सं. 1(1)/87-दि.न.क.आ.--दिल्ली नगर कला आयोग अधिनियम, 1973 (1974 का 1) की धारा 9 की उप-धारा (3) के साथ पठित धारा (27) की उप-धारा (1) की धारा (ग) में प्रदत्त शक्तियों का प्रयोग करते हुए, दिल्ली नगर कला आयोग, केन्द्र सरकार की पूर्व सहमति से दिल्ली नगर कला आयेाग (सेवा शर्तें) विनियम 1993, को संशोधित करने के लिए निम्नलिखित विनियम बनाता है, नामतः
1. (i) इन विनियमों को दिल्ली नगर कला आयोग (सेवा शर्तें) संशोधन विनियम, 2013 कहा जाएगा।
(ii) ये सरकारी राजपत्र में प्रकाशन की तारीख से प्रभावी होगें, सिवाय संशोधित वेतनमान के जो पांचवे वेतन आयोग वेतनमानों के संबंध में 01 जनवरी, 1996 से और छठे वेतन आयोग वेतनमान और ग्रेड वेतन के संबंध में 01 जनवरी, 2006 से लागू हुए माने जाएंगे।
2. धारा 8 में निहित वर्तमान अनुसूची में वेतनमान संशोधित वेतनमान जो पांचवे वेतन आयोग वेतनमान के संबंध में 01 जनवरी, 1996 से और छठे वेतन आयोग वेतनमान व ग्रेड वेतन के संबंध में जो जनवरी, 2006 के प्रथम दिवस को लागू हुए थे, जोड़े जाएंगे।
3. मुख्य विनियम 11 विलुप्त हो जाएगा।
4. भारत के राजपत्र के भाग III, खंड 4 में दिनांक 14.03.1998 को प्रकाशित 27 जनवरी, 1998 की अधिसूचना सं. 1 (1)/87 द्वारा यथासंशोधित मूल विनियम निम्नलिखित को प्रतिस्थापित किया जाएगाः--

(1615)1616 भारत का राजपत्र, अगस्त 10, 2013 (श्रावण 19, 1935) [भाग III—खण्ड 4 इन विनियमों में जब तक अन्यथा विशेष रूप से प्रावधानित न किया गया हो, आयोग के अधिकारियों और कर्मचारियों की अन्य सेवा शर्तों, जहां तक हो, मौलिक और अनुपूरक नियम, सामान्य वित्तीय नियम, केन्द्रीय सेवा (अस्थायी सेवा) नियम, 1965, केन्द्रीय सिविल सेवा (चिकित्सा सेवा) नियम, 1944, भवन निर्माण अग्रिम नियम, वित्तीय शक्तियों का प्रत्यायोजन नियम, 1978 छुट्टी यात्रा रियायत नियम, 1988, केन्द्रीय सिविल सेवा (पेंशन) नियम, 1972 जहां तक वे उपदान के प्रावधानों से संबंधित ह, दिनांक 01 जनवरी, 2004 से सेवा ग्रहण करने वाले कर्मचारियों के लिए परिभाषित पेंशन अंशदान योजना, 09.08.1999, 31.08.2008 तक निश्चित आजीविका क्रमानुसार वृद्धि योजना और दिनांक 01.09.2008 से संशोधित निश्चित आजीविका क्रमानुसार वृद्धि योजना और केन्द्र सरकार द्वारा समय-समय पर जारी आदेश व निर्णय, जो उन सभी मसलों के संबंध में, जो यहां विशेष रूप से उल्लिखित नहीं ह, से अधिशासित होंगी।
5. (i) मूल विनियम 14 के उप-विनियम 14.1 के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगाः--
''पदों का वर्गीकरण ः दिल्ली नगर कला आयोग के अंतर्गत सभी पदों को इस विषय पर केन्द्र सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार वर्गीकृत किया जाएगा''।
6. मूल विनियम 14 के उप-विनियम 14.2 को निम्नलिखित से प्रतिस्थापित किया जाएगाः--
''14.2. नियुक्ति प्राधिकारीः--
(i) समूह 'क' में सभी पदों पर नियुक्तियाँ, सचिव के पद पर नियुक्ति को छोड़कर, अध्यक्ष द्वारा केन्द्रीय सरकार के पूर्व अनुमोदन से की जाएंगी।
(ii) समूह 'ख' के सभी पदों पर नियुक्तियां, अध्यक्ष द्वारा, आयोग के पूर्व अनुमोदन से की जाएंगी।
(iii) समूह 'ग' की सभी नियुक्तियां, सचिव द्वारा की जाएंगी।
(iv) समूह 'घ' की सभी नियुक्तियां, प्रशासनिक अधिकारी द्वारा की जाएंगी।''
7. मूल विनियम 14 में उप-विनियम 14.3 के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगाः--
''14.3. अनुशासनिक प्राधिकारीः--
(1) अध्यक्ष, किसी भी कर्मचारी पर, केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 के नियम 11 में निदष्ट किसी भी दंड को अधिरोपित कर सकता है।
बशर्ते कि, समूह ख के पदधारित किसी कर्मचारी पर केन्द्रीय सिविल सेवा वर्गीकरण, नियंत्रण और अपील नियम, 1965 के नियम 11 की धारा (v) से (ix) में वणत किसी दंड को अधिरोपित करने से पूर्व, वह आयोग की पूर्व अनुमति लेगा और समूह 'क' में पदधारित किसी कर्मचारी के लिए वह केन्द्र सरकार की पूर्व अनुमति लेगा।
(2) उप-विनियम (1) के उपबंधों के प्रतिकूल प्रभाव के बिना, नियुक्ति प्राधिकारी अथवा इस विषय में आयोग के सामान्य या विशेष आदेश द्वारा कोई अन्य सशक्त/प्राधिकारी द्वारा किसी भी कर्मचारी पर नियम 11 में वणत किसी भी दंड को आरोपित किया जा सकता है।
स्पष्टीकरणः--जहां किसी वर्ग के पद को ग्रहण किए हुए कोई कर्मचारी अस्थायी अथवा परिवीक्षा पर पदोन्नत किया जाता है, तो इन विनियमों के लिए उसे उस वरिष्ठ वर्ग के पद को ग्रहण किए हुए माना जाएगा।''
8. मूल विनियम 14.5 के पश्चात् निम्नलिखित नया मूल विनियम 14.5 जोड़ा जाएगाः--
14.5 (क) पुनरीक्षण प्राधिकारीः--केन्द्र सरकार द्वारा जब तक विशिष्ट आदेश और निर्णय जारी करके प्रावधान न किया जाए, केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 के शासन के प्रयोजन हेतु पुनरीक्षण प्राधिकारी निम्नलिखित होगेंः-- समूह 'क' और 'ख' पदों के संबंध में - केन्द्र सरकार
समूह 'ग' पदों के संबंध में - आयोग
समूह 'घ' पदों के संबंध में - अध्यक्ष

दिल्ली नगर कला आयोग (सेवा शर्तें) (संशोधन) विनियम, 2010 की स्पष्टीकरण टिप्पणी
दिल्ली नगर कला आयोग (सेवा शर्तें) विनियम, 1993 का संशोधन आयोग के निम्नलिखित विस्तार के कारण अनिवार्य हो गया हैः--
(1) पांचवे और छठे वेतन आयोग के वेतनमान और ग्रेड वेतन, क्रमशः
(3) दिनांक 09.08.1999 से 31.08.2008 तक निश्चित आजीविका क्रमानुसार वृद्धि योजना और दिनांक 01.09.2008 से संशोधित निश्चित आजीविका क्रमानुसार वृद्धि योजना।
इस संशोधन से दिल्ली नगर कला आयोग में किसी के भी हित पर प्रतिकूल प्रभाव नहीं पड़ेगा।

No.1(1)/87-DUAC —In exercise of the powers conferred by Clause (c) of Sub-Section (1) of section 27, read with Sub-Section (3) of section 9 of the Delhi Urban Art Commission Act, 1973 (1 of 1974), the Delhi Urban Art Commission with the previous consent of the Central Government makes the following Regulations to amend the Delhi Urban Art Commission (Terms and Conditions of Service) Regulations 1993, namely :-
1. (i) These Regulations may be called the Delhi Urban Art Commission (Terms and Conditions of Service) Amendment Regulations, 2013.
(ii) It shall come into force on the date of its publication in the official gazette excepting the revised scales of pay which shall be deemed to have come into force on the 1st day of January, 1996 in respect of Fifth Pay Commission scales and 1st day of January 2006 in respect of Sixth Pay Commission Pay Band and Grade Pay.
2. In the existing schedule stipulated in Clause 8 the revised scales of pay which came into force on the 1st January 1996 in respect of Fifth Pay Commission scales and First day of January 2006 in respect of Sixth Pay Commission Pay Band and Grade Pay shall be added.
3. The Principal Regulation 11 shall stand deleted.
4. The Principal Regulation 12 as amended vide Notification No.1(1)/87 dated 27th January 1998 published in the Gazatte of India Part III Section 4 dated 14.03.1998 shall be substituted by the following :—
Unless expressly provided for in these Regulations to the contrary, the other terms and conditions of service of the officers and employees of the Commission shall be governed as far as may be by the Fundamental and Supplementary Rules, General Financial Rules, Central Service (Temporary Service) Rules, 1965, Central Civil Services (Medical Attendance) Rules, 1944, House Building Advance Rules, Delegation of Financial Power Rules, 1978, Leave Travel Concession Rules, 1988, Central Civil Service (Pension) Rules, 1972 so far as they relate to the provisions of Gratuity, Defined Pension Contribution Scheme for employees joining service w.e.f. 1st January 2004, Assured Career Progression Scheme w.e.f. 09.08.1999 upto 31.08.2008 and by Modified Assured Career Progression Scheme w.e.f. 01.09.2008 and by orders and decisions issued by the Central Government from time to time as applicable to the employees of the Central Government in respect of all other matters not specifically mentioned herein.
5 (i) In Principal Regulation 14 the Sub-regulation 14.1 shall be substituted by the following :—
"Classification of posts : All the posts under the Delhi Urban Art Commission shall be classified in terms of the orders issued by the Central Government on the subject from time to time."
6. In principal Regulation 14 the Sub-regulation 14.2 shall be substituted by the following :—
"14.2. Appointing Authority :—
(i) All appointments to the posts in Group 'A' excepting appointment to the post of Secretary shall be made by the Chairman with the prior approval of the Central Government.
(ii) All appointments to the posts in Group 'B' shall be made by the Chairman with the prior approval of the Commission.
(iii) All appointments to the posts in Group 'C' shall be made by the Secretary.
(iv) All appointments to the posts in Group 'D' shall be made by the Administrative Officer."
7. In Principal Regulation 14 the Sub-regulation 14.3 shall be substituted by the following :—
"14.3. Disciplinary Authority :—
(1) The Chairman may impose on an employee any of the penalties specified in Rule 11 of the CCS (CCA) Rules, 1965.
Provided that before imposing any penalty mentioned in clause (v) to (ix) of Rule 11 of the CCS (CCA) Rules, 1965 on an employee holding a post in Group 'B' he shall obtain the prior approval of the Commission and for an employee holding the post of Group 'A' he shall obtain prior approval of the Central Government.

(2) Without prejudice to the provisions of Sub-regulation (1) any of the penalties specified in Rule 11 ibid may be imposed on an employee by the Appointing Authority or by any other authority empowered in this behalf by a general or special order of the Commission.
Explanation :-- Where an employee holding a post of any group is promoted, whether on probation or temporarily, to a post of a next higher Group, he/she shall be deemed for the purpose of this Regulation, to hold the post of such higher Group."
8. The following new Principal Regulation 14.5 A shall be inserted after the Principal Regulation 14.5 :—
14.5 (A) Revision Authority :—Unless expressly provided for through specific orders and decisions issued by the Central Government, the Revision Authority for the purpose of administering the CCS (CCA) Rules, 1965 shall be as follows :—
In respect of Group 'A' & 'B' posts - The Central Government.
In respect of Group 'C' posts - The Commission
In respect of Group 'D' posts - The Chairman.

Explanatory Note to the Delhi Urban Art Commission (Terms and Conditions of Service) (Amendment) Regulations, 2010.
The amendment to the Delhi Urban Art Commission (Terms and Conditions of Service) Regulations, 1993 has been necessitated on account of the following extention to the Commission: -
(1) Fifth and Sixth Pay Commission Scales, Pay Band and Grade Pay, respectively.
(2) Defined Pension Contribution Scheme for employees joining service with effect from 1st January 2004.
(3) Assured Career Progression Scheme with effect from 09.08.1999 upto 31.08.2008 and Modified Assured Career Progression Scheme with effect from 01.09.2008.
With this amendment no one's interest would be adversely affected in Delhi Urban Art Commission.
