सा.का.नि. 161.—संविधन के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति इसके द्वारा सभी पिछले नियमों पर इस विषय पर महा-अध्विेशन में निम्नलिखित नियमों को बनाते हैं । इस तरह के महा-अध्विेशन से पहले, किये गये या छोड़े गये मामलों के सिवाय पफार्मेसिस्ट के पदों के लिए भर्ती की प(ति को विनियम करने में दिल्ली का सपफदरजंग अस्पताल है :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों को सपफदरजंग अस्पताल नई दिल्ली, पफार्मेसिस्ट भर्ती नियमावली, 2012 भी कहा जा सकता है ।

;2द्ध इन्हें सरकारी राजपत्रा में अपने प्रकाशन की तारीख पर लागू होना चाहिए ।

2. पदों की संख्या वेतन के वर्गीकरण और पैमाना.—उक्त पदों की संख्या, उनके वर्गीकरण और वेतन के पैमाने की संलग्नता उस तक होनी चािहए, इन नियमों के लिए समय-सारणी अनुब( के ;2द्ध से ;4द्ध स्तंभ में विशेष रूप से है ।

3. भर्ती, आयु-सीमा योग्यता, आदि की प(ति.—भर्ती, आयु-सीमा, योग्यता और उक्त पदों से संबंधित अन्य मामलों की उपरोक्त अनुसूची के ;5द्ध से ;13द्ध स्तंभों में विशेष रूप से होना चाहिए ।

;कद्ध जो शादी के अनुबंध् में शामिल या शादी करते हैं, उस व्यक्ति के साथ जिसका पति/जिसकी पत्नी जीवित हो, या पिफर

;खद्ध वो व्यक्ति उक्त पदों की भर्ती के लिए योग्य होगा जो किसी व्यक्ति जिसका पति/जिसकी पत्नी जीवित है, उसके साथ शादी के अनुबंध् में या शादी में शामिल होने पर उस शादीशुदा के साथ रहने वाला व्यक्ति होगा ।

केन्द्रीय सरकार यदि आप संतुष्ट हैं इस तरह के विवाह की अनुमति व्यक्तिगत कानून के तहत इस तरह के व्यक्ति के लिए लागू कर सकती है और अन्य पक्ष के लिए शादी और इस नियम के प्रवर्तन से किसी भी व्यक्ति को अन्य आधरों के लिए जो कर रहे हैं उन्हें छूट है ।

5. छूट के लिए शक्ति.—केन्द्र सरकार की राय है कि जहां ऐसा करना आवश्यक या समीचीन उपाय है, उसे करने, आदेश द्वारा कारणों के लिए लिखित रूप में दर्ज किया जा सकता है, व्यक्तियों की किसी भी श्रेणी या वर्ग के संबंध् के साथ इन नियमों के किसी भी प्रावधन से छूट है ।

6. बचत.—इन नियमों में आरक्षण, आयु-सीमा की छूट और अनुसूचित जातियों के लिए प्रदान की जाने वाली जरूरी अन्य रियायतें अनुसूचित जनजाति, भूतपूर्व सैनिकों और इस संबंध् में समय-समय पर केन्द्र सरकार द्वारा जारी आदेशों के अनुसार व्यक्ति के अन्य विशेष श्रेणियों को कुछ भी नहीं प्रभावित करेगा ।

MINISTRY OF HELATH AND FAMILY WELFARE

New Delhi, the 19th June, 2013

G.S.R. 161.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession on all previous rules on the subject except as respects things done or omitted to be done before such supersession, regulating the method of recruitment to the post of pharmacist in Safdarjung Hospital, New Delhi, namely :

1. Short title and commencement .—(1) These rules may be called the Safdarjung Hospital, New Delhi Pharmacist (Group 'C' Post) Recruitment Rule, 2012.

2. They shall come into force on the date of publication in the Official Gazette.

3. Number of posts, classification and scale of pay.— The number of the said posts, their classification, the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit, qualifications, etc. — The method of recruitment age limit, qualification and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax .— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing relax any of the provisions of these rules in respect of any class or category of persons.

7. Savings. — Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

4. निरर्हता.—वह व्यक्तिः—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति के लिए पात्रा नहीं होगा :

परन्तु यदि केंद्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतोें पर प्रभाव नहीं डालेगी, जिनका केंद्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : वेतन बैंड-1, 5200-20200 रु. + गे्रड वेतन 2400 रु. मेंं ऐसे विभागीय सहायक प्रबंध्क-सह-भंडारी जिन्होंने उस श्रेणी में दस वर्ष नियमित सेवा की है और जिन्होंने पर्यटन मंत्राालय या किसी अन्य मान्यताप्राप्त होटल प्रबंध् और खानपान संस्थानों के अध्ीन होटल प्रबंध् संस्थानों के परामर्श से सूचना और प्रसारण मंत्राालय द्वारा आयोजित कैंटीन प्रबंध् के लिए प्रबंध्कीय कौशल प्रशिक्षण लिया हो, पर भी बाह्य अध्किारियों के साथ विचार किया जाएगा और यदि उस पद पर नियुक्ति के लिए उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

New Delhi, the 18th June, 2013

G.S.R. 162.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Information and Broadcasting, Departmental Canteen Employees Recruitment Rules, 1999, in so far as it relates to the post of the Manager Grade-II, except as respects things done or omitted to be done before such supersession, the President makes the following rules regulating the method of recruitment to the post of Manager in the Departmental Canteen in the Main Secretariat of the Ministry of Information and Broadcasting, namely :—

1. Short title and commencement - (1) These rules may be called the Ministy of Information and Broadcasting, Manager (Departmental Canteen) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay or pay scale - The number of post, its classification, and the pay band and grade pay or the scale of pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. - The method of recruitment to the said post, age limit, qualifications and other matters connected therewith shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings - Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Schedules Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Departmental Assistant Manager- cum-Storekeeper in Pay band-I, Rs. 5200— 20,200 with Grade Pay of Rs. 2400 with ten years regular service in the grade and have undergone training in Managerial Skills for Canteen Manager, organized by the Ministry of Information and Broadcasting in consultation with the Institutes of Hotel Management under the Ministry of Tourism or any other recognized Institute of Hotel Management and Catering shall also be considered alongwith the outside officers and in case he is selected for appointment, the post shall be deemed to have been filled by promotion.

Note 2 : Period of deputatin including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years. The maximum age-limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1st day of January, 2006 the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation.

2. लागू होना.—ये नियमों इससे उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेेतन या वेतनमान वे होंगे जो उक्त अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि .—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की हैऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या

पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे

ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा । परन्तु यह तब जबकि

उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा

के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और

उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए, अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

G.S.R. 163.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Coastal Engineering for Fishery [Staff Car Driver (Grade I), Staff Car Driver (Grade II) and Staff Car Driver (Ordinary Grade)] Recruitment Rules, 2006, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Staff Car Driver (Grade I), Staff Car Driver (Grade II) and Staff Car Driver (Ordinary Grade) in the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries), Central Institute of Coastal Engineering for Fishery, Bangalore, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, (Department of Animal Husbandry, Dairying and Fisheries), Central Institute of Coastal Engineering for Fishery, Staff Car Driver (Grade I), Staff Car Driver (Grade II) and Staff Car Driver (Ordinary Grade) Group 'C' posts, Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Staff Car Driver (Grade II) with five years' regular service in the grade in the Pay band-1, Rs. 5200—20200 with grade pay of Rs. 2400 failing which Staff Car Driver (Grade II) with thirteen years combined regular service in the grade of Staff Car Driver (Grade II) and Staff Car Driver (Ordinary Grade), in the Central Institute of Coastal Engineering for Fishery, subject to passing of Trade Test of appropriate standard as prescribed by the Government.

Note 1: Where juniors, who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade, alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission, except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

Deputation :

Officers of the Central Government or State Government :

(i) holding analogous posts on a regular basis in the parent cadre or department; or

(ii) Staff Car Driver (Grade II) with five years' regular service in the grade in Pay band-1, Rs. 5200—20200 with grade pay of Rs. 2400; or

(iii) Staff Car Driver (Grade II) with thirteen years combined regular service in the grades of Staff Car Driver (Grade II) and Staff Car Driver (Ordinary Grade), subject to passing of Trade Test of appropriate standard as prescribed by the Government.

Note 1: The period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government, shall ordinarily not exceed three years.

Note 2 : The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of the receipt of applications.
