सा.का.नि. 239.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रादेशिक केंद्र चारा उत्पादन और निदर्शन समूह 'क' पद भर्ती नियम, 1967 को अध्क्रिांत करते हुए चारा उत्पादन और निदर्शन प्रादेशिक केंद्र और केंद्रीय चारा बीज उत्पादन पफार्म, हेस्सरघट्‌्‌टा, ;बंगलौरद्ध भर्ती नियम, 2013 में साधरण केंद्रीय सेवा समूह 'क' पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम चारा उत्पादन और निदर्शन प्रादेशिक केंद्र और केंद्रीय चारा उत्पादन पफार्म, हेस्सरघट्‌टा, बंगलौर ;समूह 'क' पदद्ध भर्ती नियम, 2013 है ।ा

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट है ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति —

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केंद्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

व्यक्तियों के लिए एक सस्य विज्ञान में स्नातकोत्तर या वनस्पति या जन्तु विज्ञान टिप्पणः इन नियमों के प्रकाशन की वर्ष ।

या रसायन में बी.एस.सी. और किसी मान्यताप्राप्त तारीख को जो अध्किारी प्रोन्नति की

विश्वविद्यालय से डेयरी में चारा उत्पादन एक विषय के साथ सीध्ी पंक्ति में हैं उन पर विहित शैक्षिक

एम. एस. सी. डिग्री होऋ अर्हता लागू नहीं होगी ।

;iiद्ध योजना बनाने और चार उत्पादन संगठन या चारा उत्पादन

अनुसंधन या विस्तार कार्य में तीन वर्ष का अनुभव हो ।

टिप्पण ः अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में उन कारणों के लिए जो लेखब( किए जाएं, संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध उन कारणों के लिए जो लेखब( किए जाएं, संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संम्भावना नहीं है ।

भर्ती की प(ति : भर्ती सीध्े होगी/प्रोन्नति प्रोन्नति/प्रतिनियुक्ति/अन्तरण द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प्रतिनियुक्ति/अन्तरण किया जाएगा प(तियों द्वारा भरी जाने वाली रिक्तियों की प्रतिशतता

टिप्पण 1ः जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होेंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ1336 THE GAZETTE OF INDIA : SEPTEMBER 28, 2013/ASVINA 6, 1935 [PART II—SEC. 3(i)] ;11द्ध

व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2ः प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति : केन्द्रीय सरकार या राज्य सरकारों या मान्यताप्राप्त अनुसंधन संस्थानों या लोक

क्षेत्रा के उपक्रमों या स्वायत्त संगठनों के अध्ीन ऐसे अध्किारी जोः

;कद्ध (i) मूल काडर या विभाग में नियमित आधर पर सद्दश पद धरण किए हुए हैंऋ या

(ii) जिनकी मूल काडर या विभाग में वेतन बैंड-29,300-34,800 रु.+ ग्रेड वेतन 4200 रु. में नियमित आधर पर नियुक्ति के पश्चात्‌्‌ आठ वर्ष की नियमित सेवा हैऋ और

;खद्ध स्तंभ ;7द्ध के अध्ीन सीध्ी भर्ती के लिए विहित अर्हताएं और अनुभव रखते हैं।

टिप्पण 1ः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

G.S.R. 239.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Regional Station (Group A Posts in Forage Production and Demonstration) Recruitment Rules, 1967, the President hereby makes the following rules regulating the method of recruitment to the General Central Service Group A Posts (Technical ) in the Regional Station for Forage Production and Demonstration and Central Fodder Seed Production Farm, Hessarghatta, (Bangalore) Recruitment Rules, 2013, namely:—

1. Short title and commencement.— (1) These rules may be called the Regional Station for Forage Production and Demonstration and Central Fodder Seed Production Farm, Hessarghatta, Bangalore (Group ''A" Posts) Recruitment Rules, 2013.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay.—The number of said posts, their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category or person.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : Where juniors who have completed their qualifying of eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 01-01-2006 the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendation of the Pay Commission. Deputation :

Officers under the Central or State Governments or UTs or Recognized Research Institutions or Public Sector Undertakings or Autonomous Organizations.

(A) (i) holding analogous post on regular bais in the parent cadre or department; or

(ii) with eight years regular service in the grade rendered after appointment thereto on regular basis in the scale of pay of Rs. 9,300-34,800 with grade pay of Rs. 4200 in the pay band-2 or equivalent in the parent cadre or department;

(B) possessing the educational qualifications and experience prescribed for direct recruits under column (7).

The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation.

Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

(period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not exceed 3 years. The maximum age limit for appointment by deputation (including short-term contract) shall not be exceeding 56 years as on the closing date of receipt of application).

सा.का.नि. 240.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और जल-भूतल परिवहन मंत्राालय, परिवहन अनुसंधन प्रभाग ;परिवहन पक्षद्ध ;कनिष्ठ अन्वेषक एवं संगणकद्ध भर्ती नियम, 1987, को जहां तक उसका संबंध् कनिष्ठ अन्वेषक के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, सड़क परिवहन और राजमार्ग मंत्राालय में कनिष्ठ अन्वेषक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सड़क परिवहन और राजमार्ग मंत्राालय, परिवहन अनुसंधन प्रभाग, कनिष्ठ अन्वेषक समूह 'ख' पद भर्ती नियम, 2013 है।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन अथवा वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण वेतन बैंड तथा ग्रेड वेतन उससे उपाब( वेतनमान वह होगा, जो उक्त अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिर्दिष्ट हैं।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिर्दिष्ट हैं।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी अन्य व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगाऋ

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां उसके लिए जो कारण हैं उन्हें लेखब( करते हुए और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों के बारे में, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है।

टिप्पण 1- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2- प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना के प्रयोजन के लिए किसी अध्किारी द्वारा, 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में गई सेवा समझी जाएगी ।

टिप्पण 1- : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्‌्‌वारा नियुक्ति के लिए विचार किए जाने के पात्रा जाने के पात्रा नहीं होंगे । टिप्पण 2-ः प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर-बा"य पद पर प्रतिनियुक्ति की अवध् िभी है, साधरणतया तीन वर्ष से अध्कि नही होगी । टिप्पण 3-ः प्रतिनियुक्ति द्‌्‌वारा नियुक्ति के लिए अध्कितम आयु-सीमा, आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी। टिप्पण 4- प्रतिनियुक्ति आधर पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा, 1 जनवरी, 2006 से वह तारीख जिसे छठे वेतन आयोग की सिपफारिशों पर आधर पर पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान को एक साधरण ग्रेड वेतन या वेतनमान के साथ एक श्रेणी में विलय हो गया है और जहां यह पफायदा केवल उसी पद ;उन पदोंद्ध के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है, वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 240.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the erstwhile Ministry of Surface Transport, Transport Research Division (Transport Wing) Junior Investigator and Computer) Recruitment Rules, 1987 in so far they relate to the post of Junior Investigator, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Junior Investigator in the Ministry of Road Transport and Highways, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Road Transport and Highways, Transport Research Wing, Junior Investigator, Group 'B' Post Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age limit, qualifications, etc..—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying /eligibility service.

from which the revised pay structure based on the sixth pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission

Deputation:

Officers of the Central Government.—

A (i) holding analogous posts on regular basis in the parent cadre or department. OR

(ii) with six years service in the grade rendered after appointment on a regualr basis in PB-1.

Rs. 5200- 20200 with grade pay of Rs. 2800 or equivalent in the parent cadre or department: OR

(iii) With ten years service in the grade rendered after appointment the recruits a regular basis in PB-1, Rs. 5200- 20200 with grade pay of Rs. 2400 or equivalent in the parent cadre or department; and

(B) possessing the education qualifications as specified for direct recruits under Column (7).

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for apppointment by promotion.

Note 2 : Period of deputation including period of depuation in another ex-cadre post held immediately preceding this appointment in the same or some other organiszation or department of the Central Government shall ordinarily not to exeed three years.

Note 3 : The maximum age limit for appointment by deputation shall not be exceeding fifty-six years as on the closing date of receipt of applictions.

Note 4 : For purpose of appointment on deputation basis the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the pay commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post (s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.
