का.नि.आ. 29.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सेना समूह 'ग' सहायक ;सेना इंजीनियरी सेवा/सेना इंजीनियरी महाविद्यालय/इंजीनियर केन्द्रों से भिन्नद्ध भर्ती नियम, 2004 और सेना समूह 'ख' कार्यालय अध्ीक्षक ;सेना इंजीनियरी सेवा/सेना इंजीनियरी महाविद्यालय/इंजीनियर केन्द्रों से भिन्नद्ध भर्ती नियम, 2004 को उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कार्यालय अध्ीक्षक ;सेना इंजीनियरी सेवा/सेना इंजीनियरी महाविद्यालय/इंजीनियर केन्द्रों से भिन्नद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, सेना कार्यालय अध्ीक्षक ;सेना इंजीनियरी सेवा/सेना इंजीनियरी महाविद्यालय/इंजीनियर केन्द्रों से भिन्नद्ध समूह 'ख' पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो । टिप्पण : प्रोन्नति के प्रयोजन के लिए न्यूनतम अर्हक सेवा की संगणना मेंं तारीख 1 जनवरी, 2006 से पहले ;या वह तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है से पूर्व किसी अध्किारी द्वाराद्ध नियमित आधर पर की गई सेवा को, वेतन आयोग की सिपफारिशों पर आधरित की गई सेवा समझी जाएगी । प्रतिनियुक्ति : केन्द्रीय सरकार के अध्ीन ऐसे अध्किारी : ;कद्ध;iद्ध जो मूल काडर/विभाग में नियमित आधर पर सदृश पद धरण किये हुए हैंऋ या ;iiद्ध जिन्होंने मूल काडर/विभाग में वेतन बैंड-1 के वेतनमान 5200—20200 ` + ग्रेड वेतन 2400 ` या समतुल्य में नियमित आधर नियुक्ति के पश्चात्‌ उस श्रेणी में दस वर्ष नियमित सेवा की हैऋ और ;खद्ध किसी मान्यता प्राप्त संस्था से 10+2 उत्तीर्ण पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । ;प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।द्ध टिप्पण : प्रतिनियुक्ति के आधर पर नियुक्ति कीे प्रयोजन के लिए, तारीख 1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा को वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्समान ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी सिवाय इसके कि जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का विलय एक ग्रेड में सामान्य ग्रेड वेतन या वेतनमान में किया गया है और जहां इस लाभ का विस्तार केवल ऐसे पद ;पदोंद्ध के लिए किया जाएगा जो बिना किसी उन्नयन के ग्रेड वेतन या वेतनमान साधरण प्रतिस्थापन ग्रेड है ।

S.R.O. 29.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Army Group 'C' Assistant (other than Military Engineering Service/College of Military Engineering/Engineer Centres) Recruitment Rules, 2004, and Army Group 'B' Office Superintendent (other than Military Engineering Service/College of Military Engineering/Engineer Centres) Recruitment Rules, 2004 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Office Superintendent (other than Military Engineering Service/College of Military Engineering/Engineer Centres) namely :—

1. Short title and commencement.—

(i) These rules may be called Ministry of Defence, Army Office Superintendent (other than Military Engineering Service or College of Military Engineering or Engineer Centres) Group 'B' posts Recruitment Rules, 2013.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay/scale of pay.—The number of the said posts, its classification and the pay band and grade pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission.

Deputation :

Officers under the Central Government

(a) (i) holding analogous posts on regular basis in the parent cadre or department; OR

(ii) with ten years regular service in the grade rendered after appointment thereto on a regular basis in the scale of pay Rs. 5200- 20200 with the grade pay of Rs. 2400 in Pay Band-1 or equivalent in the parent cadre/department; and

(b) passed of 10 + 2 from any recognized instituion.

The departmental officers in the feeder grade who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government,190 THE GAZETTE OF INDIA : JUNE 1, 2013/JYAISTHA 11, 1935 [PART II—SEC. 4] ;11द्ध

shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications.

Note : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the 6th CPC recommendation has been extended) shall be deemed to be service rendered in the corresponding grade pay/pay scale based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one scale with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/ pay scale is the normal replacement grade without any upgradation.

टिप्पण 1 : इन नियमों की अध्सिूचना की तारीख को पर्यवेक्षक श्रेणी-II जो नियमित आधर पर पोषक प्रवर्ग का पद धरण किए हुए हैं के लिए अर्हक सेवा 08 वर्ष की होगी । टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो । टिप्पण 3 : प्रोन्नति के प्रयोजन के लिए न्यूनतम अर्हक सेवा की संगणना में तारीख 1 जनवरी, 2006 से पहले या वह तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा को वेतन आयोग की सिपफारिशों पर आधरित विस्तारित समान ग्रेड वेतन या वेतन में की गई सेवा समझी जाएगी ।

S.R.O. 30.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Army Factory Canteens Employees Recruitment Rules, 2006, insofar as they relate to the post of Supervisor Grade- I, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely :—

1. Short title and commencement.—(1) These rules may be called the Army Factory Canteens Employees, Group 'B' posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay/scale of pay.—The number of the posts, their classification, pay band grade pay and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age limit, qualifications etc.—The method of recruitment, age limit, qualification and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2 : Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service, or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service.

Note 3 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission.

Deputation :

Officers under the Central Government :—

(a) (i) holding analogous posts on regular basis in the parent cadre/ department : OR

(ii) with ten years regular service in the grade rendered after appointment thereto on a regular basis in the scale of pay Rs. 5200- 20200 plus grade pay of Rs. 2400 in Pay Band-1 or equivalent in the parent cadre/department; AND

(b) passed of 10 + 2 from any recognized instituion with minimum one year experience as Canteen Supervisor.

(The departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion).

(Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government, shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications).

Note : For the purpose of appointment on deputation the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the 6th CPC recommendations has been extended) shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common Grade pay/pay scale and where this benefit will extend only for the post(s) for which that Grade pay/pay scale is the normal replacement grade without any upgradation.

4. भर्ती की प(ति, आयु-सीमा और अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1- पात्राता के प्रयोजन के लिए और अध्यापन श्रेणियों पर सीध्ी भर्ती करने के दौरान अच्छा शैक्षिक रिकार्ड के निर्धरण के लिए अनुसूचित जातियों या अनुसूचित जनजातियों या विभिन्न रूप से असमर्थ ;शारीरिक और आंख से असमर्थद्ध प्रवर्गों के लिए स्नातक और मास्टर स्तर पर 5 प्रतिशत शिथिल करने की व्यवस्था की जाएगी । टिप्पण 2- पात्राता अंक 55 प्रतिशत ;या जहां कहीं ग्रेडग प्रणाली का अनुसरण किया जाता है वहां बिन्दु मापमान में कोई समतुल्य श्रेणीद्ध और उपरोक्त वणत श्रेणियों के लिए 5 प्रतिशत शिथिल करने का अनुज्ञात बिना किसी अनुग्रहांक प्रक्रिया का केवल अर्हक अंकों पर आधरित हैं ।

टिप्पण 3- अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध उन कारणों के लिए जो लेखब( किए जाएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

टिप्पण 1- पात्राता के प्रयोजन के लिए और अध्यापन श्रेणियों पर सीध्ी भर्ती करने के दौरान अच्छा शैक्षिक रिकार्ड के निर्धरण के लिए अनुसूचित जातियों या अनुसूचित जनजातियों या विभिन्न रूप से असमर्थ ;शारीरिक और आंख से असमर्थद्ध प्रवर्गों के लिए स्नातक और मास्टर स्तर पर 5 प्रतिशत शिथिल करने की व्यवस्था की जाएगी ।

टिप्पण 4- ऐसे पी. एच. डी. धरकों को जिन्होंने अपनी स्नातकोत्तर डिग्री 19 सितम्बर, 1991 से पूर्व उत्तीर्ण कर ली है, उनके अंकों में 5 प्रतिशत की छूट-55 प्रतिशत से 50 प्रतिशत उपलब्ध् कराई जाएगी ।

S.R.O. 31.—In exercise of the powers conferred by proviso to article 309 of the Constitution and in supersession of Ministry of Defence, Headquarters Integrated Defence Staff, National Defence Academy, Principal and Vice-Principal (Group 'A' Posts) Recruitment Rules, 2010 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment to the posts of Principal and Vice- Principal, in the Ministry of Defence, National Defence Academy, Khadakwasla, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Headquarters Integrated Defence Staff, National Defence Academy, Principal and Vice-Principal, (Group 'A' Posts) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.— The number of posts, their classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit and qualifications, etc.—The method of recruitment to the said post, age limit and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.— No person,—

shall be eligible for appointment to the said posts :

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, तटरक्षक आशुलिपिक ;समूह 'ग'द्ध पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होंगे जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं.—उक्त पद पर भर्ती की प(ति, आयु-सीमा और अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके व संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 2 : प्रतिनियुक्ति/आमेलन पर नियुक्ति के प्रयोजन के लिए 1 जनवरी, 2006/वह तारीख छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान में की गई सेवा समझी जाएगी । सिवाए इसके जहां एक या एक से अध्कि पूर्व पुनरीक्षित वेतनमान का सामान्य ग्रेड वेतन/वेतनमान के साथ एक ग्रेड में विलय किया गया है, और जहां यह पफायदा केवल उस पद या उन पदों का विस्तारित होगा, जिसके लिए वह ग्रेड वेतन/वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापन ग्रेड है ।

New Delhi, the 17th May, 2013

S.R.O. 32.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Coast Guard Stenographers Grade 'A', 'B', 'C' and 'D' Recruitment Rules, 1983 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer in Coast Guard, Ministry of Defence namely :—

1. Short title and commencement.— (1) These rules may be called the Ministry of Defence, Coast Guard Stenographers (Group 'C') posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay and pay scale.—The number of the said posts, their classification and the pay band and grade pay and pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, and qualification, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be specified in columns (5) to (13) of the Schedule.

4. Disqualification.— No person,

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said Posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing in consultation with Union Public Service Commission to relax any of the provisions of these rules with respect of any class or category of persons.

6. Saving.—Nothing in these rules shall effect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation / Department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.

Note 2 : For purposes of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 the date from which the revised pay structure based on the Sixth CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding Grade pay/pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay Scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation.
