल संवर्ग अथवा विभाग में नियमित आधार पर 4600 रुपये अथवा समकक्ष ग्रेड वेतन के साथ वेतन बैण्ड-2 में नियुक्ति के पश्चात् तीन वर्ष की सेवा , अथवा तो संघ लोक सेवा आयोग के अध्यक्ष अथवा किसी सदस्य की अध्यक्षता में एक नई बैठक आयोजित की जाएगी ।

( iv ) मूल संवर्ग अथवा विभाग में नियमित आधार पर 4200 रुपये अथवा समकक्ष ग्रेड वेतन के साथ वेतन बैण्ड-2 में नियुक्ति के पश्चात् 8 वर्ष की सेवा, तथा

(ख) कालम 7 के अंतर्गत सीधी भर्ती हेतु निर्धारित शैक्षणिक योग्यता तथा अनुभव रखने वाले ।

नोट 1 : प्रतिनियुक्ति अवधि सहित (लघुअवधि संविदा सहित ) किसी संवर्ग बाह्य पद में इस नियुक्ति से तत्काल पहले उसी संगठन अथवा केन्द्र सरकार केविभाग में प्रतिनियुक्ति अवधि (लघु अवधि संविदा सहित ) सामान्यतः 3 वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति द्वारा नियुक्ति हेतु ( लघु अवधि संविदा सहित ) अधिकतम आयु -सीमा इस आवेदन की प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

नोट 2 : प्रतिनियुक्ति पर नियुक्ति (लघुअवधि संविदा सहित ) के आधार पर किसी अधिकारी द्वारा एक जनवरी , 2006 से पहले की नियमित आधार की सेवा , वह तारीख जिससे छठे केन्द्रीय वेतन आयोग के आधार पर संशोधित वेतनमान लागू हुए थे, को उपर्युक्त आयोग की सिफारिश के आधार तदनुरूपी ग्रेड वेतन अथवा वेतनमान में की गई सेवा मान्य मानी जाएगी, केवल उन मामलों को छोड़कर जिनमें वेतन के संशोधन पूर्व के दो से अधिक वेतन मानों को एक सामान्य ग्रेड वेतन अथवा वेतनमान में संविलियत कर दिया गया है तथा जिनमें यह लाभ केवल उन पदों को दिया गया है जिनके ग्रेड वेतन अथवा वेतनमान बिना उन्नयन के सामान्य रिप्लेसमेंट ग्रेड है ।

भर्ती करते समय संघ लोक सेवा आयोग से किन परिस्थितियों में परामर्श किया जाना अपेक्षित है

GS.R. 306.- In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession ofthe Government Opium and Alkaloid Works , Neemuch (Safety Officer ) Recruitment Rules , 2006 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of the Safety Officer in the Government Opium and Alkaloid Works , Neemuch , Ministry of Finance (Department ofRevenue ) , namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Government Opium and Alkaloid Works , Neemuch (Safety Officer) Recruitment Rules , 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification , pay band and grade pay or pay scale. The number of the said post, its classification, and the pay band , grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3.Method of recruitment , age- limit , qualifications , etc.- The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns ( 5) to ( 13 ) of the said Schedule .

4. Disqualifications. No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person fromthe operation ofthis rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any ofthe provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age- limit and other concessions required to beprovided for the Scheduled Castes, the Scheduled Tribes, the Ex- Servicemen , the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

(i ) Degree in Physics or Chemistry from a recognized University and

( ii) Practical experience of working in the field of safety engineering aspects in a factory in super- visory capacity for a period of not less than five years . Or

Note 2 : The crucial date for deter- mining the age-limit shall be the closingdate for receipt ofappli- cations from candidates in India bed for those inAssam, Meghalaya , Sikkim , Ladakh Division of Jammu (and not the closing date prescri- Arunachal Pradesh , Mizoram , Manipur, Nagaland , Tripura, and Kashmir State, Lahaul and Spiti district and Pangi Sub -division of Chamba district ofHimachal Pradesh , Andaman and Nicobar Islands or Lakshadweep).

( i) Degree or Diploma in Engineer- ing or Technology from a recog- nized University and

(ii ) Five years' experience in the De- partment of Central Government orState Government dealing with Administration of the Factories Act, 1948 (63 of 1948) or the Dock Workers(Safety, Health and Wel- fare) Act, 1986 (54 of 1986) .

(i ) Degree or Diploma in Engineer- ing or Technology from a recog- nized University and

(ii) Five years ' experience (full time) on training education consultancy or research in the field or accident prevention in In- dustry or in any Institution.

II. Degree or Diploma in Industrial Safety recognized by the State Government in this behalf.

Desirable :

Working knowledge of Hindi.

Note 1 : Qualifications are relaxable at the discretion of the Union Public Ser- vice Commission for reasons to be re- corded inwriting , in the case of candi- dates otherwise well qualified.

Note 2 : The qualification regarding experience is or are relaxable at the dis- cretion of the Union Public Service Commission for reasons to be recorded in writing in the case of candidates belonging to the Scheduled Castes or the Scheduled Tribes , if at any stage ofselection , the Union Public Service Commission is of the opinion that suf- ficient number of candidates from these communities possessing the requisite experience are not likely to be avail- able to fill up the vacancies reserved forthem.

Note 1: Period of deputation (including short - term contract) including period of deputation (Including short -term con- tract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation (including short - term contract ) shall be not exceeding 56 years as on the closing date of the receipt of applications.

सा.का.नि. 307.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और नागर विमानन विभाग प्रभारी अनुदेशक ग्लाइडिंग भर्ती नियम , 1991 , को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अंधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, नागर विमानन मंत्रालय , नागर विमानन महानिदेशालय में प्रभारी अनुदेशक ग्लाइडिंग और ग्लाइडिंग अनुदेशक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम , नागर विमानन मंत्रालय , नागर विमानन महानिदेशालय , प्रभारी अनुदेशक ग्लाइडिंग और ग्लाइडिंग अनुदेशक भर्ती नियम, 2012 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना. ये नियम इन नियमों से उपाबद्ध अनुसूची में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद संख्या , वर्गीकरण और वेतन बैंड , ग्रेड वेतन या वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं , आदि. उक्त पदों पर भर्ती की पद्धति, आयु - सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

5. निरर्हता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श कर , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य पिछड़े वर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति: ऐसा ग्लाइडिंग अनुदेशक जिसने वेतन बैंड-2, 9300-34800 रु. + ग्रेड वेतन 5400 रु. में उस ग्रेड में पांच वर्ष की नियमित सेवा की है और उस अवधि में निम्नलिखित का अनुभव हो :

(i ) ग्लाइडिंग अनुदेशात्मक उड़ान के 100 घंटे : तथा

(ii ) पायलट-इन-कमांड के रूप में कम- से- कम एक हजार लांच

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो , वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा , परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा , अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 01-01-2006 , से पहले उस तारीख से जिससे छठे केंद्रीय वेतन आयोग की सिफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है , नियमित आधार पर की गई सेवा उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति: ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) :

केंद्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्र प्रशासनों या अनुसंधान विकास संस्थाओं या स्वायत निकायों या पब्लिक सेक्टर के उपक्रम के अधीन ऐसे अधिकारी:

(क) ( i ) जो मूल कॉडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii) जिन्होंने उस पर नियुक्ति के पश्चात्, उस श्रेणी में नियमित आधार पर वेतन बैंड -2 में 9300-34800 रु. वेतनमान में 5400 रु. के ग्रेड वेतन पर या समतुल्य पद पर मूल कॉडर या विभाग में पाँच वर्ष की नियमित सेवा की है;

(ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव है:-

(i ) भौतिक विज्ञान और गणित के साथ 10 +2

(ii ) ग्लाइडर पायलट के रूप में पायलट- इन-कमांड का तीन सौ पचास घंटों का अनुभव जिसमें ग्लाइडिंग अनुदेशात्मक उड़ान के 200 घंटे और पायलट- इन- कमांड के रूप में कम से कम दो हजार लांच शामिल हो ।

(iii ) कम से कम 15 प्रशिक्षणार्थियों को एकल स्तर तक प्रशिक्षण दिया हो ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे , इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । )

[ प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) , केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है । ) , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ]

टिप्पण : प्रतिनियुक्ति आधार पर नियुक्ति के प्रयोजन के लिए 01-01-2006 से पहले ( उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है ) , किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा को, सिवाय उसके जहाँ एक से अधिक पूर्व- पुनरीक्षित वेतनमान या साधारण ग्रेड वेतन/वेतनमान वाले एक ग्रेड में विलय हो गया है और जहाँ यह फायदा केवल उस पद या उन पदों पर, जिसके लिए ग्रेड वेतन/वेतनमान किसी उन्नयन के बिना , सामान्य प्रतिस्थापन ग्रेड है , विस्तारित होगा, वेतन आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/ वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति/पुनर्नियोजन ( भूतपूर्व सैनिक )

भारतीय वायु सेना के स्क्वाडून लीडर अथवा थल सेना अथवा नौ- सेना में समतुल्य पद के सशस्त्र बल कार्मिक जो एक वर्ष की अवधि के भीतर सेवानिवृत्ति या रिजर्व में स्थानांतरित होने वाले हैं और प्रतिनियुक्त व्यक्तियों के लिए उपर्युक्त निर्धारित अर्हताएं और अनुभव रखते हों विचार किए जाने के पात्र होंगे । यदि उनका चयन होता है , तो ऐसे अधिकारी सशस्त्र बल से मुक्त होने की तारीख तक प्रतिनियुक्ति निबंधन के अधीन होंगें । उसके पश्चात्, वे पुनर्नियोजन निबंधन पर होंगें । यदि , ऐसे पात्र अधिकारी पद पर वास्तविक चयन से पहले ही सेवानिवृत्त या रिज़र्व में स्थानांतरित हो गए हैं, तो उनकी नियुक्ति पुनर्नियोजन आधार पर होगी । ( सिविल पदों के लिए अधिवार्षिता की आयु के प्रति निर्देश में पुनर्नियोजन ) 1873 भारत का राजपत्र : दिसम्बर 22 , 2012 /पौष 1 , 1934

method of recruitment to the posts of Instructor - incharge Gliding and Gliding Instructor, Directorate General of Civil Aviation , Ministry of Civil Aviation , namely :

1. Short title and commencement.-- ( 1 ) These rules may be called the Ministry of Civil Aviation , Directorate General ofCivil Aviation , Instructor- incharge Gliding and Gliding Instructor, Recruitment Rules, 2012 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the posts specified in the Schedule annexed to these rules.

3. Number of posts , classification and pay band, grade pay or pay scale. The number of the said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule .

4. Methodof recruitment, age- limit and other qualifications. The method of recruitment, age - limit, qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 13 ) of the aforesaid Schedule.

5. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person ,

shallbe eligible for appointment to the said posts :

6. Power to relax. Where the Central Government is ofthe opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes, the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(The departmental Officers in the feeder grade who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation . Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

[Period of deputation (including short - term contract) including period of deputation ( including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed 3 (three) years. सा.का.नि. 308. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भर्ती नियम , 1971 मुख्यालय, नागर विमानन विभाग , श्रेणी- II ( अराजपत्रित ) श्रेणी- III और IV पद ( नागर विमानन विभाग ) भर्ती नियम , 1972 जहां तक इनका संबंध सीनियर कम्प्यूटर , नागर विमानन विभाग, वैमानिक संचार संगठन ( श्रेणी- III और IV पद ) भर्ती नियम, 1974 तथा टेलिफोन ऑपरेटर और महानिदेशक , नागर विमानन ( मुख्यालय ) , डिस्पैच राइडर भर्ती नियम , 1981 से है, को उन बातों के सिवाए अधिक्रांत करते हुए , जिन्हें ऐसे अधि क्रमण से पूर्व किया गया है या करने का लोप किया गया है , नागर विमानन महानिदेशालय ( मुख्यालय ) , नागर विमानन मंत्रालय के कार्यालय में टेलीफोन ऑपरेटर , सीनियर कम्प्यूटर , केयर टेकर, डिस्पैच राइडर के पद की भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम नागर विमानन मंत्रालय , नागर विमानन महानिदेशालय ( मुख्यालय ) , टेलीफोन ऑपरेटर , सीनियर कम्प्यूटर , केयर टेकर, डिस्पैच राइडर समूह ' ग ' भर्ती नियम , 2012 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पदों की संख्या , उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि. -उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इंस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

1. Short title and Commencement.- ( 1 ) These rules may be called the Ministry of Civil Aviation, Directorate General ofCivil Aviation (Headquarters ) , Telephone Operator, Senior Computer , Caretaker, Despatch Rider (Group ' C ' posts) Recruitment Rules , 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and pay band and grade pay or pay scale. The number of the said posts , their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment, age -limit and other qualifications , etc.--The method of recruitment, age- limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to ( 13 ) of the aforesaid Schedule.

4. Disqualification. No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

GS.R. 309. In exercise of the powers conferred by the proviso to Article 309 of the Constitution , and in supersession of ( i ) the Ministry of Chemicals and Fertilizers , Department of Chemicals and Petrochemicals ( Group ' D' Posts) Recruitment Rules, 1998, and (ii) the Ministry of Chemicals and Fertilizers , Department ofChemicals and Petrochemicals (Daftry, Senior Peon and Record Sorter) Recruitment Rules, 2002 , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment for the post of Multi - tasking Staff in the Ministry of Chemicals and Fertilizers (Department of Pharmaceuticals ) , namely:

1. Short title and commencement .-- ( 1 ) These rules may be called the Ministry of Chemicals and Fertilizers, Department of Pharmaceuticals (Group ' C ' Posts ) Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification , pay band, grade pay /pay scale.--The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age - limit , other qualifications , etc. The method of recruitment, age - limit , qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 13 ) of the aforesaid Schedule.

4. Disqualification . No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) shall be eligible for appointment to any of the said posts , who, having a spouse living , has entered into or contracted a marriage with any person;

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation ofthis rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary and expedient so to do , it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
