सा.का.नि. 194.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड ;संलग्न और अध्ीनस्थ कार्यालयद्ध ;मुख्य लेखा अध्किारीद्ध भर्ती नियम, 1985 और राजस्व विभाग मुख्य लेखा अध्किारी भर्ती नियम, 2001 को उन बातों के सिवाए अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड, राजस्व विभाग, वित्त मंत्राालय के अध्ीन क्षेत्राीय विरचना और निदेशालयों में मुख्य लेखा अध्किारी के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारम्भ.—;1द्ध इन नियमों का संक्षिप्त नाम वित्त मंत्राालय, राजस्व विभाग, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड, मुख्य लेखा अध्किारी ;समूह 'क' पदद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिर्दिष्ट हैं।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया है या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगाऋ

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : प्रोन्नति के लिए पात्राता सूची काडर के भीतर पारस्परिक वरिष्ठता के साथ श्रेणी में, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के अध्ीन विहित सेवा के विभिन्न श्रेणियों के प्रशासनिक अध्किारियों द्वारा अर्हक सेवा के पूरा होने की तारीख के प्रतिनिर्देश से तैयार की जाएगी ।

टिप्पण 2 : केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड द्वारा यथा विहित प्रशिक्षण का सपफलतापूर्वक समापन प्रोन्नति की तारीख से दो वर्ष की अवध् िके भीतर अनिवार्य होगा । कोई अध्किारी जिसने मुख्य लेखा अध्किारियों के लिए अनिवार्य प्रशिक्षण सपफलतापूर्वक पूरा नहीं किया है, वह किसी वेतनवृ(ि के लिए तब तक पात्रा नहीं होगा जब तक वह प्रशिक्षण पूरा न कर ले । अध्किारी अनिवार्य प्रशिक्षण के पूरा होने पर उस तारीख से जिसको वह अन्यथा उसी के लिए पात्रा था, अपनी वेतनवृ(ि लेने का हकदार होगा । वे अध्किारी जिनकी, प्रोन्नति पर सेवा निवृत्ति के पूर्व शेष सेवा का एक वर्ष से कम होगा, उन्हें उक्त प्रशिक्षण से छूट प्राप्त रहेगी ।

टिप्पण 3 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 4 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा उक्त वेतन आयोग की सिपफारिशों पर आधरित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से

परामर्श किया जाएगा

G.S.R. 194.—In exercise of the powers conferred by the proviso to article 309 of the Constitution in supersession of the Central Board of Excise and Customs (Attached and Subordinate Offices) (Chief Accounts Officer) Recruitment Rules, 1985 and the Department of Revenue, Chief Accounts Officer Recruitment Rules, 2001 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Chief Accounts Officer in the field formations and Directorates under the Central Board of Excise and Customs, Department of Revenue, Ministry of Finance, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, Chief Accounts Officer (Group 'A' Posts) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, their classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc..—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 13) of the aforesaid Schedule.

4. Disqualification.—No person,-

(a) who, has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Administrative Officer under the Central Board of Excise and Customs in pay band-2, Rs. 9300-34800 plus grade pay of

Rs. 4600 with three years' regular service in the grade.

Note 1 : The eligibility list for promotion shall be prepared with reference to the date of completion of qualifying service by the Administrative Officers of different cadres under the Central Board of Excise and Customs of prescribed service in the grade with inter se seniority within the cadre.

Note 2 : Successful completion of training as prescribed by the Central Board of Excise and Customs within a period of two years from the date of promotion shall be mandatory. An officer who has not successfully completed mandatory training for the Chief Accounts Officer shall not be eligible for any increment until completion of training. The officer shall be entitled to draw his

increment from the date on which he was otherwise eligible for the same, on completion of mandatory training. Officers with less than one year of service remaining before retirement on promotion, stand exempted from the said training.

Note 3 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors

would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 4 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended

based on the recommendations of the said Pay Commission.

टिप्पण 1 : प्रतिनियुक्ति की अवध् ि;जिसके अंतर्गत अल्पकालिक संविदा हैद्ध केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् ि है, साधारणतया पांच वर्ष से अधिक नहीं होगी ।

G.S.R. 195.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Institute of Secretariat Training and Management (Additional Director) Recruitment Rules, 1991, except as respects things done or omitted to have been done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Additional Director in the Institute of Secretariat Training and Management, Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, namely:-

1. Short title and commencement.—(I) These rules may be called the Institute of Secretariat Training and Management (Additional Director) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc. - The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage, is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opmion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxations of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special category of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

(ii) Certificate of being trained in training techniques and methods from a Central or State Government Training Institutes such as Institute of Secretariat Training and Management, New Delhi or Administrative Training Institutes or Central Training Institutes.

Deputation/Re-employment (For Armed Forces Personnel):

Armed forces personnel in the rank of Colonel in Indian Army or Captain in Indian Navy or Group Captain in Indian Air Force in the pay band-4 Rs. 37400-67000 with grade pay of Rs. 8700 who are due to retire or to be transferred to reserve within a period of one year and having the experience and qualifications prescribed for deputationists shall also be considered. Such persons would be given deputation terms up to the date on which they may be continued on re-employment.

(Re-employment up to the age of superannuation with reference to civil posts)

Note 1 : he period of deputation (including short term contract) including the period of deputation in another ex cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed five years.

Note 2 : The maximum age-limit for appointment by deputation (including short term contract) shall not be exceeding fifty-six years as on the closing date of receipt of applications.

Note 3 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission, except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post (s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

S. R. No. 266 dated the 2.11.2012, namely:—

1. (1) These rules may be called the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Lower Division Clerk Recruitment (First Amendment) Rules, 2012.

(2) They shall be deemed to have come into force with effect from the November 3rd, 2012.

2. In the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Lower Division Clerk Recruitment Rules, 2012,

(l) Under Column 10 (ii) for "the minimum age limit for eligibility for examination is 45 years (50 years of age for SC/ ST)" the following shall be substituted namely "the maximum age limit for eligibility for examination is 45 years (50 years age for SC/ST)".

While notifying the Directorate of Marketing & Inspection (Group 'C' Non-gazetted posts), Lower Division Clerk Recruitment Rules, 2012, there was an inadvertent typographical error under Col. 10 i.e. 'Method of recruitment whether by direct recruitment or by promotion or by deputation or absorption and percentage of the vacancies to be filed by various methods' of the Schedule annexed to the Directorate of Marketing & Inspection (Group 'C' Non-gazetted posts), Lower Division Clerk Recruitment Rules, 2012 which was published in Part II, Section 3, Sub-Section (i) of Gazette of India on 3rd November, 2012 and therefore, it has been decided to amend the Directorate of Marketing & Inspection (Group 'C' Non- gazetted posts), Lower Division Clerk Recruitment Rules, 2012 and to give retrospective effect to the aforesaid amendments with effect from 3rd, November, 2012. As such, insertion of the proposed entry in the said rule will have retrospective application from 3rd November, 2012. It is certified that none will be adversely affected by the retrospective effect being given to the proposed amendment in the recruitment rules being notified.

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो उक्त अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता : वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 197.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Integrated Fisheries Project (Class III) Recruitment Rules, 1973 in so far they relate to the posts of Electronic Supervisor, Driver Class II (Sand pump & Dredger) and Driver Class I (Sand pump & Dredger), the Integrated Fisheries Project, (Life Raft Service Station) Recruitment Rules, 1983 in so far as they relate to the post of Service Assistant and the Indo-Norwegian Project (Crane Operator) Recruitment Rules, 1971, except as respects things done or omitted to be done1114 THE GAZETTE OF INDIA : AUGUST 17, 2013/SHRAVANA 26, 1935 [PART II—SEC.3(i)] before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Electronic Supervisor, Service Assistant, Dredger Operator (Saikathari or Sand Pump) and Crane Operator in Fishery Survey of India, Mumbai under the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, namely:—

1. Short title and commencement.—(1) These rules may be called the Fishery Survey of India Electronic Supervisor, Service Assistant, Dredger Operator (Saikathari or Sand Pump) and Crane Operator Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of posts, their classification and the pay band, grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc..—The method of recruitment, age limit, qualification and other matters relating thereto shall be as specified in columns 5 to 13 of the said schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, other Backward classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.— उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 198.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture and Irrigation, Department of ' Food (Picker) Recruitment Rules,1977; the Department of Food, Technical Operator (Non Gazetted) Recruitment Rules, 1986; the Ministry of Food & Civil Supplies (Department of Food) Attendants (Library, Animal House and Laboratory) Recruitment Rules, 1987; the Ministry of Food & Civil Supplies (Deptt, of Food) Laboratory Attendant Recruitment Rules, 1991; and the Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution Group ''D" Recruitment Rules, 2005, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Multi-Tasking Staff, Group "C" posts in the Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution, namely:

1. Short title and commencement. - (1) These rules may be called the Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution, Multi- Tasking Staff (Group 'C' post) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualification, etc. - The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons.

6. Saving. - Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Ground Water Board Technical Operator (Stores) Recruitment Rules, 1986, in the Schedule :

(i) In column (7), under the heading 'Age limit for direct. recruits', for the words and figures "Between 18 to 25 years", the words and figures "Between 18 to 27 years" shall be substituted;

G. S. R. 201.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Natural History, Museum, Department of Science and Technology (Class III Posts) Recruitment Rules, 1975, in so far as they relate to the post of Caretaker, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of caretaker in the National Museum of Natural History, Ministry of Environment and Forests, namely:—

1. Short title and commencement. - (1) These rules may be called the Ministry of Environment and Forests, National Museum of Natural History, Caretaker (Group 'C' Post ) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale. —The number of post, its classification pay band and grade pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc. — The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. - Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पद संख्या, वर्गीकरण वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, और उसका वेतन बैंड तथा ग्रेड वेतन वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं, आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता : वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।
