सा.का.नि. 179.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विध् िऔर न्याय मंत्राालय, विधयी विभाग, विध् िसाहित्य प्रकाशन समूह ''घ'' पद भर्ती नियम, 2005 को, उन बातों के सिवाए अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, विध् िऔर न्याय मंत्राालय, विधयी विभाग, विध् िसाहित्य प्रकाशन में समूह ''ग'' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैंं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विधयी विभाग, विध् िसाहित्य प्रकाशन, बहु-कार्य कर्मचारिवृंद समूह 'ग' पद, भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे हाेंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 179.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Vidhi Sahitya Prakashan Group 'D' Posts Recruitment Rules, 2005, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regarding the method of recruitment to the Group 'C' posts in the Ministry of Law and Justice, Legislative Department, Vidhi Sahitya Prakahan, namely :—

1. Short title and Commencement.—(1) These rules may be called the Ministry of Law and Justice, Legislative Deparment, Vidhi Sahitya Prakahan, Multi Tasking Staff, Group 'C' Posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale .— The number of the said posts, their classification and the Pay Band and Grade Pay or Pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications.— The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who, has entered into or contracted a marriage with a person having a spouse living

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 180.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Office of the Registrar General, India and Directorates of Census Operations, Data Entry Operator Grade 'B' (Group 'C' post) Recruitment Rules 2012, namely :-

1. (1) These rules may be called the Office of the Registrar General, India and Directorates of Census Operations, Data Entry Operator Grade 'B' (Group 'C' post) Recruitment (Amendment) Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Office of the Registrar General, India and Directorates of Census Operations, Data Entry Operator Grade 'B' (Group 'C' post) Recruitment Rules, 2012, in column (3), for the existing entries, the following entries shall be substituted, namely :-

"General Central Service, Group 'C', Non-Gazetted, Non Ministrial".

सा.का.नि. 181.—एतद्‌द्वारा राष्ट्रपति, संविधन के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारत के महारजिस्ट्रार के कार्यालय तथा राज्यों और संघ राज्य-क्षेत्राों में स्थित जनगणना कार्य के निदेशक के कार्यालयों में ;सहायक निदेशक, जनगणना कार्यद्ध भर्ती नियम, 2004 का अध्ग्रिहण करते हुए ऐसे अध्क्रिमण से पहले इस संबंध् में की गई या लोप की जाने वाली कार्यवाही को छोड़कर भारत के महारजिस्ट्रार के कार्यालय में सहायक निदेशक, जनगणना कार्य समूह 'क' पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

3. भर्ती की प(ति, आयु-सीमा शैक्षिक अर्हताएं, आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, शैक्षिक अर्हताएं और उक्त पद से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के कालम ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति —

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी अन्य व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुमेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह, उसके लिए जो कारण हैं उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श से इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों के बारे में, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई भी बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : पफीडर वर्ग के विभागीय अध्किारी जो पदोन्नति की सीध्ी लाइन में है प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्ति कर्मचारी पदोन्नति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

केन्द्रीय सरकार के उसी या किसी अन्य संगठन अथवा विभाग में इस नियुक्ति से तुरंत पहले धरित किसी अन्य संवर्ग बाह्‌य पद पर प्रतिनियुक्ति की अवध्ि ;अल्पावध् िसंविदा सहितद्ध सहित प्रतिनियुक्ति की अवध् ि;अल्पावध् िसंविदा सहितद्ध सामान्यतः तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्‌वारा नियुक्ति के लिए अध्कितम आयु सीमा ;अल्पावध् िसंविदा सहितद्ध आवेदन प्राप्त होने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होनी चाहिए।द्ध

G. S. R. 181.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Office of the Registrar General, India and the Offices of the Director of Census Operations in States and Union Territories (Assistant Director of Census Operations) Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director of Census Operations Group 'A' Post in the office of the Registrar General, India, namely :—

1. Short title and commencement.— (1) These rules may be called the Office of the Registrar General, India and the Offices of the Director of Census Operations and Union Territories Assistant Director of Census Operations Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and pay band and grade pay or pay scale.— The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, educational qualifications, etc.— The method of recruitment, age limit, educational qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the afore said Schedule.

4. Disqualification.- No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Govenment may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the candidate belonging to the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

(Period of deputation (including short term contract) including period of deputation (including short term contract) in an other ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not to exceed three years. सा.का.नि. 182.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और ग्रामीण विकास मंत्राालय में कैंटीन स्टापफ समूह 'ग' और समूह 'घ' भर्ती नियम 2000 को, उन बातोंं के सिवाय अध्क्रिांत करते हुए जिन्हेंं ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, ग्रामीण विकास मंत्राालय की विभागीय कैंटीन में समूह 'ग' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारंभ : ;1द्ध इन नियमों का संक्षिप्त नाम ग्रामीण विकास मंत्राालय विभागीय कैंटीन कर्मचारिवृन्द समूह 'ग' पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. लागू होना : ये नियम इन नियमों से उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पद पर लागू होंगे ।

3. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद संख्या, उनका वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति —

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केंद्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : 2 पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे।

;प्रतिनियुक्त व्यक्ति स्तंभ 7 के अध्ीन सीध्े भर्ती किए जाने वाले व्यक्तियों के विहित शैक्षिक अर्हताएं और अनुभव रखेंगे ।

(ii) कैंटीन सहायक जिनकी वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 1800 रु. में कम से कम तीन वर्ष की नियमित सेवा है और जो स्तंभ 7 के अध्ीन सीध्ी भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं रखते हैं।

टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य बाह्य काडर पद पर प्रतिनियुक्ति की अवध्ि साधरणतया तीन वर्ष से अध्कि नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी।

G.S.R. 182.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Rural Development Group 'C' and 'D' posts of Canteen Staff Recruitment Rules, 2000, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' posts of Canteen Staff in the Ministry of Rural Development namely :—

1. Short title and commencement. — (1)These rules may be called the Ministry of Rural Development, Group 'C' posts of Canteen Staff Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts specified in the column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.— The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc. — The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.— No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 185.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मीन उद्योग नौवहन तथा इंजीनियरी प्रशिक्षण संस्थान, ;समूह 'क' पदद्ध भर्ती नियम, 1992 को, जहां तक उसका संबंध् अनुदेशक ;साधरणद्ध के पद से है,[भाग II—खण्ड 3(i)] भारत का राजपत्रा : जुलाई 27, 2013/श्रावण 5, 1935 1059 उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्य पालन विभाग, केन्द्रीय मत्स्य, नौचालन एवं इंजीनियरी प्रशिक्षण, कोचीन, ज्येष्ठ अनुदेशक ;प्रशिक्षणद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्य पालन विभाग, केन्द्रीय मत्स्य, नौचालन एवं इंजीनियरी प्रशिक्षण, कोचीन, ज्येष्ठ अनुदेशक ;प्रशिक्षणद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो उक्त अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई भी बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है । ुसूच

टिप्पण 1 : प्रोन्नति के लिए पात्राता सूची अध्किारी द्वारा संबंध्ति श्रेणी या पद में विहित अहत सेवा पूरी होने की तारीख के संदर्भ से तैयार की जाएगी ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

प्रतिनियुक्ति की अवध्,ि ;जिसके अन्तर्गत अल्पकालिक संविदा भी हैद्ध जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् ि;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध है, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

G.S.R. 185.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Institute of Fisheries, Nautical and Engineering Training (Group 'A' posts), Recruitment Rules, 1992, insofar as they relate to the post of Instructor (General), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Instructor (Training) in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, in the Central Institute of Fisheries, Nautical and Engineering Training, Cochin, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Senior Instructor (Training) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band, grade payor pay scale.—The number of posts, its classification and the pay band, grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. .—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1: The eligibility list for the promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years, whichever is less and have successfully completed their probation for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 3 : For the purpose of the computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the Pay Commission.

Deputation (Including Short-Term Contract) : Officers of the Central Government or State Governments or Union Territories or Semi Government or Autonomous bodies or Statutory organizations:-

(a)(i) holding analogous posts on regular basis; or

(ii) with two years' regular service in PB-2, Rs. 9300-34800 with Grade Pay of Rs. 4800 or equivalent in the parent cadre or department; or

(iii) with three years' regular service in PB-2, Rs. 9300-34800 with Grade Pay of Rs. 4600 or equivalent in the parent cadre or department; or

(iv) with eight years' regular service in PB-2, Rs. 9300-34800 with Grade Pay of Rs. 4200 or equivalent in the parent cadre or department; and

b) possessing educational qualifications and experience prescribed under Column (7).

Note 1: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.

Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Period of deputation (including Short-Term Contract) including period of deputation (including Short-Term Contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by transfer on deputation (including short-term contract or transfer) shall be 'Not Exceeding 56 years' as on the closing date of receipt of applications).

grade with a common grade payor pay scale and where this benefit

will extend only for the post(s) for which that grade payor pay scale

is the normal replacement grade without any upgradation.

सा.का.नि. 186.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय मात्स्यिकी सर्वेक्षण, ;ज्येष्ठ मात्स्यिकी वैज्ञानिकद्ध भर्ती नियम, 2006 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्य पालन विभाग के अध्ीन मात्स्यिकी भारतीय सर्वेक्षण, मुम्बई में ज्येष्ठ मात्स्यिकी वैज्ञानिक पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, पशुपालन, डेयरी और मत्स्यपालन विभाग भारतीय मात्स्यिकी सर्वेक्षण, ज्येष्ठ मात्स्यिकी वैज्ञानिक समूह 'क' पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण और उसका वर्गीकरण वेतन बैंड और उनके ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 ः अर्हताएं अन्यथा सुअहत अभ्यथयों की दशा में उन कारणों के लिए जो लेखब( किए जाएं । संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए, किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध : केन्द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्राों या विश्व विद्यालयों या मान्यताप्राप्त अनुसंधन संस्थानों या लोक क्षेत्रा के उपक्रमों या अर्ध् सरकारी या कानूनी या स्वायत्त संगठनों के अध्ीन ऐसे अध्किारी :

;कद्ध;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किये हुए हैंऋ या

;iiद्ध जिनकी मूल काडर या विभाग में वेतन बैंड-3, 15600-39100 रफ. ग्रेड वेतन 5400 रफ. या समतुल्य श्रेणी में पांच वर्ष की नियमित सेवा की हैऋ और

;खद्ध स्तंभ ;7द्ध के अध्ीन सीध्ी भर्ती के लिए विहित अर्हताएं और अनुभव रखते हैं ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 4 : प्रतिनियुक्ति के आधर पर नियुक्ति कीे प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 186.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Fishery Survey of India, (Senior Fisheries Scientist) Recruitment Rules, 2006, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Fisheries Scientist in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Fishery Survey of India, Mumbai, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Fishery Survey of India, Senior Fisheries Scientist, Group 'A' Post Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc..—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or,

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(ii) Possessing five years' experience in survey or research of Marine Fisheries including cruise planning and participation in voyages.

Desirable: One year experience in Fishing Gear Technology.

Note 1 : Where Juniors, who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to Ist January, 2006 or the date from which the revised pay structure based on the recommendations of the sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one revised pre revised scale of pay into one grade with a common grade payor pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale in the normal replacement grade without any upgradation.

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or (ii) with five years regular service in the grade in pay Band ` 15600- 39100 plus grade pay ` 5400 or equivalent in the parent cadre or Department; and

(b) possessing the educational qualifications and experience prescribed for direct recruitment under column(7).

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation and similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : The period of deputation (including short term contract) including period of deputation (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years.

Note 3 : The maximum age limit for appointment by deputation (including short-term contract) shall be not exceeding 56 years as on the closing date of the receipt of applications.
