का.नि.आ. 20 .—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और ;iद्ध सेना समूह ''ग'' ;आशुलिपिक श्रेणी-2 और आशुलिपिक श्रेणी-3द्ध भर्ती नियम 2004 को जहाँ तक उसका संबंध् आशुलिपिक श्रेणी-2 के पद से है, (ii) रक्षा मंत्राालय, सेना ;आशुलिपिक श्रेणी-1द्ध समूह ''ख'' पद भर्ती नियम 2005 को जहाँ तक उसका संबंध् आशुलिपिक श्रेणी-1 के पद से है और सेना समूह ''ख'' ;ज्येष्ठ निजी सचिव और निजी सचिवद्ध भर्ती नियम 2006 को जहाँ तक उसका संबंध् ज्येष्ठ निजी सचिव और निजी सचिव पदों से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है रक्षा मंत्राालय के मुख्यालय एकीकृत रक्षा स्टापफ के अध्ीन स्थापनों में समूह ''ख'' ;आशुलिपिक श्रेणी-1 निजी सचिव और ज्येष्ठ निजी सचिवद्ध के पदों की भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारम्भ. - ;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, एकीकृत रक्षा स्टापफ के अध्ीन स्थापन, समूह ''ख'' पद ;आशुलिपिक श्रेणी-1, निजी सचिव और ज्येष्ठ निजी सचिवद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदाेंे की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. लागू होना.- ये नियम इससे उपाब( अनुसूची के स्त्ांभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

4. भर्ती की प(ति, आयु -सीमा और अन्य अर्हताएं - उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अईताएं और उनसे संबंध्ति

5. निरर्हता, वह व्यक्ति,-

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, और संध लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकोें और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति या प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां, जिनसे प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न प(तियों प्रोन्नति या प्रतिनियुक्ति या आमेलन किया जाएगा । द्वारा भरी जाने वाली रिक्तियों पदों की प्रतिशतता

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति ः वेतन बैंड -1, 5200-20200 रु. ग्रेड वेतन 2400 रु. में ऐसा आशुलिपिक श्रेणी-2 जिसने नियमित आधर पर इसमें नियुक्ति के पश्चात्‌ दस वर्ष सेवा की हो ।

टिप्पण 1ः इन नियमाें के अध्सिूचित होने की तारीख को आशुलिपिक श्रेणी-2 ;भूतपूर्व आशुलिपिक श्रेणी-3द्ध के पोषक पदों को धरण कर रहें व्यक्तियों के लिए पात्राता सेवा आठ वर्ष जारी रहेगीे ।

टिप्पण 2ः जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख से जिसका छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा उक्त वेतन आयोग की सिपफारिशों पर आधरित तत्स्थानी वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति :

केन्द्रीय सरकार के अध्ीन आशुलिपिक काडर से ऐसे अध्किारी :—

;कद्ध ;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण

कर रहे हैं, या

;iiद्ध जो मूल काडर या विभाग में वेतन बैंड-1, 5200-20200 रु.और ग्रेड वेतन 2400 रु. या समतुल्य मेंं नियमित आधर पर इसमें नियुक्ति के बाद उस श्रेणी में दस वर्ष सेवा कर चुके हों ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर-बाह्य पद पर प्रतिनियुक्ति की अवध् ि है, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए 1 जनवरी, 2006 ;वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई हैद्ध से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी । सिवाए इसकेे जहां एक या एक से132 THE GAZETTE OF INDIA : APRIL 20, 2013 /CHAITRA 30 , 1935 [PART II—SEC. 4] ;11द्ध अध्कि पूर्व पुनरीक्षित वेतनमान को एक सामान्य ग्रेड वेतन या वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहां यह पफायदा केवल उस पद या उन पदों की विस्तारित होगा जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापित ग्रेड है ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा

आयोग से परामर्श किया जाएगा

प्रोन्नति के लिए समूह ''ख'' विभागीय प्रोन्नति समिति संघ लोक सेवा आयोग से परामर्श करना आवश्यक नहीं है । जो निम्नलिखित से मिलकर बनेगी : —

मुख्यालय एकीकृत रक्षा स्टापफ, रक्षा मंत्राालय —अध्यक्ष

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति : वेतन बैंड -2, 9300-34800 रु. और ग्रेड वेतन 4200 रु. ऐसा

आशुलिपिक श्रेणी-1 जिसने नियमित आधर पर इसमें नियुक्ति के पश्चात्‌ पाँच वर्ष सेवा की हो । टिप्पण 1ः इन नियमाें के अध्सिूचित होने की तारीख को नियमित आधर पर पोषक पद धरण कर रहे व्यक्तियों के लिए पात्राता सेवा तीन वर्ष जारी रहेगीे ।

टिप्पण 2 : वे अध्किारी जो 1 जनवरी, 2006 को नियमित आधर पर पूर्व पुनरीक्षित वेतनमान 5500—9000 रु. में पद धरण कर रहे थे वे उन अध्किारियों से एन-ब्लाक ज्येष्ठ होंगे जो पूर्व पुनरीक्षित वेतनमान 5000—8000 रु. में पद धरण कर रहे थे ।

टिप्पण 3 : जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परीवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 4 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 01 जनवरी, 2006 या वह तारीख जिसका छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा उक्त वेतन आयोग की सिपफारिशों पर आधरित तत्स्थानी वेतन या वर्तमान में की गई सेवा समझी जाएगी ।

केन्द्रीय सरकार के अध्ीन आशुलिपिक काडर से ऐसे अध्किारी :—

कर रहे हैं, या

;iiद्ध जिन्होंने मूल काडर या विभाग में वेतन बैंड-2 और ग्रेड वेतन 4200 रु. में या समतुल्य मेंं नियमित आधर पर इसमें नियुक्ति के पश्चात्‌ उस श्रेणी में पांच वर्ष से सेवा में हों ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति

प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं

होंगे ।

प्रोन्नति के लिए समूह ''ख'' विभागीय प्रोन्नति समिति संघ लोक सेवा आयोग से परामर्श करना आवश्यक नहीं है । जो निम्नलिखित से मिलकर बनेगी : —

टिप्पण-3ः- प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए 1 जनवरी 2006 ;वह तारीख जिसको छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है द्ध से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थायी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी । सिवाए इसके जहाँ एक या एक से अध्कि पूर्व पुनरीक्षित वेतनमान को एक सामान्य ग्रेड वेतन या वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहाँ यह पफायदा केवल उस पद या उन पदों की विस्तारित होगा जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापित ग्रेड है ।

S.R.O. 20 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in partial supersession of (i) the Army Group 'C' (Stenographer Grade - II and Stenographer Grade-III) Recruitment Rules, 2004 insofar as they relate to the post of Stenographer Grade-II (ii) the Ministry of Defence, Army (Stenographer Grade-I) Group 'B' Post Recruitment Rules, 2005 insofar as they relate to the post of Stenographer Grade-I and the Army Group 'B' (Senior Private Secretary and Private Secretary) Recruitment Rules, 2006 insofar as they relate to the posts of Senior Private Secretary and Private Secretary; except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment to the Group 'B' posts (Stenographer Grade-I, Private Secretary and Senior Private Secretary) in the Establishments under Headquarters Integrated Defence Staff, Ministry of Defence, namely :—

1. Short title and commencement. — (1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, the Group 'B' Posts (Stenographer Grade-I, Private Secretary and Senior Private Secretary) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay / pay scale. —The number of post, its classification and the pay band and grade pay/pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Application. — These rules shall apply to the posts specified in Column (1) of the Schedule annexed to these rules.

4. Method of recruitment, age limit and qualification, etc. — The method of recruitment to the said posts, age limit and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification. — No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax. — Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any provisions of these rules with respect to any class or category of persons.

7. Saving. —Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Servicemen and other special categories of persons in accordance with the Orders issued by the Central Government from time to time in this regard.

Note 1 : The Elegibility service shall continue to be eight years for the persons holding the Feeder Posts of Stenographer Grade-II (erstwhile Stenographer Grade-III) on regular basis on the date of notification of these rules.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 3 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the said Pay Commission.

Deputation : Officers from Stenographer Cadre under the Central Government :—

(a)(i) holding analogous post on regular basis in the parent cadre or department; or

(ii) with ten years service in the grade rendered after appointment thereto on regular basis in the pay band-1, Rs. 5200-20200 with grade pay of Rs. 2400 or equivalent in the parent cadre or department.

Note 1 : Departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications.

Note 3 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post (s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

Note 1 : The Eligibility service shall continue to be three years for the persons holding the Feeder Posts on regular basis on the date of notification of these rules.

Note 2 : Officers who were holding the post in pre-revised scale of Rs. 5500-9000 on regular bgasis on 1st January 2006 will be en-bloc senior to those who were holding posts in the pre-revised scale of Rs. 5000-8000.

Note 3 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.
