सा.का.नि. 43. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त मंत्रालय , आर्थिक कार्य विभाग , कनिष्ठ तकनीकी सहायक भर्ती नियम , 2007 का अधिक्रमण करते हुए , सिवाय उन बातों के जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, वित्त मंत्रालय , आर्थिक कार्य विभाग में कनिष्ठ तकनीकी सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ :

(क) इन नियमों को वित्त मंत्रालय , आर्थिक कार्य विभाग , कनिष्ठ तकनीकी सहायक भर्ती नियम , 2013 कहा जाएगा ।

(ख ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद की भर्ती की पद्धति , आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति:

(क) जिसने ऐसे व्यक्ति , जिसका पति या जिसकी पत्नी जीवित है, से विवाह किया है , या

(ख ) जिसने , अपने पति या अपनी पत्नी के जीवित रहते हुए, किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा :

परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार के लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, और संघ लोक सेवा आयोग से परामर्श करने के बाद इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग या व्यक्तियों के संबंध में, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति...इन नियमों की कोई बात ऐसे आरक्षणों, आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशिष्ट वर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे प्रवर्ग जिनसे प्रोन्नति या प्रतिनियुक्ति या आमेलन किया जाएगा

प्रतिनियुक्ति( अल्पावधिक संविदा सहित ) :

केन्द्रीय सरकार या राज्य सरकार संघ राज्य क्षेत्र या सरकारी संस्थानों या सार्वजनिक क्षेत्र के उद्यमों या भारतीय रिजर्व बैंक या सार्वजनिक क्षेत्र के बैंक या वित्तीय संस्थाओं या विश्वविद्यालयों या मान्यता प्राप्त अनुसंधान संस्थाओं या केन्द्रीय विनियामक निकायों के वे अधिकारी जो:

( क) ( I ) मूल संवर्ग या विभाग में नियमित आधार पर सदृश पदधारी हो, अथवा

( II ) जिन्होंने मूल संवर्ग या विभाग में पी. बी. 1 , रु. 5200 20200 + रु. 2800 ग्रेड वेतन में अथवा समतुल्य के पदों में नियमित आधार पर नियुक्ति के बाद उस ग्रेड में छह वर्षों की सेवा की हो , अथवा

( III ) जिन्होंने मूल संवर्ग या विभाग में पी. बी. 1 , रु. 5200 20200 + रु. 2400 ग्रेड वेतन में अथवा समतुल्य के पदों में नियमित आधार पर नियुक्ति के बाद उस ग्रेड में दस वर्षों की सेवा की हो , और

(ख) किसी सरकारी कार्यालय या वित्तीय संगठन में वित्तीय और आर्थिक मामलों से संबंधित आकड़ों के संग्रहण और संकलन में दो वर्ष का अनुभव ।

प्रतिनियुक्तिया पुनर्नियोजन हेतु ( सशस्त्र बलों के कार्मिकों के लिए) :

थल सेना और वायु सेना और नौसेना में समकक्ष कनिष्ठ कमिशंड (कनिष्ठ कमिशंड अधिकारी ) अधिकारी के रैंक के सशस्त्र बलों के कार्मिकों, जो एक वर्ष के भीतर सेवानिवृत्त होने वाले हैं अथवा जिन्हें एक वर्ष की अवधि के भीतर रिजर्व में स्थानान्तरित किया जाना है और जिनके पास अपेक्षित अर्हताएं तथा अनुभव है , पर भी विचार किया जाएगा । ऐसे व्यक्ति को सशस्त्र बलों से निर्मुक्त होने की अनुमत्य तिथि तक प्रतिनियुक्ति दी जाएगी ; उसके बाद के सिविल पदों के संदर्भ में अधिवर्षिता की आयु तक पुनर्नियोजन आधार पर इस पर नियुक्त रह सकते हैं ।

टिप्पण 1 : प्रतिनियुक्ति ( अल्पावधिक संविदा सहित ) की अवधि केन्द्र सरकार के इसी या किसी अन्य संगठन/विभाग में इस नियुक्ति के तुरंत पहले धारित किसी अन्य संवर्ग बाह्य पद में प्रतिनियुक्ति (अल्पावधिक संविदा सहित ) की अवधि सहित तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति द्वारा ( अल्पावधिक संविदा सहित ) नियुक्ति के लिए उच्च आयु सीमा आवेदन प्राप्त किए जाने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन हेतु किसी

अधिकारी द्वारा । जनवरी , 2006 अर्थात् जिस तारीख से छठे केंद्रीय वेतन आयोग की सिफारिशों पर आधारित संशोधित वेतन संरचना दी गयी है , से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा को आयोग की सिफारिशों पर आधारित तदनुरूपी ग्रेड वेतन/ वेतनमान में की गई सेवा समझा जाएगा , सिवाय जहाँ एक से अधिक संशोधन- पूर्व वेतनमान का एक सामान्य ग्रेड वेतन या वेतनमान वाले ग्रेड में विलय हुआ है और जहां यह लाभ केवल उन पदों के लिए दिया जाएगा जिनके लिए वह ग्रेड वेतन या वेतनमान, उन्नयन के बिना सामान्य प्रतिस्थापन ग्रेड है ।

यदि कोई विभागीय प्रोन्नति समिति है , जो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा । (13)

लागू नहींहोता

संघ लोक सेवा आयोग से प्रतिनियुक्ति ( अल्पावधिक संविदा सहित ) या सशस्त्र बलों के कार्मिकों के लिए पुनर्नियुक्ति पर किसी अधिकारी को नियुक्त करते समय परामर्श करना आवश्यक होगा ।

GS.R. 43. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession ofthe Ministry of Finance , Department of Economic Affairs , Junior Technical Assistant Recruitment Rules , 2007 , except as respects things done or omitted to be done , before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Technical Assistant in the Ministry of Finance , Department of Economic Affairs , namely:-

1. Short title and commencement .-- ( 1 ) These rules may be called the Ministry of Finance , Department of Economic Affairs , Junior Technical Assistant Recruitment Rules , 2013.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification , pay band and grade pay or pay scale . The number of the said post , its classification and pay band and grade pay or scale of pay attached thereto , shall be as specified in Columns (2 ) to (4 ) of the Schedule annexed to these Rules .

3.Method of recruitment , age limit , qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5 ) to ( 13 ) of the said Schedule .

4. Disqualification.-No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.---Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order for reasons to be recorded in writing , in consultation with Union Public Service Commission , relax any ofthe provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these Rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(B) two years ' experience in Collecting and Compilation of data relating to Financial and Economic matters in a Government Office or financial organization .

For Deputation or re - employment ( For Armed Forces Personnel ) :

The Armed Forces personnel of the rank of Junior Commissioned Officer ( Junior Commissioned Officer) in army and equivalent in Air Force and Navy due to retire or who are to be transferred to reserve within a period of one year and having the requisite qualification and experience shall also be considered . Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be continued on re- employment upto the age of superannuation with reference tocivil post .

Note 1: Period of deputation ( includng short term contract) including period of deputation ( including short term contract) in another ex - cadre post held immediately preceding this appointment in the same or some other Organization or Department ofthe Central Government shall ordinarily not to exceed three years .

Note 2 : The maximum age limit for appointment by deputation (including short term contract) shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3 : For purposes of appointment on deputation basis , the service rendered on a regular basis by an officer to 1-1-2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the pay commission except where there has been merger of more than one pre - revised scale ofpay into one grade with a common grade pay or pay scale, and where this benefit will be extended only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation .

टिप्पण 2 : आयु-सीमा अवधारित करने के लिए निर्णायक तारीख , भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख , जो असम , अरूणाचल प्रदेश , मेघालय , मिजोरम , मणिपुर , नागालैंड , त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य का लद्दाखा संभाग , हिमाचल प्रदेश का लाहौल और स्पीति जिला और चम्बा जिले का पांगी उप- संभाग , अंडमान और निकोबार द्वीप समूह या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )

( ii ) भारत के विश्वविद्यालय अथवा डिम्डविश्वविद्यालय और केन्द्रीय अथवा राज्य सरकार के मान्यता प्राप्त अनु- संधान संस्थाओं से आर्थिक अन्वेषण अथवा अनुसंधान कार्य करने का दो वर्षों का अनुभव ।

टिप्पणी 2 : अनुसूचित जातियों और

टिप्पण 1 : प्रतिनियुक्ति या आमेलन आधार

पर नियुक्ति के प्रयोजन के लिए , 01 जनवरी , 2006 ( जिस तारीख से छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित संशोधित वेतन संरचना दी गयी है ) से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गयी सेवा को आयोग की सिफारिशों पर आधारित दिए गए तद्नुरूपी ग्रेड वेतन या वेतनमान में की गयी सेवा समझा जाएगा , सिवाए जहाँ एक से अधिक संशोधन- पूर्व वेतनमान का एक सामान्य ग्रेड वेतन या वेतनमान वाले ग्रेड में विलय हुआ है और जहाँ यह लाभ केवल उन पदों के लिए दिया जाएगा जिनके लिए वह ग्रेड वेतन या वेतनमान , अपग्रेडेशन के बिना , सामान्य प्रतिस्थापन ग्रेड है ।

टिप्पण 2 केवल केंद्र/राज्य सरकार के अधिकारी ही आमेलन आधार पर लिए जा सकते हैं ।

टिप्पण 3 : भर्ती की उपर्युक्त पद्धति एक पद के संबंध में स्थगित रखी जा सकती है जब तक कि कनिष्ठ तकनीकी सहायक के पद पर धारित एकमात्र पदधारी जो आर्थिक अन्वेषक के पद पर प्रोन्नति हेतु (जिन्होंने फीडर ग्रेड के रूप में कार्य किया हो ) संशोधित भर्ती नियमों की अधिसूचना की तारीख को आर्थिक अधिकारी के पद पर प्रोन्नत नहीं हो जाता ।

G. S.R. 44.- In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession ofthe Ministry of Finance , Department of Economic Affairs , Economic Officer Group ' B ' posts Recruitment Rules , 2010 except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Economic Officer in the Department of Economic Affairs , namely:

( 1) Short title and commencement.-( a) These rules maybe called Ministry ofFinance , Department ofEconomic Affairs, Economic Officer ( Group -B posts) Recruitment Rules, 2013.

(b) They shall come into force on the date of their publication in the Official Gazette.

(2) Number of posts , classification and scale of pay. The number of the said post, its classification and the scale ofpay attachedthereto, shall be as specified in columns (2) to (4) of the Schedule hereto annexed .

(3) Method of recruitment , age limit and other qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating to the said post, shall be as specified in columns (5 ) to (13 ) of the said Schedule.

(4) Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

(5) Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing, and in consultation with the Union public Service Commission, relax any of the provisions of these rules with respect to any class or category or persons.

(6) Saving.-Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : For the purpose of appointment on deputation or Absorption basis , the service rendered on a regular basis by an officer prior to 1-1-2006 ( the date from which the revised pay structure based on the 6th CPC recommendations has been extended) shall be deemed to be service rendered in the correspondingGrade Pay or Pay Scale ex- tended based on the recommendations of thePay Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common Grade Pay or Pay Scale , and where this benefit will extend only for the post( s) for which that Grade Pay or Pay Scale is the normal replacement grade without any upgradation.

Note 2 : Only officers from Central Govern- ment or State Government can be taken on absorption basis .

Note 3 : The above method of recruitment

सा.का.नि. 45.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और श्रम ब्यूरो ( कनिष्ठ पुस्तकालय परिचर ) भर्ती नियम , 1980 तथा श्रम ब्यूरो ( समूह ' घ ' पद ) भर्ती नियम , 1988 को इन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , श्रम और रोजगार मंत्रालय , श्रम ब्यूरो में बहुकार्य कर्मचारिवृन्द पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :--

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम श्रम और रोजगार मंत्रालय , श्रम ब्यूरो बहुकार्य कर्मचारिवृन्द भर्ती नियम, 2013 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या, उसका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अर्हताएं , आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता , वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

3.Method of recruitment, age limit , qualifications , etc.-The method ofrecruitment, age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 13) of the said Schedule .

4. Disqualification.-No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage , and that there are other grounds for so doing, exempt any person from the operation ofthis rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any ofthe provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions , required to be provided for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, Ex -servicemen , and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

सा.का.नि. 46. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयेग करते हुए पशुपालन , डेयरी और मत्स्यपालन विभाग , वरिष्ठ तकनीकी सहायक ( डेयरी ) भर्ती नियम , 2005 तथा पशुपालन, डेयरी और मत्स्यपालन विभाग , तकनीकी सहायक (डेयरी ) भर्ती नियम, 2005 को , जहां तक उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग , वरिष्ठ तकनीकी सहायक ( डेयरी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग , वरिष्ठ तकनीकी सहायक ( डेयरी ) समूह " ख " पद भर्ती नियम , 2013 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना. ये नियम इससे उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे , जो उक्त अनुसूची के स्तंभ ( 2 ) से स्तंम्भ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि.- भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession ofthe Department of Animal Husbandry , Dairying and Fisheries , Senior Technical Assistant ( Dairy ) Recruitment Rules, 2005 and the Department of Animal Husbandry and Dairying, Technical Assistant (Dairy) Recruitment Rules , 2005 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Technical Assistant ( Dairy ) in the Ministry of Agriculture, Department of Animal Husbandry Dairying and Fisheries , namely:-

1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Agriculture , Department of Animal Husbandry Dairying and Fisheries , Senior Technical Assistant (Dairy ) Group ' B ' Post Recruitment Rules , 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification , and the pay band and grade pay or pay scale . The number of post , its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4 ) ofthe Schedule annexed to these rules .

(ii) in Column 11 , under Note ( 1 ) in item (a) in sub- item ( ii ) , for the words " with three years service in the grade " , the words " with five years service in the grade " shall be substituted.

3. In the said rules , in the Schedule relating to the post of Sub - Editor (Hindi ) :-

(i ) in Column 8 in item (ii ), for the " 2 years ' experience or writing " , " 2 years ' experience of writing " shall be substituted ;

सा.का.नि. 50.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अंदमान तथा निकोबार प्रशासन के मत्स्य निदेशालय , मत्स्यनिदेशक भर्ती नियमावली , 2008 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , अंदमान तथा निकोबार प्रशासन मत्स्य विभाग में मत्स्य निदेशक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

: 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम अंदमान तथा निकोबार प्रशासन मत्स्य निदेशक भर्ती नियम , 2013 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान, उक्त पद संख्या, उसका वर्गीकरण , वेतन बैंड और उनके ग्रेड वेतन या वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं , आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षणों , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( ii ) जिनकी मूल काडर या विभाग में वेतन बैंड -3 , 15600-39100 रु. + ग्रेड वेतन 6600 रु. की श्रेणी में पांच वर्ष की नियमित सेवा की है ; और

(ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हैं : आवश्यक:

( i ) किसी मान्याप्राप्त विश्वविद्यालय या संस्थान में समुद्री जीव विज्ञान या प्राणि विज्ञान या समुद्र विज्ञान या मत्स्य विज्ञान या मत्स्य प्रबंध या मत्स्यउद्योग या मात्स्यिकी जल जीव विज्ञान में मास्टर डिग्री या केन्द्रीय मात्स्यिकी शिक्षा संस्थान मुंबई से मात्स्यिकी विज्ञान में पोस्ट ग्रेजुएट डिप्लोमा ।

वांछनीय : मत्स्य विज्ञान में डॉक्ट्रेट

2. एसे विभागीय संयुक्त निदेशक जो वेतन बैंड 3 ( वें. बैं. 3 ) 15600-39100 रु. + ग्रेड वेतन 6600 रु. में श्रेणी में पांच वर्ष की नियमित सेवा रखते हैं भी बाह्य व्यक्तियों के साथ विचारित होंगे और यदि वह पद पर नियुक्ति के लिए चयनित होता है , तो उसे प्रोन्नति द्वारा भर गया समझा जाएगा ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे , इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । )

टिप्पण 2 : प्रतिनियुक्ति की अवधि ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) , ( जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्तिआधार पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरवमा का विस्तार किया गया है , नियमित आधार पर की गई सेवा को , सिवाय उस दशा के जहाँ एक से अधिक पूर्व पुनरीक्षित वेतनमान का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहाँ यह लाभ केवल उस पद ( उन पदों ) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है , वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

GS.R. 50.-In exercise ofthe powers conferred by the proviso to Article 309 of the Constitution , and in supersession of theAndaman and Nicobar Administration Director of Fisheries in the Department of Fisheries Recruitment Rules, 2008, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Director of Fisheries in the Department of Fisheries , Andaman andNicobar Administration namely:-

1. Short title and commencement.- ( 1 ) These rules may be called the Andaman and Nicobar Administration Director ofFisheries Recruitment Rules, 2013 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and pay band and grade pay or pay scale . The number of posts , their classification and, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age - limit , qualifications , etc. The method of recruitment , age - limit , qualifications and other matters relating there to shall be as specified in columns (5 ) to ( 13 ) of the aforesaid Schedule.

4. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

I. Officers of the Central Government or State Governments orUnion Territories or Universities or Recognised Research Institutions or public sector undertakings or semi - govern- ment or statutory or autonomous organisations :

(a) (i ) holding analogous posts on a regular basis in the parent cadre or department; or

(ii ) with five years ' service in the grade rendered after appointment thereto on a regular basis in the Pay band- 3 (PB-3) of Rs . 15600-39100 with grade pay of Rs . 6600 in the parent cadre or department; and

(b) possessing the following educational qualifications and experience:

Essential :

(i) Master's degree in Marine Biology or Zoology or Oceanography or Fisheries Science or Fisheries Management or Industrial Fisheries or Aquatic Biology in Fisheries from a recognised University or Institute ; or 241 [ भाग II-खंड 3 (i ) ]

PostGraduate Diploma in Fisheries Science of the Central Institute of Fisheries Education , Mumbai .

( ii) Ten years' experience in the field of Inland andMarine Fisheriesincluding experience of implementing plan schemes and centrally sponsored schemes relating to Marine or Inland Fisheries or Coastal Aquaculture.

Desirable : Doctorate in Fisheries Science .

II . The Departmental Joint Director in the pay band 3 (PB- 3 ) ofRs . 15600-39100 with grade pay of Rs . 6600 with five years' regular service in the grade will also be considered alongwith outsiders and in case he is selected for appointmentto the post, the same shall be deemed to have beenfilledby promotion.

Note 1 : The departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation . Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

Note 2 :Period ofdeputation ( including short -term contract) including period of deputation ( including short term contract) in another ex - cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed four years . The maximum age limit for appointment by deputation ( including short term contract) shall not be exceeding 56 years as on the closing date of receipt of applications .

Note 3 For the purpose of appointment on deputation

basis , the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post( s ) for which that grade pay or pay scale is the normal replacement grade without any upgradation.
