सा.का.नि. 142.—केन्द्रीय सरकार, आसाम राइपफल्स अध्निियम, 2006 ;2006 का 47द्ध की धरा 165 की उप-धरा ;2द्ध के खंड ;कद्ध और ;खद्ध के साथ पठित उप-धरा ;iद्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ;iद्ध असम राइपफल्स अनुचर कौशल ;समूह 'घ' पदद्ध भर्ती नियम, 2000 को, जहॉ तक उसका संबंध् राइपफलमैन बढ़ई, राइपफलमैन रंगसाज, राइपफलमैन दर्जी, राइपफलमैन उपस्कर और जूता मिस्त्राी, राइपफलमैन रसोईया, राइपफलमैन नाई, राइपफलमैन धेबी, राइपफलमैन राज, राइपफलमैन लूहार, तथा ;iiद्ध असम राइपफल अनुचर कौशल ;समूह 'घ' पदद्ध भर्ती नियम, 2006 को, जहॉ तक उसका संबंध् राइपफलमैन पानी वाहक एवं सपफाईवाला पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, असम राइपफल्स में ट्रेडमैन समूह 'ग' योध्क पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम असम राइपफल्स, टे्रडमैन ;समूह 'ग' योध्क पदद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

(755)756 THE GAZETTE OF INDIA : JUNE 1, 2013/JYAISTHA 11, 1935 [PART II—SEC. 3(i)] 3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्रा नहीं होगाः

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. चिकित्सक दृष्टया योग्यता.—इन नियमों में अंतवष्ट किसी बात के होते हुए भी, केवल वे व्यक्ति जो चिकित्सा प्रवर्ग 'शेप-1' में हैं, इन नियमों के उपबंधें के अध्ीन नियुक्ति के लिए पात्रा होंगे ।

स्पष्टीकरण : इन नियम के प्रयोजन के लिए, फ्शेप-1य् से नियमानुसार परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है :—

;iद्ध कोड अक्षर शेप ;एस एच ए पी ईद्ध, जो निम्नलिखित कृत्यों का प्रतिनिध्त्वि करते हैं, द्वारा उपदशत दिए गए कारकों के अध्ीन अध्किारी की उपयुक्तता निर्धरित करने के पश्चात्‌ चिकित्सा अध्किारी द्वारा किया गया चिकित्सा वर्गीकरण :—

एस — मनोवैज्ञानिक

एच — श्रवण शक्ति

ए — उपांग ;अपैन्डेजेसद्ध

पी — शारीरिक दक्षता

इ — दृष्टि शक्ति

;iiद्ध प्रत्येक कारक के अध्ीन, किसी अध्किारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता उपदशत करते हुए दर्शाई जाएगी । कोड अक्षर के पश्चात्‌ अंक लिखे जाएंगे सिवाय उसके जहां कोई अध्किारी सभी कारकों में श्रेणी-1 में है वहां उसका प्रवर्ग एस1एच1ए1पी1ई1 लिखने के बजाए शेप-1 लिखकर दर्शाया जा सकेगा । इन अंकों का साधरण मूल्यांकन निम्नानुसार है :—

;कद्ध कहीं भी सभी कर्तव्यों के लिए योग्य ।

;खद्ध सभी कर्तव्य करने के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों या आंखों को श्रवण शक्ति या दृष्टि की तीक्ष्णता की मांग अन्तगर््रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्राों के अनुसार परिसीमाएं हो सकती है ।

;गद्ध 'एस' कारक को छोड़कर, नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान ;2700 मीटर से अध्किद्ध अत्यध्कि ठंडे क्षेत्राों या पहाड़ी भूखंड़ों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं ।

;घद्ध अस्पताल में भर्ती या बीमारी की छुट्‌टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ।

;घद्ध कर्तव्यों के लिए स्थायी रूप से अयोग्य ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 142.—In exercise of the powers conferred by sub-section (1) read with clauses (a) and (b) of sub-section (2) of Section 165 of the Assam Rifles Act, 2006 (47 of 2006) and in supersession of (i) the Assam Rifles, Followers—killed (Group 'D' posts) Recruitment Rules, 2006, in so far as they relate to the posts of Rifleman Carpenter, Rifleman Painter, Rifleman Tailor, Rifleman Equipment and Boot Repairer, Rifleman Cook, Rifleman Barber, Rifleman Washerman, Rifleman Mason, Rifleman Blacksmith, and (ii) the Assam Rifles Followers Unskilled (Group 'D' posts) Recruitment Rules, 2006, in so far as they relate to the posts of Rifleman Water Carrier and Rifleman Safai, except as respect things done or omitted to be done before such supersessions, the Central Government hereby makes the following rules regulating the method of recruitment to certain Group 'C' Combatised posts in the Assam Rifles, namely :—

1. Short title and commencement. — (1) These rules may be called the Assam Rifles Tradesman (Group 'C' combatised posts) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade pay or pay scale. —The number of the posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualifications, etc. — The method of recruitment to the said posts, age limits, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification. — No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Medical Fitness.—(1) Notiwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for appointment or promotion under the provisions of these rules.

(2) SHAPE-I shall mean—

(i) medical classification done by Medical Officer after assessing fitness of the officer under the given factors indicated by the code letters SHAPE, which represent the following functions, namely:—

S - Psychological

H - Hearing

A - Appendages

P - Physical Capacity

E - Eye-Sight

(ii) functional capacity of an officer under each factor shall be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency. The numerals shall be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I instead of writing S1H1A1P1E1. General evaluation of these numerals is as under:—

(a) fit for all duties anywhere.

(b) fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears and eyes.

(c) excepting "S" factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 metres) extreme cold areas or hilly terrain and for long assignments.

(d) temporarily unfit for duties on accounts of hospitalization or sick leave.

(e) permanent unfit for duties.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, not for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

3. भर्ती की प(ति, आयु सीमा और अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु सीमा, अर्हताएं और उससे संबंध्ति बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात्‌्‌ इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकोें और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : प्रतिनियुक्ति आधर पर नियुक्ति के प्रयोजन के लिए, नियमित आधर पर की गई वह सेवा जो किसी अध्किारी द्वारा, 01-01-2006 या वह तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित वेतन संरचना विस्तारित की गई है, से पहले की गई है, आयोग की सिपफारिश के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान में की गई सेवा समझी जाएगी सिवाय इसके कि जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान को समान ग्रेड वेतन/वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहां यह पफायदा केवल उन पद ;पदोंद्ध के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन/वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापन ग्रेड है ।

G.S.R. 143.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Institute of Secretariat Training and Management, Joint Director (Peripatetic Training) Recruitment Rules, 1988, the President hereby makes the following rules regulating the method of recruitment to the post of Joint Director (Peripatetic Training) in the Institute of Secretariat Training and Management, Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, namely :—

1. Short title and commencement.— (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Institute of Secretariat Training and Management Joint Director (Peripatetic Training) Group 'A' Posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualification, etc.—The method of recruitment to the said post, age limit, Qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualification. — No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

The maximum age limit for appointment by deputation shall not be exceeding fifty six years as on the closing date of receipt of applications).

Note : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommentations of the Pay Commission except where there has been merger or more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay/ pay scale is the normal replacement grade without any upgradation.

अध्ीनस्थ विधन संबंध्ी समिति, लोक सभा, ने विपणन एवं निरीक्षण निदेशालय ;समूह 'ग' अराजपत्रिात पदद्ध, उच्च श्रेणी लिपिक भर्ती नियमावली, 2012 जिसे 7 जुलाई, 2012 को सा.का.नि. 165 द्वारा भारत के राजपत्रा में अध्सिूचित किया गया है, की जांच करते समय इंगित किया कि पदोन्नत अवर श्रेणी लिपिक को उसी वेतन बैंड में, उसी वेतनमान पर उच्च श्रेणी लिपिक के पद पर उसकी पदोन्नति पर परिवीक्षाध्ीन नहीं790 THE GAZETTE OF INDIA : JUNE 1, 2013/JYAISTHA 11, 1935 [PART II—SEC. 3(i)] रखा जाएगा और नियम में सुधर हेतु कृषि मंत्राालय, कृषि एवं सहकारिता विभाग से अनुरोध् किया । कामक एवं प्रशिक्षण विभाग के कार्यालय ज्ञापन संख्या एसी 14017/48/2010-स्थापना ;आरआरद्ध दिनांक 31-12-2010 के द्वारा विहित किया जाता है कि संघ लोक सेवा आयोग अथवा केन्द्र सरकार के किसी अन्य प्राध्किरण द्वारा सीध्ी भर्ती हेतु खुली प्रतियोगी परीक्षा में आयु सीमा '18 से 27 वर्ष के बीच' हो तथा एक ग्रेड से दूसरे ग्रेड में परंतु उसी पद समूह में, अर्थात्‌ समूह ग से समूह ग में पदोन्नति हेतु कोई परिवीक्षा न हो । अतः यह निर्णय लिया गया है कि विपणन एवं निरीक्षण निदेशालय ;समूह 'ग' अराजपत्रिातद्ध, उच्च श्रेणी लिपिक भर्ती नियम, 2012 में संशोध्न किया जाए और इस संशोध्न को भूतलक्षी प्रभाव दिया जाए जो 7 जुलाई, 2012 से प्रभावी हो । यह प्रमाणित किया जाता है कि अध्सिूचित किए जा रहे भर्ती नियमों में प्रस्तावित संशोध्न के भूतलक्षी प्रभाव से किसी को हानि नहीं होगी ।

G.S.R. 145.—In exercise of the powers conferred by the provide to article 309 of the Constitution,the President hereby makes the following rules to amend the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012 notified vide G.S.R. No. 165 dated the 3-07-2012, namely :—

1.(1) These rules may be called the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment (Second Amendment) Rules, 2012.

(2) They shall be deemed to have come into force with effect from the July 7th, 2012.

2. In the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012,

(1) Under Column 6 for "Between 18 and 25 year of age" the following shall be substituted namely "Between 18 and 27 years of age".

(2) Under column 9 for "One year for direct recruits and promotees" the following shall be substituted namely "Two years for direct recruits and 'Nil' for promotees".

Explanatory Memorandum

The Committee on Subordinate Legislation, Lok Sabha, while examination of the Directorate of Marketing & Inspection (Group 'C' Non-gazetted posts), Upper division Clerk Recruitment Rules, 2012, notified in the Gazette of India vide G.S.R. 165 on 7th July, 2012, pointed out that a promotee Lower Division Clerk may not undergo probation on his promotion to the post of Upper Division Clerk in the same Pay Ban and requested the Ministry of Agricultue, Department of Agricultue & Cooperation to amend the rule. Further, in terms of Department of Personnel & Training's Office Memorandum No. AB. 14017/48/2010-Estt.(RR) dated 31-12-2010 prescribes the age limit by the method of direct recruitment through open competitive examination conducted by UPSC or any other authority under the Central Government shall be 'between 18 and 17 years' and no probation for promotion from one grade to another but within the same group of posts i.e. from Group 'C' to Group 'C'. Therefore, it has been decided to amend the Directorate of Marketing & Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012 and to give retrospective effect to the aforesaid amendment with effect from the 7th July, 2012. As such, insertion of the proposed entry in the said rule will have retrospective application from 7th July, 2012. It is certified that none will be adversely affected by the retrospective effect being given to the proposed amendment in the recruitment rules being notified.

Note : The principal rules were published vide G.S.R. No. 165 dated 3rd July, 2012 and were last amended vide G.S.R. No. 25 dated 14th January, 2013.
